Abstract:
In Jimmo v. Sebelius, the plaintiffs alleged that the Centers for Medicare and Medicaid Services (CMS) regularly and improperly denied Medicare reimbursement for outpatient therapy treatment when the beneficiary did not show a likelihood of improvement. These denials, based on policy manuals and other guidance, appear to contradict the government's own regulations, which specifically prohibit coverage denials based solely on the so-called “Improvement Standard.” In Jimmo, the United States District Court for the District of Vermont found that CMS' use of the Improvement Standard may have viola

One reflection of the rising discontent among Israelis and Palestinians concerning the prospect of continuing violence is the intense debate surrounding a private Israeli-Palestinian ““civil society”” peace initiative announced in Jordan on 10 October. The so-called Geneva Accord, described by its signatories as a ““model draft framework final status agreement,”” has no official standing: it was negotiated in secret by Israeli opposition figures and prominent Palestinians, some of them PA officials but acting in their private capacities. More important, the framework agreement was vigorously d

These dramas have different foci but all represent some aspects of Australian Indigenous history and how it interacts with 'mainstream' representations of Australian history. The four programs I will look at are Cleverman (Goalpost Pictures, 2016-ongoing), Glitch (Matchbox Films, 2015-ongoing), The Secret River (Ruby Entertainment, 2015) and Redfern Now (Blackfella Films, 2012), each of which engages with the past in a unique

Abstract Marian McPartland’s learning curve is apparently infinite, an Escher-like, Velcro-covered loop that keeps picking up incremental details as it winds its way through jazz for six decades, turning what began as a generic approach into something personal. Her early ‘50s records, made at the start of her eight-year engagement at the Hickory House, reveal a gifted pianist with accomplished technique and a passable understanding of contemporary currents. But her playing was often polite—stylish without suggesting much individual style. Yet even by that time, Margaret Marian Turner of Windso
