Abstract In Third Republican Paris, newspapers' classified sections were cast as sites of sexual demoralization peopled by prostitutes, pornographers, and abortionists. Moralizing this space was no easy task: sex was discussed in code, making it hard to distinguish between legitimate and illegitimate ads—between ads for midwives and those for abortionists. Could the law read symptomatically to make the distinction? Or was it limited to surface reading? The contemporary conflation of pedophiles and child sex offenders is a prevalent aspect of reporting in news and social media, as well as in government-sponsored efforts to prevent child sexual victimization. Throughout twentieth century Canada, however, legal experts, psychologists and psychiatrists, and social activists were recognizing the harmfulness of grouping individuals who may have a propensity to commit crime with those who have committed the most heinous of criminal acts. By examining medieval medical understandings of human physiology, I will ask what it means to 'have authority over a body' when the bodies themselves are not equal. It begins with a scholarly tradition, forged during the eighteenth-century Enlightenment, which privileged sentimental articulations of feelings. Sexologists, as their discipline developed alongside the modern rational bureaucratic nation-state, maintained attention to emotive expressions. At first introduced by the praetor in order to protect the interest of the defendant, it becomes a legal remedy of great importance. A lot of different versions and types of exceptions emerge, depending on the actio they counter. However, we observe lack of information, concerning the exceptio’s nature and characteristics as a whole, and while we owe that to the well-known abstractness of Roman jurists, a need for systematization appears, in order to better our understanding of the Roman law and procedure.
