The basis for the conclusion of civil law transactions is the equality of participants in civil transactions and the principle of freedom of contract, which correspond to the requirements for conscientious behavior of participants in public relations and the prohibition of abuse of law. The thesis aims to reconstruct the procedural rules that apply whenever the simulation of contract becomes an issue within a civil proceeding.To this end, a different method is followed from that commonly used by the courts and in the scholarly literature, which have mostly deduced the content of these rules assuming, as a starting point, a certain solution to the problem of the nature of simulated contracts.
