US compliance with the Geneva Conventions in Iraq and Afghanistan appeared to vary with the particular subject matter and battle space. In military operations during the last decade, the United States assessed the legality of virtually every proposed target to avoid the intentional targeting of civilians. Legal specialists also, however, flagrantly overlooked Common Article 3’s minimum prescription that all captured individuals have the right to be treated humanely. This variation in compliance is explained by the shift in mission objectives: When the United States approached these conflicts as purely counterterror operations, the goal was to disrupt the enemy. However, under the population-centric counterinsurgency mission, noncompliance with the Geneva Conventions equated to mission failure. The shift from counterterrorism to counterinsurgency increased US sensitivity to civilian casualties and the operational consequences of detainee abuse. By adapting practice to comply with the Conventions, the people became the prize in the war on terror.

Abstract The monetization of personal data has become an increasingly common business practice, igniting global debate on the interface between data privacy law and competition law. Data Privacy and Competition Law in the Age of Big Data provides a comprehensive, novel, and interdisciplinary analysis of this nexus. Drawing insights from emergent properties and complexity science, it exposes the commonalities and conflicts between how data privacy law and competition law address challenges resulting from the commercialization of personal data. The book begins by identifying key shifts in big data: the growing trend of processing personal data for diverse purposes, the aggregation of data across various operations, and the shift from offering stand-alone products and services to ecosystems of several, with personal data central in connecting the different markets. These shifts engender a complex economic landscape, marked by multiple actors, a web of interactions, and non-linear, emergent outcomes. Despite this complexity, the prevailing approach to data privacy law and competition law emphasizes isolated units of analysis—whether a relevant market or a distinct processing operation. This approach overlooks system-wide (emergent) risks borne of cumulative processing operations and cross-market practices. Additionally, a mindset focused on either data privacy law or competition law overlooks the increasing intersection between the two regimes, missing opportunities for synergy. In light of these challenges, the book calls for recalibrating data privacy law and competition law for a complex economy, emphasizing a holistic, systems-level perspective that addresses emergent harms and a polycentric strategy that leverages the strengths of each legal regime.

Singh argues that in recent years, there has been a discernable shift in India’s maritime posture in the Pacific. While the Indian Navy still identifies the Western Pacific as a secondary area of interest, its operational deployments to Southeast Asia have been gradually rising, signalling an enhanced appreciation of Indian strategic stakes in the region. Toward the end of World War II, the commander of the Air Corps, General Henry Hap Arnold, remarked: Someday . . . the man holding my job will meet here with a staff of scientists, and they will wear no pilot's wings on their chests. That day may be near. Here, Collins reveals the emerging challenges posed by cyberspace to the traditional culture of the Air Force. The U.S. Air Force added cyberspace to its warfighting mission in December 2005, and the 8th Air Force was assigned operational responsibility for cyberspace in November 2006. These events clearly indicate that the nexus of activities collectively known ascommand, control, communications, computer systems, and intelligence, which are the nervous system of the military, had achieved critical mass. Such activities are no longer merely important to airpower, but form the basis for independent operations in cyberspace. Although the technological implications of this shift in Air Force missions is apparent, the ultimate impact on the officer corps is not. While fighter pilots have traditionally represented the image of the Air Force, today more and more officers work at remote consoles operating unmanned aerial vehicles that deliver precision-guided munitions.

An acronym for Counterintelligence Program, this is the code name the FBI gave to the secret operations aimed at five major social and political protest groups--the Communist party, the Socialist Workers Party, the Ku Klux Klan, black nationalist hate groups, and the New Left movement.Spying on America, the first book to chronicle all five of the operations, tells the story of how the FBI, from 1956 until COINTELPRO's exposure in 1971, expanded its domestic surveillance programs and increasingly employed questionable, even unlawful, methods in an effort to disrupt what amounts to virtually our entire social and political protest movement. Violations of citizens' constitutional rights were rampant, and the secret operations actually resulted in a number of deaths. At the time, neither the public nor the news media knew anything about COINTELPRO. In vivid detail, Spying on America demonstrates that the system of checks and balances designed to prevent such occurrences was simply not functioning--until an illegal act uncovered the secret activities. The book opens with the daring raid of a Media, Pennsylvania FBI office by a group that adeptly used its booty--about 1,000 classified documents--to make COINTELPRO operations public. The burglars, who called themselves the Citizen's Commission to Investigate the FBI, used sophisticated methods (the FBI never caught up with them), releasing copies of incriminating documents to the media at carefully timed intervals. Spying on America draws on newspaper and magazine articles, interviews with many of the people involved, and FBI memos to trace the historical beginnings and operating methods of COINTELPRO efforts against each of the five targeted groups. In vivid detail, the author re-creates the reactions of the bureau--including the subsequent policy changes--as well as the response of the news media and the resulting shift in public attitudes toward the FBI. Finally, Davis looks at the possibility of similar operations in the future. In the context of our current, heightened state of socio-political awareness, it is difficult to comprehend how so many unlawful deeds could have been committed without the public's knowledge. Anaesthesia for ophthalmic surgery has always been challenging because the patients range across all ages, but the elderly are especially vulnerable. They have an increased morbidity and are often taking multiple drugs that make even anaesthesia for minor surgery more risky. No wonder there has been a shift in the delivery of anaesthesia towards regional techniques although general anaesthesia remains the technique of choice for many intermediate and most complex ophthalmic operations. Understanding the physiology of the eye, the relevant anatomy, and the ophthalmic drugs patients may receive, all have major influences on the choice of anaesthesia. This varies worldwide but the current preference is firmly in favour of local anaesthesia. A practising ophthalmic anaesthetist should be skilled in a range of different techniques to deal with the needs of different operations, operators, and, most importantly, patients.

This chapter examines pacific settlement and collective security as the primary instruments of the United Nations for promoting and underwriting international security. It begins by focusing on the development of newer approaches to UN-centred collective security in the new millennium in response to increased security threats. The chapter discusses economic sanctions, consent-based peacekeeping, robust peace operations, the coercive responsibility to protect (R2P), and nuclear security. In particular, it considers the evolution of peacekeeping side by side with preventive diplomacy, as well as the increase in the number of UN operations after the end of the Cold War to resolve outstanding conflicts. It also evaluates the report prepared by Algerian diplomat Lakhdar Brahimi, chair of a high-level international panel appointed by UN Secretary-General Kofi Annan to make recommendations for changes in UN peacekeeping. The chapter concludes by considering the shift from collective security to global governance.

There is a growing sense that many liberal states are in the midst of a shift in norms—a shift that is happening slowly and for a variety of reasons relating to security. The Internet and tech booms—paving the way for new forms of electronic surveillance—predated the 9/11 attacks by several years, while the police’s vast use of secret informants and deceptive operations began well before that. The recent uptick in reactionary movements—movements in which the rule of law seems expendable—began many years after 9/11 and continues to this day. One way to describe this book is as an examination of the moral limits on modern police practices that flow from the basic legal and philosophical tenets of the liberal tradition. The central argument is that policing in liberal states is constrained by a liberal conception of persons coupled with particular rule-of-law principles. Part I consists of three chapters that constitute the book’s theoretical foundation, including an overview of the police’s law enforcement role in the liberal polity and a methodology for evaluating that role. Part II consists of three chapters that address applications of the theory, including the police’s use of informants, deceptive operations, and surveillance. The upshot is that policing in liberal societies has become illiberal in light of its response to both internal and external threats to security. The book provides an account of what it might mean to retrieve policing that is consistent with the basic tenets of liberalism.

The community co-operatives that are spreading today in many parts of the world are the arrival point of an evolutionary process that has seen the progressive shift of co-operatives’ focus from specific social and professional groups to society as a whole. Since the term ‘community co-operative’ is relatively new and similar institutions are named differently at different times, the first task is to elucidate the concept. Its basic elements are community goods, territory, and citizenship, which are discussed with reference to factual cases. We then discuss differences between new community co-operatives and old ones. In the second part we review some data about them, with a special focus on customer-owned providers of public services. The chapter closes with a discussion of the economic reasons why citizen participation through consumer ownership this organizational mode is more likely to expand today in response to privatization failures than it did in the past.

The European Court of Human Rights is in the process of refining its conceptual tools for determining the responsibility of the States Parties to the European Convention on Human Rights (ECHR) acting in execution of a Security Council resolution. Where the implementation of resolutions involving the use of force is concerned, the Court’s recent case law has shown a shift towards systematic acceptance of the extraterritorial scope of the ECHR. As to whether the conduct in issue should be attributed to the States Parties or to the UN, the Court now makes a clear distinction between operations authorized by the Security Council and UN peacekeeping operations. The implementation of UN economic sanctions will be addressed differently according to whether or not the respondent State is a member of the EU. The criterion of ‘equivalent protection’ is only applicable in the former scenario. And in any event, it needs to be applied cautiously on a case-by-case basis. As regards the enforcement of economic sanctions by non-EU Member States, the Court tends to interpret Security Council resolutions in a manner consistent with the obligations deriving from the ECHR. More generally, the Court’s approach is oriented towards systemic harmonization rather than towards normative conflict.

This chapter assesses the strategic and doctrinal responses of Western Europe’s major powers and their armed forces to terrorism after the cold war. The chapter focuses on Europe’s ‘big three’, the United Kingdom, France, and Germany, and examines the means, ends, and ways of military counterterrorism strategies and operations in these three countries. Select examples of medium and lesser powers include Italy, the Netherlands, Belgium, and Denmark. Critical of the central role military force played in the US global war on terror after the 9/11 attacks, many European powers called for the need to utilize alternative instruments of statecraft. Over time, they adapted their counterterrorism approaches to reflect the new realities at home and abroad. This shift became particularly apparent after the emergence of the Islamic State inspired violent attacks in various European countries, drawing a more military-centric response from Europe’s great, medium, and lesser powers.

Abstract:
Both Charles Bell and his brother George married into the Shaw family of Ayrshire. Bell’s character, personality, and social life are explored, particularly as they change throughout the years. In 1814, he was elected surgeon to the Middlesex Hospital in London. He worked hard as a general surgeon and teacher with an interest in the genitourinary system, and described a muscle in the urinary bladder since named after him. The death of his brothers Robert (1816) and John (1820) did not interrupt his work. The publication of his famous Illustrations of the Great Operations of Surgery in 1821 was followed by a shift of the focus of his work to the nervous system, aided by John and then Alexander Shaw. A dispute with the famous surgeon SirAstley Cooper concerning the role of surgery after spinal trauma led to angry words between them, but they remained friends.
