Full textDespite important progress in the field of health and safety regulations in the workplace, job insecurity continues to be a scourge in our society, and that could have an effect on anyone taking part in a production process. While investigating the responsibilities of the various parties involved in the preventative mechanism, it was brought to light the concern of those professional figures like an engineer who assumes relevant and multifaceted prevention functions, due to the evident uncertainty of the limits of the security obligation. At times it almost seems to imply the hypotheses of objective responsibility, not declared by the legislator. To better understand the issue, the legislative evolution of the principle of maximum possible security has been analyzed. In order to understand the extension of the right to health and safety in the workplace, it has been examined in depth the study of the current legislation in force (legislative decree 81/2008) that refers to the models for responsibilities distribution provided by the law. After having described the responsibility profile of each individual figure considered, and in light of the most relevant jurisprudential declaration, especially with reference to what is established in the Title IV of the Legislative Decree 81/2008, the problem of contributory negligence on which the uncertainty of the limits of responsibility on security duties has been faced. To take on a role in prevention matter which is present in the majority of working environments, but even more, in the construction industry, it involves exposure to an undefined responsibility. Although, the regulatory apparatus appears to be rather complete, well-structured and organized, when, from the abstractness of the norm we pass to the concreteness of the judgments, the problems of the same emerge with overwhelming evidence that fuel rather than suppress the apprehension of the operators. Concerns that, in parallel and consequently, sees legal entities called to answer for the crimes committed in violation of the accident prevention regulations by subordinates or top managers according to the law 123/2007.

Full textThis dissertation focuses on investigating the determinants and the consequences of risk at work and occupational accidents in the labour market. The first contribution (Chapter 1) provides a critical survey within an harmonized framework of analysis to highlight the weaknesses of the theoretical and empirical literature. In investigating the determinants of accidents at work (Chapter 2), we analyze the role of working conditions and safety at work in reducing the probability of accidents at work and the corresponding duration of absence, which is an unexplored issue in the limited empirically literature on risk at work and occupational accidents. Our findings provide cross-country evidence that more safety at work contributes to reduce the probability that an accident occurs and its consequences, in terms of days off from work. Particular attention is used in considering the role of safety at work regulations and of work organization practices. Chapter 3 studies the consequences of occupational injuries. We focus in determining how an accident may affect workers’ costs, namely a decline of employment probabilities and earning losses, either in the short or in the long term. Using the BHPS data, we find that, in the short term, a state of injury, following an occupational accident, leads to a higher probability of losing job; in the long term, injured workers may support significant earning losses that may vanish if they are employed in the public sector or in unionized firms.

Full textLa tesi ha l’obiettivo di indagare l’evoluzione della gestione della sicurezza sul lavoro nell’Italia del Novecento e in particolare del secondo dopoguerra. L’attenzione viene focalizzata sul caso specifico della navalmeccanica e del Cantiere di Monfalcone, anche in chiave comparata con un approfondimento sul periodo fra gli anni Sessanta e Ottanta. I primi 3 capitoli si occupano della sicurezza sul lavoro in Italia nella seconda metà del Novecento, mentre i capp. 4-6 trattano della salute operaia nel Cantiere di Monfalcone e negli altri stabilimenti navali. In ogni capitolo si affronta il problema in termini riferibili sia agli infortuni sia alle malattie professionali, svolgendo approfondimenti specifici sull’esposizione all’amianto.

Full textSafety in the workplace is an extremely important factor both for the protection of the worker and in terms of a company’ competitiveness, especially the craft one, whose endurance also depends on the prevention management of the workplace. The digital-technological evolution offers important and new tools, valuable for improving working conditions. These are rarely accepted by artisan employers, often due to the limited resources, not only economic, that characterize them. At the same time, however, it is essential to guarantee even to craft enterprises and their respective employees, adequate levels of workplace safety, in light of the social function that the artisan field plays in the entire "Country System". For this reason, therefore, in the matter of workplace safety, it becomes fundamental the role of support and assistance that the Consolidated Law on Workplace Safety assigns to social parts. These include representative associations of craftsmen employers and trade unions, from which activities, also and above all in a bilateral and equal form, ultimately depends on the practical success of the initiatives and the various tools that are provided at a regulatory level, especially in relation to the production and work systems updates in the face of technological evolution and its derivatives. Furthermore, the analysis of the craft industry relations of the Sassuolo’s Distretto Ceramico allows us to comprehend the reasons that, even today, determine the non-safety policies in the workplace and to discover new and innovative methods, sometimes thanks to modern technologies, that are valuable for increasing the quality of working conditions in small craft enterprises. At the same time, however, it is possible to identify what may be the causes that may slow down this essential improvement process, by thoroughly examining methods that are applied by collective bargaining in order to assist and support the artisan universe.

Full textThe regulation of occupational health and safety is mainly focused on the importance of organisational aspects regarding both private and public sector. The aim of this study is to demonstrate that the origin of the public organisation system set out in the T.U. d.lgs 81/2008 is in compliance with the mission and institutional aims of the Public Administration, under a systematic perspective. “Valuing and protecting the dignity of the workers, safeguarding the physical, mental and social welfare”, will practically enforce the preventive regulatory system and increase the productivity of the working process. The individual and organisational well-being is strictly co-related to the general level of performance achieved by organisations specifically in the public sector, where the improvement of working conditions can be considered as an implementation of Constitutional principles in the context of the Public Administration which nowadays is deemed to face, with limited financial resources, the changes of the society and the current economic crisis. Each public organisation shall, by law, increase its level of welfare according to its own means and type of participation, in order to provide a service that complies qualitatively with the needs of the public. For this purpose the study is conducted through the analysis of legislations and practical experiences related also to the aims of the customer satisfaction. Moreover the study establishes which are the main psychosocial risks (stress, mobbing, burn out), and identifies for each member of the organisation not only its own debt security but also the importance of its role in the growth of the well-being. In the end the author concludes that public employees have the right to obtain a collective and individual well-being through a compensation scheme and that in the public administrations, the job safety, the organisational well being and the job performance are strictly and inevitably interdepend.

Full textThe work aims to give an overview on the evolution of the labor criminal law of the past few years, trying to bring out the profiles of heightened tension between the discipline and the principles that govern the guarantee freedoms of citizens in the face of punitive power state. In particular, special attention to the complex issue of the relationship between the offense, which is not possible without a personal responsibility, and the organizational phenomenon, which naturally tends to spread and to confuse the individual contributions to the management of the collective process, is dedicated. Overall, the thesis consists of an introduction and four chapters. In the introduction, the profiles of tension that inherently mark criminal liability from accidents at work or occupational disease compared to the main principles of guarantees, are reveled. The first chapter is dedicated to providing an overview of the various criminal cases that come into play in this field, always by pointing out the problematic issues and the difficulty of reconciling the principle of individual criminal responsibility. In the second chapter we analyze instead the various figures responsible for the fulfillment of the obligations of the Company within the preventative, as required by TU 81/2008. The third chapter, instead, gets to the heart of greater complexity of the matter, that the manner in which the internal organization of the companies has an effect on the distribution of criminal liability borne by the employer and its managers. It is thus particularly important in the establishment of the delegation of functions that, after decades of case-processing, has now found the definitive consecration legislation at the art. 16 of TU 81/2008. Finally, the fourth and final chapter is devoted to the discipline of accountability for crimes of companies pursuant to Legislative Decree no. 231/2001, and in particular to its application in the field of accident prevention after the legislative action of 2007, which has typed the liability of entities even compared to the types of injuries and homicide by negligent violation of the safety regulations.

Full textAnalysing the existing literature on this subject a serious gap emerges: ever since the obligation for companies to employ people with disability was introduced in Italy (by Law no. 482/68, later revoked by Law no. 68/99), no studies on the management of these workers’ security & safety have been carried out. In other countries, although research on the same subject is limited and incomplete, the issue seems to draw more attention. The crucial point in managing workplace security & safety, with specific reference to our subject, is the lack of a unitary and interdisciplinary approach to both disability and security & safety. In an ever-changing technological scenario, and with new aspects to security & safety continuously emerging – such as privacy – employers and security & safety managers are often unprepared to employ a worker with disability due to both organizational and structural problems. This investigation is divided into two different studies. The aim of the former is to identify the critical points in the ‘disability-workplace safety & security’ relation. In particular, it intends to examine how companies meet their accessibility, information, training, risk assessment and emergency management obligations. To this end, a quantity-quality survey has been designed and administered to both workers with disability and company managers. 118 questionnaires were collected and analysed. Another step in the research included administering 4 semi-structured interviews to workers with disability who contacted us spontaneously for information and made themselves available for further investigations. This allowed us to deal more thoroughly with some issues that emerged from the questionnaires as particularly interesting. The second study’s aim is to check whether the customization of the training for workers with disability and security & safety managers is functional to the promotion of security & safety culture in the workplace as applied specifically to disability issues. A customized training course for 4 workers with disability and 3 security & safety managers was developed. A careful company analysis was performed, considering documents such as social accounting, risk assessment form and security policy document, and using tools like semi-structured interviews and entrance tests to identify the training needs. The evaluation of the training’s results was carried out both ex post, using exit tests and semi-structured interviews, and in itinere, to monitor and – if necessary – fine-tune the course, by using classroom journals and discussions.
