Abstract A decade ago, Jonathan Simon and I published a pair of articles that introduced the idea of the ‘new penology’ and ‘actuarial justice’ into criminology (Feeley and Simon 1992, 1994). Our arguments struck a chord just as concern with ‘risk’ was being embraced in the social sciences more generally. We have been edified by the reception. Our articles have taken on something of a life of their own, and risk analysis is now commonplace in criminal law and criminal justice scholarship.
