Abstract:
Abstract Compared to nuclear weapons, chemical and biological weapons or advanced conventional weapons systems, such as missiles, small arms and light weapons (SALW) and the ammunition required to render them lethal, have received less attention from arms control analysts. Accordingly the focus of this commentary is upon two particular inadequacies identified within the existing SALW restraint repertoire. They include, first, a failure to have SALW ammunition designated as an objective deserving explicit restraint designation and, secondly, persisting and largely unresolved state differences over controlling supplies of this weaponry to armed non-state actors. Both concerns illustrate how a use of consensus procedures within relevant rule formulation has favoured the interests of major SALW suppliers. The two deficiencies identified are considered destabilising given their continued capacity to degrade restraints designed to restrict deployments of this long-lasting weaponry—particularly within locations exhibiting limited forms of state capacity. The scope for existing legal mechanisms to remedy these deficiencies is examined, as is their potential to induce enhanced compliance and implementation.

Abstract:
Officially, international control of small arms and light weapons (SALW) has made considerable advancements in recent years, most notably in the form of the 2014 Arms Trade Treaty (ATT). Nonetheless, important systemic and structural deficiencies seem to persist, which prevent these control mechanisms from achieving their intended purpose. In an attempt to find an explanation for these shortcomings, this article traces back previous attempts aimed at combatting the illicit proliferation of SALW, by emphasising both their unbowed demand and the trade’s continuous commercial viability. The example of Bulgarian-made AK-47 machineguns underlines the picture of a system intentionally failing to prevent the weapons’ profitable export. It concludes that following the rise of globalisation, the privatisation of SALW manufacturing industries appears to have become the biggest impediment to effective control. Subsequently, it is argued that most anti-proliferation treaties are deliberately limited to a priori insufficient trade restrictions, as they lack any pre-emptive measures that target these weapons’ mass production in the first place. Once produced, SALW will find a buyer – no matter the existence of trade restrictions.

Abstract:
This paper analyses the role of the arms trade in the growth and spread of transnational crime in Africa. The work shows that the proliferation and ready availability of Small Arms and Light Weapons (SALW) on the continent is contributing in no small measure to political, economic and social insecurity in Africa. Major transnational crimes that the work identifies in Africa include drug trafficking, human and people trafficking, environmental crimes, arms trafficking and stolen vehicle trafficking. The work uses qualitative research methodology, which involves the extensive collection, collation and analysis of secondary data, to capture the essence and scope of the impacts of SALW on the growth and spread of transnational crime on the continent. A major and significant contribution of the work is the crucial connection that it establishes between the proliferation of SALW and the high incidence and recurrence of transnational crime in Africa. The work shows the destabilizing impacts of the proliferation of SALW in Africa and how these is contributing to the recurrence of conflicts and criminal activities on the continent. In its conclusion, the work recommends that in order for states on the continent to be able to proactively tackle transnational crime and the proliferation of SALW, they will have to do the following: carry-out an extensive and critical survey to create a database that will identify the nature of the different transnational crime that is carried-out in each regions; create (where it does not exist) and, strengthen and implement (where it exist) legislations and laws designed to tackle transnational crime; and encourage interagency cooperation and coordination among the affected states in the regions.

End of the Cold War had contributed to the plentitude of firearms within the Southeast Asia region which led to the increase of small arms and light weapon (SALW) smuggling activity. For decades till today, most countries in this region continue to face internal armed conflicts. Malaysia strategic location, situated at the world’s busiest sea lane trades had resulted in rampant cross border crime of SALW smuggling activities. Malaysia’s strict firearms law disallows the possession of SALW without a license. In spite of such strict SALW legislations, these smugglings continues. What are the factors that contribute to the increase of SALW smuggling into Malaysia? The main objective of this article is to scrutinise the external factors that promote the increase of SALW smuggling into Malaysia. This study employs a qualitative method with primary data obtained through preliminary and formal interviews with Malaysian and Thailand security agencies, crime desk journalist, non-governmental organizations, smugglers, former separatist member, former Thai residents, informers and prisoners of SALW related. Whilst secondary data was acquired via credible research. The study found that the national factors and non-national factors have influenced the increase of SALW smuggling into Malaysia.

Abstract:
The protracted proliferation of Small Arms and Light Weapons (SALW) across the globe to Africa and specifically in Northern Nigeria has led to the explosion of social crises which culminated in insecurity situation in the region for more than a decade now. Armed conflicts emanated from the effects of the spread of SALW across the three geopolitical zones in the North which manifested in the Boko Haram insurgency in the Northeast, farmers-herders conflict in the Northcentral, armed banditry in the Northwest and ethnoreligious conflicts in addition to kidnappings in the region. The objective of this study is a critical and thorough investigation of the SALW in exacerbating armed conflicts in general in the Northern part of Nigeria. The problem is the scenario in which the armed conflicts are threatening to entirely destabilised the region and the manner in which the SALW are increasing despite the global efforts to contain their spread for security reasons. This research used a qualitative method of data collection and analysis. Both the primary and secondary sources were used. The primary source was the interview conducted with selected informants in the relevant area of study. The secondary source was the use of available literature on the subject matter of study and the discussions were made using thematic analytical interpretations. The research discovered that the rampant armed conflicts in Northern Nigeria is the reminiscent of the spread of SALW in the region which tantamount to the present critical security situation. Also, weak policy and political institutions contributed to the spread of SALW which means there is a need for a strong policy approach. The work recommends among other numerous suggestions that efforts should be intensified in intelligence gathering to detect the networking of the racketeers in the armed business and contain them appropriately as well as total blockage of the weapons’ route.

In spite of the robust provisions of the ECOWAS convention for the control of small arms and light weapons (SALW) in West Africa, Nigeria which is a leading Member State has been experiencing daunting challenges to personal human security posed by the large-scale availability of SALW. Although Nigeria has made some efforts towards the implementation of the Convention, the status of the country in that regard has not been clear. This paper sought to examine the nature of the implementation of the Convention in Nigeria with a view to determining the lacuna in the process and addressing it. In-depth interviews were conducted with relevant stakeholders and leaders of institutions such as the ECOWAS Commission and Nigeria’s Presidential Committee on Small Arms (PRESCOM). Secondary data were also used including official documents and researches related to them. The study revealed that Nigeria has failed to domesticate and implement the Convention accordingly. It therefore recommended that the Federal Government should urgently take steps towards establishing the National Commission and put the required structure and support to ensure its effective and efficient implementation. The excessive availability of conventional weapons, small arms and light weapons (SALW) in particular, and the unrestricted trade which make them available raise serious security, humanitarian and social-economic concerns of international nature. These weapons are the major tools of contemporary armed conflicts, abuses of human rights and humanitarian norms, violence, terrorism and criminality. This has led many, including the former United Nations (UN) Chief, Kofi Annan, to believe that these arms are the real weapons of mass destruction of our time, causing half a million deaths annually. This is not to suggest that conventional weapons are not also useful for good causes. They are necessary for maintaining law and order and self-defence purposes. However, their proliferation and unrestricted transfer across borders, especially from the industrialized world to developing (and conflict-torn) countries, have not yet been addressed. In other words, their availability and supply have not been subjected to proper (legal and enforceable) restrictions.

Prevention and management of crime is one of the core mandate responsibilities of security agencies who are peoples that are trained to oversee the internal security system in Nigeria. These agencies includes Nigeria Police Force, Nigeria Security and civil Defense Corps, Nigeria Immigration Service, Nigeria Customs Service, Directorate of State Security Service(DSSS) and to some certain extend when the level of internal security is over raising Nigeria Militaries, both Land Armies, Air Force and Navy gives intervention hand to curtail the situations. The widespread of small arms and light weapons in Kano State has it is genesis from both locally manufactured and the imported ones that mostly passed from various porous or illegal borders that are located in the neighboring states of Kastina and Jigawa State. SALW are the primary tools that trigger both ethnic and internal conflict and other related violent crimes that poses a threat to internal security, democracy and the operation of good governance not only in Kano State but in Nigeria. SALW is one of the key major factor s that generate to various categories of crime like armed robbery, kidder napping, community violent conflict, insurgent attacks and the host of many other crimes. The paper uses the failed state theory to explain the gap how state as an institution fails in its responsibilities and also the paper is empirical in nature by conducting interviews and administering questionnaire to some selected respondent populations from security personnel’s, academicians, traditional institutions and Community Based Organization’s CBO’s. The paper was on the position that for democracy and good governance to be truly functional the internal security must be guaranteed by empowering security agencies in terms of increasing their number, effective training, enough working tools, good condition of service and providing policies that will address the level of poverty and unemployment in the society as well as prosecuting any member of elite that either imported the arms or given arms to youth for achieving his political interest.

General population growth and an increase in the number of farmers, environmental degradation, disruption of conditions for resolving land and water disputes, and the proliferation of Small Arms and Light Weapons (SALW) in the Sahel and West Africa have exacerbated the struggle for the survival and security of economic livelihoods, and in particular negatively affected relationships between shepherds and farmers in several communities in Africa. This kind of conflict between farmers and herdsmen mainly applies to Nigeria, but is also present in other African countries, especially in Mali, Burkina Faso, Chad, Senegal, Cameroon, and Côte d’Ivoire. Such conflicts are not triggered by a single reason, but are driven by a set of multi-causal factors, such as scarce resources in the face of greater need, reprisal attacks, land and climate change, etc. Obviously, in case of Nigeria this kind of conflicts have a disintegrative impact, as they lead to the inimical effects to the country’s unity. The need for fostering value reorientation and restoring earlier interactive ties between herdsmen and farmers seems vital today, so that Nigerians can learn to appreciate the values that unite them more than those that separate the society.

In the Contemporary Conflicts of the post-Cold War period, the question of what comes first, Conflict or Weapons, becomes irrelevant in the face of the quantity and sophistication arms available to actors involved. Pakistan is a country that shows many of the symptoms which are a characteristic of small arms diffusion into the larger social fabric. Given the complex nature of politics, the country is affected not only by external but domestic sources and drivers that have complicated the issue over the decades. For academic purposes, these sources and problems can broadly be divided into four categories canvassing the range of regulated and non-regulated drivers and causes both at the domestic as well as external level. The study aims to examine at length the impact of how regulated sources of SALW in the private armament sector have gradually emerged and cast an impact on the security profile of the country.

Именно в те годы история, образно говоря, начинала свой новый отсчет, но несколько в ином направле- нии, чем виделось американскому ученому. Это стало заметно не сразу, но сути дела этого не меняло. Пер- выми «ласточками» новой реальности стали много- численные региональные и локальные конфликты, как снег на голову обрушившиеся на до этого вполне благополучные народы, в том числе и европейские, начавшие забывать после Второй мировой войны о том, что жизнь может быть другой. Значительно воз- росло число конфликтов и в так называемом «третьем мире», где конец биполярного противостояния был воспринят на уровне местных противоборствующих элит как сигнал к вседозволенности и анархии. Целые регионы мира оказались «наводненны- ми» легким и стрелковым оружием (ЛСО), которое стало наиболее применимым видом вооружений в 47 из 49 региональных и локальных конфликтах 90-х годов прошлого века. Другим следствием резко уси- лившейся региональной и локальной нестабильнос- ти стал невиданный прежде рост организованной преступности, которая также является активным потребителем ЛСО.

تشارك العديد من الدول بنشاط في عمليات نقل الأسلحة الصغيرة والأسلحة الخفيفة والذخائر، بوصفها دولًا مستوردة، أو مصدرة، أو دول عبور. وفي بعض الأحيان، يمكن أن تُفقد تلك الأسلحة أو تُسرق نتيجة الفساد الحكومي والسعي وراء الربح من قبل سماسرة الأسلحة، في حين تساعد السيطرة الفعالة على تدفق الأسلحة الدولية على منع وقوعها في أيدي مستخدمين نهائيين غير مرغوب فيهم.وقد تم استخدام المنهج الوصفي التحليلي بهدف وصف وتحليل ظاهرة الاتجار بالأسلحة الصغيرة والخفيفة على الصعيد الدولي، والنظر في تداعياتها السلبية، إلى جانب توضيح أهم ملامحها وأسبابها، وأبرز التدابير الخاصة بمواجهتها، مع الإشارة إلى أهم الاتفاقيات الدولية الناظمة لها.بفضل سهولة استخدامها وحجمها الصغير واحتمال نقلها عبر الحدود، ليس هناك شك في أن الأسلحة الصغيرة والخفيفة ستزيد من العنف والجريمة المنظمة وعدم الاستقرار الدولي؛ إذ لا تزال الضوابط الوطنية والدولية التي تحكم تجارة الأسلحة الصغيرة والخفيفة تواجه تحديات كبيرة بسبب افتقارها إلى الدعم من كبار منتجي ومورّدي ومصدري الأسلحة، بالنظر إلى مصالحهم السياسية والاقتصادية. ولذلك، يجب على الدول اتخاذ تدابير أكثر صرامة لمراقبة صادرات الأسلحة وضمان خضوع العقود أو شهادات المستخدم النهائي للائحة تحظر تحويل وجهة الأسلحة أو إعادة تصدير الأسلحة دون إذن سابق من المُصدّر الأصلي، مع رفض منح تراخيص التصدير حيثما كان هناك خطر واضح من استخدام هذه الأسلحة لترهيب المدنيين أو انتهاك الالتزامات الدولية، بما في ذلك: قرارات العقوبات الصادرة عن مجلس الأمن الدولي

This article argues that the Philippines' small arms control measures have failed. This failure is seen in two ways. First, statements issued by the Philippines in the 2007 United Nations (UN) Conference on the Illicit Trade in Small Arms and Light Weapons in AI/ Its Aspects and the follow-up 2003 Biennial Meeting of States on the Implementation of the Program of Action of the previous conference are partly inconsistent with the national laws instituted in the country. Another way of looking at the failure of the Philippines in controlling the diffusion of small arms in its territory is through the conflict in Mindanao. The national mechanisms currently in place are insufficient to address this problem because the influx of weapons continues, further intensifying the conflict.

AbstractContrary to the general trend of trade liberalization, specific goods—such as small arms, drugs, and antiquities—have come under increasing international control in recent decades through a set of international regulatory agreements. This article offers a theoretical framework of government preferences on the international regulation of these goods. Departing from conventional models of trade policy, the theoretical framework introduces negative externalities, rather than protection, as the motivation for restricting trade; it also takes moral concerns into account. I test this framework empirically through an original survey of government views on international small-arms regulation. Based on interviewing officials from 118 countries, the survey reveals a large variation in government preferences that conforms to the theoretical expectations. I employ this variation to explain why the international regulation of small arms is weak, despite the fact that these are the deadliest weapons of all in terms of actual death toll.

Those promoting the new instrument emphasize the existing obligations of States, under the law of State responsibility, not to aid or assist another State in violating international law. This article explores the extent to which the prohibition of “complicity” is a sufficient basis for requiring States to consider the end-use of the weapons they transfer. Throughout the world, violence, delinquency and fear undermine the basic right of individuals to live in peace and fully benefit from the healthy and sustainable commu-nity. More worrisome is the seemingly uncontrollable proliferations of small and light weapons which remained one of the major challenges for security and sustainable development in Nigeria. It is against this backdrop that this study examines the threats that small arms and light weapons proliferation portends on the Nigerian security and sustainable development. They study relied on secondary data and utilizes the content analysis for interpretation of data. This study is anchored on the state failure theory to underscore situations that warrant recourse to small arms and light weapons. The study concludes that the debilitating economy, failure of the state to provide the basic necessities of life, corruption, high rate of youth unemployment and sluggishness among the state’s instrument of force viz: the Army, police etc., are some of the major factors that serve as challenges to meaningful efforts and policies at combating the menace in the country. This study therefore recommends among others that the gov-ernment in all levels should embark on poverty alleviation programs and provide em-ployment opportunities to unemployed youths. This will discourage youths from join-ing ethnic militias and other militant groups that pose threats to peace and security in Nigeria.

By the approaching of international regime theory, this article explains the interest based of regime that explain the background of regime formation which could influence state behavior to cooperate and successfully implement the rules of the international regime itself. The research applying qualitative research methods with data sourced from primary and secondary data from ASEAN official documents, books, journals, online news. This article shows that the effectivity of AMMTC to deal with the illicit Small Arms Trade is strongly influenced by the implementation commitment of the state members.

John Sislin and Frederic Pearson have written a fine book that addresses a complex and understudied issue: the role of arms in ethnic conflict. While it is abundantly clear that arms and ethnic conflict are closely intertwined, we have little systematic knowledge on the nature of the relation. What kinds of weapons—tanks versus small arms, say—play the greatest role? Whatever the weapon, how does its influence vary at different stages in the process of ethnic conflict? As unpleasant as the thought might be, are there conditions under which armaments play a positive role in such conflicts—for example, by promoting a situation of stalemate or bringing about outside humanitarian intervention? The signal contribution of this compact volume is to shed much-needed light on these and many other questions.
