Abstract:
Esta pesquisa investiga como se dão as interações e as relações entre a tecnologia e o trabalho do(a) Advogado(a). O estudo tem o objetivo de analisar as condições atuais do trabalho na advocacia a partir das modificações trazidas pelo Processo Judicial Eletrônico – PJE. Busca-se apresentar o quantum o PJE tem condicionado a práxis cotidiana da atividade da advocacia. Temse como pressuposto teórico que o trabalho e a tecnologia não determinam o agir humano, sendo, pois, o ser humano livre para direcionador as facilidades trazidas pela tecnologia, as quais deveriam, em tese, proporcionar a melhoria nas condições materiais da vida das pessoas. Trata-se de pesquisa realizada a partir de questionários abertos que permitem, tanto uma análise qualitativa dos conteúdos de depoimentos escritos, quanto certa quantificação, via consolidação das respostas obtidas. São analisadas as transformações provocadas pela informatização do processo judicial em sua nova forma eletrônica – mudanças estas ocorridas a partir do advento da Lei 11.419/2006 – e a reestruturação do trabalho na advocacia brasileira nestes últimos anos. O problema que se pretende responder, em última análise, é o seguinte: Qual a potencialidade emancipatória da tecnologia para o trabalho do(a) advogado(a)? Ao final do estudo são apresentados os resultados obtidos na pesquisa quanto a: intensificação no trabalho do(a) advogado(a); modificações observadas na estrutura dos escritórios de advocacia; principais dificuldades dos(as) advogados(as) com o PJE; alterações na produtividade no trabalho dos(as) advogados(as); percepção dos(as) advogados(as) quanto aos impactos da implantação do PJE na saúde, e; algumas implicações de gênero, entre advogados e advogadas, para se para trabalhar com o Processo Judicial Eletrônico.
This research investigates how interactions occur and the relationship between Technology and the Work of the Lawyer. The study aims to analyze the current conditions of work of advocacy from the changes brought by Judicial Process Electronic - PJE. We seek to present the quantum the PJE has conditioned the daily praxis of advocacy activity. It has as theoretical assumption that the Work and Technology does not determine human action and therefore humans free to control the facilities brought by technology which should in theory provide the improvement in the material conditions of life people. This is research from open questionnaires that allow both a qualitative analysis of the content of the written reports, as some quantification via consolidation of replies. It analyzes the transformations caused by computerization of the judicial process in your new electronic form, these changes occurred since the enactment of Law 11.419/2006 and the restructuring of the work of Brazilian advocacy in recent years. The problem we intend to answer is the following: What is the emancipatory potential of technology to the work of the lawyer? At the end of the study presents the results obtained in the research regarding: intensification of labor lawyer, modifications in the structure of advocacy firms, lawyers 'main difficulties with the PJE, changes in work productivity of lawyers, lawyers' perception regarding impacts of the implementation of PJE in health and some gender implications between men and women lawyers to get to work with the Judicial Process Electronic.

Abstract:

The crews/actors/subs during a construction project make relationship and communicate with each other on the jobsite primarily when they work in a task sequence or when they work in the same working area at the same time. These interdependencies can have various impacts on their performance, the decisions their supervisor make and their action from both engineering and social aspects. The main focus of the past research is on the project parties’ relationship based on the information exchange and formal communication, while the research pertaining to the interpretation and investigation of the construction crews/trades’ interdependencies during the construction project is very limited. How are the construction jobsite actors connected in a construction jobsite? How do the existing interdependencies among them affect their performance? And how can understanding these interdependencies be beneficial for construction site managers? The primary goal of this research is to better understand the existing interdependencies among the construction crews/trades/subs and its impact. Particularly, the objectives of this research are to: 1) develop the jobsite social network of construction crews/trades and quantify its impact, 2) investigate the impact of social conformity on the performance of construction crews/trades, 3) identify the improvement direction (benchmarks) for inefficient construction crews/trades, and 4) investigate the cost/benefit of low or high reliable construction crews/trades and to develop a new educational version of Parade Game.

First, social network analysis (SNA) is implemented to develop a technique to construct the dynamic jobsite social network of crews/trades in a project and quantify its impact through the network centrality analysis. The results of a case study are presented. Then, SNA and social norm analysis are combined as a method to measure conformity, one of the main social network influences types that results in a change of performance/behavior in order to fit in a group, at construction crew/trade level and demonstrate how it can play role in the performance of crews/trades/subs particularly in their work plan reliability through two case studies. Then, inspired by social learning phenomenon, data envelopment analysis and SNA is combined to develop a procedure that can identify the improvement direction for the inefficient crews/trades/subs in a construction project. At the end, the research concentrates on the engineering aspects of the jobsite interdependencies by developing a simulation model, as a new educational version of Parade Game, that uses different variability levels and the corresponding costs at different work stations to investigate the relationship between the interdependencies and crews/trades’ variability/reliability.

Results demonstrate that the performance of construction crews/trades is under the influence of the social aspect of the interdependencies as well as the engineering aspect. They show that there is an association between influences a crew/trade/sub receives from the network and his/her performance. Results of case studies show that the subcontractors follow the performance norm in the project and their tendency to follow the norms of their neighborhood is higher than their willingness to follow the project norm. Parade Game simulation results also show that the production will enhance if the reliability increases and the investment made to improve reliability will return in most of the scenarios.

This research is significant and valuable as it looks at construction jobsite interdependencies from an exclusively analytical perspective, which has not been done previously. Previous research also did not investigate the social aspects of the construction crews/trades/subs interdependencies. Construction personnel at every level of management are constantly planning and trying to figure out how best to manage and coordinate the construction crews/trades/subs. A better understanding of the existing jobsite interdependencies will help project managers to control it through better planning and leadership, consequently increasing jobsite productivity.

Abstract:
The Commercial Court in London is frequently dealing with applications for a freezing injunction. The vast majority of academic literature and court decisions directly or indirectly adopt the view that freezing injunctions have stood the test of time and are so frequently granted in commercial litigation that there is no need for any serious concern about their scope, let alone the need to identify and question the legitimacy of the justifications for their existence. Contrary to the traditional view, this thesis has identified equipage equality as the primary function of freezing injunctions. This recognition that freezing injunctions seek to establish a level-playing field in litigation has led the author to conclude that the current scope of the relief is excessively claimant-friendly and involves illegitimate interference with the sovereignty of foreign states. Taking into account the tactical reasons for seeking a freezing injunction, the author challenges the current interpretation of the substantive preconditions for granting the relief. Their current interpretation does not strike a fair balance between the interests of the parties. The author argues that these concerns are exacerbated by the current international scope of freezing injunctions due to the insufficient regard for the principles of public international law. The encroachment on the jurisdiction of foreign states undermines equipage equality by enabling claimants to make multiple applications for interim relief in respect of the same assets. In the light of the above, the author has sought to make a range of proposals to restrict the scope of freezing injunctions with the aim of bringing the relief in line with equipage equality.

Abstract:
It is now over twenty years since the criminal trials of two women caught the attention of the British media. Sandra Craddock (later Smith) and Christine English both raised a successful defence of diminished responsibility based on premenstrual syndrome to a murder charge. In these cases the Court of Appeal apparently determined that PMS is a factor that can limit criminal responsibility. Although this thesis concentrates on the situation as it exists in English law, many of its conclusions are equally relevant to other legal systems, particularly those in common law jurisdictions.
The issues that are likely to arise in a criminal trial in which a defendant wishes to base a substantive defence on premenstrual syndrome can be condensed into five central questions: (i) Does premenstrual syndrome exist at all? (ii) If so, does the defendant suffer from the condition? (iii) Did PMS cause or contribute to the defendant's actions? (iv) If the answer to (iii) is yes, should the act be excused? (v) If so, under what category of excuse? This thesis will discuss the way in which these questions might best be approached. (Abstract shortened by UMI.)

Abstract:
Social change strategies grounded in theory help change agents to be more effective in their efforts. This study attempts to make explicit the links between public education efforts and the social change goals of non-profit organizations through an examination of both radical humanist thought and various social change theories.
This thesis maintains that public education is an essential component of lasting change, serving eleven identifiable roles in the social change process. Of particular note, education can serve to challenge the dominant corporate paradigm and to develop an informed, critical, and more active citizenry. Education can also help create an environment conducive to achieving systemic changes. It is argued that civil society organizations are well situated to play a leading role in the creation of a more just and healthy society. Public education is proposed here as an approach that shows considerable promise to move us in that direction.

Abstract:
This thesis is concerned with the latest education reform, called 4+4+4 (4+), and overall educational changes in the basic education system (K12) since 2002 by the governing Justice and Development Party (AKP). The study investigates the role that education plays in state formation processes as well as looking at how dominant groups’ ideologies influence education policies. The research problem is the extent to which the state uses education policies to create a new public ideology. There are three key research questions that this thesis addresses. The data for this research was obtained from fifteen semi-structured interviews conducted with teacher trade unions, journalists and policy makers, focusing on their experiences and views not only about the 4+4+4 education system but also about the policymaking process in Turkey. The interviews present the pressing issues within the education system and indicate how education works a state apparatus for the government to gain and secure society’s consent. Located in a critical tradition, the research draws its theoretical framework from the Italian theorist Antonio Gramsci, especially focusing on his concepts of hegemony, civil society and consent. Using a Gramscian theoretical framework allows this study to place the 4+ reform in a bigger picture. The thesis analyses the reform not only from a local perspective but also from an international education policy perspective, focusing on the relationship between power, ideology and schooling. The findings suggest that the state and its private associations (i.e. media, and political parties) are actively encouraging Islamisation along with neoliberalism in order to consolidate their hegemonic dominance.

Abstract:
Information technology, media, financial flows and consumer culture have long been acknowledged as transnational connective forces that spread ideas and values around the globe. This work proposes an alternative mechanism for such spread: development-focused civil society organizations. This thesis argues that such organizations constitute a backbone of connections that link a diversity of development actors and local communities into a network with global scope. While individual nodes in these civil society networks may not possess global reach, the network as a whole facilitates the far flung transfer of knowledge and ideas. This work focuses on the ways that knowledge is generated, transferred and renegotiated on both the global, national and local scale through such networks of development institutions. How are global discourses formed, adapted and spread via civil society into local communities? How do local communities interact with, change, implement or ignore the values, knowledge and rhetoric of global movements? How are communities shaped by these discourses and what role do they have in informing the discourses themselves? The project constructs two case studies of such 'knowledge networks' - two international foundations, their partner NGOs in the developing world (Kyrgyzstan and Kenya), and the local communities where the NGOs support ecologically-focused initiatives. The case studies demonstrate the complex and uneven ways in which knowledge and values are shared - and contested - within the networks. Ideas are transformed, adapted or ignored between different nodes, and yet the network retains enough common discourse and shared knowledge to function as a whole. Despite power imbalances, local actors remain agents, not subjects, in these networks and produce knowledge that is prized by other organizations and individuals in the networks. Civil society knowledge networks thus sculpt the content and application of knowledge across global movements, development-focused civil society organizations and local communities in the developing world.

This study proposes to critically analyze the mechanisms implemented as a result of reforms in the Brazilian civil procedure in the last two decades, that aims to standardize court decisions and expedite procedure. The study sustains that , given the conditions under which the Law operates in contemporary society, these mechanisms are unusable to provide court decisions with predictability nor certainty, because these mechanisms tends to become, themselves, a source of uncertainty and unpredictability. Mechanisms of court decisions standardization, such as the Brazilian binding precedent ( súmula vinculante ), depends upon proceedings and legal requirements that undermine the autonomy of the Legal System s operational code, which exposes the system to attacks from the code of other systems, such as Economy and Politic. Mechanisms to expedite proceedings, such as the Court s monocratic ruling by the reporting Justice, by their turn, engender losses in the system s capacity to legitimate judicial decisions by means of the legal proceeding, which also generates uncertainty regarding the social adequacy of the judicial decision. The present work uses Niklas Luhmann s system theory to describe the conditions under which the Law operates in the society, as well as the interrelated Guilherme Leite Gonçalves s thesis, also based upon system theory, to whom problems related to certainty of Law arises out of modern society s semantic inadequacy to describe a society that no longer can count on the old metaphysic certainty centers of the pre-modern societies. The application of the system theory to the Brazilian s Judiciary is based upon Celso Fernandes Campilongo and Orlando Villas Bôas Filho s theoretical approaches, according to which Brazilian Law is a case of an autopoietic system, to which the system theory may be applied, and that suffers with the overload of burdens arising from its environment and hardship to protect the system s center (the Courts) from such burden, which jeopardize the system s autonomy. With this instrumental, the study analyzes the history of the control mechanisms of Court s interpretation of the Law, upon which standardization of Court decisions is based, as well as its main theoretical references, such as common Law s stare decisis et non quite movere and the recent jurisprudence on equality on the application of Law and the right to a expedite trial
Este trabalho propõe uma análise crítica dos mecanismos de uniformização de jurisprudência e de aceleração do procedimento processual implementados pelas reformas no processo civil brasileiro nas últimas duas décadas. Defende-se que, nas condições em que o direito da sociedade contemporânea opera, esses mecanismos não são capazes de propiciar previsibilidade para as decisões judiciais nem certeza do direito, uma vez que eles próprios tendem a se transformar em fontes de incerteza e imprevisibilidade. Mecanismos de uniformização de jurisprudência, como a súmula vinculante, dependem de procedimentos e requisitos que minam a autonomia do código operacional do sistema jurídico, expondo o sistema a investidas de outros sistemas, como a política e a economia. Por sua vez, mecanismos de aceleração do procedimento, como os julgamentos monocráticos pelo relator, importam em perdas na capacidade de legitimar as decisões pelo procedimento, gerando também mais incerteza com relação à adequação social da decisão judicial. O trabalho faz uso do instrumental da teoria dos sistemas de Niklas Luhmann para descrever as condições em que o direito opera na sociedade, bem como da correlata proposta de Guilherme Leite Gonçalves, igualmente baseada na teoria dos sistemas, para quem os problemas de certeza do direito decorrem da inaptidão da semântica da sociedade moderna para descrever uma sociedade que já não conta com os antigos centros de certeza metafísicos das sociedades pré-modernas. Para aplicar o instrumental sistêmico ao Poder Judiciário brasileiro, faço uso das propostas de Celso Fernandes Campilongo e Orlando Villas Bôas Filho, que consideram o direito brasileiro um caso de sistema autopoiético, ao qual a teoria dos sistemas pode ser aplicada e que sofre com a sobrecarga de demandas do ambiente e dificuldade de proteger o centro do sistema (os tribunais) do ônus de lidar com essas demandas, pondo em risco a autonomia do sistema. Com esse instrumental, é feita uma análise histórica dos mecanismos de controle da interpretação judicial do direito, em que a uniformização de jurisprudência se funda, no processo civil brasileiro, bem como de suas principais referências teóricas, isto é, o princípio do stare decisis et non quieta movere da common Law e as recentes construções sobre os princípios da igualdade na aplicação da lei e da celeridade processual

Esta dissertação tem como objeto de estudo a disciplina jurídica do assédio moral na relação de emprego com foco em seus aspectos configurativos bem como em sua reparação. Busca este trabalho inicialmente trazer algumas considerações acerca da perspectiva civil-constitucional da dignidade da pessoa humana partindo-se do conceito trazido por Kant. Analisa-se também o direito do trabalho como instrumento que preserva esta dignidade diante do conflito de interesses existentes no ambiente laboral. Neste cenário o assédio moral no ambiente de trabalho deve ser entendido como um fenômeno social que atinge diretamente a dignidade do trabalhador sendo portanto necessário um aprofundamento na sua análise diante da ausência de leis federais específicas sobre a matéria. Para a construção desta disciplina jurídica sobre o assédio moral adentrou-se em seus aspectos configurativos partindo-se da análise de conceitos já existentes na doutrina bem como na jurisprudência. Ademais fez-se mister a verificação da presença de elementos comuns em todas as hipóteses de assédio moral. Visando ainda mais a sua particularização foram expostas as diversas modalidades deste fenômeno bem como relatadas atitudes que apesar de apresentarem certa similitude não configuram o assédio moral. Outros aspectos tratados dizem respeito aos efeitos do assédio moral sobre quatro óticas quais sejam a do empregado assediado a do empregado assediador a do empregador e a da coletividade. Foi feito também um paralelo da legislação francesa com a realidade brasileira em razão dessa lei ter sido a pioneira em todo o mundo. Sobre os aspectos reparatórios cumpre informar que inicialmente figurou como preocupação desse estudo trazer as linhas gerais acerca da responsabilidade civil. Outrossim buscou-se evidenciar as particularidades acerca da prova do assédio moral evidenciando uma postura preferencial acerca das presunções frente à inversão do ônus da prova. Por fim tratou-se da política preventiva e de combate a este fenômeno.

Abstract:
This study looks at the responses of the Yorkshire Catholic gentry to the immense changes to their religious landscape in the early modem period, between 1536 and 1642. It examines how they continued to adhere to the Catholic religion, despite all attempts first to induce and then compel conformity and highlights the ways in which they managed to survive and prosper throughout the period, demonstrating that previously neglected groups such as women and younger sons had a crucial role to play in this process. The overwhelming theme to their actions was one of pragmatism, rather than the heroic and self-destructive behaviour that was much admired by earlier historians who wanted to identify martyrs to the Catholic cause. The areas that are to be examined reflect both public and private gentry activities. In the public sphere the Yorkshire gentry's part in the rebellions of the Tudor and Stuart eras are studied along with their rejection of plots. The importance of marriage as an early modem tool for building alliances and social advancement is acknowledged and the impact that a continuing adherence to Catholicism had on this is considered. The gentry and the church are examined through a study of the Catholic gentry's involvement with their local parishes, their reaction to the dissolution and their continuing adherence to monasticism, as shown through their devotion to English orders on the continent. To reflect the changes that were occurring in this period Catholic involvement in education, the law and medicine are also explored showing that the Catholic community was not isolated from the wider society. Lastly the role of Catholic women is given specific consideration in order both to redress the imbalance in previous studies and due to the crucial role that women played in the continuation of the Catholic community within Yorkshire.

Abstract:
Arroyo Chico Wash, an important drainage for central Tucson, Arizona, runs through numerous neighborhood and industrial areas before emptying into the Santa Cruz River. Within four suburban neighborhoods along the wash, direct observations, personal interviews, survey questions, and historical documents are used to describe design and management influences on the biological and human aspects of the wash. Plants along the wash are identified by 2-meter wide belt transects run at 100-meter intervals over the 4 kilometer length of the study area. Wild animal and bird lists are based on observation and information given by residents. Relationships between design, maintenance and neighborhood attitudes toward the wash are assessed using a survey questionnaire given to people living adjacent to the wash. Results show the wash in the Colonia Solana neighborhood has the greatest biological diversity, highest neighborhood satisfaction and highest recreational use. In neighborhoods where the wash is a "backyard easement", satisfaction and use are the lowest.

This paper examines the relationship between Track I Diplomacy and Civil Society in Cyprus. Cyprus has been a divided island for over 45 years despite numerous attempts at reconciliation on the societal level and ongoing negotiations on the diplomatic level. It was the aim of this study to examine the ways in which both civil societies and their leaders do or have worked together, if at all, to negotiate a political solution or reconciliation between the two communities. Interviews were conducted on both sides of the cultural divide and within both political and civil society sectors. Those interviews were coded, categorized, and then thematically analyzed. Findings explicate three themes that challenge the relationship and cooperation between Track I and Track II; Structural Elements, Nationalism, and International Support. Furthermore, it is proposed that the leaders must lead and support their citizens in reconciliation and peacebuilding efforts while continuing to negotiate a solution to the Cyprus problem as civil society organizations continue to support negotiation efforts.

Abstract:

Congestion charging is a now accepted means of influencing traffic to behave in a more socio-economic optimal way, like e.g. in the Stockholm project. Already early work, in the 1920’s, showed that road use can be inefficient due externalities, i.e. that users don’t experience their own (negative) effect on other users: an extra car on a traffic link causes delays for other cars, but the driver himself does not experience this cost.In the 1950’s it was further shown - for a congested road network with homogeneous users – that if each user is charged a toll equal to the total value of time loss incurred on other users of the network, then -if we have fixed travel demand - this will induce an equilibrium that is system optimal in the sense that the total cost of network usage is minimal (assuming that all users have fixed and identical time values).  But toll charges need to be levied in monetary units, and different travelers have different values of time. Therefore, to account for the effects of tolls, and to be able to compute equilibria, one needs to introduce different user classes, differing in their time values.

In this thesis, consisting of four papers, we study congestion pricing of road networks with users differing only in their time values. In particular, we analyze marginal social cost (MSC) pricing, a tolling scheme that charges each user a penalty corresponding to the value of the delays inflicted on other users, as well as its implementation through fixed tolls.

Paper III contains the main theoretical work of the thesis. In that paper we show that the variational inequalities characterizing the equilibria in question can be stated in symmetric or non-symmetric forms. The symmetric forms correspond to optimization problems, convex in the fixed-toll case and non-convex in the MSC case, which hence may have multiple equilibria. The objective of the latter problem is the total value of travel time, which thus is minimized at the global optima of that problem. Implementing close-to-optimal MSC tolls as fixed tolls leads to equilibria with possibly non-unique class specific flows, but with identical close-to-optimal values of the total value of travel time. Finally we give an adaptation, to the MSC setting, of the Frank-Wolfe algorithm, which is further applied to some test cases, including Stockholm.

Paper I is an early application using Frank-Wolfe, after having realized the possibility to symmetrize the problem.

Paper II gives a convexification of non-convex equilibrium problem for MSC tolls. We have used these convexifications to compute lower bounds when computing equilibria.

Paper IV is a short note commenting some flaws in two papers by Dial on MSC tolls.

Social capital research has traditionally been conducted in western and Christian settings as a precursor of changes such as democratization and development. This paper focuses on Islamic religious engagement and its potential to foster social capital. The model presented here is designed to suggest whether the Islam's influence occurs through doctrinal channels, or through Islam's capacity to organize social structures. The analysis conducted is a linear regression model with measures of social capital as dependent variables and measures of religious engagement as independent variables. The analysis is conducted on data from the fourth wave of the World Values Survey. Results suggest that religious engagement and social capital have both belief and behavioral elements that should be treated as separate entities in quantitative research.

Abstract:
The United States is among one of the only democratic industrialized nations in the world that does not provide guaranteed access to civil representation in cases involving basic human need. This leaves indigent litigants who are at risk of losing their homes or their children left to seek counsel through insufficient pro-bono programs or limited scope legal self-help centers. This thesis provides a history of the struggle for the right to civil counsel, known as Civil Gideon, and explores a variety of proposed solutions to bridge the justice gap for indigent litigants. Despite considerable support for Civil Gideon among scholars and the legal community, the public is unaware of the justice gap- about 80% of Americans assume the right to civil counsel already exists. This thesis conducted two studies to understand possible reasons for this gap between public knowledge and reality and to identify the possibility of manipulating public knowledge through exposure to injustices. The findings from these studies are used to inform a network approach to shape public support for Civil Gideon so that the US court system can truly represent opportunity and equality for all citizens.

Artical 2 of civil procedure code establishes the main aims of civil litigation:defence of violated subject rights and licit interests, proper applying of law when hearing civil cases and passing judicial decisios,swift restoration of legal peace,interpretation and development of law. The essential goal of master's final thesis is to investigate how the above mentioned aims of procedure are implemented in the judicial practice. The author claims that procedural aim of proper appliance of law in the practice of Lithuanian courts is interpreted as the duty of court to identify material truth.The author as well analyses the influence of the recent reform of civil procedure unto the rapidity of litigation and states that there still exist some negative practice in pastponing the hearing of the case when there are no serious reasons for such procedural decision instesd of passing a default judgement or appying procedural penalties. It is generalished that the new Code of Civil procedure established better premises to materialise the essential aims of the procedure.

Abstract:
This thesis examines the phenomenon of child-soldiering from a different perspective. It seeks to challenge, using a novel approach, earlier studies on the roles of former child-soldiers in post-war societies. It focuses on the subjectivity of young veterans, that is war veterans formerly associated with armed forces and groups as children during the 14-year gruesome civil war which bedevilled Liberia between 1989 and 2003. This civil war claimed roughly 250,000 lives, and saw the active participation of approximately 21,000 child-soldiers. This thesis departs from previous works which mostly painted an apocalyptic picture of young veterans, and explores the nexus between their self-agency, Foucauldian technologies of the self and their transformation in the post-war society. The majority of previous scholarly works which have dominated the field of child-soldiering dwelt on the impact of armed conflict on the child-soldiers, the negative consequences, the causes of child-soldiering, and the rehabilitation and reintegration of the young veterans after their disarmament and demobilization. What this thesis seeks to do however, is to establish that, rather than considering the young veterans simply as social misfits, distraught and dispirited human beings, it should be noted that young veterans through their agency, are capable of ensuring their reintegration into their war-ravaged societies. Sadly, these young former fighters’ self-agency and technologies of the self in defining their civilian trajectories have often been overshadowed by vaunted humanitarian aid and multilayered war-profiteering. This study is underpinned by interpretive constructivism, symbolic interactionism, social identity theory, sociometer theory and expectancy theory, and sheds light on how young veterans’ self-agency, instrumental coalitions, and decision-making processes, synergistically shifted the negative identities foisted on them as a result of their participation in the war.

This dissertation is a study of morale in the western Confederacy from early 1864 until the Civil War's end in spring 1865. It examines when and why Confederate morale, military and civilian, changed in three important western states, Mississippi, Alabama, and Tennessee. Focusing on that time frame allows a thorough examination of the sources, increases the opportunity to produce representative results, and permits an assessment of the lingering question of when and why most Confederates recognized, or admitted, defeat. Most western Confederate men and women struggled for their ultimate goal of southern independence until Federal armies crushed those aspirations on the battlefield. Until the destruction of the Army of Tennessee at Franklin and Nashville, most western Confederates still hoped for victory and believed it at least possible. Until the end they drew inspiration from battlefield developments, but also from their families, communities, comrades in arms, the sacrifices already endured, simple hatred for northerners, and frequently from anxiety for what a Federal victory might mean to their lives. Wartime diaries and letters of western Confederates serve as the principal sources. The dissertation relies on what those men and women wrote about during the war - military, political, social, or otherwise - and evaluates morale throughout the period in question by following primarily a chronological approach that allows the reader to glimpse the story as it developed.

ENGLISH ABSTRACT: Nigeria is a country that has witnessed ongoing – albeit sporadic – violent conflict since its independence in 1960 from Britain. A brutal civil war, known as the Biafra war, lasting from 1967 to 1970, was not to end social tensions in this ethnically diverse country. Violent conflict has been an ongoing reality since the end of the Biafra war in 1970. In addition, Nigeria has exhibited substantial environmental degradation and resource scarcity during this time. Hence, this study assesses whether environmental degradation and resource scarcity are independent causes of domestic violent conflict in Nigeria since the end of the Biafra war. Additionally, rich reserves of natural non-renewable resources – in particular the prevalence of oil – are analysed vis-à-vis the degradation and growing scarcity of renewable resources in order to consider the impact both these aspects have on post civil war conflict in Nigeria. In order to achieve this, this study concerns itself primarily with causation. It considers two aspects in this regard. Firstly, it evaluates the assertion that the environment is an independent cause of conflict. That is to say, it investigates the notion that the environment impacts independently on human behaviour. Secondly, it examines the components of the social structure that create conditions that manipulate the environment in such a way that conflict is the ultimate outcome. This study asserts that the agency-structure composite is important to understand in order to examine violent conflict and its relationship with the environment in Nigeria. This relationship-structure-cause premise is examined by using a complex theory framework. Consequently, importance is placed on the causal relationship between violent conflict, environmental degradation and scarcity, natural non-renewable resource dependency and the social, economic and political milieu in which this transpires. This study ascertains that severe environmental change can only be considered a cause of conflict when its impact is considered with other important factors such as economic and political anonymity, which – for the most part – create the milieu in which subsequent violent conflict is the outcome.
AFRIKAANSE OPSOMMING: Nigerië is 'n land wat deurlopend kan getuig, alhoewel sporadies, dat daar sedert sy onafhanklikheid van Brittanje in 1960, geweldadige konflik was. 'n Brutale burgelike oorlog wat geduur het vanaf 1967 to 1970, het geensins die sosiale spanning ge-eindig vir hierdie etniese diverse land nie. Gewelddadige konflik is 'n deurlopende werklikheid sedert die einde van die burgeroorlog in 1970. This thesis asks the following fundamental question: to what extent can economic and social rights be made effective through law? Because this question touches at once upon the effectiveness of these rights and on their status as norms of positive law, attempting to answer it requires first, an openness to other disciplines, and subsequently, to the question of the respect and control of these norms, namely that of sanction. From the outset, a preliminary and multidisciplinary analysis of the issue of contemporary poverty hints at an undeniable deviation with "pure legal theory". Moreover, economic and social rights are becoming more and more tangible in national legislation and more frequently invoked before the court (who is turn are showing a growing openness). 'Hard law' does have a place in this implementation, notably a symbolic one. Thus, the first part is dedicated to the determination of the role of 'hard law' as well as to the relevance of judicial activism. Given the limitations of 'hard law', the second part examines the issue of alternate courses of State action as opposed to any other demands for rights. Two forms of 'soft' and 'reflexive' law will then be examined in the interest of rendering economic and social rights effective: respectively from within the State, and from outside its framework. First, strategic planning (accompanied by outcome-based management) may serve to coordinate the State apparatus in the struggle against poverty. In what concerns the role of law at a societal level and in the context of a complex society, societal guidance will be preferred to impose strategic planning. In this way, it will be possible to shed light on other forms of sanction, which may be complimentary to legal ones. Finally, it is necessary to establish certain control and follow-up mechanisms of this category of rights, more relevant and innovative in order to garner a greater effectiveness of economic and social rights.

A healthy democracy is generally seen as one in which citizens participate regularly in formal political activities. Citizens’ participation in governance has come to be accepted as an expression of their rights and the manifestation of citizen agency. Access to information remains a crucial component of the right to participate. Transparency, as a normative and constitutional value, represents a means, not an end. The means is the mechanism of access to information. Within the South African context, there is evidence of an increase in participation of a variety of interest groups by means of different processes, as well as through the establishment of numerous consultative bodies and mechanisms for popular participation at all levels of the political structure (Houston, 2001:1). However, accountability to citizens can best be gauged by assessing citizens’ opportunities to influence legislation between elections. Ultimately, the effectiveness and sustainability of mechanisms aim at improving citizens’ participation in policy formulation in order to become effective when they are “institutionalized” and when the state’s own “internal” mechanisms are rendered more transparent and open to civic engagement. Furthermore, the success depends on some form of effective interaction between the state and civic society. In the case of South Africa, whilst the political context and culture for participation exist in the form of the constitutional provisions and several pieces of legislation, a discrepancy exist whereby many South Africans are excluded or devalued by the vast differences in wealth. Citizen’s votes may count equally, but they are still not able to participate on an equal basis between elections. Participatory mechanisms established to ensure citizen’s participation, access to information and monitoring inside and outside the legislature, remain ineffective. These unequal opportunities mean that the poorer and less organised segments of society are prejudiced in terms of influencing legislation and policy. Their lack of full and meaningful participation means legislative outcomes are less representative of, and responsive to, the interests of the poorer segments of society (Habib, Shultz – Herzenberg, 2005: 144). The focus of this study is limited to the province of KwaZulu-Natal. The aim is to, firstly, assess the extent to which citizens can control those who make collective decisions about public affairs. Secondly, it assess the extent to which citizens participate in the existing participatory mechanisms, and thirdly, the study explores the possibilities of the synergy between the state and civil society in promoting effective participation by its citizens. The study, therefore : 1. Assess the theoretical and policy framework for citizen’s participation in South Africa; and 2. Evaluate the level of participation and effectiveness of participatory mechanisms inside and outside the KwaZulu - Natal Legislature. The study introduces the theoretical and conceptual framework of citizen participation through a literature review; followed by an empirical study of citizen participation in the legislative process in the kwaZulu Natal legislature. The study makes the following findings: 1. The literature review concurs that South Africa has one of the most progressive and liberal constitutions in the world. This is coupled with a sound policy framework demonstrating genuine political will for citizens’ participation in policy formulation. 2. Within the political context and culture for citizen participation, the main question of how much control citizens have over the actions of their government remains. Another issue is whether existing mechanisms in the legislature are effective in engendering citizen’s participation and quality input in public policy – making processes. 3. The study showed that ultimately the effectiveness and sustainability of citizen participation mechanisms is improved when they are “institutionalised” and when the state’s own internal mechanisms of accountability are rendered more transparent and open to civic engagement. The study also highlighted the need for synergy between the state and civil society. This includes, among other things, participatory budgeting, public expenditure tracking, monitoring of public service delivery, investigative journalism and citizens’ advisory boards. The study, therefore, makes two recommendations: 1. A comparative Citizens Education and Outreach Programme be developed and spearheaded by both the legislature and civil society in kwaZulu-Natal; and 2. A further study needs to be undertaken to investigate the possible structural nature of the synergy (relationship) between the state and civil society in the province.

This thesis examines the key question: can voluntary associations enhance democracy? It tests critical claims made by Habermas and others that voluntary associations have the potential to reinvigorate a public sphere in a state of atrophy. The thesis outlines the major theoretical arguments pertaining to these areas and then presents the results of empirical work within voluntary organisations. Specifically the thesis: Critically examines the concept of the public sphere, being a sphere between the state and civil society and investigates why theorists have advocated voluntary associations, claimed to be the core institutions of civil society, as sites where democratic ideals can be secured; Goes on to examine the concept of civil society and reviews the recent literature that has attempted to define and analyse the role of voluntary associations in contemporary society; Tests empirically the normative ideals that have been advocated on behalf of voluntary associations through the presentation of data obtained using qualitative methodology. The analysis of the data collected during interviews with key employees and members of six voluntary associations in Melbourne, Australia allows for a more informed knowledge regarding the key concepts and themes of the thesis. The thesis ends by directly addressing the following points: whether or not the public sphere is in a state of atrophy; the particular nature of voluntary associations contemporary engagement in the public sphere; and whether voluntary associations can indeed, be sites where democracy can be enhanced and democratic ideals be secured. It is concluded that voluntary associations operate within Habermasian public spheres, counterspheres, and postmodern public spheres and that unitary notions of the public sphere, such as those Habermas proposes, do not adequately explain voluntary associations engagement in the public sphere. Accordingly, it is concluded that voluntary associations have the potential to invigorate public spheres, though not in ways that many theorists writing on the subject suggest.

This dissertation explores the emerging relationship between the U.S. military and the commercial video game market. Specifically, this study situates this relationship in terms of the U.S. military's evolving role in a variety of media-such as Hollywood feature films, television, and television news-for the purposes of propaganda and the influencing of public opinion. Consequently, an analysis and critique of the U.S. military's production and commissioning of commercial video games will be advanced that takes into account contemporary analyses and media critiques with respect to war and representation. Since these games are also a part of the larger field of entertainment and cultural production, this study will attempt to understand these products for the complex ways they combine cultural expression, modern spectatorship and the desire to influence or mediate popular conceptions of war. Consideration will also be given to situating these products within the emerging field of video game studies and aesthetics, as well as questions concerning genre, realism, historical revisionism, and the ethics of simulation.

The purpose of this study is to conduct an assessment of the role of civil society organizations with regards to poverty alleviation. The study is conducted in Amathole District, Eastern Cape Province. The sample for the study is constituted by 3 civic society organizations (CSO), which are located in 3 local municipalities; namely, Amahlathi (Ikhwezi Women Support Center), Mbhashe (Nyhwara Home Base), and Mnquma (We Care Ministries) Local Municipalities. In terms of the data collection, semi-structured interviews were conducted with 14 officers from these civic society organizations. Concerning the research design, a combination of a qualitative and quantitative research approach was used. Concerning the findings of the study, the following points were noted: the different forms of interventions by civic society organizations, poverty eradication strategies, challenges that were experienced by civic society organizations, and the logical framework versus unexpected changes. It is probably safe to make mention that CSOs in the Eastern Cape portray a positive attitude and willingness to learn to manage the organizations better. The continuing support from the Department of Social Development will go a long way to assist the CSOs to become sustainable, in the context of management and efficient running of these organizations. The study thus concluded that specific benefactor-beneficiary dynamics are crucial for the success of any anti-poverty intervention. A greater need for the robust pro-poor social policy, availability of resources with which to translate it into action, and local entrepreneurial potential do not in themselves bring about success; they must operate in a certain way and be supported by certain principles and commitment for them to become powerful proper vehicle for alleviating poverty.

Resumo: Nesta tese estabeleceu-se o objetivo de pesquisar a construção da abordagem socioambiental, na perspectiva da sociedade civil da América Latina no âmbito internacional, com o recorte nas conferências internacionais e reuniões organizadas pelas Nações Unidas sobre meio ambiente. Neste sentido, o que se pretendeu nesse trabalho foi compreender as origens, os significados e os desdobramentos das discussões sobre a sustentabilidade, o desenvolvimento, a temática ambiental, ocorridas nas fases preparatórias e durante a realização desses encontros, e de que forma levaram à formação de uma perspectiva socioambiental na arena internacional. Também são apresentadas as alterações no contexto, nos elementos constitutivos e nos referenciais teóricos criados pelos atores participantes dos fóruns internacionais patrocinados pela ONU ao longo de cerca de cinco décadas, especialmente no que diz respeito à sociedade civil. Procurou-se, assim, realizar a análise dos registros e produtos gerados nas fases preparatórias e durante a realização de cada um dos eventos internacionais, tanto na agenda oficial quanto nos eventos paralelos de cada um deles. A tese também faz uma análise segundo cada um dos períodos históricos vinculados às conferências e reuniões da ONU e cobertos pela pesquisa (1960 e 1970, 1980, 1990 e século XXI), procurando construir uma caracterização dos movimentos e das organizações sociais em relação a sua forma de organização, a sua agenda, ao seu modo de atuação e as suas relações com os demais atores sociais, com especial atenção para a realidade Latino-Americana. Na parte conceitual, formulou-se um breve panorama acerca das principais correntes de pensamento que procuraram refletir sobre a sociedade civil e os movimentos sociais na transição do século XX para o século XXI, onde são apontados os elementos mais significativos de como tais linhas de pensamento procuravam analisar e compreender suas características, suas relações com seus pares e com os demais atores sociais da esfera pública e privada, além deressaltar as diferenças em relação à sociedade civil de outras épocas. O objetivo principal era salientar que são conceitos em constante alteração e objeto de grande debate por parte do campo acadêmico e em várias áreas do conhecimento, reflexos da complexidade que tais atores vêm ganhando ao longo do tempo. Por ser a América Latina o foco de análise da tese, são apresentadas informações sobre os fatores sociais, econômicos e políticos da região a partir de eixos temáticos comuns, característicos do continente e que têm significância para o surgimento da abordagem socioambiental: elementos sociais, políticos e econômicos históricos, as relações entre os campos públicos e privados e a relações da sociedade civil com o Estado, na democracia e em regimes autoritários. Tal apreciação abrange os seguintes países: Argentina, Bolívia, Brasil, Chile, Colômbia, Equador, México e Peru. A esse painel soma-se um quadro sobre a situação e os desafios ambientais na América Latina e suas relações com a esfera internacional. Finalmente, são apresentados os elementos que pautaram a formulação da abordagem socioambiental e os desafios para que esta visão seja efetivamente implantada por atores sociais, propondo-se, para tanto, da adoção de um paradigma pautado pela Ecopolítica, capaz de enfrentar a questão ambiental, sua complexidade e seu caráter global.
Abstract: In this thesis objective was to investigate the construction of the social environmental approach in the perspective of the Latin America civil society at international level, with the cutting out in the international conferences and meetings organized by the United Nations on environment. In this sense, the intent was to understand the origins, the meanings and the ramifications the debate about sustainability, development, environmental issues taken place in the preparatory phases and during the realization of these meetings and, in which form they led to the formation of a social environmental perspective at the international level. It also shows the changes on the context, in the constitutive elements and in the theoretical referential created by the actors along five decades, especially regarding civil society. Therefore an analysis of the registers and products produced in the preparatory phases and during the realization of each one of the international events was carried out, both in the official scenario and in the parallel events. The theory also does an analysis following each one of the historical periods linked to the conferences and meetings of the United Nations and covered by the research (1960 and 1970, 1980, 1990 and century XXI) in order to build a characterization of the movements and social organization regarding their form, agenda, way of acting and of their relationship with other social actors, with special attention for the Latin-American reality. In the part conceptual part a short view was formulated about the main theoretical groups that tried to explain civil society and social movements during the transition of the century XX for the century XXI, where the most significant elements were highlighted referring to their characteristics, relations with their peers and with other social actors of the public and private sphere, besides emphasizing the differences regarding the civil society of other times. The main objective was to point out that those are concepts in constant alteration and object of great discussion on the academic field and in several areas, which reflects the complexity those actors have gained along the time. Since the Latin America is the focus of analysis of the theory, information about historical, social, economical and political reality of the region have been presented from a thematic axles referring common characteristic of the continent and that have signification for the appearance of social environmental approach: historical social, political and economical elements, relations between the public and private fields and relations of the civil society with the State in the democracy and in authoritarian regimes. Such an appreciation includes the following countries: Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, Mexico and Peru. A picture is added up to this panel on the situation and the environmental challenges in the Latin America and its relations with the international sphere. Finally, the thesis presents the elements that ruled the formulation of the social environmental approach and the challenges so that this vision might be effectively implemented by social actors, being proposed the adoption of a paradigm ruled by Ecological Politics, able to face the environmental issue, its complexity and global character.

ENGLISH ABSTRACT: Socio-economic rights are the subject of much debate in South Africa and elsewhere. At first they were simply denied the status of any rights at all. Lately, there is a fair amount of recognition for them as rights. The tendency is, however, to relegate them to paper rights and invest very little effort in bringing about their actual realisation. In this thesis I inquire into the question of what a human right, properly so called, is, and then whether, in the light of that inquiry, there is a basis for the reluctance to embrace socio-economic rights. South Africa is uniquely fortunate in having a constitution that gives recognition to socio-economic rights and requiring the Human Rights Commission to monitor their implementation. But again there is a risk that the recognition of socioeconomic rights is left as a constitutional matter, and nothing or little is done for their practical implementation. Therefore I inquire into the manner in which the Human Rights Commission monitors the implementation of these rights. The inquiry into the Human Rights Commission's monitoring role is largely a question of methodology. Whether, in other words, the methods of the Commission are such as to yield reliable information on the subject. I also inquire whether the government's budgetary allocations indicate a serious approach to these rights. The budgetary allocations that are brought under the microscope relate to the seven core rights enshrined in the constitution, namely, housing, health care, food, water, social security, education, and environmental rights.
AFRIKAANSE OPSOMMING: Sosio-ekonomiese regte is die onderwerp van vele debatte in Suid-Afrika en elders. Aanvanklik was daar nie erkenning gegee aan die status van hierdie regte nie. Hierdie situasie het die afgelope tyd begin verander. Die tendens is egter steeds om dit te sien as regte slegs op papier en daar word nie 'n poging aangewend vir die realisering van hierdie regte nie. Ek ondersoek in hierdie tesis die kwessie van wat 'n mensereg, korrek so genoem, is en ook of, in die lig van hierdie ondersoek, daar 'n basis is vir die huiwering om sosio-ekonomiese regte te aanvaar. Suid-Afrika is uniek in die sin dat die konstitusie erkenning gee aan sosioekonomiese regte en die Waarheid-en Versoeningskommissie opdrag gegee het om die implementering daarvan te monitor. Daar is egter weereens die risiko dat die erkenning van sosio-ekonomiese regte slegs gesien word as 'n konstitusionele aangeleentheid en dat niks of baie min gedoen word rakende die praktiese implementering daarvan. Ek stel daarom ook ondersoek in na die wyse waarop die Menseregtekommissie die implementering van hierdie regte moniteer. Die ondersoek na die monitering van die Menseregtekommissie is hoofsaaklik metodologies van aard; dus of die metodes wat gebruik is, deur die Menseregtekommissie, betroubare inligting verskaf. Ek ondersoek ook of die regering se begrotingallokasies 'n ernstige ingesteldheid jeens hierdie regte toon. Flash flood is among the most hazardous natural disasters, and it can cause severe damages to the environment and human life. Flash floods are mainly caused by intense rainfall and due to their rapid onset (within six hours of rainfall), very limited opportunity can be left for effective response. Understanding the socio-economic characteristics involving natural hazards potential, vulnerability, and resilience is necessary to address the damages to economy and casualties from extreme natural hazards. The vulnerability to flash floods is dependent on both biophysical and socio-economic factors. This study provides a comprehensive assessment of socio-economic vulnerability to flash flood alongside a novel framework for flash flood early warning system. A socio-economic vulnerability index was developed for each state and county in the Contiguous United States (CONUS). For this purpose, extensive ensembles of social and economic variables from US Census and the Bureau of Economic Analysis were assessed. The coincidence of socio-economic vulnerability and flash flood events were investigated to diagnose the critical and non-critical regions. In addition, a data-analytic approach is developed to assess the interaction between flash flood characteristics and the hydroclimatic variables, which is then applied as the foundation of the flash flood warning system. A novel framework based on the D-vine copula quantile regression algorithm is developed to detect the most significant hydroclimatic variables that describe the flash flood magnitude and duration as response variables and estimate the conditional quantiles of the flash flood characteristics. This study can help mitigate flash flood risks and improve recovery planning, and it can be useful for reducing flash flood impacts on vulnerable regions and population.

Abstract:
This study examines trade union resistance to the post 1977 Export Oriented Industrialisation (EOI) strategies in Sri Lanka, and the possibilities of developing new strategic options. In contrast to perspectives that narrow unions to political economic dimensions, this study emphasises the cultural and the movement dimensions of unions. The purpose of the study is to understand the ways unions can regain their role as civil society actors on the basis of building worker solidarity. The study is divided into two main parts. The first part focuses on the features and tendencies of social movement unionism as advancing new possibilities towards revitalising unions. Under globalisation, unions are faced with an increasingly casualised labour force with more women absorbed as wage workers. The promotion of labour market deregulation and privatisation, endorsed by neo-liberal ideologies of competitive individualism, illustrates the narrowing of unions to the workplace while undermining worker solidarity. The first part of this research describes the impact of :neo-liberal globalisation on trade unions; conceptualisation of and resistance to globalisation; the essence of trade unions; social movement unionism and labour internationalism. According to social movement unionism perspectives, party independent union strategies, based on elements of internal democracy and structured alliances open the possibility of emphasising the movement dimension of unions. The second part explains the context of unions in Sri Lanka, focusing on three unions - the Nurses, Tea Plantation workers, and Free Trade Zone workers. In terms of the structural context, Sri Lankan unions faced a multi-faceted weakening under the post-1977 EOI policies. The assertion of an authoritarian state, promoting interests of capital, enhanced the fragmentation of unions along party differences that were further compounded by divisions along ethnic identity politics. Moreover, the increasing militarisation of the state, which maintains a protracted ethnic war, reinforced coercive state strategies restraining union resistance and shrinking the realm of civil society. In confronting state strategies of labour market deregulation and privatisation, the enduring party subordinated unions are increasingly inadequate. In contrast, the three unions in this study express forms of party-independent union strategies. By analysing their modes of resistance related to the articulation of worker interests, their organisational modes, and their engagement in representative and movement politics the study explores the possibility of developing a social movement unionism orientation in order to regain their role as civil society actors

Abstract:
Cyberspace produces friction when the law is implemented by domestic courts using 'state-laws'. These laws are based on a ‘physical presence’ of an individual within the territory. It elevates conflicts relating to cyberspace jurisdiction. This research examines private international law complications associated with cyberspace. The paradigm of libel that takes place within the domain of social media is used to evaluate the utility of traditional laws. This research is conducted using ‘black-letter’ methodology, keeping in mind the changes constituted by the Defamation Act 2013. It pinpoints that the instantaneous nature of social media communication demands an unambiguous exercise of 'personal-jurisdiction', beyond the doctrine of territoriality. An innovation to the code of Civil Procedure is recommended to revise the process of service for non-EU defendants. The permission to serve a writ via social networks (or to the relevant Embassy of the defendant’s domicile state), can accelerate the traditional judicial process. This thesis can be utilised as a roadmap by libel victims for preliminary information. It contributes to the knowledge by discovering that the thresholds under Section 1 and Section 9 of the Defamation Act 2013 overlap with the conventional ‘forum-conveniens’ tests. This crossover is causing legal uncertainty in the application of existing rules to the digital libel proceedings. Section 1 and Section 9 thresholds do not fulfil the purpose of eliminating ‘libel-tourism’ and maintaining a balance between speech freedom and reputation rights. They raised the bar for potential victims and restricted their rights to justice. It is proposed that the traditional ‘conveniens test’ must be used for social media libel victims to produce legal certainty in cyberspace defamation.

This research tested the perception of Christian parents framing of gender and sexual identities in Duduza, Nigel. The researcher conducted the quantitative research based on the theoretical framework and measured it by means of variables and questions through the development of a questionnaire. The triangulation questions from the literature review were included in the questionnaire. The quantitative data collected was in the form of numbers. The literature review was completed to find out what had previously been written about the dependant variable, and to clarify and define concepts contained in the dependant variable, as well as to examine the independent variables and their elements influencing the dependant variable. The study provides the recommendation for the Christians denominations towards influencing change in the Christian parents’ framing of gender and sexual identities in Duduza, Nigel.

ENGLISH ABSTRACT: The study represents an analysis of the role of civil society organisations/non‐governmental organisations (CSOs/NGOs) in building human capabilities through knowledge construction. It assesses the effectiveness of community publishing in building human capabilities under challenges they face in the environment they are operating in. The complex environment CSOs/NGOs are operating in is dealt with. It will be demonstrated that CSOs/NGOs give marginalised communities, especially women, children and the disabled, a platform where they can organise themselves and give them an opportunity to influence policy and development of their community. Community development has many interpretations. This study focuses on communities as central agents responsible for their own development. When communities participate in their own development, they are engaging in an educational process which is both formal and informal in nature. The education process helps them to understand their situations better. This type of education called ‘popular education’, is based on the belief that people involved in the process have important knowledge that they have acquired from their experiences in life and the education they receive mainly consists of dialogue between different knowledge sets that they possess. In the process, when people participate actively in the development of their communities, a sense of ownership is developed. For the purpose of designing the study, observation of the direct involvement of staff from local government, Africa Community Publishing Development Trust and partner organisations as well as working with communities from Shamva, Umzingwane and Buhera provided the basis. It is noted that party politics affects the development of a CSO/NGO sector that is capable of building human capabilities. It is, therefore, clear that government should create an enabling environment that is free from violence and rule of law should be respected as this helps CSOs/ NGOs to implement capability building programmes conducive for all communities to participate in the development of their areas.
AFRIKAANSE OPSOMMING: Die studie ontleed die rol van burgerlike organisasies/nie‐regeringsorganisasies (BOs/NRO's) in die bou van menslike vermoëns deur middel van kennis konstruksie. Die studie beoordeel die effektiwiteit van die gemeenskap uitgewery in die bou van die menslike vermoëns en die uitdagings wat hulle in die gesig staar in die omgewing waar hulle hul bevind. Die komplekse omgewing waarin BOs / NRO’s hul bevind word inmiddels behandel. BOs/NRO's gee gemarginaliseerde gemeenskappe veral vroue, kinders en gestremdes 'n platform waar hulle hul self kan organiseer en gee hulle ' n geleentheid om beleid te beïnvloed en hul gemeenskap te ontwikkel. Ontwikkeling van die gemeenskap het baie interpretasies. Die studie fokus op die gemeenskappe as sentrale agente wat verantwoordelik is vir hul eie ontwikkeling. Wanneer gemeenskappe betrokke is in hul eie ontwikkelings proses, neem hulled deel aan ’ n opvoedkundige proses wat van nature beide formeel en informeel is. Die opvoedkundige proses help hulle om hul situasies beter te verstaan. Hierdie tipe van Onderwys genaamd "gewilde onderwys", is gebaseer op die oortuiging dat mense wat betrokke is in ‘n proses belangrike kennis besit as gevolg van persoonlike lewenservaringe, die opvoeding wat hulle ontvang bestaan hoofsaaklik uit dialoog tussen die verskillende kennis stel dat hulle besit. Wanneer mense aktief deelneem in die ontwikkeling van hul gemeenskappe, word 'n gevoel van eienaarskap ontwikkel. In terme van die ontwikkeling van die studie het die direkte betrokkenheid van die personeel van plaaslike regering, ACPDT en vennoot organisasies asook die werk met die gemeenskappe van Shamva, Umzingwane en Buhera die basis gevorm van die studie. Politieke partye beinvloed die ontwikkeling van die BO/NRO‐sektor en dit stel hulle in staat om menslike vermoëns op te bou. Die regering moet 'n instaatstellende omgewing skep wat vry is van geweld en waar die oppergesag van die reg gerespekteer word. Dit sal BO’s/NRO's help om vermoëns bouende programme te implementeer wat gemeenskappe die geleentheid sal gee om deel te hê aan die ontwikkeling van hul gemeenskap.

Abstract:
Does banning opposition candidates from ballots increase the risk that they will turn to bullets instead? Globally, since the end of the Cold War, blatant election rigging tactics (such as ballot box stuffing) are being replaced by 'strategic rigging': subtler procedural manipulations aimed at winning while maintaining the guise of legitimacy in the eyes of international observers. In particular, incumbents (in regimes stuck between democracy and authoritarianism) are turning to 'electoral exclusion', neutralizing key rivals by illegitimately banning certain candidates, in turn reducing the need for cruder forms of election day rigging. I used mixed methods - combining insights from an original global dataset with extensive elite interviews conducted in five countries (Madagascar, Thailand, Tunisia, Zambia, and Côte d'Ivoire) - to establish that electoral exclusion is an attractive short-term election strategy for vulnerable incumbents that produces a much higher chance of victory but comes with high costs in the longer-term. Global probit modeling (using electoral exclusion as an independent variable and coups d'état and civil wars as separate dependent variables) suggests that, since the end of the Cold War, excluding opposition candidates from the ballot roughly doubles the risk of a coup d'état or quadruples the risk of civil war onset. In spite of these risks, incumbents fall into this 'exclusion trap' because of the shortened time horizon that frequently accompanies competitive multi-party elections. Vulnerable incumbents worry more about the short-term risk of losing an election than the long-term but ultimately unknown risk that political violence will ensue after the election. Finally, the inverse corollary of these findings is that inclusion of opposition candidates during multi-party elections can be a stabilizing factor. Though it may seem counterintuitive, fragile 'counterfeit democracies' - and so-called 'transitional' regimes - may be able to stave off existential threats to regime survival by extending an olive branch to their fiercest opponents. These findings combine to form the overarching argument of this dissertation: when opposition candidates are excluded from the ballot, they become more likely to turn to bullets by launching coups d'état and civil wars.

ENGLISH ABSTRACT: This study is concerned with children and youths in conflict with the law, who are additionally at risk of becoming or being in need of care. The study eventuated from concern for neglected children and youths from poor, disadvantaged and violent communities in the Western Cape Province, who inevitably lapsed into crime. Child and youth care, including juvenile justice, in South Africa is presently in a process of transformation, managed by the inter-ministerial committee on young people at risk. As an outcome of the transformation of the juvenile justice system, assessment centres were established at juvenile courts. Probation officers were appointed in terms of the Probation Services Act (Act 116 of 1991) to assess arrested children and youths before their first court appearance in view of a suitable awaiting trial placement and possible diversion of the criminal case. The researcher investigated how arrested children and youths, being in need of care, are managed within the criminal justice system. The research study showed that in spite of the implementation of policies and legislation to protect children and youths from detention in prison, the number of children and youths in prisons awaiting trial have steadily increased. A continuous shortage of vacancies in awaiting trial places of safety exists. It has further been established that professionals such as magistrates, prosecutors and probation officers recognize the needs of arrested children and youths who are additionally at risk of being or becoming in need of care. Factors such as the existing lack of vacancies in awaiting trial places of safety however result in children and youths not being protected in terms of care in all instances. The research study also indicated that arrested children and youths who are current subjects of the Child Care Act (Act 74 of 1983) as amended are often not effectively managed within the criminal justice system. A lack of sufficient knowledge of the said Child Care Act by especially prosecutors appears to be a contributing factor. A comprehensive criminal justice system for children and youths in South Africa is being envisaged, as contained in the draft Bill (Bill B), which will enable individualized but holistic services in respect of children and youths in conflict with the law. The role and tasks of probation officers carrying out assessments have as such become a key element in the management of arrested children and youths, as contained in the draft Bill (Bill B). Probation officers therefore playa significant role in advising the court regarding the appropriate management of arrested children and youths who are at risk of becoming or being in need of care.
AFRIKAANSE OPSOMMING: Hierdie studie het betrekking op kinders en jeudiges in botsing met die gereg, wat bykomend in gevaar is om sorgbehoewend te raak of sorgbehoewend is. Die studie het voortgevloei uit besorgdheid oor verwaarloosde kinders en jeugdiges van arm, agtergeblewe en geweldadige gemeenskappe in die Wes-Kaap Provinsie, wie noodwendig in misdaad verval het. Kinder- en jeugsorg, insluitend jeugreg in Suid-Afrika is tans in 'n proses van transformasie, wat deur die inter-ministeriële komitee vir jong persone in gevaar, bestuur word. As 'n uitkoms van die transformasie van die jeugregsisteem, is asseseringsentrums by jeughowe tot stand gebring. Proefbeamptes is in terme van die Wet op Proefdienste (Wet 116 van 1991) aangestel om gearresteerde kinders en jeugdiges te asseseer voor hulle eerste hofverskyning in die lig van 'n geskikte aanhouding terwyl verhoofafwagtend en moontlike afwending van die kriminele saak. Die navorser het ondersoek ingestel na die wyse waarop gearresteerde kinders en jeugdiges wat sorgbehoewend is, binne die kriminele jeugregstelsel hanteer word. Die navorsingstudie het getoon dat ten spyte van die implementering van beleid en wetgewing om kinders en jeugdiges van aanhouding in gevangenisse te beskerm, die hoeveelheid kinders en jeugdiges verhoorafwagtend in gevangenisse voortdurend toegeneem het. 'n Deurlopende tekort aan vakatures in plekke van veiligheid kom voor. Dit is verder vasgestel dat die behoeftes van gearresteerde kinders en jeugdiges wat bykomend in gevaar is om sorgbehoewend te raak of sorgbehoewend is, deur professionele persone soos landdroste, aanklaers en proefbeamptes erken word. Faktore soos die bestaande tekort aan vakatures in plekke van veiligheid veroorsaak egter dat kinders en jeugdiges nie ten alle tye beskerm word nie. Die navorsingstudie het ook aangedui dat gearresteerde kinders en jeugdiges wat steeds onderhewig is aan die Wet op Kindersorg (Wet 74 van 1983) soos gewysig dikwels nie doeltreffend binne die kriminele jeugregsisteem hanteer word nie. Gebrek aan voldoende kennis van die genoemde Wet op Kindersog deur veral aanklaers, blyk 'n bydraende faktor te wees. 'n Omvattende kriminele jeugregsisteem vir kinders en jeugdiges in Suid-Afrika word beoog, soos vervat in die konsep Wetsontwerp (Wetsontwerp B), wat die geleentheid vir individuele maar holistiese dienste ten opsigte van kinders en jeugdiges in botsing met die gereg sal bied. Die rol en take van proefbeamptes wat assesserings uitvoer het as sulks 'n sleutel element geword in die hantering van gearresteerde kinders en jeugdiges, soos vervat in die konsep Wetsontwerp (Wetsontwerp B). Proefbeamptes speel gevolglik 'n belangwekkende rol ten einde die hof te adviseer oor die gepaste hantering van gearresteerde kinders en jeudiges wat in gevaar is om sorgbehoewend te raak of sorgbehoewend is.

Abstract:
The purpose of the study was to determine how the Fourth Amendment is treated in the age of the internet. To determine the degree of the significance of this relationship a comparative approach is used. Court opinions from cases involving other technological innovations and the Fourth Amendment were examined and their reasoning was compared to that of cases involving the internet and the Fourth Amendment. The results indicated that contrary to some fears that the internet would require a different approach with respect to the law it actually did not present many novel barriers to its application. The principle conclusion was that the reasoning used in cases involving older technologies, namely the test outlined in Katz v. United States, was consistently applied even in the age of the internet.

ENGLISH ABSTRACT: On The io" of May 1994 Nelson Mandela was inaugurated as the first democratically elected black president of South Africa. The occasion was regarded, both nationally and internationally, as a triumph for humanity and perfused with a widespread optimism for the future of South Africa. Mandela proclaimed in his inaugural speech that "Never, never and never again shall it be that this beautiful land will experience oppression of one by another .... The sun shall never set on so glorious an achievement." However, now, less than 10 years later the rapidly accelerating and devastating HIV/AIDS epidemic is again 'obscuring the sun'. Those people affected so negatively by the racial, economic and gender injustices of the apartheid past, seem again to be suffering a possible injustice, because of a health and welfare system that is struggling to meet the needs of the HIV affected population. The purpose of this dissertation is to examine the concept of distributive justice in South Africa, within the context of this devastating epidemic. I begin by discussing the Bill of Rights in the South African Constitution. I argue that an acceptable framework for a theory of justice for health care in South Africa, must be worked out against the background of this egalitarian Bill of Rights. I then consider the extent of the HIV epidemic, the effect it is having on the people of South Africa and the consequent implications for health care needs. It is within this context that I examine and compare three theories of distributive justice, namely utilitarianism, John Rawls' theory of "Justice as Fairness" and a libertarian concept of justice, as proposed by Robert Nozick. Utilitarianism is a consequentialist theory that focuses on producing the 'greatest happiness for the greatest number'. I argue that many health policy decisions in South Africa are in fact guided by this principle. However utilitarianism has both strengths and weaknesses which are critically examined. Within the framework of health care policy making, utilitarian justice dictates that rights are derivative and that the welfare of the majority usually takes precedence over the pressing needs of a minority. This issue in particular is discussed. Rawls' theory of "Justice as fairness" is critically discussed next. This theory has been adapted to health care by Norman Daniels, who argues that the Rawlsian principle of "fair equality of opportunity" is a suitable founding principle for health care institutions. Apartheid entrenched a system of 'inequality of opportunity'. Consequently, a theory that focuses on equality of opportunity, has many advantages within the South African context. I examine this theory in detail and provide justification for my assertion that it could be usefully adapted to South African healthcare and the HIV/AIDS epidemic. Finally, I discuss a Libertarian (Nozickian) theory of justice and examine both the strengths and weaknesses of this theory. I attempt to demonstrate why a libertarian system, with it vigorous commitment to moral and economic individualism and belief that one is only entitled to that share of healthcare that can be paid for, would be unjust, if rigorously applied within the post-apartheid South African context. I conclude my dissertation by reiterating my assertion that "Justice as Fair Equality of Opportunity" could be used as a just foundation for a theory of justice for health care in current day, HIV/AIDS affected South Africa.
AFRIKAANSE OPSOMMING: Teorieë van geregtigheid en 'n gesondheidsbeleid vir die VIGS epidemie in Suid Afrika: 'n vergelykende ontleding. Op die 10de Mei 1994 is Nelson Mandela ingehuldig as die eerste demokraties verkose swart president van Suid- Afrika. Die geleentheid is in beide Suid-Afrika en in die buiteland beskou as 'n oorwinning vir humaniteit. Optimisme oor Suid-Afrika se toekoms was oral tasbaar. Mandela het in sy inhuldigingstoespraak verkondig dat dit nooit weer sal gebeur dat hierdie pragtige land sal lyonder die onderdrukking van een oor die ander nie. Hy het gesê dat die son nooit salondergaan op so 'n wonderlike prestasie nie. Nou, minder as tien jaar later, is die verwoestende VIGS epidemie besig om weer die 'son te laat ondergaan'. Dieselffde mense wat alreeds onder apartheid se rasisme en ekonomiese en geslagsongeregtighede gely het, blyk nou weer verontreg te word; hierde keer omdat die gesondheids- en welsynsisteem sukkel om in die behoeftes van die VIGS-geaffekteerde populasie te voorsien. Les réseaux sociaux affectent les choix individuels dans tous les contextes socio-économiques, influençant de nombreux aspects de la vie économique et sociale. Ils peuvent jouer un rôle particulièrement central dans les économies en voie de développement où les institutions gouvernementales, qui facilitent les transactions anonymes entre partis n’ayant d’autres liens que ceux impliqués par l’échange, sont souvent moins fiables. Par exemple, lorsque les tribunaux commerciaux sont inefficaces ou inaccessibles à la plupart des entrepreneurs, le capital social tissé par les réseaux peut servir à mieux garantir le respect des termes des contrats et la collaboration. Cette thèse explore deux facettes de ce thème. Deux de ses chapitres étudient les mécanismes à l'œuvre dans les réseaux horizontaux entre petits entrepreneurs en Ouganda. En utilisant des données de réseau en panel et en mettant à profit la variation expérimentale introduite par une formation dispensée de manière aléatoire à un échantillon d’entrepreneurs, je montre que ces réseaux peuvent être endogènes à des interventions de politique publique, et que les changements observés indiquent un comportement stratégique de formation de réseau. Un troisième chapitre est consacré aux moyens d'améliorer l'efficacité du règlement formel des différends commerciaux, en analysant les mécanismes en jeu dans les réformes institutionnelles. L’analyse d’une réforme au Sénégal utilisant des données granulaires de haute fréquence montre que des petits ajustements de procédure peuvent avoir un impact important sur la rapidité sans compromettre la qualité des jugements rendus lorsque les incitations des juges sont alignées
Social networks affect economic decision-making in all socio-economic contexts, influencing many aspects of social and economic life. They may play a particularly central role in the developing economy where formal institutions, which facilitate anonymous, arm's length transactions, tend to function less well. For example, when commercial courts are inefficient, or are inaccessible to a large share of the entrepreneur population, the social capital inherent in networks may be used to sustain contracting and collaboration. This thesis explores two facets of this thematic cluster. Two of its chapters investigate the mechanisms at work in horizontal business networks between small-scale entrepreneurs in Uganda. Using experimental variation from a randomized training and panel network data, I show that these networks can be endogenous to a public policy intervention, and that observed changes indicate strategic network formation behavior. A third chapter is concerned with how the efficiency of formal commercial dispute resolution can be enhanced, unpacking the mechanisms of institutional reform. Analyzing a reform in Senegal using high-frequency case-level data, it shows that procedural tweaks can have a large effects on speed without jeopardizing quality when judges’ incentives are aligned

The conflict in Sudan reflects historic hatred and ethnic discrimination between Northern Arab Muslims and Southern African Christians and Animists. The longest and worst conflict began in 1983 and ended in 2005, when African Christians and Animists struggled to form an interim autonomous government. This conflict claimed 2 million lives from both sides and displaced almost 4 million people from the South. This thesis attempts to understand how people from Southern Sudan perceive the root causes and sustaining factors of the Sudanese conflict between Arab Muslims and African Christians. This research looks specifically into the roles of ethnic differences and religion. In this study, 10 emigrants from South Sudan were chosen to present their perceptions and views about the conflict, in the form of written responses to 22 questions. Analysis of their responses in light of conflict resolution literature suggests that the North-South Sudan conflict involves complex issues primarily fueled by ethnic and religious differences. This research reveals that South Sudanese refugees from varying backgrounds and professions expressed similar experiences of racial, religious discrimination and political and economic marginalization, and suggests that Sudan's July, 2011 declaration of independence, creating two separate nations, North and South Sudan, was a positive solution to achieving a just peace.

Detta är ett examensarbete av undersökande karaktär för att se i vilken riktning man kan gå när man utformar mötesplatser i det offentliga rummet i nya stadsdelar. Utgångspunkten för detta arbete är den nya stadsdelen Ebbepark som håller på att byggas i Linköping i Östergötland. I Ebbepark kommer människor båda att bo och jobba. I studien undersöks om det finns några gemensamma nämnare mellan dessa två grupper (boende och anställda på företag i Linköping) och hur de idag träffar andra människor i sin närhet. Vad som även undersöks är hur de tänker kring hur dessa mötesplatser skulle kunna utformas och vad man skulle kunna göra på en sådan mötesplats. De två undersökta grupperna får även möjligheten att reflektera över om urbana odlingar skulle kunna vara ett inslag i dessa mötesplatser och vad de tror att urbana odlingar skulle kunna bidra med för dem. Från resultaten av den enkätundersökning som har genomförts har det visat sig att det inte återfinns någon signifikant skillnad på någon av frågorna mellan de två olika grupperna i studien. Att det inte finns någon signifikant skillnad mellan grupperna leder till att man enklare kan se i vilken riktning som mötesplatserna kan utformas. Detta kan man då göra genom att studera medelvärden för respektive kvantitativ fråga i enkäten. Det blir även intressant att studera de identifierade teman från en tematisk analys på den kvalitativa delen av enkäten. Detta för att erhålla en djupare förståelse för hur respektive enskild individ resonerar. Från de kvantitativa resultaten ser man att deltagarna överlag ställer sig positivt till växter i närheten av där de jobbar och bor. Det framkommer även att det redan finns några mötesplatser där deltagarna jobbar respektive bor men att de skulle kunna tänka sig fler. Vidare anser de att det finns en poäng med att boende och de arbetande i samma område beblandas och umgås med varandra. Från den tematiska analysen framkom att en mötesplats för de tillfrågade försöksdeltagarna antingen var en plats där man bara kunde vara, umgås och prata med andra människor. Det andra identifierade temat var att man på en mötesplats samlas kring någon form av aktivitet. Dessa två identifierade teman pekar antingen på lågintensiva eller högintensiva mötesplatser. När man vidare studerar fler av de teman som uppkom i analysen så träffades människor ofta i samband med måltider. När de tillfrågades vad man kunde göra på en mötesplats så menade flera personer att de ville prata med andra människor och ville gärna fika. Detta är mer i linje med de lågintensiva mötesplatserna där man inte behöver träffas kring en given aktivitet. Denna kandidatuppsats är ett examensarbete som har genomförts tillsammans med Vissheim och Sankt Kors Fastighets AB. Vissheim är ett nystartat företag som har tagit fram en lösning för autonom odling. Sankt Kors är det företag som driver byggnationen av den nya stadsdelen Ebbepark i Linköping, Östergötland.

Este trabalho apresenta o desenvolvimento de um estudo técnico social para definir as diretrizes que garantam a sustentabilidade de uma minirrede baseada em sistemas solares fotovoltaicos, localizados nas Zonas Não Interconectadas (ZNI) da Colômbia. A literatura da pesquisa está baseada na importância da energia elétrica e das construções sustentáveis para o homem e nos princípios de energia solar e de minirredes baseadas em sistemas solares fotovoltaicos. Após este levantamento, aplicou-se o método de pesquisa documental para contextualizar o leitor com os aspectos mais importantes sobre a Colômbia e sua realidade hoje. A partir destes aspectos foi possível concentrar a pesquisa em uma região, selecionada a partir de critérios de recurso solar disponível, economia, segurança, saúde e educação. Uma vez escolhida a região, foi feita uma pesquisa de campo em que foram entrevistados os agentes que podem influenciar no funcionamento de uma minirrede. Também foram observados os aspectos técnicos relacionados com as construções e a eficiência energética desta região, constatando que a mesma já contou, em alguma ocasião, com sistemas solares fotovoltaicos, mas estes foram vendidos pela própria comunidade por não encontrarem utilidade nenhuma neles. A partir das respostas encontradas nas entrevistas foi feita uma proposta de gestão da minirrede baseada em sistemas solares fotovoltaicos. Concluiu-se que é primordial que os agentes técnicos e administrativos do sistema como um todo tenham contato contínuo com o usuário para entender as suas necessidades e conseguir satisfazê-las com a instalação da minirrede. Também se observou que é importante criar no usuário um sentido de posse pela minirrede, identificando os benefícios educativos, de saúde e econômicos que esta nova tecnologia traz para ele. Este estudo abre as portas para novas pesquisas de avaliação e descrição das diretrizes propostas.
This research presents the development of a social-technical study to define guidelines to ensure the sustainability of a mini-grid based on solar photovoltaic systems located in Non Interconnected Areas (NIA) of Colombia. The literature of this research is based on the importance of energy and sustainable buildings to people, the principles of solar PV, and mini-grid based on solar photovoltaic systems. After this firt part, was applied the method of documentary research to contextualize the reader with the main relevant aspects of Colombia related to the research. From these aspects, it was possible to focus the research to a region, which was chosen by criterias such as: solar resource, economy, security, health and education. When the area was chosen, it was made a field survey. In this survey the agents that influence the operation of a mini network were interviwed. Also, it was observed the technical aspects of buildings, and the energy efficiency in this region. As a result it was observed that in the past there were PV solar systems, but these were sold by the community because they did not find them useful. From the interview answers, it was made a proposal about the management of the mini-grid based on solar photovoltaic systems. In conclusion, it is essential that the technical and administrative agents that make part of this system have continuous contact with the user to understand their needs and satisfy them with the installation of mini-grid. It is also important to create a sense of belonging from the user to the mini-grid, identifying the benefits, educational, health and economic that this new technology brings to him. This study opens the door to new research about evaluations and descriptions about the proposed guidelines.

ABSTRACT Background: Previous criminal justice policies have been non-effective leading to overpopulated prisons and unsuccessful reintegration. There is a lack of effective supportive and/or rehabilitative services resulting in high rates of recidivism and mental health implications. Objective: This study investigated the perceived impact that incarceration and reintegration with little to no supportive and/or rehabilitative services has on the mental health status of an individual. The emphasis was on participant perception and not on professional reports because of underreporting and lack of attention to mental health in the criminal justice system. Methods: Focus groups in the Inland Empire and Coachella Valley were held to gather preliminary data used to develop the survey for this study. The survey was distributed to 88 male and female ex-offenders over the age of 18 who were no longer on probation or parole. Secondary data from United Way 211 and California State Reentry Initiative was collected to report current trends of supportive and/or rehabilitative services. Results: Incarceration was found to negatively impact perceived mental health status, but reintegration was not. Supportive and/or rehabilitative services continue to be rarely offered and accessed, but when accessed, perceived mental health status is better. Supportive and/or rehabilitative services are more readily available. People who are using these services are improving their quality of life, becoming productive members of society, and preventing recidivism. Conclusions: A paradigm shift is currently under way to reduce recidivism by improving supportive and/or rehabilitative services during incarceration and reintegration. Many offenders are receiving services as an alternative to incarceration, recidivism rates are being reduced, and ex-offenders are becoming productive members of society. The field of social work is an integral part of reentry services and should continue advocating for policies and services that support reintegration efforts at the micro and macro level.

This study sets out to investigate Lunchtime Live, a twice-weekly, one-hour long current affairs show broadcast on a small community radio station, Radio Grahamstown, to understand its role in the local public sphere, and its value in helping civil society’s understanding of and involvement in the power structures and political activities in Grahamstown. Lunchtime Live seeks to cultivate a collective identity and promote public participation in the public affairs of Grahamstown. As a key avenue of investigation, this study seeks to test theory against practice, by evaluating Lunchtime Live’s aspirations against the audiences’ perception of it. This investigation uses qualitative content analysis of selected episodes of recorded transcripts of the shows that aired between August 2010 and March 2011, together with the audiences’ verbalised experiences of this programme through focus group discussions. The study principally uses qualitative research informed by reception theory. The research reveals three key findings. First, that resonance rather than resistance is the more dominant ‘stance’ or ‘attitude’ towards the content of Lunchtime Live. Residents interviewed agreed that the programme is able to give a “realistic” representation of their worldview, and thus is able to articulate issues that affect their lives. Second, that whilst the programme is helping establish links between members of the civil society as well as between civil society and their political representatives, residents feel that local democracy is failing to bring qualitative improvements to their everyday lives and that more ‘participation’ is unlikely to change this. Most respondents blame this on a lack of political will, incompetence, corruption and populist rhetoric by politicians who fail to deliver on the mantra of ‘a better life for all’ in the socioeconomic sphere. The study finds a scepticism and even cynicism that participatory media seems to be able to do little to dilute. Thirdly, in spite of the largely positive view about Lunchtime Live’s capacity to be a platform for public engagement, its participatory potential is structurally constrained by the material privations of most of its listeners. Given that in order to participate in talk shows and discussions audience members have to phone in, economic deprivation often precludes this. It is clear from this research that despite shows such as Lunchtime Live that are exploring new techniques of popular involvement, the voice of the ordinary people still struggles to be heard.

Abstract:
The debate over the display of the Confederate battle flag in public places throughout the South focus on the flag's display by state governments such South Carolina and Mississippi. The state of Texas is rarely placed in this debate, and neither has the debate adequately explore the role of high schools' use of Confederate symbols. Schools represent the community and serve as a symbol of its values. A school represented by Confederate symbols can communicate a message of intolerance to a rival community or opposing school during sports contests. Within the community, conflict arose when an opposition group to the symbols formed and asked for the symbols' removal in favor of symbols that were seen more acceptable by outside observers. Many times, an outside party needed to step in to resolve the conflict. In Texas, the conflict between those in favor and those oppose centered on the Confederate battle flag, and the memory each side associated with the flag. Anglos saw the flag as their school spirit. African Americans saw hatred.

Abstract:
This thesis analyzes the ideologies present the campaign rhetoric surrounding the 2008 California legislative initiative Proposition·8. Using Foss' method of ideological criticism the campaign is read prior after the opposition response to determine if an ideological shift occurs. The study is framed to identify this shift as a potential product of oppositional interaction, a characteristic of rhetoric defined by Smith and Windes. The study concludes that the shift in ideology during the campaign by the supporters of Proposition 8 was a significant development. The response from the Proposition 8 campaign reframed the debate, making the electorate vulnerable to a different ideology. This new ideology places the state education apparatus, not the courts, in the spotlight as the state mechanism that is in dispute in the marriage controversy. When placed in .this context, theories of political economy are employed to explain how the electorate may have interpreted these arguments. One. explanation offered is that the response ideology of the Proposition 8 campaign allowed voters to vote to outlaw gay marriages as a proactive response to a mistrust of education. The discussion section indicates that this could be an adjustment to existing ideologies, or development of an issues specific ideology that is only relevant for one issue in the mind of the individual. Ultimately, this study demonstrated the utility of ideology as a method to analyze political rhetoric and examines the role that oppositional interaction plays in the long-term development of public dialectic.

Abstract:
L’action en justice intentée en matière de Responsabilité Sociale de l’Entreprise révèle certaines limites lorsque les justiciables parties prenantes souhaitent protéger leurs intérêts. Par une juridicisation du droit de la RSE à mi-chemin entre la soft law et la hard law, l’action en justice des parties prenantes pourrait être véritablement efficiente. Dès lors, les mécanismes processuels traditionnels sont insuffisants lorsqu’il s’agit d’agir en justice dans ce domaine. C’est notamment à travers l’intérêt et la qualité à agir en justice des parties prenantes que des aménagements de la procédure civile vont être véritablement nécessaires. Des améliorations supplémentaires telles que l’instauration d’une action de groupe élargie au domaine de la RSE et davantage américanisée permettrait notamment aux parties prenantes d’assurer leur défense grâce à un dispositif nouveau très efficace. De plus et par la voie extrajudiciaire des modes alternatifs de règlement des litiges, les acteurs de la RSE peuvent également décider de porter le différend qui les oppose hors de la connaissance du juge étatique. Ce choix d’action peut être révélateur d’une préférence pour une justice davantage négociée. Ces propositions semblent être indispensables à la mise en œuvre d’une action en justice efficace en matière de RSE. Les parties prenantes pourront alors agir en justice de manière inédite afin de parachever leur protection. Les nécessités juridiques et sociales actuelles semblent ainsi faire évoluer le droit afin que les parties prenantes puissent bénéficier d’une action en justice considérée comme un véritable contre-pouvoir face à l’entreprise
Legal actions brought to court concerning Corporate Social Responsability reveal certain limits when litigants’ stakeholders wish to protect their interests. The Corporate Social Responsability law falls between soft law and hard law. Going through CSR law’s judicalization could really make litigation of stakeholders efficient. Usual processual mechanisms are insufficient once an action has to be brought to court dealing with CSR. The civil procedure will need some changes, specifically relating to legal standing and stakeholder interest. Some added improvement would allow stakeholders to ensure their legal defence thanks to this new and efficient legal device. The setting up of a collective action including a CSR with more resemblance to the American one would represent one such improvement. Moreover, stakeholders can decide to settle the matter out-of-court with an extrajudicial approach, using alternative dispute resolution. This choice could amount to a more negotiated inflection of justice. These proposals seem to be necessary to settle an efficient legal action concerning CSR. In this way stakeholders will be able to litigate in a whole new way in order to consolidate their protection. Current legal and social needs seem to make the law evolve so that stakeholders benefit from a legal action which can be considered as a real countervailing power against a corporation
