Full textGlobal biodiversity is currently being lost at an unprecedented rate, posing a threat to vital ecosystems and hence the generation of ecosystem services that human society is entirely reliant upon. Within the European Community, the EU has set a target of halting biodiversity loss within the territory by 2010. This goal is intended to be operationalized by the implementation of the Habitats Directive and the Birds Directive. These directives constitute the framework for the establishment of a coherent ecological network, referred to as the Natura 2000 network.
This study examines and analyses the socio-ecological complexities surrounding the designation of Natura 2000 sites in Östhammar municipality, Sweden. The use of a case study-approach to focus on this area is applied in pursuit of identifying and explaining the inherent intricacies in the designation processes and linking them to the broader global context. Throughout Europe, biodiversity exists in a rich variety of grasslands, but only a few studies have been performed to establish appropriate conservation management strategiesrequired for each habitat. This study makes a significant contribution towards shedding light on the Natura 2000 designation process, a phenomenon which has previously been only modestly documented, especially in Sweden. Ecosystem management is discussed and utilized as the theoretical basis for managing ecosystems sustainably, and an important aspect of note is the recognition that the distinction between man and nature needs to be understood as artificial and arbitrary.
The study explains how social-ecological factors have had a prominent effect on the designation process of Natura 2000 sites. The main determining factor behind the designation process has been the time-constraints, which have affected the designation of SCIs as well as the interaction between the Uppsala CAD and local stakeholders. The lack of adequate participatory approaches used during this process has heightened the risk of compromising the aim of the network: to achieve Favourable Conservation Status (FCS) for natural habitat types as well as species.
Biodiversiteten världen över minskar i en tidigare aldrig skådad hastighet vilket resulterar i ett hot mot fundamentala ekosystem, samt dess produktion av de ekosystemtjänster som det mänskliga samhället är beroende av. På grund av detta har EU satt upp målet att stoppa förlusten av biodiversitet inom unionens gränser tills 2010. Detta mål skall uppnås genom implementeringen av Habitat- och Fågeldirektivet. Dessa direktiv utgör ramen för etableringen av ett sammanhängande ekologiskt nätverk, det så kallade Natura 2000 nätverket.
Denna studie utreder samt analyserar de socio-ekologiska aspekter som omger utpekandet av Natura 2000 områden i Östhammars kommun, i Uppsala län i Sverige. Genom appliceringen av en fallstudie av området söker denna uppsats att identifiera samt förklara inneboende svårigheter i processen av dessa utpekanden, samt att sätta dem i ett globalt sammanhang. Inom Europa existerar biodiversitet bland annat i olika typer av ängar, dock har endast ett fåtal studier tagit sig an uppgiften att formulera anpassade förvaltningsstrategier för dessa habitat. Denna studie bidrar till att sprida ljus över implementeringen av Natura 2000, ett fenomen som tidigare endast studerats i blygsam utsträckning, speciellt i Sverige. Den teoretiska grunden utgörs ekosystemansatsen, som appliceras för att utvärdera ett uthålligtförvaltande av ekosystem. Vidare understryks vikten av att betrakta ekosystem och mänsklig aktivitet som ett och samma system, och att synen på dem som skilda system bör anses artificiell och motsägelsefull.
Denna uppsats förklarar hur socio-ekologiska aspekter har påverkat utpekandeprocessen av Natura 2000-områden i Östhammars kommun. De avgörande faktorerna bakom detta är en identifierad tidsbrist, vilket har influerat utpekandet av områden av gemenskapsintresse samt interaktionen mellan Länsstyrelsen i Uppsala och lokala markägare. Bristen på samverkan och information har resulterat i en förhöjd risk av att målet med nätverket inte kommer att nås: att åstadkomma gynnsam bevarandestatus för arter och habitat.

Full textThis thesis attempts to assess the security aspect of the Barcelona Process (Process), or so called Euro-Mediterranean Partnership (EMP) within the theoretical framework of new regionalism and the Copenhagen School (Security complex theory) which agrees with neo/realism, neo-liberal institutionalism and constructivism in some aspects. The end of the Cold War broadened the security agenda and new security concerns emerged. Actually, most of the so- called security threats are not new, but the perception of them by the states has changed with globalization which increased the interconnectedness and density of the interaction. Global challenges have made states more vulnerable so appreciated the cooperative interaction at regional level. Comprehensive and cooperative security approaches gained importance and led regional security partnership among states. The construction of Euro-Mediterranean security partnership is one case stemming from the high level of interdependence between the European and the Mediterranean countries. The historical ties, economic dependency, geographical proximity increased the EU’s interest towards the Mediterranean. While new regionalism enables to grasp systemic factors in the Process, the Copenhagen School permits to understand security partnership at the regional level. The rise of illegal immigration flows and religious fundamentalism in the Mediterranean as well as tension in the Middle East conflict, the Iraqi War, and terrorist attacks to the US, Algeria and recently Turkey appreciated the importance of the EMP policy and security cooperation so make this study more crucial.
This study showed that the security challenges in five sectors of the security defined by the Copenhagen School are observable in the EMP’s case. Both military and non-military concerns threaten the stability and prosperity in the Mediterranean Basin. The three baskets of the EMP depict its comprehensive security approach. Having made an overview of the Barcelona Process, the thesis evaluated the security challenges in general and the thematic areas of concerns in depth. Since security cannot be defined without reference to the perceptions and security cultures of the actors, the study examined the perceptions and security cultures in the EMP.
The evaluation of the EMP showed that the EMP has shown certain developments on the way for the security cooperation. However, it could not produce tangible results due to the fundamental shortcomings categorized as inter and intra-institutional incoherence, definitional/perceptional problems and multi- actor involvement in the region. The lack of institutional structures, asymmetrical relations among partners, unbalanced distribution of powers and lack of commitment of the EU are crucial problems. On the basis of all problems lie the gap between the perceptions and security culture of Europe and the Arab world. Thus, this thesis emphasizes the enhancement of inter- subjective understanding and cultural dialogue in order to improve trust and interaction among partners. The EMP is on right track to build zone of peace in the Basin, but it requires longue durée to achieve this.

Full textCross-border mergers of incorporated companies do not only interest Company Law but also comprise important aspects of Labour & Employment Law. If the European Directive dated 26 October 2005 facilitates these transactions, the reference made to national legislation raises many difficulties in the absence of harmonized treatment of the social consequences of transactions. The questions raised by the implementation of workers' participation in management bodies of the company resulting from the transaction are an illustration. Other issues include the fate of employees’ representative bodies of existing staff within the merging companies, collective norms and employment contracts, remain unresolved. To these and others, this study attempts to provide answers. The consequences of the cross-border transactions require that answers be given to the unresolved issues

Full textL’apport majeur de notre thèse est l’analyse d’un matériel empirique conséquent que nous avons collecté auprès des acteurs syndicaux communautaires. Notre analyse se concentre sur les stratégies institutionnelles des fédérations syndicales sectorielles européennes et sur leurs implications en matière d’européanisation de la politique salariale. Nous avons démontré que le développement des processus de coordination européenne des négociations collectives nationales, en particulier au niveau sectoriel, peut contribuer à renouveler la conception de la négociation collective et des relations professionnelles dans l’espace européen jusqu’alors appréhendée dans la littérature par le dialogue social. Nous avons identifié trois obstacles à la négociation collective européenne :le salaire « dépolitisé » dans le partenariat économique, le patronat devenu « partenaire-lobby » dans le dialogue social sectoriel, et la difficile européanisation syndicale.

Full textAlthough the EU is a privileged point of focus for political science studies, its discursive activity has not received all the attention it deserves. This corpus analysis adopts a descriptive approach, based on the Neo-Aristotelian trend in argumentation theory, by using both analytical categories of classical rhetoric and (emic or etic) categories that belong to the conceptualization of the debate entertained by its own participants. The corpus consists of public interventions by representatives of the three main EU Institutions (Commission, European Council and Parliament). The speeches were pronounced between June and December 2005. Since it is discussed every seven years, the topic of the Financial Perspectives offers the possibility of making diachronic comparisons; it also allows identifying values, projects and means of the European construction at a rhetorical level. The last six months of 2005 followed two significant events: the conflicting attitudes of European Governments regarding the Iraq war and the rejection of the Constitutional Treaty by referendums.
In the absence of any other metaphysical or natural foundation, the technocratic enterprise provides the European project with a rational and secular justification that is not always assumed as such, though, by the presidents of the Commission. The conceptual metaphors stemming from the preambles to the treaties convey the idea that European integration will be achieved by triggering a gradual process that should lead to the realization of an ultimate aim.
From a rhetorical point of view, the Financial Perspectives are in need of legitimacy. In 2005, the rhetorical invocation of dates/milestones, abundantly used by former presidents of the Commission, does not seem to work anymore. Both the requirement of unanimity in the legislative procedure and the habitus of European deliberation make it necessary to find an agreement; this consequently promotes “consensus” as a meta-communicational argument. The notion of a “consensus” runs against such theoretical (epistemological) and pragmatic objections that it proves imperious to wonder about its origin and roots. One should take into account not only scholarly conceptions of “consensus” (Habermas, the Deliberative Democracy movement), but also naïve and popular visions of it.
The EU Institutions are aware of the difficulty they meet in awakening citizens’ interest, and they have developed their Communication Policy in order to give themselves the means to overcome this obstacle. A systematic reflection on their strategy should take into account the divergent opinions of Moravscik and Hix, as well as the possibility of grounding the EU project anew on a revival of ancient homonoïa.

Résumé
Quoique l’Union Européenne (UE) soit un objet de prédilection pour les politologues, son activité discursive n’a pas reçu toute l’attention méritée.
La thèse offre une analyse de corpus effectuée sur base d’une grille de lecture incluant des catégories rhétoriques étiques et émiques. Elle adopte une approche descriptive puisée dans le versant néo-aristotélicien de l’étude de l’argumentation. Le corpus a été constitué d’interventions publiques tenues par les représentants des trois principales Institutions Européennes (Commission, Conseil Européen, Parlement Européen) entre juin et décembre 2005. Le sujet des Perspectives Financières, débattu à intervalles réguliers, permet des comparaisons diachroniques ;il permet aussi de contraster les valeurs, les projets et les moyens de la construction européenne. La conjoncture des six derniers mois de 2005 présente la particularité supplémentaire que le projet de Traité Constitutionnel venait d’être rejeté et que les gouvernements européens s’étaient auparavant divisés sur l’intervention en Irak.
En l’absence d’un fondement métaphysique ou naturel, l’entreprise technocratique fournit au projet politique européen une justification rationnelle et laïcisée, même si elle n’est pas assumée explicitement en tant que telle par tous les présidents de la Commission. Les métaphores conceptuelles mobilisées dans les préambules des traités traduisent le fait que l’unification européenne devrait s’accomplir à la fois par l’entremise de réalisations progressives et à travers la poursuite d’un objectif lointain.
Sur le plan rhétorique, les Perspectives Financières sont en manque d’une légitimité emblématique. La clause des rendez-vous, des étapes cruciales, abondamment utilisée dans le passé par les présidents de la Commission, cesse de fonctionner en 2005. La nécessité d’un accord, issue tant de la lettre de la procédure législative par unanimité que de la coutume des délibérations, est devenue matière à un argument méta-communicationnel qui en est arrivé à englober toute circonstance susceptible de faciliter le « consensus ». Cette dernière notion soulève des réticences théoriques (épistémologiques) et pragmatiques qui imposent de s’interroger sur son origine. La problématisation que nous avons opérée tient compte non seulement des conceptions savantes du « consensus » (Habermas, courant de la Démocratie Délibérative), mais aussi de ses variantes populaires ou vulgarisées.
Les Institutions Européennes sont conscientes de la difficulté qu’il y a à motiver l’intérêt citoyen, et elles ont voulu, à travers leur Politique de Communication, se donner les moyens de dépasser cet obstacle. La thèse mène, à ce propos, une réflexion plus générale qui tient compte des avis opposés de Moravcsik et Hix, et d’une éventuelle refondation dans l’homonoïa de la rhétorique classique.

Full textCross-border company mobility principally involves two main sets of State norms. Firstly, mobile companies continuously encounter conflict of laws questions. Therefore, mobility implies a necessary passage from the fundamental question of recognition of foreign companies, the application of conflict of laws rules determining the lex societatis and, more generally, the consultation of all the rules delineating the normative jurisdiction of the State in corporate matters, namely the conflict of laws rules (whether they stem from positive law or from judicial precedents) or the mandatory rules (lois de police) likely to be implemented in cross-border M&As, reorganizations and take-overs. Secondly, company mobility brings inevitably into play the national or international tax rules which constitute the national systems of international taxation of companies, namely tax rules emanating either from national tax legislation or from international treaties on avoidance of double taxation. These two aspects of the matter of company cross-border mobility shall not be examined separately, given that the formation of conflict of laws rules and tax jurisdiction rules that delineate a state’s tax jurisdiction depends on each State’s hierarchically superior imperatives of a political, economic and social nature, these two body of rules being, therefore, interdependent. The study of their historical evolution within the legal systems examined in our thesis (French, English, German and Belgian) from the early 19th century to date, demonstrates that their current state constitutes the result of their mutual influence. Through an interdisciplinary analysis, we emphasize, in the first part of our thesis, on the crossing points of these two sets of rules in order to explain the complex mechanics of cross-border mobility of companies and point out the legal and tax considerations that dominate the matter. We further explore their transformation by EU law which is intended as a meta-order aimed at orchestrating national government and economic agents’ behaviors according to and towards a new model of market regulation susceptible to the creation of a European single market. The second part of our thesis is dedicated to the study of the impact of secondary EU legislation and European Court of Justice jurisprudence –that act jointly to achieve the European single market objective- on the aforementioned bodies of national rules, that leads to the conclusion that the recent and anticipated developments on the mobility of companies within the EU both on national and European level, fall within the broader framework of the overall development of the transition process of national legal orders from a traditional capitalist model of market regulation inspired by the theories of M. Keynes towards a neo-liberal model which is accelerated by the pressure of the contemporary trend of economic globalization. Addressing the subject of cross-border mobility of companies within the EU both from a historical and an interdisciplinary perspective, we endeavor to identify trends and patterns and to assess the progress achieved since the early 19th century

Full textThe second volume describes principal results of analysis of interviews issued from qualitative research between 90 individuals. We focus on explication of cultural and individual context that contributes to the formulation of Czech political attitudes toward Europe. A very detailed individual analysis helps to understand the reason of Czech reticences toward a process of the European integration at the beginning of the twenty-first century. We show four groups of tensions (antinomies) in social representations that actually constitute dynamic elements for political attitudes.

Full textLa littérature scientifique qui traite de cette problématique dans le cadre de l’enseignement scolaire en Europe ,analyse les conceptions d’acteurs de l’enseignement scolaire – enseignants et/ou élèves – sur ce sujet, en étudiant notamment le lien qu’entretiennent ces conceptions avec les représentations que ces mêmes acteurs ont de la science, avec leurs parcours personnels, avec leur formation, etc. Un point aveugle observé dans cette littérature est la rareté des recherches portant sur les directives officiellement adressées aux enseignants. C’est pourquoi nous avons choisi de nous pencher sur le contenu de ces directives.
Cette recherche a, en premier lieu, une visée exploratoire. Elle consiste à construire et utiliser un instrument théorique et méthodologique qui permet, d’une part, d’identifier des représentations du savoir scientifique, de la croyance religieuse et/ou de leurs rapports (ou non rapports) véhiculées par les curriculums prescrits européens et, d’autre part, de déterminer des mécanismes à travers lesquels ces représentations pourraient influencer, d’une façon ou d’une autre, le rejet ou l’acceptation de la théorie de l’évolution au nom de croyances créationnistes ou encore, inversement, le rejet ou l’acceptation de croyances créationnistes au nom de la théorie de l’évolution. Pour repérer les représentations recherchées, nous utilisons la méthode de l’analyse de contenu thématique.
Une autre visée de cette étude est confirmatoire. Il s’agit de confirmer le postulat suivant lequel la nature des éventuelles représentations repérées au sein des curriculums prescrits au moyen de l’instrument susmentionné peut être mise en lien – lien dont la nature sera définie dans le corps de notre dissertation, sur la base de l’analyse de données sociohistoriques rapportées dans la littérature – avec les modalités de gestion de la laïcité mises en place par les politiques éducatives de différents pays européens :la France, la Grèce et la Belgique francophone. Ces pays ont justement été sélectionnés pour leur profil divergent en matière de politiques de gestion de la diversité culturelle. Pour démontrer ce lien, nous nous livrons à une analyse comparative sociétale.

Full textRussian demographic statistics reflect the persistence of a dramatically wide gender gap in life expectancy and mortality over the last decades - about twice that found in the developed world. On average, men in Russia live 12 years less than Russian women, and 14.5 years less than men in Western Europe. This thesis provides an overview and synthesis of the most recently available literature that addresses the persistent gender gap in mortality and life expectancy in Russia. I reviewed the prevalent behavioral and social-structural drivers that explain the causes of higher male mortality in contemporary Russia. Especially, I looked at how the conceptualization of the male social role and related norms that shape masculine behavior contribute to high male mortality in Russia. The study reveals that men’s unhealthy, risky behavior and their higher vulnerability to stress are considered to be linked to their gendered social identity which is created and reproduced by the social-structural context of the Russia’s society.

Full textThis dissertation investigates how death as a subject matter in the work of contemporary artists living in European, American, and South African societies, relates to attitudes towards death in those societies. It examines how attitudes towards death have changed over the centuries, and how death is perceived in these societies today. It examines how the treatment of death in art today. differs from other periods because of these attitudes. Chapter One, Section One examines three major shifts in attitudes towards death In Western history, as outlined by Philippe Aries, a leading writer in the field. Chapter One, Section Two looks at death as a subject matter in Western art history, from ancient Greece to the mid-twentieth century. Categories discussed include funerary art, religious art, art and medicine, death personified, historical and analytical, personal, political art, and death and consumerism. Chapter Two, Section One examines attitudes towards death in contemporary Westernized societies, focusing on the medicalization of death, funeral rituals and disposal practices, and attitudes towards death in South Africa, specifically within the cultural framework of white, English-speaking South Africans. Chapter Two, Section Two examines death as a subject matter in the work of selected contemporary artists in America, Europe, and South Africa, and how it relates to attitudes towards death in those societies. Artists examined are Damien Hirst, Christian Boltanski, Joel-Peter Witkin, Andres Serrano, Donna Sharrett, Gerhard Richter, and Jo Ractliffe. The paper concludes by outlining the main arguments of the research and conclusions reached.
