Full textENGLISH ABSTRACT: This thesis examines the psychological and social reasons for recidivism among women offenders of the law and explores the impact halfway houses could have on reducing recidivism in SA. Despite the problem of high crime and offender recidivism in SA there is a lack of research into projects within the country that are attempting to address the situation. This paper ascribes to be an authentic voice from one who has had the unique opportunity of observing the SA prison system from within, over a period of 15 years, and one who has sought to assist ex-offenders in their reintegration from prison to society by providing support once outside of prison over the past 10 years. The thesis is auto-ethnographic in design and method. This research examines the reasons for criminal acts among women and seeks to investigate and determine the unique complexities surrounding women and crime. A high prevalence of sexual and physical abuse is corroborated as common precursors to conduct problems in female offenders, while mental ill health is found to be marked among women in prison. Recommendations are made for the establishment of halfway houses in SA and strategies are suggested for the development of such halfway houses.
AFRIKAANSE OPSOMMING: Hierdie verhandeling ondersoek die sielkundige en sosiale redes vir residivisme onder vroue oortreders van die wet en ondersoek die impak wat halfweghuise kan hê op die vermindering van residivisme in Suid-Afrika. Ten spyte van die probleem van hoë misdaad en residivisme in Suid-Afrika is daar nie baie geskryf oor projekte in die land wat probeer om die situasie aan te spreek nie. Hierdie verhandeeling is geskryf om 'n outentieke stem te wees van ‘n persoon wat ‘n unieke geleentheid het om die Suid-Afrikaanse gevangenis stelsel van binne af te sien oor 'n tydperk van 15 jaar, en wat poog om die probleem wat ex-oortreders vind met herintegrasie uit die tronk deur middel van ondersteuning buite die tronk vir die afgelope 10 jaar. Die verhandeling is outo-etnografies in ontwerp en metode. Hierdie tesis neem die redes in ag van kriminele dade onder vroue en poog om die unieke kompleksiteit rondom vroue en misdaad te ondersoek. Die navorsing staaf 'n hoë voorkoms van seksuele en fisiese mishandeling as 'n gemeenskaplike voorloper probleem in vroulike oortreders. Geestesgesondheid is waar geneem onder vroue in die tronk. Die idee van halfweghuise in die Suid-Afrikaanse gemeenskap is op die been gebring. Die artikel stel verder strategie vir die ontwikkeling van die halfweghuise in Suid-Afrika voor.

Full textStable housing is a necessity and an essential prerequisite for strengthening the well-being of individuals. A residence is not only a place for storing property but is also closely linked to several basic "capabilities" that allow individuals to manage their health and hygiene, meet their sleep needs and maintain a social network. In this way, a stable home is one of the decisive factors for an individual to achieve successful re-adjustment in society after serving a prison sentence. The criminological research that examines the lives of individuals after serving prison sentences deals almost exclusively with general social consequences after release without further focus on the housing situation specifically. This leads to a knowledge gap in the area. Considering this knowledge gap, our study aims to investigate what the housing situation looks like for individuals who have previously served a prison sentence. This was done with the help of semi-structured interviews with individuals who previously served a prison sentence. Furthermore, the study aimed to investigate the respondents' experiences of the assistance they received from authorities and organizations regarding housing. The results show that these respondents have had great difficulties in finding stable housing after serving prison sentences, where a high degree of mobility has occurred. Poor financial conditions in the form of payment notes and debts were a decisive factor for this. The experiences of authorities and organizations have varied among the respondents, where both negative and positive experiences have been depicted.

Full textA significant number of Liberian ex-militants are unemployed and underemployed despite the job skills, formal education, and entrepreneurial training they received as participants in the Formal Disarmament, Demobilization, and Reintegration (DDR) program that was established to reintegrate combatants into civilian society at the end of the two civil wars in Liberia in 2003. The purpose of this study was to examine the strengths and weaknesses of the vocational training offered by the DDR program. Informed by the theories of Human Capital, Peace Building, and Bronfrenbrenner, the research questions for this study assessed the benefits of the educational component of DDR. A phenomenological study design was employed with a purposeful sample of ex-militant participants that included 12 ex-militants and a focus group of 6-ex-militants drawn from the 12 who completed vocational training at the Monrovia Vocational Training Center in Monrovia (MVTC). All data were inductively coded and analyzed using a constant comparative method. Data analysis uncovered five textural themes: motivation for disarmament, hope to rebuild lives through vocational training, dissatisfaction with reintegration, perception of reintegration, and perception of future combat participation. Findings support human capital, peace building, and ecological systems theories in that ex-militants perceived the benefit of education in their transition to peacetime endeavor, but consider themselves only partially reintegrated since all consider themselves unemployed with no means to survive economically. This study is significant because it provides recommendations to policymakers on how such a program can improve the vocational training offered and provide follow-up life-skills counseling.

Full textThe current research (with a qualitative-hermeneutic approach) explores the phenomenon of Colombian armed conflict. It is specifically focus on social reintegration process and the subjective experience of ex combatants and ex abducted people. The study of the phenomenon in its clinical and sociopolitical complexity, articulates three vertices of analysis: Study 1: Social representations, around the current armed conflict and its involved figures. Study 2: The principal models of intervention offered by two organizations that work directly with ex abducted people (País Libre Foundation) and with demobilized people from illegal groups (Colombian Agency for Reintegration, “ACR”). Study 3: Family patterns, and its principal relational resources tan have supported subjects during their experience as abducted or combatants and once their return to society. The three axes of family patterns were explored (the origins, the couple relationship and the generational passage –Cigoli & Tamanza-) and the resources that can support family resilience (Walsh, 2005). Results break traditional polarization on the lectures around Colombian armed conflict. The present research transcends the individual study of involved participants and of implications of traumatic facts, to explore inside their relationships and resources. New approaches are presented to orientate interventions in clinical psychology that could be helpful to social reintegration process. It is also presented a new approach that includes the decisive role of families and communities as active actors instead of passive and victimized as they have been generally treated.

Full textI ett samhälle är tanken att en människa som utfört brottsliga handlingar ska efter avtjänat straff få en andra chans att återintegreras till samhället. Juridiskt sett blir brottslingen en vanlig medborgare igen efter avtjänat straff, men är straffet verkligen avtjänat? Numera har bakgrundskontroller av den arbetssökande blivit allt mer vanligt och är en aspekt som är avgörande vid anställning. Statistik från polisens rättsavdelning visar att myndigheten lämnade ut 740 000 registerutdrag under de 11 första månaderna 2017, vilket är 10 000 fler än motsvarande period 2016. På tio år har förfrågningarna tredubblats. Syftet med denna uppsats är att få en djupare förståelse för hur f.d. kriminella upplever deras återintegrering till samhället genom arbetsmarknaden. Empiri samlades in genom kvalitativa semistrukturerade intervjuer med sju f.d. kriminella och har tolkats utifrån den hermeneutiska metodologin. Analysen av materialet har gjorts med stöd i teorierna stämplingsteorin av Becker, hänsynsemotionssystem och sociala band av Scheff samt stigma av Goffman. Resultatet av analysen visade på att när de f.d. kriminella tar det stora steget att lämna kriminaliteten ges dem inte en chans att bevisa att dem förändrats. Synliggörandet av deras brottsliga bakgrund gör att begränsningar och skamkänslor skapas, både i arbetslivet och i möjligheten att bygga upp trygga och starka sociala band.

The present study analyses whether a Social Impact Bond is a suitable tool to fund APAC Portugal’s intervention model aiming to enhance the life of former offenders and reduce recidivism rates through helping them reinsert into society upon release. While the costs of running a prison will be borne by the public sector just as any other prison, the innovative intervention model has to find another way of financing. The suitability of using a Social Impact Bond to fund this innovative intervention was tested through the building of a robust excel model representing the investment mechanism in order to test the profitability of such a measure. The results show that a Social Impact Bond could indeed fund APAC Portugal’s intervention model efficiently.
Este estudo é uma análise à eficácia de um Social Impact Bond como como instrumento financeiro no modelo de intervenção da APAC Portugal. O objetivo é o de melhorar a vida de ex-criminosos e reduzir os índices de reincidência de modo a apoiar a sua reinserção na sociedade após a libertação. Enquanto os custos de funcionamento de um estabelecimento prisional forem suportados pelo sector público, como é de lei, o modelo inovador de intervenção terá de encontrar um meio alternativo de financiamento. Sendo assim, testámos a rentabilidade de um Social Impact Bond através de um bem estruturado modelo Excel que simula o mecanismo de investimento, tendo os resultados demonstrado que um Social Impact Bond pode, de facto, financiar o modelo de intervenção da APAC Portugal de forma eficaz.

Full textMore than 80 000 inmates have been released from French prisons in the last ten years. Questions about these releasees had to be studied from the point of view of recidivism and social reintegration. A sample of the French inmate population has been built, from a professional field, to study the social profiles and courses of the released inmates. This study tries, by quantitative and qualitative approach, to find the most predictive social determinants of the individual post-custodial journey.Analysing the results of sentence adjustments, and more generally life courses, made it possible to isolate a number of factors that can predict the pursuit (or not) of a criminal route.The nature and the quality of the integration into the social fabric before custody, defines the continuation or interruption of a criminal life.The strongest repression of the most common offences (theft, violence, reckless driving) is also confirmed by the study as well as the fact that the segment of the population most affected by repeat offenses are the poorest classes

Full textSyftet med studien är att öka förståelsen för tidigare dömdas behov av stöd vid etablering på arbetsmarknaden och belysa vad studie- och yrkesvägledning kan tillföra för att utveckla Krami. Krami är ett samarbete mellan Kriminalvården, Arbetsförmedlingen och i många fall även kommuner och har som uppdrag att hjälpa tidigare dömda in på arbetsmarknaden. Genom intervjuer med personal och studier av styrdokument ges en bild av vad vägledningskursen innehåller och hur personalen tänker kring målgruppens utmaningar och behov. Resultatet visar att man inom vägledningskursen arbetar med att stärka såväl deltagarnas självkännedom som kunskaper om arbetslivet. Det läggs även stor vikt vid att öva på att göra övertänkta val och att hantera konsekvenserna av dessa val. Detta är centrala inslag i många vägledningsteorier. Kunskaper om studie- och yrkesvägledning kan bidra till att utveckla vägledningskursen ytterligare genom de metoder och modeller för kartläggning och vidgning av perspektiv som många studie- och yrkesvägledare använder i sitt arbete.

Narrative therapy, Cognitive Behavioral Therapy, art therapy, and mindfulness may significantly ameliorate the conditions faced by this population, as well as the overall well-being of the community through a showcase of expressive arts composed and performed by the clients of Homeboy Industries. A search for potential funding sources led to The Goldhirsh Foundation as the most appropriate source for this grant. A grant proposal was written describing an expressive arts program for Homeboy Industries that will ultimately result in a showcase for community consumption. Actual submission and/or funding of the grant were not required for the successful completion of this project.

Full textThis research focuses on the juvenile criminal law and restorative justice in a comparative approach between France and Belgium. Beyond revealing the similarities and differences of these countries in these fields, the research also carters to the difficulties encountered by France and Belgium in the acceptance of restorative justice in juvenile criminal law and its development in the judicial institutions. By studying the reasons that led France to miss the “turning” of restorative justice and those enabled, in Belgium enabled, the implementation of restorative justice in the criminal law for minors, anchor points have been identified for its development in the order of 2 February 1945. Subsequently, an experiment in youth justice service on the reparation measures was led considering difficulties which concern the service itself (actuarial logic, supervisory, financial, professional ideologies and fears). Our analysis of practices in the youth justice services on the reparation measures, reveals that the experimentation of restorative justice is limited by a managerial rationality treatment of juvenile criminal phenomenon. Also, some of the minor approaches and their implementation in the measure facilitate (psycho-criminological approach to acting out part and a psycho-socio-educational dimension in reparation) or inhibit (criminological approach to act itself and a retributive dimension in reparation) restorative justice programs. However, even if the practice facilitates experimentation and that educators apply “direct reparation”, ideological barriers remain in dealing with victims. However, it remains essential to underline that, thanks to the presentation of the principles and promises of restorative justice educators met, the identified pitfalls fall, mainly with the presence of the victim during the implementation of “direct reparation”. Such a development professional postures omen a harmonious integration of next restorative justice approaches in juvenile criminal law

Full textThis research study seeks to examine the South African labour market, using the case of ex-offenders and their difficulties in entering the formal labour market and securing full-time employment after they have been released from correctional facilities. The „Scarlet letter‟ in the title refers to a euphemism used to describe the effects of the criminal record on the prospect of employment. As part of the research, I also examine the perspectives of employers about their willingness to employ ex-offenders as well as some of the reservations they may have, as representatives of the labour market. Although there is extensive research on reintegration as well as barriers to reintegration, especially in Europe and the United States, none of these have married the labour market experiences and reintegration experiences of ex-offenders, especially in the South African context. This study employed qualitative research methods and techniques to explore the meaning ex-offenders attach to their social experiences. Data was collected by means of in-depth interviews in order to gain a comprehensive understanding of the lived experiences of these ex-offenders and a vivid picture from the key informants. In this regard, participants in the study consisted of thirteen Black male ex-offenders, three representatives from the National Institute for Crime Prevention and Reintegration of Offenders (NICRO), one representative from a Non-governmental Organisation (NGO) called We Can Change Our World (WCCOW), five Human resource managers at a property management firm as part of a focus group discussion and one executive at a recruitment company. All interviewed ex-offenders shared similar experiences of their challenges and limited social and economic reintegration, especially related to finding a job in South Africa. The study reveals that discrimination in the workplace continues in contemporary South Africa, but such experiences are even worse for ex-offenders. The study concludes that a lot still needs to be done to transform the South African labour market and correctional facilities, linked policies and practice for the majority, especially ex-offenders who have “paid their debt to society”.
