Abstract:
The present study considers the treatment of failed States in international law. State failure represents a relatively recent phenomenon, which presents novel problems for the international community to deal with. For international law, the principles and experience of dealing with the creation, continuity and extinction of States present the nearest analogies, and so will form the basis of its responses to failure. Failure is defined as governmental and societal collapse in a State, so severe as to render it incapable of exercising internal and external sovereignty. It is likely to take the f

In the context of sugar production in Trinidad, the dissertation examines the role of law and the state in the incorporation of unfree labour during the colonial and early post-colonial period. In orienting the analytical focus to account for the human agency and resistance of sugar workers, the dissertation finds that law and the state channel worker opposition into processes or pathways of exit. These exit processes mediate the shifts within, and transitions between, unfree labour regimes. Three key observations emerge from the historical analysis. First, the "mobilize to immobilize" dyna

In 1997 the journalist and author Maciej Zaremba published an article in the Swedish newspaper Dagens Nyheter. The article drew associations between racial biology, eugenics and the Swedish social democratic governance. Zaremba’s article presented records from a period of forty years when over 60 000 people of the Swedish population were sterilized. The records showed that many of them were executed under questionable circumstances. Zaremba woke a debate within the Swedish mass media with the intended goal to foil the general view of the Swedish state of welfare. In this study the debate that

Abstract:
Mental health treatment in state prisons is revealed to be highly variable, under-funded, and systematically inadequate. Existing literature exposes this injustice but fails to provide a comprehensive proposal for reform. This paper attempts to fill that gap, outlining a cost-effective, evidence-based treatment proposal, directly addressing the deficits in care revealed through analysis of our current system. In addition, this paper provides historical overviews of the prison system and mental health treatment, utilizing theoretical perspectives to contextualize this proposal in the present st

Abstract:
The thesis is a study of labour regulation and the State in the Sudan in the light of a general theoretical conception of labour law and the State. The first Chapter defines the concepts of analysis that are used throughout the study, isolates the "essential" properties of the Capitalist State and Law from the historically concrete forms which they assume in a particular society and distinguishes between processes which influence development of the form of law and others which influence its sociological development. Drawing on the analysis in Chapter I, Chapter II exposes the inter-relationshi
