In my research, I am attempting to employ a novel approach to legal textbooks, by treating them as the source and effects of social change. Legal textbooks are used on a daily basis by students, academics, and the legal profession—lawyers, solicitors, barristers, and also by judges. For a number of reasons, the last group of professionals is the scope and range of my research. Judges are considered to be highly esteemed and important representatives of the legal profession. Their decisions influence—and are being influenced by—directly and indirectly, legal textbooks and their content. Law textbooks are the source of inspiration, and might be considered as a repository of legal knowledge. Some law schools in Indonesia reject socio-legal studies with epistemological arguments that puts jurisprudence as sui generis. Rejection is based argument that jurisprudence is a normative science. In fact socio-legal studies in the development of jurisprudence outside Indonesia has long existed and contributed to the legal reform. Socio-legal studies also significant for legal reform. It is caused by the existence of non doctrinal aspect in law making and implementation of the law. Therefore the position and relevance of socio-legal research is not related to the benefits that provided for the development of national law or jurisprudence. Beberapa fakultas hukum di Indonesia menolak penelitian sosio-legal dengan argumentasi epistemologis yang menempatkan ilmu hukum sebagai sui generis. Penolakan tersebut didasarkan argumentasi bahwa ilmu hukum adalah ilmu yang bersifat normatif. Kenyataannya studi sosio-legal dalam perkembangan ilmu hukum di luar Indonesia telah lama eksis dan berperan dalam pembaharuan hukum. Selain itu, studi sosiolegal juga berperan dalam pembaharuan hukum. Hal ini disebabkan adanya aspek-aspek nondoktrinal yang berperan dalam pembentukan hukum dan implementasi hukum di masyarakat. Oleh karena itu kedudukan dan relevansi penelitian sosio-legal pada ada tidaknya manfaat yang diberikan bagi perkembangan hukum nasional ataupun ilmu hukum.

Abstract:
Introduction. Anincreasing trend of illegal acts including grave and especially grave crimes, violent crime, a growing number of participants involved in criminal activity, the growth of criminal damage have become sustainable characteristics of criminological situation of modern Russia. The identification of the causes of the current situation affected the importance of the factors of choosing the model of legal behavior by the individual. The important feature of legal behavior is the developed legal consciousness of the individual and the existence of legal consciousness deformations, characterized by legal nihilism, legal idealism and legal infantilism. The phenomenon of “legal infantilism” has not been thoroughly examined in law despite the worksof legal scholars V. R. Petrov, P. P. Baranov, D. E. Marchenko, and A. M. Tsaliev. Manifestations of legal infantilism, the degree of its influence on the current criminological situation makes it necessary to search for and implement means of counteracting its formation. Methods. The main methodological principles of the research were the breadth of learning of legal processes and phenomena, the unity of theory and practice. System and value methodological approaches were the basic methods of research. The method of integrity allowed to determine the characteristics of legal infantilism, forms of its manifestation and prerequisites for its emergence identified by scientists during the historiographical analysis. Results. The research revealed that legal infantilism as a phenomenon has not received legal systematic examination so far.The article characterizes approaches to the analysis of the phenomena “infantilism” and “legal infantilism”. The paper revealed the significant influence on the ideas concerning legal infantilism by the achievements of medicine and the absence of a comprehensive study of legal infantilism in modern jurisprudence.Different types of infantilism (personal, psychological, social) are characterized; legal infantilism is considered to be a type of social infantilism, a specific form of manifestation of deaxiological legal consciousness. The reasons for the formation and forms of manifestation of legal infantilism were determined. The article makes the conclusion about the usefulness of developing a strategy to counteract the formation of legal infantilism in the legal consciousness of Russian citizens, the structural elements of which should be scientific and legal, legislative and law enforcement components.

The article focuses on the problems of bullying. Legal and socio-psychological aspects are analyzed in order to further prevention and improvement of the methods counteracting this phenomenon. In particular, the stages of development of the problem are drawn, special attention is paid to research in which it is possible to develop a plan of action to prevent bullying in educational institutions. Bullying is one of the most uncertain and debatable definitions that needs further study. Systematic, regularly repeated violence (mostly psychological) is the main feature of bullying. Scientists D. Olveus, P. Randall, N. Duncanson and others have studied the problem of bullying. The article reveals the legal aspect of bullying, namely legal liability (administrative and criminal). The content of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine about Countering Bullying (Harassment)” of December 18, 2018 №2657-VIII and other regulations are analyzed. Methods to counter bullying such as the Farst, Link crew and the Finnish KiVa method are presented. Development of an action plan, aimed at preventing and combating bullying (harassment) in educational institutions, is among the ways of solution the problem. Thus, bullying is the worldwide problem. This problem is called socio-psychological which leads to destruction of the personal character. According to the authors, education from childhood is necessary. A person should know, already in his adolescence, that he can be prosecuted criminally or administratively for illegal actions. Bullying is violence, therefore science of law must be taught. This problem mustn`t be ignored because it could lead to irreparable consequences and ruin lives of many people. The authors note that it is impossible to eradicate bullying but it is possible to minimize such cases. Sehingga pada tataran teoritik, hal tersebut memunculkan sociology of law dan pada tataran filsafat memunculkan sociological jurisprudence. Ilmu hukum yang terus berkembang pada akhirnya menciptakan berbagai aliran, mulai aliran hukum alam (irasional dan rasional), aliran hukum positif (analitis dan murni), aliran utilitarianisme, mazhab sejarah, sociological jurisprudence, pragmatic legal realism, socio legal studies dan aliran hukum kritis. Hal ini menunjukkan proses searching the truth tidak pernah berhenti. Menjelaskan keterkaitan hukum, ilmu hukum, sociological jurisprudence, diperlukan suatu methode research yang tepat dan representatif. Karena melalui research akan ada temuan-temuan baru, berupa pengetahuan yang benar (truth, true, knowledge) dan pada akhirnya digunakan untuk menyelesaikan suatu permasalahan.

Abstract:
The article covers the range of issues on the efficiency of combating corruption from the perspective of taking into account the role of social perception of legal norms. The author lays emphasis on the perception of corruptive relations as an object of legal pressure, and the law, as means for the implementation of the anti-corruption policy through their social nature. The author acknowledges the issuance of specialized laws and regulations to be a restricted measure, and states the need in ensuring effectiveness of the institutionalized anti-corruption norms. In this respect the author introduces the concept of social reality as a key attribute necessary to ensure the efficiency of law-making and implementation of law-enforcement processes. The article pays special attention to the problems of appearance of social alienation and formation of a consumer society, which are very topical for modern Russia. Besides, as part of the identified range of issues, the author examines taking into account of structural specific characteristics of the existing society, and the factor of social consciousness inertia which collectively considerably influence the efficiency of legal anti-corruption initiatives.

Abstract:
Privacy rights are growing apace, as can be seen from a continuing stream of judgments from UK and European courts, the rise of special interest privacy groups and other institutions tasked to protect privacy. Privacy has – its proponents suggest – at last arrived as a fully fledged legal right. However, despite these advancements, I suggest that privacy is becoming less prevalent in society; primarily because of technological and cultural changes, but also because the technical legal implementation of privacy is highly problematic. In this article it is argued that this seeming paradox should be more critically examined by socio-legal researchers who, to date, have done little to test the assertions and assumptions of the privacy lobby. This article maintains that there is a need for more investigation of the basis and assumptions behind data protection and privacy law and that a more robust analysis of the claims and rhetoric for these rights will change our attitudes towards privacy developments. The sociological conception that ‘underlying all social interaction there seems to be a fundamental dialectic’ will be used to undermine the legal notion of privacy as an individualistic ‘fundamental right’.

In this review to mark the 25th anniversary of Social and Legal Studies ( SLS), we offer an assessment of the evolution of socio-legal scholarship on the Third World. We seek to locate the journal in the broader history of socio-legal studies and legal education in the United Kingdom and to consider its engagement with the work of Third World scholars. In order to do this, we recall the founding commitment of the journal’s first editorial board to non-western perspectives on law and locate this commitment both historically and biographically. We explore a number of important interventions concerned with socio-legal studies in the Third World, but also point to significant gaps and omissions since 1992. To end, we argue for a reassertion of SLS’s founding commitments to anti-imperial scholarship and the challenges posed by critical, non-western perspectives.

The connection between law and contemporary social science emerged as a consequence of the quest for social reform. As law became more instrumental, it also became more empirical, more concerned with policy. For this process, it turned to social science. Social science complied and has become an adjunct to law in the quest for solving social problems. As this partnership has developed, the relationship between law and social science has matured. Not only has social science sought to educate and influence law, it has also incorporated law into its own disciplinary concerns. Furthermore, the field of socio-legal studies may be on the verge of establishing itself as a separate and distinct discipline, independent of the practical concerns of law.The scholarly intersection of law and social science — or socio-legal studies, as I shall call it — now speaks with at least three voices addressed to at least three audiences. It speaks as policy analysis, a handmaiden to law. It also speaks in the traditional language of the social sciences. Thirdly, it may be gaining a voice of its own, reflecting a belief that law is a distinct form of ordering that merits its own position among the scholarly disciplines, separate from both scholarly fields and the professional concerns of law. At their core, each of these enterprises entails a distinct voice, a distinct audience, and a distinct agenda.

The article is devoted to the problem of ensuring the right to health protection and medical care, the organization and provision of medical care to children with rare (orphan) diseases are of great relevance today, due to increased attention to it not only in Russia, but throughout the world. This is mainly due to the high level of economic and social burden of rare diseases. Orphan diseases include congenital (hereditary) or acquired diseases, the frequency of which in the country and the world does not exceed a certain number established by the laws of various countries. The low incidence of rare (orphan) diseases leads to difficulties in obtaining useful, reliable and timely information about the pathology; the correctness of the diagnosis; lack of adequate dispensary observation; limiting budgetary allocations for the development of orphan drugs and, as a result, the timely receipt of timely and appropriate treatment by people suffering from rare (orphan) diseases.

The article studies environmental conflict and identifies it as a specific socio-legal phenomenon – legal environmental conflict  on the basis of the suggested unified approach to understanding its nature. It is confirmed that legal conflict has to be studied in terms of the inseparable unity of its social basis and legal nature. It is concluded that the generic features of social conflict in the process of juridization turn into features of legal nature and acquire legal character in legal conflict. The distinction is made between the notions of “legal conflict” and “legal collision”.

Abstract:
In terms of its form, the law can be in the form of written law and can also be unwritten law. The purpose of this study is to analyze the influence of socio-cultural aspects on legal changes in Indonesia. The research method used is normative legal research. The results of the study show that talking about legal culture is the same as talking about public legal awareness. These two things are an inseparable unit, because they are closely related to the implementation of law in society. Thus, legal culture and legal awareness are two things that can be developed properly in an integrated manner so that the legal reforms implemented can be accepted by the community as behavioral guidelines that must be followed.

<table border="0" cellspacing="0" cellpadding="0"><tbody><tr><td valign="top" width="388"><p class="TableParagraph"><em>Women often become victims of crimes, especially sexual crimes and domestic violence, in legal proceedings, but the legal protection stipulated in laws and regulations is still considered inadequate and many women still experience discrimination and injustice. The purpose of this study is to analyze the legal protection of women victims in criminal justice proceedings in Indonesia from a socio-legal perspective in order to identify the socio-cultural-structural barriers that cause the weakness of such protection. This study uses an empirical legal research method with a sociological legal approach to analyze the application of regulations on protecting women victims in criminal proceedings, with primary data obtained from field studies and interviews which are then analyzed qualitatively. The results show that nomatively, regulations on protecting women victims are adequate, but in practice they are heavily influenced by patriarchal socio-cultural factors and negative stigma against women victims which affect the attitude of law enforcement officials, resulting in many victims experiencing discrimination and injustice. The socio-cultural-structural barriers include negative stigma and discriminatory treatment of victims, patriarchal culture that subordinates women, lack of psychosocial and legal support for victims, and limited access to justice for marginalized women victims. At the structural level there are also problems of low gender capacity of law enforcement officials, lack of NGO advocacy, and legal and judicial systems that are not yet victim-friendly.</em><strong></strong></p></td></tr></tbody></table>

The article examines the defining legal culture problem as one of the main legal reality factors, considered in philosophy and in the law theory. The purpose of the investigation is to generalize scientific knowledge and theories that reveal the relationship between legal culture and legal reality. By applying general and special research methods, analysis and scientific material generalization, consideration of various approaches to legal culture and legal reality to identify these categories relationship of their constituent elements are carried out. The authors analyze and compare the perspectives and scientific positions of philosophers and legal theorists in the researching field of the legal culture development in modern society in the legal reality formation. The categories “legal reality”, “legal validity”, “legal culture” as phenomena of social reality interacting with each other and constituting the broadest philosophical and legal category “legal reality” are considered. The result of the research is the legal culture consideration as a factor that determines legal reality, which includes the entire spectrum of legal phenomena encountered in legal life. The legal culture research and legal reality are considered as the basic modern humanitarian science necessity, which aims to ensure the most complete development of the human personality in harmony with public interests and needs, the most important are mediated through law. We highlight the main problems of the legal culture and legal reality definition, which are due to a wide range of considered categories, a large number of constituent elements, different understanding of a law and legal life. Legal culture defines legal reality as the real existence of legal matter as one of the types of social reality.

Smart contracts are computer protocols that self-enforce encoded terms. They arguably allow for individual freedom and increased sovereignty from inconveniences. The enthusiasm goes as far as foreseeing that smart contracts will make contractual legal oversight obsolete. However, whereas contract law theory evolved to acknowledge the importance of flexibility and relationality, smart contracts activists defend the opposite direction, arguing for contractual rigidness and denial of social norms supporting complex transactions. This paper departs from this paradox to argue that (i) smart contracts based on existing technology are unlikely to thrive in complex contractual settings, and (ii) contextual analysis is important for LawTech’s propositions.
