Full textThe study of the European case law at the beginning of the 21st century shows the willingness of the Court or Justice to create a new legal category. This willingness responds to the need to keep barriers between community competence and national competence. To this end, the European Court of Justice (ECJ) elevated the concept of solidarity to a legal principle, which enabled to include in this new category all the constitutional economical and social rights. The first part of our research aims at showing that the criteria constituent of the notion of economical activity taken into account by the ECJ should be understood as those answering a merchant logic. The competition right tends then to structure activities according to its merchant concepts, which allowed it to enter in to the social domain, could not ail activity be likely to function under a merchant mode? The second part shows that the ECJ has affirmed repeatedly that an activity presenting a high degree of solidarity does not constitute an economical activity but rather an activity with an exclusively social character and this as well in competition right as in free movement, opposing the merchant logic to the solidarity logic. The ECJ established a division line, between community competence and state competence. However, this division line seems to be terribly shrinking. After the turning point ending the all merchant logic- opened by the judgement Höfner-, marked by the case law Poucet & Pistre and Albany, the case law Viking. Laval. They are also an object of study which occupies a central place in the scientific literature, especially in the field of economics. In this thesis, remittances are considered from a socio-anthropological perspective, putting into perspective the remittances of emigrants in relation to the process of individualisation at work in migratory situation and in African societies.Semi-directive interviews carried out in addition to classical and netnographic observations make it possible to highlight the meaning that the emigrants give to the individual and collective financial assistance they provide to their family, the different strategies employed by the emigrants to control the use of remittances, and their own interpretations of the standards of community redistribution

Full textFrench local authorities and those of countries of CEMAC and ECOWAS were given under the principle of free administration, new competences to lead actions abroad as a decentralized cooperation. If interstate cooperation allowed to lay the foundations of community law, the decentralized cooperation can help to stimulate and strengthen integration. That such cooperation is intra-European or intra-African, the role played by local authorities is crucial, in spite of the fundamental attributes of states in matter of diplomacy and sovereignty. Inspired design doctrinal and French experiences of decentralized cooperation the territorial francophone African States have the assets to help boost African community integration. However battle for peace, democracy, local development, the right governance and the struggle against poverty always require more efforts at sub-regional level. That’s why, the issue of decentralized cooperation demands responses based on a big complementarity and a synergy between all the actors namely citizens, local powers, traditional authorities, lay people, central powers and community institutions

Full textThe study of undocumented migrants 'protests can raise some interesting questions about social groups' mobilization and action repertoires. This is not the "integration" of these populations, defined by their illegal situations, but the alliance between immigrant militants, Christian militants in some fractions of the French left, or some leftists linked to an "old" antiracist movement, that allows to explain types of mobilization which could have seemed unlikely. After a study of the specificity of these immigrant populations, with the help of resource mobilisation theories, the dissertation considers the question of action repertoires, and especially of hunger strikes. This dimensions makes it possible to link strategy and identity in the analysis of collective action. Through a quantitative and qualitative analysis, particular attention is payed to the genesis and ideological universe of the defenders of immigrants rights, who have constantly sided with undocumented’s' mobilisations

Full textThe microfinance constitutes a solution to the social problems and represents an ethical finance. So, this finance has to find necessary funds to insure a sustainable development and guarantee the solvency of the IMF. The first objective of this thesis consists in determining a typical profile of the borrower on the basis of a set of factors. The significant factors are determined from a database relative to the Tunisian bank of solidarity. Our empirical results show the non-existence of a typical profile of the borrower, on the other hand the reserved factors are determining in the analysis of its solvency. The second objective of this thesis consists in proposing a model of scoring allowing to select the solvent borrowers. This model joins the works pioneers by Altam. The found results show that the performance of the IMF is widely dependent on its rate of covering and on the nature of the financial projects

Full textCommonly, Europe incarnates itself in a dream (the political project) and a reality (the territory and its borders). The European regional policy synthesizes this duality: it tends towards an harmonious economic development in Europe and is represented by the whole of the regional and local authorities of the European Union. Along with the various programmings, the attribution of the Community funds under these policy rules follows a double philosophy: first, solidarity, based on an assistance towards the least developed regions and more recently, competitiveness, driving all the European areas towards an ideal of full employment and economic growth of the Union as a whole. To meet these needs and to transform them into projects for the territories, the managers of these “structural” funds, within the Member States, find themselves facing a renewal of the administrative missions and of their ways of being applied. Far from establishing an “Europe of areas”, these fund distributions counterbalance a traditionally centralized and hierarchical National and European management of public policies. The management of the European structural funds becomes, in spite of national reluctancies and European gropings, the forefront of the new Union strategy of competitiveness in the worldwide market

Tendo como atividade principal a poupança e/ou o crédito, as iniciativas que interessam ao nosso estudo formam o campo das finanças solidárias, o qual se inscreve no campo da economia solidária. O objetivo central do traballho foi delimitar as finanças solidárias no Brasil e na França, questionando o papel dessas iniciativas no desenvolvimento da economia solidária em um dado território. Numa perspectiva socioeconômica, a questão do papel das finanças solidárias para além da dimension financeira supõe uma compreensão ampliada da economia, a qual se baseia no pensamento de Karl Polanyi. A partir de um trabalho de campo etnográfico, constatamos que quando analisamos a atividade de financiamento solidário de maneira isolada, seu impacto, em termos de financiamento e de desenvolvimento da economia solidária, parece relativamente pouco importante. Para compreender seu papel, é preciso considerar as dimensões econômica,social e política dessas iniciativas
