Abstract:
Příspěvek se zabývá problematikou právního rozhovoru soudu a stran v civilním sporném řízení, v rámci kterého by soud měl se stranami probrat věc po skutkové a právní stránce. V příspěvku je analyzována současná česká právní úprava (včetně návrhu věcného záměru civilního řádu soudního) a zejména možnosti inspirace v zahraničních (rakouském a německém) civilních procesech, ve kterých má právní rozhovor (Rechtsgespräch) své pevné místo coby součást materiálního vedení řízení soudem. Příznivé účinky, které může probrání věci s účastníky mít na průběh a výsledek celého řízení, jsou pak demonstrovány skrze funkce, které právní rozhovor v řízení plní.

Abstract:
V této studii bych rád vysvětlil, jakým způsobem je možné vnímat naše okolní žité prostředí jako místo, kde se odehrává proces myšlení. Svůj argument podpořím příkladem experimentální studie testující jeden z dílčích momentů tohoto problému. Od představy přirozeného světa a jeho možností vlivu skrze afordance a přímou percepci postupně vysvětlím zákonitosti kulturně modifikovaného prostředí jako pro náš život uzpůsobeného seskupení materiálních objektů a k nim se vážících celků kulturních konvencí implikujících určité režimy interakcí mezi lidmi a věcmi. Myšlení jako situovaný proces je možné chápat právě jako jednu z takových. Tento moment se stává jasnější, pokud začneme prozkoumávat hranice a přechody mezi lidmi a věcmi a zdůrazňovat právě ty typy zapojení, při nichž se vnější objekty stávají součástí myslícího celku a podílí se na vyšších kognitivních funkcích – pochodech myšlení tradičně považovaných za specificky lidské kompetence. Jako příklad uvedu výzkum vlivu antropomorfních reprezentací na prosociální jednání. V druhé části práce tak předkládám teoretické pozadí experimentu i jeho návaznost na svět náboženských tradic. Snažím se také nabídnout určitá možná vysvětlení povahy vlivu materiálního objektu na naše myšlení.

The theoretical part describes the basic notions connected with valuation, describes the methods of valuation and also the valuated locations itself. The practical part deals with the aparment valuation using these methods - the method according to price provision, specifically comparative technique, then the comparative method itself but not according to price provision and finally using the yield method for an assessment of the current price.

Abstract:
The dissertation deals with problems in the valuation of parts and accessories of land with an emphasis on the difference between landscaping and engineering structure. Despite the existence of defined components and accessories immovable in the Civil Code in practice often appear doubts about whether in a particular case is still part of the real property, or whether it is already a matter of self. The work addresses this issue in detail only for roads, drainages and retaining walls. There were studied various laws and the earlier Court decisions. The Court judicature often solves problems of ownership determination. Can be seen as an example: Determining ownership of the rock, that is formed by hardening the land surface rocks and planting permanent crops. Whether the owner of the land owner or the person who built it. Likewise, there are disputes to determine ownership of utility connections, ownership structures, which are kept below the surface of the land. Based on the new Civil Code no. 89/2012 Coll. there has been extensive changes in the field of things and their allocation. There is a new concept existing, instead of the current concept of property. There is existing a new concept called Real property. A very important change is that the engineering structures are parts of the land, but based on the § 509 utilities, especially water, sewer or power lines or other, are not parts of the land. It is believed that parts of the utilities are also buildings and technical equipment that is connected to them operationally. Also important is the § 3055 para. (1): Engineering structure which is connected to the ground with a solid foundation, which is under the existing legislation part of the land on which it is established, and the effective date of this Act, owned by a person different from the owner of the land, and the bottom the entry into force of this Act does not become part of the land and immovable property. The same applies to the building, which is co-owned, if one of the joint owners and the owner of the land or if they are just some of venturers building co-owners of the land. The author presents the general specifics valuation external works and civil engineering in selected cases and the valuation of construction law. Work includes a chronological overview of valuation rules.

Abstract:
The concept of a building in the roman law Abstract This diploma paper deals with a definition of a building concept in the roman law. Thanks to many possibilities of its appellation, the attention is paid to the designation used by the sources at first. Its definition according to the legal characteristic of things follows. Concerning the building description as a composed thing, the perception of the part in general is also taken in focus, because of the specific understanding kept by the roman law, particularly in relation with things sometimes called as pertinecies. However, the application of the general standard used by romans as the definition of the part (perpetuus usus) to the building brings some difficulties. Firstly, the building was specially defined in a context of some special norms. Tignum iunctum is the most important example, but a prohibitive regulation of demolitions or destructions, including particularly the senatusconsultum Aviola et Pansa, was significant too. Secondly, the development of the understanding what does it involve took a part, as the things used for the water supply illustrate. Than the paper focuses on the negative delimitation of the building by the categories of things, such as instrumentum, ornamentum or suppellectiles and ruta et caesa. Last part of the paper deals...

Abstract:
The aim of the thesis is to describe the concept of the superficial principle in the valid legal regulation and its influence on land law relations. As a result of the reintroduction of the superficial principle into the legal order of the Czech Republic by Act No. 89/2012 Coll., The Civil Code, all that is associated with the earth's surface becomes part of the given land. The thesis is divided into five structured chapters. The first chapter is devoted to land law as an interdisciplinary law system. The aim of second chapter is to explain the key importance of the superficial principle within the context of land law. The third chapter deals with the historical background of the development of legal relations to immovables in the territory of the Czech lands, also including the introduction of the Roman settlement as the basis of the superficial principle. The next part of the thesis contains the interpretation of the most important legal institutes related to the superficial principle in the context of the valid law. The chapter further describes exceptions to the principle. The fifth part of the thesis is focused on the analysis of selected land law relations influenced by the superficial principle.

SUPERFICIES SOLO CEDIT English Abstract Andrea Gabrielová The topic of my master thesis is represented by an ancient roman principle called superficies solo cedit. This principle is gowerning the ownership of the land and is closely linked to the legal institutes as component parts, immovables, the right of superficies.. According to this principle, buldings and plants form part of the main legal object, which is land the superficies solo cedit principle leads us to the ancient Rome, which has been giving complex legal base to the current continental system of law untill nowadays. Therefore I dedicate my first chapter to the origin of the principle in roman law. Second chapter is dedicated to the ABGB Code, which is basicly inspired by roman law and as itself is the main source of the new Civil Code Nr. 89/2012 Sb. New civil code is the core of this thesis. Above all because it reestablished the superficies solo cedit principle and after many years brought it to life. Reestablishment of the principle has uncountable consequences not only in the area of private law. The most important consequence brought to the frame of private law is the unification of the legal régime of constructions and land.
