Abstract:
The Special Educational Needs and Disability (Northern Ireland) Order (2005) (SENDO) which became operative on lSI September 2005 was the catalyst for this study. Set within the context of change, the purpose of the research was to investigate the implications for Special Educational Needs Co-ordinators (SENCOs) in Northern Ireland in implementing SENDO. Quantitative and qualitative data was obtained using a mixed method approach; a questiollilaire, which was constructed and forwarded to SENCOs throughout Northern Ireland, revealed a number of themes which were further explored through semI structured interviews with focus groups of SENCOs. The findings, which were representative of the overali situation in Northern Ireland, revealed that while there is general positivity about the principles of SENDO, there are differing approaches to inclusion throughout schools in Northern Ireland. Whilst there has been a shift from the traditional role as a special needs teacher to a co-ordinating . role, it would appear that a number of SENCOs are not totally ready to fully embrace the new legislation. The main implications for SENCOs include lack of status, with orily a small number on senior management teams, insufficient resources, especially classroom assistants and a lack of time to effectively manage very demanding workloads. In addition a lack of qualifications, training and support within the area of special education, especially managing challenging behaviour and dealing with medical issues, were highlighted as major implications. The study concluded with a number of recommendations for schools, Education and Library Boards and the Department of Education to consider 'In order to support SENCOs with the successful implementation of SENDO.

Abstract:
Aspects of fuzzy vector spaces and fuzzy groups are investigated, including linear independence, basis, dimension, group order, finitely generated groups and cyclic groups. It was necessary to consider cardinality of fuzzy sets and related issues, which included a question of ways in which to define functions between fuzzy sets. Among the results proved, are the additivity property of dimension for fuzzy vector spaces, Lagrange's Theorem for fuzzy groups ( the existing version of this theorem does not take fuzziness into account at all), a compactness property of finitely generated fuzzy groups and an extension of an earlier result on the order-homomorphisms. An open question is posed with regard to the existence of a basis for an arbitrary fuzzy vector space.

Ögren, Lisa. "Producing special-ordered engines : A mapping of the special-order process and the impact of working from home at an engine assembly plant."

Abstract:
This report is presenting a master thesis work in Industrial Design Engineering with a focus on production development at Luleå University of Technology. The thesis work was conducted in the spring term of 2021 at the engine assembly plant of Scania in Södertälje. The project aimed to map the special-order process to create an overview of the process and present improved work patterns. The project also aimed to map the impact of working from home. A special order is an order that is tailored for the customer in a way that is not supported by the standard order system but produced in ordinary production, this is made possible using the S-order process. The background of the project was that the process is among other things, unclear and person dependent and has resulted in stops and unnecessary and costly maneuverers in the production. The project was a pilot study with a focus on the mapping and analysis of the current and future state of the process, limited to the engine assembly, marine and industry engines and with a focus on the local product preparators. Interviews, observations and document studies were the main methods used to map the process. These data collecting methods complemented each other to create an understanding of the situation using a broad range of perspectives. The result of the data collection was then analysed to present the process and the perceptions of the process to find problems and needs. A specification of requirements was used to summarise the results and to be used during concept development. Concepts were developed through a workshop where the participants brainstormed solutions on the found problems and needs. Literature research was conducted about customisation, digital work environment and learning organisation. Research on customisation was used to understand the background and the challenges with it. The digital work environment consisted of the effects of digital work as well as research on how to design and implement a digital work environment. Research on learning organisation was used to support the presented needs and proposed improved work patterns. The mapping of the current state showed that it is a quick process that affects a lot of people who together quickly must assess if and how the orders are and will be possible to deliver. A coordinator at the engine assembly must make sure that the right people are informed and involved meanwhile these people have been shown to lack understanding of the process its responsibilities and activities, resulting in e.g., worry and stress. To improve the process, a proposition was made on focusing on improving the transfer of knowledge and experience, create a common understanding and approach and improve communication and collaboration. Four concepts were presented where the focus was on learning organisation, continuous improvements and based established methods used at the engine assembly.

Yoon, Hee-Cheol. "Word order and structure of Old English : with special reference to Ælfric’s Catholic Homilies." Thesis, University of Edinburgh, 2002. http://hdl.handle.net/1842/23276.

Full text
Abstract:
The aim of the study is to analyze word order of Old English in terms of the minimalist framework suggested in Chomsky (1995-2000). Old English data for the analysis are mainly drawn from Ælfric’s Catholic Homilies, which is most likely to represent the language spoken in Anglo-Saxon England around the end of the 10th century. According to Kayne’s (1994) version of universal base hypothesis, the analysis assumes that Old English has head-initial structure for every projection. It is therefore presupposed that linear order in Old English is closely related to structural hierarchy determined at syntax. The study suggests that Old English ordering patterns other than the base one result from uninterpretable feature-driven operations. However, economy considerations under the minimalist framework require an additional uninterpretable feature to force a costly operation of movement. Those optional features indispensable for movement are generalized in the study depending on the type of movement: the [+Affix] feature for head movement and the EPP features for XP movement. The postulation of the [+Affix] feature forcing affixation provides a unified account for various head movement-type operations in Old English. The optional nature of the feature in a derivation accords with optionality in head movement in Old English, which denies the traditional head-final hypothesis presuming a fixed position for finite verbs both in main and subordinate clauses. It is therefore no longer necessary to introduce empirically and conceptually unmotivated assumptions including string-vacuous verb movement, various types of extraposition, and the clitic analysis of personal pronouns based on head movement. The head movement analysis suggested in the study accounts for various positions of finite verbs in main and subordinate clauses, the distribution of verb-particle constructions, and all the ordering patterns in verbal complexes.

Scanlon, Regina M. "Improving Individualized Educational Program (IEP) mathematics learning goals for conceptual understanding of order and equivalence of fractions." Thesis, University of Delaware, 2013. http://pqdtopen.proquest.com/#viewpdf?dispub=3594968.

Full text
Abstract:

The purpose of this Executive Position Paper project was to develop resources for improving Individual Educational Program (IEP) mathematics learning goals for conceptual understanding of fractions for middle school special education students. The investigation surveyed how IEP mathematics learning goals are currently determined and proposed a new approach. It demonstrated how the approach would work through a pilot project in which two tools were developed: (1) a list of learning goals for goal writers to use as a reference when writing mathematics learning goals for middle school special needs students and (2) an assessment linked to the goals that would determine whether or not a student has achieved the goals. A description is given of the process that combines knowledge from research literature and information from instructional practice and that continually refines the products.

For this pilot project the learning goals were focused on order and equivalence of fractions. The goals were identified through a review of educational literature and examination of several sources related to practice for teaching fractions. Assessment items were then developed for the goals. Four experts reviewed the learning goals and assessments for content and clarity and the assessments for validity. Based on their feedback, edits were made to both the learning goals and the assessment items. Four middle school teachers field tested the assessment with their students. Analysis of student work confirmed that the assessment revealed detailed information on individual students' strengths and weaknesses in conceptual understanding of order and equivalence of fractions and that appropriate learning goals could be selected as a result of the assessment.

Final recommendations include expanding the project to additional math content and other grades and developing instructional lessons and resources linked to the learning goals that teachers could use to help students achieve the learning goals. Additionally, it is recommended that a system of continual improvement be incorporated into the process of further development.

Patrick, Wanda Pearl. "Teacher Perception of Technology as a Conduit to Acquiring Critical Thinking Skills." ScholarWorks, 2016. https://scholarworks.waldenu.edu/dissertations/2420.

Full text
Abstract:
Seventh-grade and eighth-grade special education students struggle to learn higher-order thinking skills in pre-algebra and algebra that can be addressed by using technology. However, little is known about science, technology, engineering, and math (STEM) teachers' attitudes toward use of and their actual use of calculators and technology to access students' development of higher-order thinking skills. The purpose of this qualitative case study was to explore the perceptions of rural middle school Grade 7 and 8 STEM teachers in one Western state. This study used Gardner's multiple intelligences and Armstrong's neurodiversity theories as a framework. Participants were 10 Grade 7 and 8 STEM teachers in a Western state. Data sources included interviews, surveys, and teacher journals. Open coding allowed the identification of similar threads, common words, or expressions that were then examined for themes and patterns. The emergent themes included a need for training, teachers' technological expectations, and whether teachers could meet grade level standards and students have success. This study assists social change by informing school administrators and teachers how technology is and is not being used in the classroom and how its use can be facilitated in the future.

Abstract:
The thesis begins with a critical comparison of the philosophy of Michael Polanyi, John Macmurray, Karl Popper and Albert Einstein. This serves to highlight several important features of Michael Polanyi's philosophy which are of relevance. From this preliminary discussion of Michael Polanyi's philosophy it becomes clear that certain ultimate beliefs underly all scientific work - a belief in order, a belief in its contingent singular nature, and a belief that we can know that order. The ultimate beliefs found in the scientific community are paralleled by a similar set of beliefs in the Christian community, and this community is itself ordered by principles which this thesis would maintain are equivalent to those found in t The prayers and worship of the Christian community, by which we come to know the divine order, are then compared and contrasted with scientific research, by which we come to know nature's order. This leads on to a discussion of miracles.

Young, Peter John. "Punishment, money and legal order : an analysis of the emergence of monetary sanctions with special reference to Scotland." Thesis, University of Edinburgh, 1987. http://hdl.handle.net/1842/12247.

Full text
Abstract:
This thesis is a study of monetary sanctions, in particular the fine, set in the broader context of the relationship between punishment, money and legal order. The purpose is to analyse the way in which money enters into penal relations. The thesis is divided into two main parts, the first of which begins by identifying a paradox in the structure of contemporary, sociological explanations of punishment. This paradox may be rendered thus; why is the fine much used but little studied? Why do contemporary sociological accounts endeavour to explain the penal system with little or no reference to the most commonly used of all penal sanctions, the fine? A number of factors accounting for this paradox are suggested, but most important of all, it is argued, the paradox reflects a broader, cultural estrangement of punishment from money. By this is meant that money is unable to fulfil our cultural expectations of what punishment ought really to be like. The nature of this process of estrangement is explored via an analysis of why, in serious crimes like rape, fines are seen as inappropriate sanctions. It is argued that this process of estrangement captures both an historical process and a contemporary reality. Historically, money was once used to deal with the full range of crimes and offences. However, for reasons which are explained, this relationship has been shattered. In the modern penal system, punishment and money are estranged. The phenomenon of estrangement is clearest only at a certain level of the penal system - that level at which grand claims for its legitimacy are debated and discussed. Beneath this, the system relies on the fine in an increasing number of crimes and offences. The second part of the thesis uses concrete, empirical data, gathered by a variety of methods, to explore the place of the fine in the contemporary Scottish criminal justice system. The explanation is carried out in the light of the more general themes developed in the first part of the thesis. By analysing official data, it is shown that fines are now used in fairly serious crimes, particularly the property ones. The thesis then turns to an examination of how a group of sentencers, sheriffs, use the fine. This analysis is conducted by using data collected by the interview method. The thesis concludes by considering the significance of its findings for the contemporary sociology of punishment and for our understanding of modern penal practice.

Shimasaki, Katsuomi. "Focus structure in Biblical Hebrew : a study of word order and information structure with special reference to Deuteronomy." Thesis, University of Gloucestershire, 1999. http://eprints.glos.ac.uk/3323/.

Full text
Abstract:
This thesis examines the word order of Biblical Hebrew from the perspective of Information Structure, specifically in the articulation of a theory of focus structure. To focus is to mark an item as informationally prominent. The thesis proposes that 1) in Biblical Hebrew focus is expressed by word order and by pitch prominence; 2) the clause-initial position is marked for focus for both nominal and verbal clauses; 3) and Biblical Hebrew has three major clause types: (P represents predicate including verb; X represents an argument, a cover-ten-n for non-predicate elements. Capitals mark. focus indicated by word order and/or high pitch. ) a) Px Predicate-Focus Structure adds new information preferably to an active or accessible referent( commenting); b) Xp Argument-Focus Structure relates X with the missing argument of a presupposed proposition (identification); c) XP Clause-Focus Structure indicates that the clause has pragmatic implication(s) other than commenting and identification. These implications include (information level): activation of inactive referents; introduction of a brand-new referent; (inter-clausal level): exclamation/proclamation, contrast of the whole proposition, circumstantial clause; (text-unit level): onset functions, background information, climax and closure; and finally parallel construction and list structure. Most of these implications show non-sequentiality to or independence of the preceding texts informationally, temporally or logically. The thesis also explores the relationship between emphasis, intensification (loud voice), contrast, focus and word order. Emphasis is achieved through various means which include intensification (loud voice) and implicit contrast. Contrast is created not by fronting but only by the presence of the contrastive members (either explicit or implicit). Contrast belongs to contextual implicatures not to syntax. Intensification belongs to prosody not to syntax. Only focused constituents are contrasted or intensified. Detection of intensification (loud voice) in written texts is highly subjective.

Artamonova, Maria. "Word Order Variation in Late Old English Texts: With Special Reference to the Evidence of Translations and Revisions." Thesis, University of Oxford, 2007. http://ethos.bl.uk/OrderDetails.do?uin=uk.bl.ethos.486970.

Full text
Abstract:
The aims of the thesis are threefold: to investigate the amount of syntactic variation in late Old English prose texts; to assess the relation of these texts to their Latin originals and their usefulness for studies of Old English word order; and, finally, to describe individual stylistic peculiarities of these texts _and their impact on the resulting formal descriptions. The study focuses on two main kinds of text: Old English translations from Latin (including continuous glosses), which allow a close comparison of Latin and English wordorder principles; and revisions or adaptations of earlier Old English texts, which allow analysis of the changes made by different vernacular writers. The key text for the analysis is the Old English Rule of St. Benedict, its subsequent revisions and the comparable contemporary texts like the Rule of Chrodegang and the Capitula Theodulfi. A number of other texts, ranging from Early Old English to Early Middle English, have also been discussed. Each text has been subjected to a close analysis which considers the distribution of word order patterns within a wider context involving the circumstances of composition, c9Pying and revision, the relation of the texts to the manuscripts they survive in, the possible aims of translation/revision, and (for translated texts) the amount of our knowledge concerning the possible original. The method therefore entails both the presence of a large representative corpus and a detailed analysis combining the linguistic and philological data with the information from palaeography and textual history. The main conclusions that follow from such an analysis are that large-scale variation can be observed even within a narrow genre of ecclesiastical rule. iEthelwold's translation of the Rule of St. Benedict emerges as a text whose idiosyncratic word order cannot be attributed to the influence of the Latin original or any other factors apart from personal style. It is also significant that although attempts have been made to revise this translation, its word order was largely left intact. . Another important conclusion is that only a few syntactic peculiarities of the Old English translations can be attributed to the influence oftheir Latin originals. Even with rare and unusual patterns, Latin influence can be at most questionable. Thethesis is written within the framework of traditional grammar. Its ultimate aim is to provide information and material to as wide an audience as possible, including scholars of literature, historical linguistics and comparative philology, whatever their theoretical_background may be. It takes into account studies by both traditional and generative grammarians, including the most recent work, but it does not make any commitments to Particular theories.

Abstract:
Thesis advisor: Lynda Lytle Holmstrom
Rape is a socially constructed behavior used in patriarchal societies to devalue women and ensure male supremacy. Being socially constructed means that the definition of rape can change. This thesis addresses the question of whether an established institution—television—can promote a more progressive definition of rape and help delegitimize it. It uses a feminist content analysis to examine the main themes on 14 episodes of Law and Order: Special Victims Unit (SVU) aired from 2012-2015. It is qualitative and inductive in nature, approached from a grounded theory perspective. The data demonstrate that SVU does, to some extent, present a more progressive view of rape instead of perpetuating the common stereotypes of rape. Essentially, SVU represents a new variety of definitions of rape that are reflective of white, privileged, heterosexual and young women's experiences in the United States. Race, class, sexual orientation and identity are barely taken into account even though many social inequalities based on them characterize American life

Morgan, Eric Raymond. "The Mennonites and the Amish : a critique of religious conservatism with special reference to the Old Order Amish in Pennsylvania / Eric Raymond Morgan." Thesis, Potchefstroom University for Christian Higher Education, 2002. http://hdl.handle.net/10394/896.

Full text
Abstract:
The concept of religious conservatism is related to the faith of the Anabaptists in early 16Ih century Switzerland, Germany and Holland as developed by the Swiss Brethren, maintained and developed by the Mennonites and Amish in Europe and thence into the USA, especially in Pennsylvania. Tenets of the faith are revealed in these peoples' actualised theology as they have long unyoked themselves from the outside world and formed a free church. The continuity of the faith is traced through a number of Confessions of Faith since 1527. The purity of the redemptive community is ensured by the order or 'ordnung' and its demands are known to those undergoing adult baptism. Different interpretations of the ordnung and the strictness of the ban on sinners have resulted in schisms since Menno Simons and Jacob Ammann. The faith has remained firm in spite of schisms also resulting from reactions to technological changes and pressures from the outside world. Conservative attitudes are revealed in these groups' old-fashioned distinctive simple clothing, hair, beards, head covering and transport. Pacifism and 'gelassenheit', the yielding to God's Will and that of the congregation, add to this distinctiveness and conservatism. The great number of schisms among the Mennonites reveal differences in imposing the 'ban', shunning (or meidung) or excommunication and the degrees of rejection of contemporary material changes (e.g. automobiles, telephones, mains electricity). The most conservative are the 'Old Orders'. The selection of ministers (by the 'lot') and their roles are examined and continuity is emphasised by the practice of feet washing (insisted by Arnrnann) and singing hymns from a mid- 16th century hymnal, the Ausbund. Numerous references from the New Testament are quoted in justification of their religious beliefs within an actualised theology and the relationship between congregations and baptised believers is also addressed in some detail. Their possible future as religious groups may be conjectural in a world so inimical to so many of their beliefs. They remain a powerful witness to His word in spite of their small numbers. Observations of and conversations with many of these people over the past thirty years confirm their personal characteristics outlined in the thesis. Through their religious beliefs, their actualised theology and steadfastness in living their beliefs, they can contribute an understanding of the contemporary world by offering their religious conservatism as exemplifying their belief in witnessing a comer of God's Kingdom. The underlying paradoxes in their lives must, however, be fully appreciated. The thesis is that the nature of their long-held beliefs, discipline and gelassenheit brings fulfilment and a witness to the outside world. Their steadfastness makes acceptable the many paradoxes in their lives, reflecting a need to react constantly to outside pressures without undermining the faith.

Digital Commons @ East Tennessee State University, 2007. https://dc.etsu.edu/etsu-works/7521.

Abstract:
Boundary value problems in PDEs usually require determination of the eigenvalues and Fourier coefficients for a series, the latter of which are often intractable. A method was found that simplified both analytic and numeric solutions for Fourier coefficients based on the slope of the eigenvalue function at each eigenvalue (eigenslope). Analytic solutions by the eigenslope method resulted in the same solutions, albeit in different form, as other methods. Numerical solutions obtained by calculating the slope of the eigenvalue function at each root (hand graphing, Euler's, Runge-Kutta, and others) also matched. The method applied to all classes of separable PDEs (parabolic, hyperbolic, and elliptical), orthogonal (Sturm-Liouville) or non orthogonal expansions, and to complex eigenvalues. As an example, the widespread assumption of uniform capacitance was tested. An analytic model of cylindrical brain cell structures with an exponential distribution of membrane capacitance was developed with the eigenslope method. The stimulus-response properties of the models were compared under different configurations and shown to fit to experimental data from dendritic neurons. The long-standing question was addressed of whether the amount of variation of membrane capacitance measured in experimental studies is sufficient to markedly alter the vital neuron characteristic of passive signal propagation. We concluded that the degree of membrane capacitance variation measured in cells does not alter electrical responses at levels that are physiologically significant. The widespread assumption of uniform membrane capacitance is likely to be a valid approximation.

Abstract:
It seems that from the inception of western civilization as we know it the question of the nature of our time has been prominent. In fact, Sherover has claimed that “it was concern with the nature of time and change that first provoked the Western development of rational thinking about the world…” Thinking about time, though, has experienced the ebb and flow of history that is typical of any subject, where at certain epochs the issue was more recognized than at others. Among the many important contributions of twentieth century thought has been a renewed interest in the nature of time and the correlate to this phenomenon has been the resurgence within Christian thought of the relationship of God and time.

Abstract:
The existence of police forces in the French Concession was not planned under the basic articles that regulated the foreign settlements in China. The police came into existence at a time when Chinese local authorities were paralyzed during the Taiping and Small Sword rebellions in the city. The police came into being as a fait accompli. The French police underwent a process of militarization and professionalization under the leadership of Mallet, Fiori and Fabre to cope with the new challenges in Shanghai. At the end of this process, the police of the French Concession was fine and complex modern police force. The police were composed of officers from several nationalities, the four most important being French, Russian, Chinese and Vietnamese. Through a comparative study of recruiting conditions, training courses, salaries, welfare and job turnover, I establish that the police was a hierarchal institution based on a differentiated treatment according to race and nationality. The police forces adjusted their strategy of spatial control to the three successive expansions of the territory of the French Concession. By controlling the urban space, the police not only helped develop a civilized and ordered Shanghai Frenchtown, but it also created the special cultural character of the French Concession in Shanghai. From the 1920s to the 1930s, nationalism, communism and Japanese expansionism met in Shanghai and led to the creation and development of the Political Service of the French police force

Abstract:
Flexibility in housing has been studied and implemented both in Europe and North America. However, there is a need for more research on which spaces in the home and which elements in those spaces require flexibility to accommodate all phases of the family life cycle. The particular spaces in a single-family home requiring this flexibility were determined in five case studies covering a minimum span of 15 years of the family life cycle. The spaces that underwent changes most frequently were dens, studies and recreation rooms. Bedrooms changed frequently only when there were crowded conditions or when residents were unhappy with the status quo. Through a review of the physical limitations of the elderly, it was determined that a sensitive application of accessibility standards in all homes would extend the usefulness of the homes as the occupants enter the final stage of the life cycle.

Baker, Bruce D. "The transformation of persons and the concept of moral order : a study of the evangelical ethics of Oliver O'Donovan with special reference to the Barth-Brunner debate." Thesis, University of St Andrews, 2010. http://hdl.handle.net/10023/975.

Abstract:
This dissertation investigates the evangelical ethics of Prof. Oliver O’Donovan in order to explore the implications of his “evangelical realism” for theological anthropology, moral knowledge and the concept of moral order. The Barth-Brunner debate regarding natural theology provides a lens onto these issues. Theological case studies are used to test our findings. Chapter 1 provides an overture to these issues, paying attention to current ideas about human nature and morality, and the growing influence of neuroscience and evolutionary psychology. Chapter 2 focuses on Resurrection and Moral Order, elucidating the salient factors in its outline for evangelical ethics. Chapter 3 diagnoses the challenges which a dialectical epistemology presents to the development of a doctrine of evangelical ethics. Chapter 4 delves into O’Donovan’s treatment of the Barth-Brunner debate over natural theology, and discovers therein an illuminating correspondence between O’Donovan’s ethics and the concept of a human “capacity for revelation” (Offenbarungsmächtigkeit), which became a hinge issue in the debate. This provides a helpful lens onto O’Donovan’s concept of moral order. Chapter 5 examines the intrinsic connection between the concept of moral order and the epistemic role of faith. Kierkegaard’s treatment of the paradoxical aspects of faith as an event of epistemic access figures prominently in this analysis. Chapter 6 brings together the results of our analysis and applies them to the thesis that: the transformation of persons lies at the heart of evangelical ethics. The cosmology of faith emerges as a critical hermeneutical factor in the development of a doctrine of evangelical ethics. We explore here the doctrinal implications for Trinitarian theology. Chapter 7 draws out practical implications of our thesis. We see the central place of prayer and worship in evangelical ethics, and point out implications for teaching. Lastly, we show practical applications of our thesis by examining the bio-ethical issues of human reproductive technologies, with special attention to O’Donovan’s work, Begotten or Made?

Abstract:
The Order of Fontevraud, founded in 1100 by the hermit/preacher Robert of Arbrisssel was the only twelfth-century women's order incorporating into its structure a group of chaplains and lay brothers whose specific role was to serve the nuns. This thesis examines the origins of the order and demonstrates that the English foundations were a stage in its development, closely linked to its Angevin connections. Each of the two houses established in England c.l 150 was founded and patronised by supporters of Henry Plantagenet. Westwood, founded by the de Say family, lesser barons from Herefordshire, received a modest endowment. Nuneaton, founded by the magnate Robert, earl of Leicester, was richly endowed. Twenty years later Henry II expelled the Benedictine community from Amesbury replacing it with a group from Fontevraud, thus founding the third house. A fourth, Grovebury, is not treated; it was never a foundation for women. I have studied the process of endowment and shown that the wealth and status of the founder in no small measure determined the future prosperity of the foundation. The internal organisation of the Fontevraud houses has been explored, in particular the balance between local autonomy and dependence on the mother house. As well, I have examined recruitment and shown that this, too, reflected on the circumstances of foundation. My main focus has been on the economy of these three houses, their income and expenditure and the exploitation of their assets. The nuns are seen as a group of women who were dynamic and creative in managing their affairs. This has not precluded an investigation into the spiritual, and in particular, the liturgical dimension of life in the English foundations. Fundamentally the Order of Fontevraud is presented as an opportunity for noble women of England in the twelfth and thirteenth centuries to live religious life in a new order, one renowned for its strict interpretation of the Rule of St Benedict and for the prayerfumess of its members, and one in which women were manifestly in control of their own destinies.

Abstract:
This study focused on how teachers' planning and teaching methods changed after they acquired more confidence in applying differentiated strategies in their instructional units. Teachers were given a questionnaire about their skills, qualifications and teaching beliefs comparing teaching general education students and gifted education students within the typical classroom setting. Then teachers received several professional development opportunities within the school year exposing them to different forms of differentiation. Time was given between trainings so that teachers would have ample time to integrate what they learned into their planning and instructional design. At the end of the study, teachers were given another questionnaire, similar to the first one, where they had to rank themselves on skills, education, and teaching methods for general education students and gifted students after the professional development. Comparisons between the two questionnaires showed that teachers were more confident in how to meet individual students' needs through differentiation after the trainings than before the study. In fact, before the study, 50% of teachers reported that the needs of gifted students are not being met in the general classroom setting; but, after the study, that number dropped to only 6%. Because teachers felt more confident in their abilities to teach gifted students in the traditional classrooms, the students' needs were addressed.

Abstract:
In dialogue with the national and international contexts of mass imprisonment and criminal justice systems crisis, the Juizados Especiais Criminais (Special Criminal Courts) emerge in Brazil with two scopes: reducing the complexity of minor crimes procedure without stop punishing minor crime even in a soft way. By using horizontal and flexible intervention procedures in which it creates, theoretically, an exchange of interests between criminal justice and conflict parts, favoring a quickly and less painful answer for both parts, this kind of doing justice has been called by bargaining justice. Through ethnography of the Special Criminal Courts of Sao Bernardo do Campo, the research aimed to understand the meanings of punishment mobilized on these bargaining situations. The research revealed that these situations are influenced by the process of affirmation of professional identities in the justice field, especially the prosecutor\'s identity which leadership in these special courts creates a particular dynamic centered on the criminal punishment and not on the conflict mediation. The ethnographic approach of the special courts hearings also made possible verifying the predominance of a system of sanctions attribution characterized substantially by management strategies and also by classical theories of punishment. In this influence play, the forms of punishment that prevail are mainly monetary sanctions and only barely community service. To understand the reasons for the lack of community service application, the research had a second ethnographic moment at the Center of Alternative Punishments and Measures of Sao Bernardo do Campo. Thus, it was possible to verify that the lack of confidence about this kind of punishment is related to the challenges of making the community service mandatory, a reliable punishment for prosecutors and judges. The dissertation concludes that the sanction system mobilized in the bargaining justice, theoretically an alternative justice, keeps a traditional semantic of suffering even in a soft way.

The present work examines the prequestionamento and, principally, analyses if matters of public order could be known in the judgement of Extraordinary Appeals to the Supreme Court and Special Appeals to the Superior Court of Justice. Firstly, it is studied the Constitutional Model of these Extraordinary and Special Appeals, talking about the history of the High Courts and how these appeals came out and were defined by the Brazilian Federal Constitutions. The general theory of the Extraordinary Appeals is analysed with its requirements of admissibility. The devolutive and transferable effects are studied to show that Extraordinary and Special Appeals do not have the last one. The idea of the complete motivation of the decision is an important topic of the work. The appeal of requesting clarification of a decision is studied in this context. The preclusion, definition and examples of matters of public order are examined too. It was possible, after this work, to verify that the constitutional rules must be observed and they determine that it must exist decided cause about the issue at the appealed decision. The knowledge of matters of public order by the High Courts depends on it, because the Constitution does not make exceptions. The function and the purpose of the Supreme Court and the Superior Court of Justice, the objectives of the Extraordinary Appeal and the Special Appeal, their requirements and the importance of the uniform interpretation of the Federal Constitution and the Federal Laws are topics to which special focus was given

Abstract:
An optimal solution of vortex-induced vibrations of structures would be a time-domain numerical simulation that simultaneously solves the fluid flow and structural response. Yet, the requirements in terms of computing power remains a major obstacle for implementing such a simulation. On the other hand, lower- or reduced-order models provide an alternative for determining structural response to forcing by fluid flow. The objective of this thesis is to provide a consistent approach for the development of reduced-order models for the lift and drag on oscillating cylinders and the identification of their parameters. Amplitudes and phases of higher-order spectral moments of the lift and drag coefficients data are combined with approximate solutions of the representative models to determine their parameters. The results show that the amplitude and phase of the trispectrum could be used to model the lift on the oscillating cylinder under different excitation conditions. Moreover, the amplitude and phase of the cross-bispectrum could be used to establish the lift-drag relation for oscillating cylinders. A forced van der Pol equation is used to represent the lift on a transversely oscillating cylinder, and a parametrically excited van der Pol equation is used to model the lift coefficient on an inline oscillating cylinder. All cases of excitations lead to close values for the damping and nonlinear parameters in the van der Pol equation. Consequently, and as shown in this thesis, different excitation cases could be used to identify the parameters in the governing equations. Moreover, the results show that the drag coefficient could be derived from the lift coefficient through a square relation that takes into account the effects of the forced motions.

Abstract:
An implicit finite volume algorithm is developed for higher-order unstructured computation of inviscid compressible flows. The Spectral Finite Volume method is used to achieve high-order spatial discretization of the domain, coupled with a matrix-free LU-SGS algorithm to solve the linear systems arising from implicit time marching of the governing equations, avoiding the explicit storage of the flux Jacobian matrices. A new limiter formulation for the high-order terms of the reconstruction polynomial is introduced. The issue of mesh refinement in accuracy measurements for unstructured meshes is investigated. A straightforward methodology is applied for accuracy assessment of the higher-order unstructured approach based on entropy levels and direct solution error calculation. The accuracy, fast convergence and robustness of the proposed higher-order unstructured solver for different speed regimes are demonstrated via several known test cases from the literature for the 2nd-, 3rd- and 4th-order discretizations. The possibility of reducing the computational cost required for a given level of accuracy using high-order discretization is demonstrated. The main features of the present methodology include the reconstruction algorithm that yields 2nd-, 3rd- and 4th-order spatially accurate schemes, an implicit time march algorithm, high-order domain boundaries representation and a hierarchical moment limiter to treat flow solution discontinuities.

Abstract:
The aim of the thesis is to evaluate the specificity of general and special polices in french administrative law. The first part studies the characteristics of the competence of general police and those of the competence of special police, and acertains that these two expressions represent two different legal realities. Thus the general police appears to be based on an implicit standard of empowerment general public order, which gives it certain characteristics (the conservative, liberal and general character of the empoverment, to act insofar as the preservation of order requires). The special police is always based on an explicit text, which has at least a legislative origin, it represents the assertion of public power within the limits of the principle of specialty. The second part deals with the specificity of the regime of each competence. It shows that the polices do not present an entire specificity (with respect to one an other) and that the exercise of the police as a whole sees its specificity diminish with respect to the other administrative activities. Therefore we notice a small specificity in the decisions of the police, that the jurisdictional control of legality is amply suited to the nature of each police and that a relative specificity of the regime of responsability is maintained

Abstract:
This study examined how Florida administrative law judges (ALJs) constructed an appropriate education for students with disabilities in their final orders. This study utilized the Johnstone Method as a heuristic in analyzing the data. It examined the construction of an appropriate education from the implementation of PL 94-142 up to the U.S. Supreme Court decision in Board of Education v. Rowley (1975-1978), after the Rowley decision (1983-1986), and after the reauthorization of the Individual with Disabilities Education Act in 2004 (2004-2007). Each time period was examined individually and then the results were compared. The data sources included six purposively sampled final orders obtained from the Florida Division of Administrative Hearings and the Florida Department of Education. Two final orders per time period have been examined. For each time period, one final order with the school district as the prevailing party and one with the parent as the prevailing party were selected. Immersive line-by-line coding, and grounding of claims in specific textual evidence have been utilized to establish trustworthiness. The results indicate that during the period pre-Rowley, ALJs constructed an "appropriate" education based on the needs of the child and the special education program proposed to meet those needs. Deference was not given to one party over the other and the ALJ used his or her judgment in helping to construct an appropriate education. After the U.S. Supreme Court decision in Board of Education v. Rowley (1982), experts were charged with constructing an appropriate education for students with disabilities. This decision established an epistemic hierarchy that gave deference to school districts over parents. Outcomes were not considered by ALJs in constructing an appropriate education post-Rowley. The purpose of special education as outlined in IDEA (2004) had no impact on the construction of an appropriate education for a student with a disability; instead the Rowley decision impacted the time period post-IDEA (2004). Throughout the three time periods, the ALJs all emphasized that school districts are not required to provide the "best" education to students with disabilities.

Abstract:
Virus recognition by visual examination of electron microscope (EM) images is time consuming and requires highly trained and experienced medical specialists. For these reasons, it is not suitable for screening large numbers of specimens. The objective of this research was to develop a reliable and robust pattern recognition system that could be trained to detect and classify different types of viruses from two-dimensional images obtained from an EM. This research evaluated the use of radial spectra of higher order spectral invariants to capture variations in textures and differences in symmetries of different types of viruses in EM images. The technique exploits invariant properties of the higher order spectral features, statistical techniques of feature averaging, and soft decision fusion in a unique manner applicable to the problem when a large number of particles were available for recognition, but were not easily registered on an individual basis due to the low signal to noise ratio. Experimental evaluations were carried out using EM images of viruses, and a high statistical reliability with low misclassification rates was obtained, showing that higher order spectral features are effective in classifying viruses from digitized electron micrographs. With the use of digital imaging in electron microscopes, this method can be fully automated.

Abstract:
A major objective in speech coding is to represent speech with as few bits as possible. Usual transmission parameters include auto regressive parameters, pitch parameters, excitation signals and excitation gains. The pitch predictor makes these coders sensitive to channel errors. Aiming for robustness to channel errors, we do not use pitch prediction and compensate for its lack with a better representation of the excitation signal. We propose a new speech coding approach, Vector Sum Excited Cascaded Linear Prediction (VSECLP), based on code excited linear prediction. We implement forward linear prediction using five cascaded second order sections - parameterized in terms of line spectral frequency - in place of the conventional tenth order filter. The line spectral frequency parameters estimated by the Direct Line Spectral Frequency (DLSF) adaptation algorithm are closer to the true values than those estimated by the Cascaded Recursive Least Squares - Subsection algorithm. A simplified version of DLSF is proposed to further reduce computational complexity. Split vector quantization is used to quantize the line spectral frequency parameters and vector sum codebooks to quantize the excitation signals. The effect on reconstructed speech quality and transmission rate, of an increased number of bits and differently split combinations, is analyzed by testing VSECLP on the TIMIT database. The quantization of the excitation vectors using the discrete cosine transform resulted in segmental signal to noise ratio of 4 dB at 20.95 kbps, whereas the same quality was obtained at 9.6 kbps using vector sum codebooks.

Aubin-Brouté, Raphaèle-Jeanne. "Le contrat en agriculture." Thesis, Poitiers, 2013. http://www.theses.fr/2013POIT3014.

Full text
Abstract:
Contracts concluded by the farmer for the satisfaction of its professional needs form a family of contracts : all have part in the public action in agriculture. Their common identity is methodological. The contract is a legal instrument of the agricultural policy. All its utilities are mobilized for protecting the farmer or managing the agriculture. The special law of the agricultural contracts allows the penetration in the legal act of the value system chosen by the State. The contractual public order in agriculture also shows itself by an action of police of the contract. The contract in agriculture is not only an object of the public action : it is also one of its modalities. The contractualization shows itself at first by a joint production of the legal rule, with the State or between professionals. It shows itself then by the research for the consent in the standard, specially environmental. The contractual speech justifies the public action in agriculture. The agro-environmental contract allows the public remuneration for an ecological or territorial performance supplied by the farmer. This thesis brings to light a deep change of paradigm in the agricultural policy. While the law of the exploitation is absorbed, partly, by that of the company, an original legal corpus appears which proceeds of the new multifunctional identity recognized by the agricultural activity. This thesis also reveals the methodological sliding which takes place of the private contractual law forced by the public law towards the public law produced by contract
