Abstract:
Since the nineteen-forties figurative painting formed a major aspect of the work of Olivia Spencer Bower. Recently historians and feminist artists concerned with the relation between gender and art have drawn attention to how her identity as a woman has influenced her figurative painting in both the selection and treatment of themes. This thesis attempts to explore in detail the close connection between Spencer Bower's life experiences and her painting by concentrating on an examination of three principal series, the Rawene mother and child works, 'Getting About' and the Spinners. Chapter One examines the first major extended figurative series, which was produced when Spencer Bower, relieved of domestic duties, lived for a period in the small town of Rawene in 1948. The series constitutes an examination of the theme of motherhood and research into the circumstances of their production has revealed the extent to which social and political considerations at the time circumscribed her interpretation of the theme. The series discussed in Chapter Two studies elderly women and the process of growing old and has been shown to stem directly from her experiences of caring for her mother during the fifties. Her painting is related to work by other New Zealand women artists who have examined the theme by drawing on their observations and life experiences. Chapter Three examines the last and most extensive of the figurative series, the Spinners, produced during the sixties and seventies and related to her work of the previous decade. An analysis of the series reveals how it constitutes an extensive examination of the relationships between women and between women and the land. Spencer Bower was unusual among women artists of her generation because she expressed an awareness of a relation between her gender and art. This is supported by the connection established between her life and painting.

Es por ello que esta investigación propone una gestión de recursos humanos basada en competencias personales de la mano de obra, con el objetivo de capacitar y mejorar el desempeño de los trabajadores para aumentar la productividad y lograr un vínculo laboral positivo. Se comenzó el diagnóstico de la empresa, iniciando una breve charla con el gerente de la compañía el cual explico detalladamente el problema que más se suscitaba en la organización era el del desempeño de los trabajadores, por ello es conveniente enfocar la investigación utilizando el modelo Spencer y Spencer el cual está basado a la gestión por competencias, orientado a las características de trabajo, que posterior al comienzo de su aplicación se lograra el aumento de productividad, personal más especializado e identificado con la organización.

Abstract:
Psychobiography is a qualitative approach to exploring and understanding the life story of an individual through the lens of psychological theory. The application of theory is typically conducted on the finished lives of well-known or enigmatic people. This study explores and describes the psychological development across the lifespan of Winston Leonard Spencer Churchill, by applying the Individual Psychology of Alfred Adler. Winston Churchill voted the greatest Briton of the twentieth century, was an author, painter, adventure, soldier, politician and Prime Minister that led the United Kingdom during World War Two. Extensive data has been examined in this work to ensure an accurate description of Winston Churchill‘s life. Alexander‘s model of identifying salient themes was used to analyse the data within a conceptual framework derived from the theory. Churchill‘s difficult childhood motivated him to succeed, his passion for the nation of Britain and his dislike of the Nazi regime meant that Churchill was always abreast with current affairs, anticipating every possible scenario of attack. When the time came to fight the Nazi‘s Churchill was ready to die for his country. The research findings highlight Churchill‘s ability to rise above his childhood stigmas and surpass all expectations and so cementing his name into the history of a country he loved and a democratic world he hoped for. Alfred Adler‘s Individual Psychology proposes that an individual‘s potential weaknesses can be used as a means to strive and achieve greatness within their sphere of influence.

Abstract:
The Crib Mound Site (12 Sp 1-2) is a shell mound that contains a major Mid-Late Archaic element. This site has been largely destroyed over the past few decades as a result of erosion by the Ohio River, development, artifact collecting and blatant looting. Collections of artifacts from the mound, and much of the relevant information about the site, are located in the private sector. Only minimal artifact representations from Crib Mound reside in universities or museums.This site has received little in-depth professional investigation or study. Although it is one of several significant multi-component archaeological sites in the Lower Ohio Drainage with an indication of a significant Mid-Late Archaic component, it has not been accurately incorporated into discussions of Mid-Late Archaic settlement systems. The underlying reason for this omission relates to the information from the site not having been systematically recorded or synthesized into a usable format for archaeological research.This thesis analyzes, documents and evaluates the chronologically sensitive data from Crib Mound as a means of defining the mound's relationship to other (already documented) Mid-Late Archaic sites that are found in the region of theLower Ohio River Basin. This research also explores the relationship between tradition and phase (as it existed in this area), perhaps identifying an earlier phase or phases that can be distinguished from within the tradition. All information from the Crib Mound Site is integrated into the regional prehistory by either expanding on the anomaly of the mound or by clarifying and supporting the mound's relationship with the current regional settlement patterns.

Emanating from a large, gaseous star forming the center of the universe - commonly referred to as the sun - light colors the world. Light is a mystifying, transient element, a source of energy and life that has transfixed mankind for centuries. Also seduced by the wonders of light (and color) is contemporary artist, Spencer Finch. He has embarked on a quixotic mission of trying to measure, capture, and replicate the temporal qualities of light and color. His interest lies in capturing the fleetingness of the moments he experiences. To some extent Finch is successful in his impossible quest. Even in failure, his artworks become a vehicle for exploring the intricacies of human vision and perception. Mixing scientific inquiry and art, Finch utilizes remnants of the past - iconic sites and figures, famous literary texts, etc. - to reflect on personal memories and experiences. His artwork is a means of working out his own questions and ideas about vision and perception. By grounding his work in the known, Finch allows the viewer to enter and understand his works. Viewers are offered a unique chance to consider the ways in which the world is seen and understood. In the end, Finch hopes he is able to offer an almost out-of-body, or maybe just deeply insightful, experience in which vision is called into question, allowing an insight into understanding what it means to perceive.

This thesis explores the relationship between ideology generated by advocates of the Women's Liberation Movement and President Kimball's purposes of using Relief Society to strengthen Latter-day Saint (LDS) women. Navigating women through the societal attack on womanhood, President Kimball, and other general Church leaders during his administration (1973-1985), taught LDS women of their privilege and duty to the organization and the importance of generating strength through a sisterhood focused on service. Relief Society programs, procedures, and curriculum were evaluated, adjusted, and reinforced to deepen women's commitment to divinely established roles, to enhance women's doctrinal confidence, and expand the influence of women's leadership. The purpose of this thesis is to show how Relief Society strengthened LDS women's commitment to family and influenced increased cooperative efforts in defending families through Relief Society and priesthood organizations.

Bakgrund: EG-domstolens förhandsavgörande i Marks & Spencer målet har väntats utgöra ett efterlängtat besked kring problemen med gränsöverskridande resultatutjämning. Genom en prejudicerande verkan är domen betydelsefull för samtliga länder som tillämpar liknande koncernbidragsregler som Storbritannien och påverkar härmed även svenskt rättssystem.

Marks & Spencer fallet: I Storbritannien finns regler som möjliggör koncernbolag att utjämna vinster och förluster inom koncernen med villkoret att förlusten inte gäller ett utländskt dotterbolag. Marks & Spencer begärde att få göra just ett sådant koncernavdrag och menade att reglerna strider mot EG-fördragets fria etableringsrätt.

Syfte: Uppsatsens syfte är att klarlägga vilken betydelse EG-domstolens utslag i Marks & Spencer domen har för svensk rätt.

Metod: Uppsatsen tillämpar den traditionella rättsdogmatiska metoden, varmed avsikten är att beskriva, förklara och analysera gällande rätt.

Analys och slutsats: EG-domstolen konstaterar att den brittiska lagstiftningen strider mot etableringsfriheten, men att denna inskränkning är berättigad då syftet är legitimt och motiverat av tvingande hänsyn till allmänintresset. I det aktuella fallet strider det dock mot proportionalitetsprincipen att inte medge avdrag då det utländska dotterbolaget uttömt möjligheterna att i hemviststaten utnyttja förlusten i dåtid, nutid och framtid.

Domen efterlämnar ett tvetydigt budskap där den Europeiska Unionens önskvärda utveckling påvisas samtidigt som en mycket långtdragen rättfärdigandebedömning stärker medlemsstaternas suveräna skattesystem gentemot den inre marknadens fria rörlighet.

Någon omfattande revidering av svensk lagstiftning är inte aktuell utöver vad som gäller de mycket begränsade situationer som EG-domstolen anger. Påstötningen att den nationella lagstiftningen, under vissa kriterier, även skall omfatta koncernbolag med hemvist i andra medlemsstater visar dock vägen för en önskvärd utveckling som medlemsstaterna nu själva ansvarar för.

Esta investigación analiza la narrativa audiovisual en el formato videoblog de La Habitación de Henry Spencer (2007-2020). Asimismo, es una aproximación sobre la propuesta del videoblog, desde la narrativa audiovisual, la cual constituye una tendencia unitaria en la denominada “primera ola” de videoblogs en el contexto histórico de los nuevos medios digitales en la era de la web 2.0. La metodología empleada es la presente investigación es cualitativa. Se han seleccionado tres formatos representativos del videoblog (entrevista, crónica y perfil), junto con cinco videos publicados en su canal de YouTube, con el objetivo de revisar y analizar la técnica audiovisual, el guión literario, con el objetivo de establecer las tendencias en la producción audiovisual de este fenómeno comunicacional.
This research analyzes the audiovisual narrative in the videoblog format of La Habitación de Henry Spencer (2007-2020). Likewise, an approach will be provided on the proposal of the videoblog, from the audiovisual narrative, which constitutes a unitary trend in the so-called "first wave" of videoblogs in the historical context of the web 2.0 era. The methodology used in the investigation is qualitative. Three representative formats of the videoblog have been selected (Interviews, profiles y chronicles), along with five videos published on their YouTube channel, with the aim of reviewing and analyzing the audiovisual technique, the literary script and the journalistic guideline, with the objective of establishing trends in audiovisual production of this communication phenomenon.

Abstract:

The European Union (EU) is built on the principle of freedom of establishment, meaning that companies have the possibility to establish themselves as a company or by setting up a secondary establishment in other Member States. This right has been confirmed by the European Court of Justice through case law.

A basic feature in domestic tax legislation is that losses are allowed to be set off against profits when calculating the tax liability of a company. At the moment cross-border loss compensation within the EU is restricted, unfeasible or just accepted on a temporary basis. This lack of recognition of loss-offset gives the fact that double taxation may occur and claims form two or more national tax systems leads to uncertainty in the way a company will be taxed. Depending on whether the secondary establishment is a subsidiary or a branch, the rules relating to loss compensation differs.

Taxation of secondary establishments is based on the principle of whether or not they are considered as a resident or a non-resident of the state. In regards to taxation of secondary establishments, the PE is considered to be a non-resident and a subsidiary considered to be a resident. However, the European Court of Justice approach of non discriminatory treatment and equal treatment that has been developed and seen in the history of case law leads to the question if the Marks & Spencer ruling that concerned secondary establishments in form of subsidiaries can be applied to permanent establishments.

The most vital difference between a subsidiary and a permanent establishment is connected to the taxation of the two. The subsidiary is considered to become a resident of the establishing state while the permanent establishment is seen as a non-resident. This legal difference between the two leads to different treatment under tax law. Taxation under a tax treaty leads to the situation where one of the contracting states will either credit or exempt the income deriving from the permanent establishment. Permanent establishments are often taxed under the method of exemption.

In the Marks & Spencer case it was held that losses and profits were two sides of the same coin. Applying this statement to permanent establishments gives the notion that if a contracting state exempts an income, there will be a set off of the symmetry of having losses and profits within the same tax system. This lead to the fact that if applying the Marks & Spencer ruling on permanent establishments that are taxed under the exemption method, allowing terminal losses to be taken into account at the head office will set off the symmetry. Therefore it can be considered as the Marks & Spencer ruling shall not apply to permanent establishments.

With an increasing number of fashion retailers and textile manufacturers outsourcing products and extending their global supply base, risk management has gained significance in the textile and clothing supply chain in terms of: increasing flexibility and agility, achieving quick response and sustaining effective relationships with suppliers. However, there is limited research on risk management within this sector and even less empirical research conducted in this sector. This is quite surprising considering the volatile nature of this dynamic sector. Through the application of an in-depth single case study, this thesis explores the strategic role of risk and risk management in Marks and Spencer and examines key risk reducing strategies to sustain competitive advantage. The empirical findings from the case study provide some insightful results, particularly the inter-relationship between risk, design and supply network and their subsequent impact to a firm achieving competitive advantage.

Abstract:
This thesis is a study of the paintings of Stanley Spencer (1891-1959) and is designed to challenge received accounts of his work. Its theoretical perspective is that of 'cultural materialism' and its purpose is to place Spencer and his pictures within the social, cultural and political history of their time. It begins by outlining the four critical constructions of 'Stanley Spencer' that it challenges and by describing Spencer's somewhat oppositional location in the institutional complex of the artistic field. Then, rather than adopt a conventional chronological narrative, sets of paintings are studied in relation to their social context or historical moment. Here, several fresh arguments are advanced about particular aspects of Spencer's work. Thus, features of his landscape output are interpreted as at odds with a mainstream tradition sponsoring dominant notions of 'Englishness'; his original and politically charged solution to the problem of representing industrial labour is discussed; he is claimed as a Realist painter and his role, alongside others, as a sympathetic investigator of everyday life is examined; the 'stoic response' to the First World War of Spencer and his peers is identified and differentiated from the 'traditionalist response' of the powerful and the better known 'radical response' of the war poets; his libertarian sexual politics is specified and the utopian dimension of his erotic pictures clarified; his paintings of Christ and resurrection are then placed in the context of radical Protestant traditions. Thus, rather than limiting itself to the biographical reductionism of earlier accounts or the narrower art-historical approach of more recent 'revisionist' writing, this study offers a way of understanding Spencer's work which emphasises its populist, radical and, in effect, political dimensions. His art emerges as a profoundly public one - offering ordinary life and experience as worthy of representation in forms aspiring to public display and soliciting a new reading practice from viewers confronting them.

Ekonomiska nackdelar som uppstår till följd av att en verksamhet bedrivs genom flera självständiga dotterbolag istället för under ett bolag med flera driftställen avhjälps normalt med lagregler om koncernbidrag. Dessa regler är emellertid endast tillämplig på nationella koncerner, dvs. koncerner där samtliga bolag har säte i ett och samma land. Problem uppstår emellertid när de olika dotterbolagen är belägna i olika länder. Denna uppsats behandlar problematiken kring gränsöverskridande förlustutjämningar inom EU. Grunden för uppsatsen är det kontroversiella målet Marks & Spencer där frågan om gränsöverskridande förlustavdrag ställdes på sin spets. Målet fick stor betydelse för rättsutvecklingen i såväl Sverige som övriga Europa.

Herbert Spencer est l'une des figures les plus énigmatiques de l'histoire intellectuelle moderne. Très populaire durant la second moitié du dix-neuvième siècle, avec des œuvres traduites et vendues partout dans le monde, ses théories tombent en discrédit dès la fin de sa vie. Néanmoins, on ne peut ignorer le rôle important qu'elles ont joué dans l'élaboration des doctrines sociales et politiques de ses nombreux lecteurs. En France et en Italie, l'influence de la pensée de Spencer a été particulièrement forte. Or, dans ces deux pays, les adeptes de ses idées évolutionnistes n'hésitent pas à les reformuler et à les réadapter à leurs propres besoins et préconceptions. Chemin faisant, ils investissent le modèle scientifique du développement humain d'une signification autre que celle que lui a accordée originellement son auteur, et énoncent des doctrines politiques complètement opposées à l'individualisme spencérien. Dans notre travail, nous examinons les raisons du succès de Spencer en France et en Italie et nous étudions le processus d'appropriation de ses idées dans ces deux pays. Resumo: Esta Tese trata do liberalismo, do neoliberalismo e da educação em Roque Spencer Maciel de Barros. Procura analisar seu pensamento e sua obra, explicitar suas contradições e demonstrar que o liberalismo é a ideologia justificadora da sociedade burguesa, neste caso da burguesia brasileira. Na primeira parte apresentamos a trajetória intelectual do autor: sua formação e a construção de sua imagem de mundo e de homem. Na segunda tratamos do liberalismo. Abordamos como compreende a história do liberalismo, a relação com o "totalitarismo", a justificação e legitimação do liberalismo, as condições de possibilidade de uma vida ética e o liberalismo atual, o chamado "neoliberalismo". Na terceira tratamos da educação. Analisamos as razões do surgimento tardio da primeira universidade brasileira - a Universidade de São Paulo -, a criação da Faculdade de Filosofia, Ciências e Letras e os motivos e os fins para os quais foram criadas; tratamos do surgimento da Faculdade de Educação e como o autor compreendia a relação entre a História, a Filosofia e a Educação. Abstract: This thesis is about liberalism, neoliberalism and Roque Spencer Maciel de Barros' view of education. It once tries to analyses his thoughts and works as well as it tries to explain his contradictions and it tries to show that liberalism is an ideology that justifies the bourgeois society. In the first part it shows the author's intelectual trajectory: his background and the construction of his idea of world and mankind. In the second part it considers the liberalism itself, its relation to "totalism", the justification and ligitimacy of liberalism, the possibilities of an ethical life and the contemporary liberalism, the so-called "neoliberalism". In the third part it deals with education. It analyses the reasons of the late creation of the first university of Brazil - The University of Sao Paulo-, the creation of the "College of Philosophy, Science and Literature" and the reasons and purposes of these creations; it also considers the creations of the "College fo Education" and how the author understood the relations among history, philosophy and education. After that it ana1yses the campaign for the Public School at the end of the fifties, the restructuring of the University of Sao Paulo, the University Reform and how and why they happened. The research addresses a central tension of modern society between materialism and retail expansion on the one hand and growing environmental awareness on the other, during the 1970s and 1980s. It does so through a study of the operations of Marks and Spencer, with comparative reference to other leading retailers, principally Sainsbury’s and the John Lewis Partnership. Marks and Spencer experienced a complex renegotiation of its relationship with the environment and resource use as it underwent rapid expansion and changes in the period 1968-1992. This has yet to be addressed by academics, especially in relation to the notable growth in environmental concern at this time. It is this changing retail context, as experienced by Marks and Spencer, coupled with the evolving significance of the broader environmental agenda, which this thesis addresses. It makes extensive use of the Marks and Spencer Company Archive to address the importance of the company’s changing commercial operations, its relationship with consumers, the government and British society more broadly, in shaping its approach to the environment and resource use. The thesis contributes to existing academic literature concerning retailing and the environment by illustrating the extent to which the environment was a highly constructed and negotiated retail concern, which invariably predated the environmental fervour of the late eighties and early nineties and the subsequent commercial clamour to be seen to be green. The research addresses Marks and Spencer’s response to environmental issues, its energy conservation efforts, its retail store development, as well as the internal and external environments of its stores. It shows how the relationship between retailers and the environment was shaped as much by the outlook and operations of individual retailers and the changing nature of modern retailing, as it was the wider environmental agenda and growing popular concern.

Located in the south-west region of Spencer Gulf, South Australia, a multi-million dollar aquaculture industry based on the ranching of southern bluefin tuna (Thunnus maccoyii) contributes significantly to the regional economy. The interaction between aquaculture activities and the environment is of significant interest to industry stakeholders, management authorities and the broader science community. No studies, to the best of my knowledge, have investigated the relationships between the hydrodynamics and biogeochemistry of the system and the ability of the benthic ecosystem to deal with the increased loads of organic material from aquaculture activities. This thesis uses a multi-disciplinary approach combined with modern statistical techniques to explore the linkages between hydrodynamics, sediment geochemistry, sedimentary nutrient cycling and the aquaculture industry. Modelling results have identified that swell entering the mouth of Spencer Gulf from directly south causes the greatest swell heights in the central tuna farming zone. Winds from the north-east through to south-east generate the greatest wind-wave heights in the central tuna farming zone. This is directly related to the available fetch. The energy contained in the locally generated wind waves was the same order of magnitude as that of the dissipated oceanic swells. Yet the incoming swell poses the greatest risk to aquaculture activities as the increased wave length causes swell energy to penetrate to the seafloor. The results of this work suggest that the sediment geochemistry is tightly coupled to both the hydrodynamic regime and the buildup of silt originating from aquaculture activities. In the more exposed regions of the tuna farming zone, periodic resuspension events caused by swell propagating into the area from the Southern Ocean, resuspend fine unconsolidated sediments into the lower 10 m of the water column. This material is then advected through the region by the residual (low-frequency) currents until it settles out in areas of lower energy. This process has created two distinct provinces within the region that can either be classified as depositional or erosional. The combined effect of wave action and tidal currents have generated a heterogeneous distribution of biogeochemical properties within the sediments. Denitrification rates were measured in these heterogeneous sediments using a novel technique based on Bayesian statistics to explicitly account for the spatial variability of the sediment biogeochemistry. The denitrification rates were found to be generally low, largely due to the lack of organic matter entering the sediments. However, adjacent to aquaculture activities, the high organic loads stimulate sedimentary denitrification, with rates reaching values of up to three orders of magnitude greater than the control sites. Denitrification efficiencies were high adjacent to the aquaculture activities, with up to 95% of the dissolved inorganic nitrogen produced from the breakdown of organic matter in the sediments being removed. Variability in the denitrification efficiencies was related to the textural characteristics of the sediments, with high efficiencies in finer sediments. It is proposed that this is due to the lower permeability of these sediments restricting the advective exchange of porewater nutrients.

The present thesis deals with Herbert Spencer Jennings (1868 1947) contributions to genetics and evolution between 1908 and 1912. During this period, this American biologist developed a series of experiments with Paramecium, and attempted to test the action of selection on those organisms. The aim of this thesis is to analyse Jennings experimental results, trying to elucidate whether his conclusions were well grounded according to the patterns of scientific rationality of his time or not, taking in account the contributions of his colleagues on the subject. Besides that, it will try to situate Jennings contributions in the history of genetics and evolution trying to find out if some labels applied to him or his contributions such as pioneer of biological investigation ; the one who changed the directions of biology ; or who published and presented works clear and coherent , were fair. This thesis contains an introduction and five chapters. Chapter 1 deals with the hereditary and evolutionary precedents as well as Jennings general outlook concerning the subject. Chapter 2 presents some information related to the experimental material employed by Jennings in his experiments. Chapter 3 discusses some results related to heredity and evolution obtained by Jennings in his experiments with Paramecium developed from 1908 to 1910. Chapter 4 discusses the results got by Jennings in his experiments developed from 1911 to 1912, in which he tried to elucidate some features of evolution and heredity in such organism. Chapter 5 presents some final remarks on the subject. This study led to the conclusion that Jennings conclusions (such as that natural selection does not act on pure lines, and that conjugation does not rejuvenate those organisms) were well grounded. However, he cannot be regarded as a pioneer of biological investigation , since several other authors dedicated themselves to it before his time. The scope of this thesis does not allow us to answer whether Jennings contributions changed the directions of biology. But certainly his works were clear and coherent and his contributions enriched the history of genetics and evolution

O objetivo desta tese é analisar os resultados dos experimentos de Jennings, procurando elucidar se suas conclusões estavam bem fundamentadas de acordo com os padrões de racionalidade científica da época ou não, levando em conta as contribuições de seus colegas sobre o assunto, na época. Além disso, procurará situar as contribuições de Jennings na história da genética e evolução, procurando detectar se alguns rótulos que lhe são aplicados ou às suas contribuições, tais como pioneiro da investigação biológica ; aquele que mudou os rumos da biologia ; ou aquele que publicou ou apresentou trabalhos claros e coerentes são justos. Esta tese contém uma introdução e cinco capítulos. This study explores Charlotte Perkins Gilman’s use of the dramatic form to challenge Herbert Spencer’s social Darwinism by offering feminist adaptations of Darwin’s theories of natural and sexual selection. As she does in her career-defining manifesto, Women & Economics (1898), Gilman in her lesser-known plays deploys her own brand of reform Darwinism to serve the feminist cause. Despite her absence in histories of modern drama, Gilman actively participated in the establishment and development of this literary, historical, and cultural movement. After situating Gilman in the context of nineteenth-century naturalist theater, this thesis examines two short dramatic dialogues she published in 1890, “The Quarrel,” and “Dame Nature Interviewed,” as well as two full-length plays, Interrupted (1909) and the Balsam Fir (1910). These plays demonstrate Gilman’s efforts to use the dramatic form in her early plays to “rehearse” for Women & Economics, and in her later drama, to “stage” the theories she presents in that book.

Despite the revival of interest in nineteenth century psychology and ethics in Britain during the 1980s, and the current debate around Utilitarian ethics in medicine (Buckle, 2005) and care (Offer, 2004), Utilitarian premises, understood as a psychological theory rather than as a moral philosophy, remain largely dormant in contemporary British Psychology. This is so despite their apparent survival in Behaviourism (Plaud & Vogeltanz, 1994). This article examines aspects of their decline within Victorian psychology, by focussing upon the relatively neglected psychological writings of Herbert Spencer. In doing so, it seeks to make a modest contribution to unravelling the complex changes in the nature of nineteenth-century psychology. In particular it is argued that, whilst some explanations of the decline of Utilitarian premises in the Victorian development of psychology focus upon the later part of the century and cultural or institutional factors, an examination of Spencer's works at the mid-century supports the view that changes were under way earlier. Whilst several explanations might be offered for this, changes in economic organisation and in the experience of individual agency are highlighted. The relation between Utilitarian psychology and Utilitarian ethics will then be considered. Finally, at this stage it should be possible to comment upon the significance of the marginalization of Utilitarian premises within the development of Victorian psychology for the contemporary debate about health resource allocation.

The diversity of sizes and uses of dams and embankments, in Brazil, is reflected, in terms of these structures, too. Some are impeccably designed, meeting safety standards consistent with national and international standards more stringent, while others have serious risks that safety limits are exceeded, and may even result in the disruption of the structure, given the complexity and excessive hand-labor calculations of slope stability. The aim of this study was to evaluate the performance of the methods of slope stability analysis less accurate, to reduce the number of operations which make use the most accurate methods available in the literature. The development work was given from the performance index of 4 methods of calculating slope stability, being Fellenius (1936), Bishop (1955), Simplified Bishop (1995) and Janbu Simplified (1973) compared with the method of Spencer (1967) considered an exact method for calculating the safety factor, however, which requires more computational time to obtain the results. The procedure was performed in scenarios with different soil types, heights and inclinations of slopes, and for conditions subject to reservoir emptying fast and slow. Based on the calculated FS values were adjusted linear regression equations, where the dependent variable was obtained by the FS equation Spencer, and independent variable FS values estimated by other methods. Thus, comparative analyzes were performed using the correlation index "r" accuracy "d" (WILLMOTT et al., 1985) and performance "c" suggested by Camargo & Sentelhas (1997). The methods we have obtained optimum performance for all conditions with the highest levels of trust were Simplified Bishop and Janbu Simplified, and the values obtained by these FS calculated determination coefficients of 99% and 96.59%, respectively, and can be used alternatively, replacing the Spencer s method, in the analysis of slope stability in earth dams.
A diversidade de tamanhos e usos das barragens e aterros, no Brasil, reflete-se, também, nas condições dessas estruturas. Algumas são impecavelmente projetadas, atendendo normas de segurança compatíveis com os padrões nacionais e internacionais mais exigentes, enquanto outras apresentam sérios riscos de que os limites de segurança sejam ultrapassados, podendo, inclusive, resultar no rompimento da estrutura, visto a complexidade e excessiva mão-de-obra dos cálculos de estabilidade de taludes. O objetivo deste trabalho foi avaliar o desempenho dos métodos de análise de estabilidade de taludes menos precisos, visando reduzir a quantidade de operações dos quais se utilizam os métodos de maior acurácia existentes na literatura. O desenvolvimento do trabalho se deu a partir do índice de desempenho de 4 métodos de cálculo de estabilidade de taludes, sendo Fellenius (1936), Bishop (1955), Bishop Simplificado (1995) e Janbu Simplificado (1973) comparados ao método de Spencer (1967) considerado um método exato no cálculo do fator de segurança, porém, que requer maior tempo computacional para a obtenção dos resultados. O procedimento foi realizado em cenários com diferentes tipos de solos, alturas e inclinações de taludes, e para condições de reservatório sujeito a esvaziamento rápido e lento. Com base nos valores de FS calculados, foram ajustadas equações de regressão linear, onde a variável dependente foi o FS obtido através da equação de Spencer, e variável independente os valores de FS estimados pelos demais métodos. Com isso, foram feitas análises comparativas usando o índice de correlação r , exatidão d (WILLMOTT et al, 1985) e desempenho c sugeridos por Camargo e Sentelhas (1997). Os métodos que obtiveram desempenho ótimo para todas as condições com os maiores índices de confiança foram Bishop Simplificado e Janbu Simplificado, sendo que os valores de FS calculados por estes obtiveram coeficientes de determinação de 99% e 96,59%, respectivamente, podendo ser utilizados como alternativa, em substituição ao método de Spencer, na análise de estabilidade de taludes em barragens de terra.

Resumo: À constituição de uma nova nação corresponde também a formação da idéia que a expressa, o modo de representá-la como objeto do pensamento que abarca os seus caracteres sociais, culturais, econômicos, geográficos, históricos e políticos. O propósito dessa tese é estudar a formação desse objeto de pensamento primeiro como um requerimento da filosofia da história do século XIX e, depois, como noção trabalhada no bojo das teorias evolucionistas do período até ela se materializar através da ¿arte de governar¿. A orientação do estudo é, portanto, dispor a nação como conceito em formação segundo a diretriz de integração dos seus vários componentes. Os autores em cujos textos se persegue esse rocesso são, com prioridade, Euclides da Cunha, Manoel Bomfim e Silvio Romero e, secundariamente, Oliveira Vianna. A tese está dividida em quatro partes e nove capítulos. Na primeira parte, em três capítulos, são expostas as hipóteses do trabalho, o enquadramento histórico do tema e a diretriz de integração que orienta metodologicamente o estudo. Na segunda parte, composta por um capítulo, trata-se da filosofia da história como gênero literário típico do século XIX e dos problemas da absorção de uma nação nova nesse nível de representação da história, tomada como um processo ascensional marcado por descontinuidades ¿ ¿decadências¿ ¿ que também afetam a sua trajetória. Na terceira parte, composta por quatro capítulos, discorre-se sobre a adoção por autores nacionais dos paradigmas do evolucionismo, em variantes darwinistas e pré-darwinistas, como elementos de crítica do conhecimento no tratamento de temas como a hereditariedade e a adaptação, considerando as particularidades do meio e das ¿raças¿ humanas que integram idealmente a nação. É esse tratamento pelos autores nacionais que lhes permite vislumbrar uma agenda política para o Estado, agora como principal fautor da nação ou agente político da sua integração. Abstract: As it is well known, the constitution of a new nation also corresponds to the construction of the very idea of nation and its own way to represent it as the object of thought which embraces social, cultural, economic, geographic, historical and political characters. The aim of this dissertation is to study the formation of this object of thought first of all as a request of the Philosophy of History in the 19th century, and further, as a notion worked in the core of the evolutionist theories of the period up to its incorporation as object that the state shall incorporate in the ¿art of governing¿. Therefore, the guideline of the study is to display the nation as a concept under formation, according to the guidelines of the integration of its many components. The authors whose texts we pursue this processes are, primarily, Euclides da Cunha, Manoel Bomfim and Silvio Romero, and secondarily, Oliveira Vianna. The dissertation is divided into four parts and nine chapters. In the first part, in three chapters, the hypothesis of the work, the historic settlement of the theme, and the guideline of the integration which gives the methodological orientation of the study, are presented. The second part, corresponding to one chapter, deals with the Philosophy of History as a typical 19th century literary genre, and with the problems of absorbing a new nation in such a level of representation of History as a rising process marked by discontinuities, ¿decadency¿, which also affect the integration of new nations. The third part, composed by four chapters, discoursed about the adoption of the evolutionism paradigms by home authors in Darwinist and pre Darwinist variations, as elements for knowledge criticism in treating themes, such as heritage and the adaptation along the historical process, considering the particulars of the environment, and of the human ¿races¿ which integrate ideally into the nation. It is this treatment given by home authors that allows them to forsee a politic agenda for the Estate, now as the main nation factor or the political agent of its integration. Finally, the forth part presents final arguments of the study as of the correlations of the dissertation parts

Abstract:
Works of art often refer to one another. Perhaps a closer examination of this relationship occurs if they are theoretically displaced from the sequence of events that contextualise them. Placed side-by-side, they may take on a fresh meaning that might identify artistic intention as universal — as a 'redemptive' statement of Being. Both Piero della Francesca and Stanley Spencer painted 'Resurrection' pictures. The five hundred years that separate them notwithstanding, the reasons for their so doing must bear some comparison. Each made a statement of belief in their depiction of a metaphysical world created primarily in the imagination but housed in cultural milieus that would identify them as 'visionary' amongst their peers. Yet, in many ways, one picture is the antithesis to the other, the first deeply religious, the second highly personal. Regardless of their differences, each work might perpetually and simultaneously strive toward 'the spiritual' in an individual and universal sense. As an artist whose work ostensibly denies any lofty 'spiritual' aspiration whatsoever, Frank Zappa's dismissal of authority, whether couched in religious, musical or sociological terms, marks a valid juxtaposition to current acceptance of artistic form. Not only was it legitimate to invite a musician into the affray, for me it was a vital continuation of my earlier exploration. Zappa seriously challenges the notion of 'feeling' as little more than a pre-set conditioned response to music. I hoped to establish that Zappa's own quest for musical perfection flew in the face of his notorious cynicism, proclaiming his output as 'redemptive' — alongside that of Piero della Francesca and Stanley Spencer. It is the main contention here that as the human predicament requires that the artist should attempt to re-present his vision in order to redefine reality for himself and his peers, the role of artist as 'visionary' is worthy of perennial consideration.
