Een Franse voorloper van het Rookverbod-arrest? Op 11 april 2012 deed de hoogste Franse bestuursrechter, de Conseil d’État, uitspraak over de inroepbaarheid en rechtstreekse werking van volkenrechtelijke normen in de nationale rechtsorde. Deze uitspraak staat bekend onder de naam GISTI et FAPIL 2012. In de onderhavige bijdrage staat deze uitspraak van de Conseil d’État centraal.
