Full textOur purpose is to describe, to interpret and to explain the proper logic of the ways of using the dispositions of the welfare state. The description is made through an original way which consists in the study of eighteen particular cases. They have led us to define, under the "idealtypus" patterns, three strategies of utilization : the strategy of dependance, the strategy of subjection and the waiting strategy. The interpretation is led in terms of acquisition of a social status, the status of a person who receives state relief. We will admit that a form of social identity is elaborated around to poles which represent the singular presence of misfortune and the right of not working. Finally the explanation needs the constuction of a pattern of a social situation which specifies the families supported by the welfare state. But it is by giving all its importance to their system of preferences that the rationality of the strategies of utilization will be taken. .

They are led to question the choice of a salaried or self-employed. But to know or choose their social status, the officer must investigate the form of the Company that wants to create or integrate the legal structure, the conditions for the exercise of its activity and its status as personal professional.Social protection differs depending on a salaried or self-employed, and thus confers benefits more or less attractive to the manager. The status of the leader may confer significant advantages in terms of remuneration and benefit from device, hitherto devoted employees. The social status of leaders it is likely to move towards harmonization of employees and self-employed? What advice would you give to an officer in search of the most profitable status for him in the long run?Two main topics are treated : the first relating to the determination of criteria come into account in the choice of the social status of the leader, the second on the consequences of this choice in order to offer the manager

Full textMultiple employment ; may be defined as the performance of several types of work by the same person often called "having a sideline" or "moonlighting. ; at one time controversial and not very highly regarded, recently it is becoming an integral part of full employment policies. This has given it a new legitimacy, in addition to its legal principles. In the agricultural communities where this sort of practice began, it especially helps combat rural depopulation. In an urban environment, it provides a supplemental income, or an alternative and more stable employment. Multiple employment has obviously become more common as job stability has decreased. But multiple employment also plays an important role in competition. Some farmers are true entrepreneurs. Multiple employment also helps people improve their skills and knowledge, gives them more work experience and helps them prepare themselves for a career change, as may be seen with those people who either perform the same job under a different status, or perform a second job according te their expertise. Therefore, traditional barriers to multiple employment or having a + sideline ; are disappearing. However, multiple employment remains limited because of loyalty issues and the legal restrictions to working more than the number of hours legally allowed per week as an employee not to mention incompatibilities with work codes. Yet, labor laws and social security were established with typical work in mind. It is with social security law that the effort te change is most noticeable. The dual plan that permitted several affiliations and contributions at once in exchange for benefits from the main job is becoming less common. Now more commonly the worker is partially or totally covered by the main job from a legal standpoint and contributes proportionally according te the amount of work performed. Nevertheless, only a few modifications te labor laws have been effected. Therefore, the undefined status of multiple employment tends te encourage undeclared work. The laws must be changed for employees with several employers as well as seasonal workers so ensure that laws that promote multiple employment are effective

Full textThe aim of this research is to study the social and legal status of intermediaries in the real estate sector in order to envisage perspectives for real change. Intermediaries play an essential role in real estate operations and the accompaniment of uninitiated users, but the status of these professionals is still vague and suffers from a poor image in France. Intermediaries are professionals who work actively to carry out operations on the real estate property of third parties. Today, they are faced with a legislative crisis and increasingly present national and international competition. In light of this, French intermediaries have entered a period of questioning and reflection with regard to their legal and professional orientation. This research makes it possible to review the social and legal status of intermediaries in France, for whom there are a number of issues that limit the very exercise of their profession. Taking into account positive law and recent legislative changes, as well as a comparative law approach and pragmatic social and economic influences, this research proposes perspectives for change in favour of the intermediaries to help them face up to the problems they encounter. The study proposes several avenues for reflection, as well as practical solutions for bringing about change in the status of intermediaries, giving them sufficiently effective legal tools that are adapted to contemporary needs in terms of real estate

Full textInitially conceived as a response to the specific problems dividing labor and capital during the 19th century, catholic social teaching has evolved to incorporate the social sciences. The common good is a basic insight that informs the whole, allowing for the amelioration of social structures through the acceptance and the accord of the majority. By its insistence upon the ethical and spiritual, this thought structures concerted action by investing it with form and meaning. The questions of goodness and justice do not only reside in one's convictions and motivations. They also relate to social structures and to the social action whose rules are specifically public. The supporting epistemology is defined through a prioritization of a "deliberation upon ends" and by the fact that its theological foundation serves as a symbolic mediation on rules specifically public. Catholic social teaching insists upon a preferential option for the poor and on the witness value of work. Thus, it dissociates itself from ideology and from pure social theory. The theological foundation emphasizes the unconditionality of collective action by basing itself upon the works of Jesus of Nazareth and the commandment to love one's enemies

Full textThere is a consensus about the bidimensionnal structure of social judgment. The aim of this thesis was to show that the concepts of agency and competence are two distinct registers within the vertical dimension of social judgment. Agency reflects a motive to advance the self where as competence refers to a set of instrumental resources. The first implication of this distinction deals with the relationship between the two dimensions of social judgment. We found that sociability and agency were negatively correlated while sociability and competence were orthogonal. Another implication deals with social status perception. Results showed that agency is specifically associated with high status individuals whereas competence can be associated with high status individuals and relatively low status individuals. These findings suggest that these two registers do not play the same role in social judgment

Full textEven if it is difficult to satisfy the legitimate demands of real professional workers at a time of general decline in agriculttural income, the legal status of the farmer's spouse has now been largely formulated. Positive law recognizes three main modalities for conjugal cooperation on the family farm : collaboration, co-operation and association, the spouse's status being dependant on spouse's status being dependant on his her being, merely the "spouse" or formally associated in its structure. Despite its incompleteness, the professionnal status of the farmer's spouse outlined by the agricultural orientation act of 4 july 1980 illustrates the desire of the authorities to acquire a greater understanding and the position of person who serves the family farm, legislation conveyying the protean nature of the spouse's activity. Moreover, the family farm, more than any other economic entity, being permeable to the marital status of the couple for whom it is the occupation and centre of activity matrimonial law is quite naturally called upon to provide the means for conjugal association and to ensure the permanence of the farm despite the vicissitudes of the family fortunes. However, only the legal emergence of the farm, the structure giving substance to tasks which are real jobs, appears able to provide the farmer's spouse with a proper status which does not exist fully in reality

Woman is related to the past tradition and dffered from nowadays necessities. So, the problem which takes place is the woman between the past tradition and what concerning the present time. Evidently the very sensitive state like religion, education politique and the others. Moroccan woman is living in a critical condition and leads many particular problems and difficulties which take her away from the rest of the family. Indeed she is often threatened to be divorced. Sometimes the economique power is depending on the women but the man is away from that difficulties I mean he has always the authority and the power. Eventually, whenever we think about these problems we have to take the changement into consideration. The question is to choose between old traditions and what concerning the present time

Full textThe purpose of the research is to study the legal and social status of fishermen in Morocco in order to predict concrete prospects for evolution. This category of workers is subject to as much risk.Faced with these elements, Moroccan fishermen have entered a period of questioning and reflection on their social status. This research makes it possible to establish the observation of this status, from which many problems emerge which negatively affect the exercise of this profession. It follows from this study that the irreducible particularism of work in the maritime fishing sector and the autonomy of maritime labor law are no longer sufficient to establish an incompatibility of principle likely to hinder the application of certain rules of the land labor law.The study revives an old legislative and doctrinal debate on the autonomy of maritime labor law. It then proposes several avenues for reflection and concrete solutions to change the status of fishermen and sailors within the framework of a moderate autonomy. A rapprochement and a conciliation between the maritime labor law and the labor law are necessary, in adequacy with the identified needs

Full textOur research intends to study the gap between pre-established social status given to any social actor and the practice of it, affected by this very status and the one they claim. Through his practice, any actor may choose to correspond to this pre-established identity or one as ather way round to get as far as possible from it. The advantage of consider profesional book-sellers is this occupation suggests immediately a desire to claim the distinction between book-selling vendors and profesional book-sellers in the established category of book-selling retailers. Consequently, working as a profesional book-seller is not considered there just as an occupation, but mainly as a social path varied profesional identifications. The evolution of book selling through several social or economical systems from the old regim up to the 19e siecle makes clear the basic caracteristics of the present profesional book-sellers status. Their progressive coming to specialized trading explains why institutions and sociologicts have not been interesed in studying the field. It is yet possible to establish a difference socialogicaly based, between bookselling vendors an professional book-sellers. Only the latters are being able to prove a "savoir-faire" increating an old stock and advising costumers. To consider the attachment to profesional group as being result of a claimed profestional identity, opends a wide range of investigation concerning profesional choces and practice. The way the profesional practice develops depends on the inherited identity, the constrained identity as well as aimed identiy, three builtvariables. It is possible to understand selling practice of profesional book sellers only if we consider this commercial activity as an interaction between the professional book-seller and his actual customers in space and time at the very moment of selling

Full textThe aim of the present research program is to identify the role of social status as an antecedent of the achievement goals that students pursue when facing an academic task (Dweck, 1986; Nicholls, 1984), in the selective context of University (Darnon, Dompnier, Delmas, Pulfrey, & Butera, 2009).The first series of studies (studies 1 to 6) documents that low-status students (students whose parents did not achieve the baccalauréat) endorse more performance-avoidance goals (try not to perform poorly) than high-status students, particularly at a high level of academic achievement (real or perceived). The studies also showed that high- and low-status Psychology students do not differ in their endorsement of performance-approach goals (trying to perform better than others). Nevertheless, a difference was observed in a more selective academic curriculum (Medical school), such that high-status students endorsed more performance-approach goals than low-status students. In the second series of studies (studies 7 and 8), we focus on how the selection context affects the relation between social status and the endorsement of achievement goals. Results show that (1) the selection function of university leads students - regardless to their social status - to endorse performance-approach goals via the social utility associated to these goals and that (2) the interaction between social status and academic achievement on performance-avoidance goal adoption appears mainly in a context of academic selection. The last study (study 9) seeks to test the same hypotheses in a context that makes salient temporal comparison (rather than social comparison). Results show that competition and status predict self-based goals, more relevant in this context, than performance-based goals.Together, these results confirm that, in addition to individual antecedents, students’ social status can influence achievement goal endorsement - especially in a context of selection

Full textThe present study focuses on the topicality and future of women's legal and social status in Niger. Its purpose is to provide a better understanding of women's stigmatization, as a pitfall of the patriarchal ideology organized around women's status; that is, around their situation, both legitimately and effectively. It appears that nowadays, the development of the Nigerienne woman's status in every aspect (economic, cultural, and political) is constantly evolving, to the extent that one would even be tempted to say that women have conquered legal and legislative equality. But actual equality is yet to be conquered, in the sense that some practices and the socio-cultural weight still act as a check on women, regarding the total use of their potential, for their own fulfillment and for that of their country. The supremacy of customary law over modern law contributes towards the reinforcement of women's hold back out of economic life, as well as towards the reinforcement of social inequality, of which they are victims. The inequality between men and women is frequently reflected in concrete evidence and it applies more specifically in terms of access to the means of production, health, and education; in short, to the access to different categories of power: social, legal, and political

Already shown on the ground of the relations between shareholders, this tendency exists in comparison with the situation of the leaders of limited companies. The latter are indeed brought to conclude a certain number of contracts with the company or thirds, but also to profit from certain agreements concluded between the company and from the thirds, of which the number and the importance make it possible to show the existence from a true conventional statute from the leaders of limited comapny. Even within the form of the most institutionalized member, the development of this statute seems to receive the favour of our right. .

Full textIn general, having a job is a satisfactory factor for the majority of persons. However, most of the employees are stress-prone, which has an important effect both on individuals and on structures. Those structures often do not possess relevant standards to thoroughly evaluate this phenomenon. The lack of precise knowledge about stress at work and its origins, especially the two dimensions of personal status and professional status in France, has led us to conduct a thorough diagnosis for several years on several plants of a large industrial company. The chosen company is emblematic of the industrial labour organization in France. The mapping of stress at work, with the identification of mainly exposed populations, should be applicable to other organizations to quickly set an anti-stress action plan, without first making a detailed inventory; for the greatest benefit of employees and the work environment and production. The different stakeholders interested in deploying a policy against stress, the employees, the hierarchy, Human Resources Departments, occupational psychologists, occupational doctors have been solicited as part of this research. After a general diagnosis, facing the large number of possible research topics and because of the lack of studies on the relationship between staff’s personal status and "professional situation" with the other factors already integrated within conventional models about stress at work, we focused on this issue by defining a theoretical model to be validated experimentally through questionnaires. In this research we explain how we found that among the factors related to stress at work, the category "professional situation" influenced this phenomenon more than the "personal status" category.Among the factors in the category "professional situation", the most important in decreasing order are: socio-professional category, English practice, and seniority. Among the factors in the "personal status" category, the most important in decreasing order are: the level of education, gender and age. This finding is rather good news for companies because they will be able to reduce stress at work by acting on the "professional situation", knowing that they cannot interfere with the personal status of employees. This contribution should be supplemented by other researches to enhance the completeness of the diagnosis about stress at work and to conduct complete actions plans covering all topics

Full textThis thesis questions the perception and justification of status differences in society. The literature shows that social judgment is based on two fundamental dimensions : a horizontal dimension, which refers to qualities that enable good social relations to be maintained, and a vertical dimension, which refers to qualities that enable objectives to be achieved. This vertical dimension, linked to status, is composed of two facets: assertiveness, i.e. the motivation to succeed and develop, and competence, i.e. the resources to achieve one's objectives. Our objective was to highlight that only competence can justify social hierarchy. We conducted eight studies, which confirmed our hypothesis. Thus, the more people justify inequalities, the more they attribute competence to people with a high status in society (i.e. rich, powerful people). Moreover, the relationship between assertiveness and status has not been moderated by the justification of the system, suggesting that assertiveness does not justify status differences

Full textHow does motherhood affect the mobility behavior of women? Is mobility identical for all of them? When is a car available to them? Is there in that respect a difference with men? This research shows that women's mobility is strongly related to the structure of the family group, whereas men's mobility is much less affected by this factor. Most existing studies on women's mobility concentrate on the reasons for the short distance travelled between home and work. Here, the home-to-work distance is one indicator considered through the standpoint of family life. It appears that even active single women live closer to their workplace than single men. So, key differences in terms of social identity affect daily life, and mobility is only one among the revelators of these differences. Behavior projections cannot lead to a near perfect similarity between men and women mobility, even with similar professional and household status. Two opposite trends play against each other : the convergence resulting from the extension of women's role in Western society (such as accession to automobile usage) ; the social identity resulting from women involvement in motherhood and household care, which cannot be completely effaced

Full textPublic intervention in the intimacy of the family is characteristic of the relationships between the institutions and the families in the modern era, marked by the separation of private and public spaces around children when they are taken away from collective space. But those relationships are often studied from the standpoint of power relations rather than from what the different actors have in common. Looking at contracted relationships between parents and child protection services, the present work analyses the changing in parent-institutions relationships in the light of the status of childhood and its changes in time. Through a socio-historical study based on child protection service files since the 1960s and, for the present time, on interviews with parents, we can trace the changes in a social work negotiated with the families. This research shows that children are more and more active in their own protection depending on their age and discernment. This changing could have a reverse effect leading children to be as active in the dangers they are exposed to as in the protection they are entitled to. The present thesis shows that if modern childhood was shaped by specific time and space with an education apart form adults, present childhood, far from being united, is given a totally new status questioning education in the family as well as in the institutions. New socializing ways are emerging adjusting a new mixing of ages without knowing if concrete experience and the specificity of children are really taken in consideration. Public and private interactions are being reshaped through the new status of children: the civil society could play a new role

Full textThis thesis studies, mainly by analysing selected groups of documents (papyri in the first place), the different aspects of the social status of soldiers in the first six centuries of the roman empire. The thesis has two parts. The first part starts with the military reforms of augustus and with a rapid overview of the evolution of the model created by this emperor under the early empire. It then focuses on the new developments which determine the place of soldiers in the society under the later roman empuire and in the early Byzantine period (4th-6th centuries). A glance at the different categories of troops that compose the imperial army is followed by a study of changes in the status of veterans which provide a good indication of he growing social integration of soldiers. The penomenon of limitanei lilites, garrison troops who stat cultivating land, is then studies in detail. The first part of the thesis ends with a study of the social integration of soldiers of mobile units (comitatenses) in the cities and with a series of appendixes. The second part presents a preliminary edition of a little codex on papyrus which contains the fiscal register of the village of aprodito in the thebaid (middle egypt). Full textIn animal kingdom, aggressivity is a very frequent behavior obvious. Serotonin (5-HT) and steroid hormones modulate this behavior. However, even if several hypothesis raise that one interaction is possible between these molecules to control aggressivity, no study can confirm it. Moreover, neuronal actions behind this behavior stay unclear. In this study, we show how 5-HT and steroid hormones can regulate neural networks and aggressivity. Crayfish molting is regulated by a steroid hormone, called 20-hydroxyecdysone (20E) and its concentration increases during pre-molt period. 20E decreases crayfish aggressivity and locomotion. Locomotors activities and sensory-motor integration are also inhibited during pre-molt. This inhibition is caused by a drop of neural reactivity because input resistance of motoneurons decreases. After injection of 20E or during pre-molt period, 5-HT concentration increase. We think this increase would block networks in inhibition state during pre-molt

The official right is sometimes a right attached with the respect of the divine law, sometimes a right which could be described as layman. The laws of the family, joined together within the Codes of the personal statute, are those of which the degree of emancipation compared to the divine law is the weakest. As for the civil, economic and political laws, their sources do not fit in the theological and cultural references but rather answer criteria marked with a universal thought of democratic invoice. The statute of the woman is thus located in this ambivalence between a private sphere regulated by a right in conformity with Islam and the Arabic and Moslem cultural identities and a respectful public sphere of the equality of the genders. In spite of the pression of the militants of the women's rights and the international organizations in load of promotion of the elimination of the gender’s discriminations, the North African countries, to differing degree, maintain uneven family legislations marked with patriarchate. The statutory condition of the women from North Africa thus takes place in this “legal schizophrenia”. To release them from this statute of inferiorisation, it is advisable to remove the persistent textual inequalities but also to follow a true policy of the chances man-woman in order to lead still phallocratic mentalities to evolve to a universal concept of human rights

Full textThis doctoral thesis put forward an historical reading of the musician’s status in the city. The ancient Greeks had another approach of the city, known as a political community organised around the willingness of « the community life ». The study of the musician’s social status since prehistory has allowed nowadays to shed light on a new paradigm. The musician became a mediator or a medium in conjunction with an economical, technological and symbolic environment, he contributes to a transformation, which makes visible the human beings inside the environment, in particular those marginalised, banned from the society or in situation of vulnerability. The neurosciences highlight this matter by strengthening this phenomenon. Indeed, the music considered as a body language can genuinely operate on people without reducing the human beings to neuronal attentions which can explain the contemplation or the creation of the art work, as neuroesthetics claim

Full textThe purpose of this work was to contribute to the explanation of achievement differences between social groups. Several studies have revealed that the reputations of intellectual inferiority that usually target stigmatized group members can alter their cognitive functioning (i. E. Stereotype threat hypothesis, Steele, 1997). Though research has repeatedly demonstrated that the performance of low status group members, (e. G. Blacks in the United states or women) can be disrupted by stereotypes alleging intellectual inferiority when they are made salient, very little id known about the process underlying this pehnomenon. We hypotesized that the suspicion of lower ability faced by low status group members in evalutive settings can lead them to focus on the self-evalutation implications of a potential low performance. This focalization in turns would generate sel-regulation demands that would disrupt performance on the main task. Our first study shows that evaluative situations affect stigmatized individuals' self-esteem and motivation. Moreover, when these individuals have the opportunity to affirm positive aspects of the self, their performance increases (studies 2, 3 and 4). In other words and in accordance with our hypothesis, stereotype threat appears to involve some self-regulation. However studies 5 and 6 did not allow us to determine if individuals's focus on negative self-knowledge iduces a self-regulation activity interfering with performance. Nevertheless, our work suggests that self-image devaluation generated by negative stereotypes applicability in testing situations is responsible for stereotype threat effects. Further research we review and discuss reveals that, when intellectual abilities are not perceived as fixed anymore, or when some low status individuals invalidate negative sterotypes of their group, members of these stigmatized groups perform better in evaluative situations

Full textThe subject that we propose here gives a significant importance to the family, which remains the pillar of our societies. The ancient Turkish legislation granted for a long time a dominating place to the man within the family and reduced sentences for authors of violence or honour crimes towards women. The legal reforms give and grant now the same rights to married women in all area. In fact, the new civil code of 2002 gives a new role to the woman in the family and the article 10 of the Turkish Constitution forces now the state to ensure non-discrimination between women and men. Moreover, a law of 1998 tackles the question of marital violence and represents useful means to fight against this violence towards women. The new Penal code of 2005 qualifies sexual crimes against women as a crime against the person, and does not allow sentence reduction to author of raps or honour crimes. However, it still exist an important gap between the law and its enforcement. The existence of a laic and democratic legislation does not prevent certain discriminatory customs to be opposed to these laws. These discriminations are consolidated and approved by the legal and police system itself. Confronting this kindness, women that can find enough money and courage decide to flee the country and take refuge Europe. Granting asylum in France to women victims of family violence confirms this reality. Beside, on June 2009, Turkey was sentenced by the European Court of Human Rights to breach from authorities in their duty of protecting women and also for discrimination against them.

Inferiorized work status and “salarial” conflict. Store employees in France and Belgium
RESUMÉ DE LA THÈSE EN ANGLAIS
Our dissertation aimed at showing the links between the strengthening of the establishment of hierarchy at work and the modes of resistance to a subaltern status. We studied a constantly renewing working space in France and Belgium: retail trade stores (ready-to-wear). Sociology works on the increasing lack of job security rarely investigated the work relations in these particular types of structures, in which the limited number of employees is a deciding characteristic, in particular young women. The passage from an independent trade to a rationalized « mass stores » trade lead to a transformation of the framing conditions. There has been a change from the small boss to the salaried manager. This new and invisible relation to the employer leads to a renewal of the modes of domination now based more on the market competition justifying a temporal and space flexibility, and permanent. The comparative observation of the situations of employees in France and Belgium allowed us to shed light on shared social processes of resistance to the store discipline, which take different shapes depending on the experience and the modes of reciprocal exchange at work. The development of the conflict process ensues from two dynamics of socialization ;one is an individual one that leads to a capacity to claim rights ;and one is an intersubjective, producing a representation of possible social act to the precarious status.

Full textE-Opinion Leaders (e-OL) identification on internet social networks is a major issue for marketing managers. This thesis deals with the role, status and identification of these e-OL. Each one of these three aspects are subject to controversial debates in the literature. Three studies are conducted within this thesis. They provide complementary and crossed answers to these debates. Regarding the e-OL status, we offer a definition for the e-OL concept in the specific context of internet social networks within three main characteristics: expertise in the product category, the will to publish valuable contents for their contacts, and the will to develop their social capital. Then, for the e-OL identification, we develop a new and multidimensional measurement scale for this concept. This scale shows good external validity. We confront it with others e-LO measures inspired by traditional OL measures, but also with alternative identification methods as the Twitter profile indicators and the Klout score algorithm. Finally, we test four models and their variants in order to better understand the origin and mechanism of the main e-LO role: the e-influence. We especially show that e-OL has an impact on e-influence. We also show that confidence mediates the link between e-LO and e-influence. These results speak to the relevance of e-OL in a viral marketing perspective

Full textHistorically, labour law has evolved in opposition to civil law, specifically the principles of personal liability. Since the end of the 19th century, special rules have been set up that build the framework of the employee's statute. Personal liability laws have been used to complete the lawmaker's task, either marginally or as its main basis. Apart from the cases when their use has been specifically called for, personal liability laws have diffused into labour law, thus deeply modifying the existing patterns. Although spontaneous recourse to personal liability laws has allowed harlmonious conpletion in the field of individual industrial relations, it can be argued that their recourse in the field of collective disputes comes up against numerous obstacles pertaining to the very nature of personal liability laws and equally to the deeply original nature of the field of collective industrial relations. Consequently, personal liability laws have contributed to complelent the statute of the employee, thus stressing some of its inperfections and the necessity to promote solutions suited to the particular nature of labour law
