Abstract 
 Recently, Shi’a-Sunni’s controversy in Indonesia increase dramatically as occurring as geo-political clash in the Middle East, particularly between Saudi Arabia and Iran. The culmination of Indonesian Shi’a’s conflict is assigned by expulsion several communities from their home and village. Afterward, that’s discrimination is legitimated by the book of MUI entitled Mengenal dan Mewaspadai Penyimpangan Syi’ah di Indonesia. This article aims to review the book’s contents by using linguistic philosophy in form of Stephen Toulmin’s theory of argumentation. Stephen Toulmin is professor of Linguistic Philosophy Studies at Cambridge University. He develops six concepts for examine argumentation namely data, claim, warrants, backing, qualifier and rebuttal. Dialectically, its six concepts is related each other to form an argumentation. A good argumentation, as Toulmin’s opinion, is arranged from factual and objective data, supported by strong warrants and backing, truthful qualifier, and can defend from rebuttal. As one of result, this research shows that the correlation between data and claim in MUI’s book categorized as unilateral fact that produces negative issues and impacts to discriminative action for Shi’a community.

 Perdebatan mengenai Syiah di Indonesia meningkat seiring dengan meruncingnya kontestasi geopolitik di Timur Tengah, khususnya yang diwakili oleh Saudi Arabia dan Iran. Konflik Syiah di Indonesia mencapai puncaknya ditandai dengan pengusiran sebagian kelompok Syiah dari tempat tinggal dan kampung halamannya. Perbuatan diskriminatif atas komunitas Syiah itu kemudian mendapatkan legitimasi dengan terbit dan beredarnya buku atas nama MUI pusat yang berjudul Mengenal dan Mewaspadai Penyimpangan Syi’ah di Indonesia. Artikel ini hendak meninjau ulang bangunan wacana dalam buku tersebut dengan perspektif filsafat linguistik, tepatnya menggunakan teori argumentasi yang digagas oleh Stephen Toulmin. Sebuah wacana argumentatif dapat disebut baik, menurut Toulmin, apabila data yang disajikan merupakan fakta bersifat objektif yang didukung oleh warrant dan backing yang kuat, jujur atas qualifier, serta dapat mempertahankan diri dari rebuttal. Salah satu kesimpulan penelitian menunjukkan bahwa korelasi antara data dan claim dalam buku MUI tentang Syiah dikategorikan sebagai fakta sepihak yang melahirkan isu negatif dan dapat berimplikasi pada sikap diskriminatif terhadap komunitas syiah.

Equipped with the authority of a deterministic world-view, they have influenced the politics and culture of the modern society to a !arge extent. A philosophy that insists on 'locality'and 'particularity' should, nevertheless, also take into account the actual problems of the contemporary societies, a task which Toulmin accomplishes only insufficiently.

Abstract:
For my dissertation, I analyze the impact of English philosopher Stephen Toulmin's 1958 The Uses of Argument on philosophy and rhetoric. Because Toulmin holds that arguments must be assessed in relation to their original contexts, I begin by examining the intellectual context surrounding The Uses of Argument. I trace the development of formal, symbolic logic from the latter part of the nineteenth century and into the middle of the twentieth century. I argue that Toulmin was inspired by the work of ordinary language philosophers such as Ludwig Wittgenstein; with The Uses of Argument, Toulmin challenges the mathematical, deductive, and positivistic logics of philosophers such as Rene Descartes and Bertrand Russell. Next, I consider features of The Uses of Argument that are overlooked or misunderstood by critics and reviewers, including Toulmin's discussion of probability, field-dependent and independent aspects of arguments, and epistemological theory.After finding that many of the reviews of Toulmin's work were not as critical as recent scholars of rhetoric have portrayed, I evaluate the various ways philosophers and speech communication scholars have responded to Toulmin's arguments. Before examining composition scholars' uses of Toulmin, I briefly trace the development of argumentation in composition instruction. Then, I evaluate the wide range of reactions to and uses of Toulmin's work by composition scholars.Finally, having examined the intellectual history, the critical reception, and the variety of scholarly applications of The Uses of Argument, I offer my own application of Toulmin's work. I explain that good, "Toulmin-inspired" arguments are (1) contextual, (2) supported, and (3) multi-sided. Using student examples from my freshman composition courses, I demonstrate how students and I have used Toulmin's schema in several stages of the writing process, including invention and revision. I conclude that while Toulmin's work has had a significant impact on argumentation theory and pedagogy, rhetoricians-particularly composition scholars-have not yet fully realized the rhetorical and epistemological implications of The Uses of Argument.<br>Department of English

PONTIFÍCIA UNIVERSIDADE CATÓLICA DO RIO DE JANEIRO<br>A distinção entre argumentar a partir de regra, e argumentar quando não há regra, é retomada para elucidar alguns aspectos da atividade justificatória no âmbito legal. A referida distinção encontrou em Rawls um porta-voz que realçou de modo incisivo sua importância para a prática legal. Antes dele, porém, Hume, Mill, Ryle e Toulmin, entre outros, já haviam tecido considerações relevantes ao tema. A distinção serve de motivação para dividir o campo da argumentação prática, particularmente da argumentação jurídica, em duas classes, a saber, argumentos de primeira e de segunda ordem. Nos argumentos de segunda ordem, uma regra atua na forma descrita no modelo de Toulmin. Nos argumentos de primeira ordem, caracterizados pela ausência de regra, procede-se mediante ponderação de razões, substanciadas em princípios gerais, valores morais, interesses políticos, programas econômicos, considerações religiosas e pretensões corporativas. Alguns exemplos ilustram a distinção. Argumenta-se que a base lógica dessa distinção assenta-se no conceito de regra como razão excludente, no sentido estabelecido por Joseph Raz.<br>The distinction between justify a conclusion from rule and justify it when no rule is resumed to elucidate some aspects of legal activity. This distinction found in Rawls a spokesman that incisively pointed out its importance for the legal practice. Before him, however, Hume (A Treatise of Human Nature), Mill (A System of Logic), Ryle (The Concept of Mind) and Toulmin (The Uses of Argument), among others, had already made relevant considerations to the topic. The distinction serves as motivation to split the field of argumentation practice, particularly of the legal argument, into two classes, namely, arguments of first and second order. In the arguments of second order, a rule operates in the manner described in the Toulmin model, in the arguments of the first order, characterized by the absence of rule, by weighting of reasons, substantiated on general principles, moral values, political interests, religious considerations and corporate claims. Some examples illustrate the distinction. It is argued that the logical basis of this distinction is based on the concept of rule as exclusionary reason, within the meaning established by Joseph Raz.

Paul Grice's conversational implicature is a widely studied and commonly accepted theory in the field of linguistics, and Stephen Toulmin's model of argument is perhaps even more widely studied and accepted in the field of argument. I was struck by the great similarities between the two theories, particularly the leap of logic both are dependent upon, and surprised by the fact that it didn't seem that anyone had explored the similarities. In this thesis, I explore the similarities of the processes, of Grices's implicature and Toulmin's model of argument, and how looking at the two together increases the understanding of both.

This Master’s thesis has the politics of museum in focus, as a subordinate governmental cultural policy, as a continuation of cultural reform in a time when legislation were to take place in Sweden. The aim of the study is to map out claims from museums and their responsible authorities in response to the governmental bill Ny Museipolitik. The study deem the subject area of politics of museums as a organizational field. By using the Toulmin model of argumentation several hundred claims about the works of museums and the effects on society were founds. The result could be arranged in eight different themes. In the analysis of the claims both unifying and disrupting tendencies could be observed. The themes presented in the result are: a new legislation, a new administrative authority, handling the collection, cooperation, fundings, museums and society, quality assurance and research at the museum and a round up theme called other.      One conclusion showed that the different levels of authorities in particular produced diversified needs and challenges. Some findings point out how the field are contested concerning legitimacy. There is also conclusion indicated by the claims that showed how several isomorphic tendencies were apparent. Legislation are considered to heighten the state of affairs and the increased level of ambition are welcomed. A very apparent conclusion is that a much needed reform, according to the comment letters, is that governmental grants are increased and secured over time.

Dissertação de Mestrado em Filosofia apresentada à Faculdade de Letras<br>Esta dissertação procura capturar o espírito da obra de Stephen Toulmin e, particularmente, examinar a relação desse pensamento com a questão do relativismo: o que implica refletir sobre a maneira como o autor, no contexto da pós-modernidade, procura, através da Retórica e da Argumentação, preservar a matriz universalista característica da filosofia moderna. O trabalho encontra-se dividido por três capítulos, cada qual, refletindo uma fase distinta do pensamento do autor. A fragmentação proposta não pretende ser definitiva nem exclui a possibilidade de interpretações alternativas. O primeiro capítulo é dedicado à teoria da argumentação e ao ‘modelo de Toulmin’ apresentado em Os Usos do Argumento. A questão do relativismo coloca-se aí, um pouco à revelia do pensamento do próprio Toulmin, na medida em que o problema não havia sido equacionado pelo autor nessa fase. Não deixa, porém, de ser pertinente aferir as consequên¬cias da teoria divulgada em 1958, especialmente na medida em que a obra em questão visa promover uma reforma da Lógica enquanto ferramenta aplicada na análise de argumentos, e que essa ambição só poderia ser bem sucedida tendo a problemática do relativismo sido devidamente equacionada. O segundo capítulo é dedicado ao exame das obras Compreensão Humana e Conhecer e Agir, nas quais a teoria da argumentação reverte numa tese mais ampla sobre a racionalidade humana. Nesta segunda fase do pensamento do autor, a questão do relativismo aparece já no centro das suas preocupações. Em Conhecer e Agir, o autor empenha-se na elaboração de uma conceção filosófica, unificada, do estudo da racionalidade, integrando o contributo conjunto de três modelos distintos de argumentação, ou paradigmas da racionalidade – o modelo geométrico, o antropológico e o crítico. Toulmin procurou fornecer, nas obras mencionadas, verdadeiras fundações filosóficas para poder enquadrar os empreendimentos racionais no seu conjunto – que, para o autor, envolvem tanto o domínio prático como o teórico. A fase madura do pensamento de Toulmin aparece exposta em Cosmopolis e em Retorno à Razão, que analisamos ao longo do último capítulo, no qual, incluímos a conclusão do trabalho. Nesta última etapa, as consequências do relativismo adquirem contornos, porventura, menos problemáticos à luz de um modelo evolucionário do conhecimento do que seria de esperar, tendo em conta o descrédito de que haviam sido alvo os pressupostos fundacionalistas da filosofia moderna, que guardavam o mérito de proporcionar verdadeiros alicerces universais para os empreendimentos da razão.<br>This essay aims to portray the spirit of Stephen Toulmin’s work and, specifically, to examine the relationship between his though and the question of relativism – a task which implies a reflection about the way the author tries, in a post-modern context, to preserve the universalist current that characterises modern philosophy. This paper is divided into three chapters, each one dedicated to a distinct phase of the author’s thought. This proposed fragmentation is not intended to be definitive, neither does it eschew the possibility of alternative interpretations. The first chapter delves into argumentation theory and “Toulmin’s model” as presented in The Uses of Argument. The relativist question is present here, even if unbeknownst to the author, since he had not yet addressed the problem at the time. It is still pertinent, nevertheless, to gauge the consequences of the thesis presented in 1958, specially given that it concerns itself with a reform of Logic as an applied tool for argument analysis, and that such a reform could only happen successfully after the relativism problematic had been satisfactorily equated. The second chapter is dedicated to examining Human Understanding and Knowing and Acting, in which argumentation theory expands into a wider thesis about human rationality. In the second phase of his though, the author keeps the relativism question at the core of his reflections. In Knowing and Acting, the author applies his efforts to create an unified philosophical conception of the study of rationality, integrating the joint contributions from there distinct models of argumentation, or paradigms of rationality - the geometric, anthropological and critical models. Toulmin tried to offer, in the works mentioned above, true philosophical foundations to frame the rational undertakings as a whole - endeavours that, for the author, imply both the practical and the theoretical domains. The fully formed phase of Toulmin’s though is exposed in Cosmopolis and Return to Reason, which we will analyse in the last chapter – where we will also include our conclusions. In this last step, the consequences of relativism turn up to be, perhaps, less problematic when under the light of an evolutionary model of knowledge than what we were led to believe, taking into account the derision faced by the presupposed founding fathers of modern philosophy, that kept for themselves the merit of offering the true universal foundations for rational endeavours.

This chapter outlines and critically evaluates the “new casuistry” account of Albert Jonsen and Stephen Toulmin. It begins by explaining the core elements of casuistical analyses of this kind, such as the theoretical primacy they place on actual cases as opposed to principles. In doing so, it clarifies how the “new casuistry” differs from the method of casuistry pioneers in the Middle Ages who brought abstract and universal ethico-religious precepts to bear on particular moral situations. The chapter then outlines some advantages of the method before uncovering some of its problems. In particular, problems arise from trying to separate out which cases are morally significant, and there are concerns about casuistry’s handling of the issues of indeterminacy and consensus.

The synthetic element is the chart showing the link patterns. 7.10.2.7 The chart The chart is constructed simultaneously with the key listing. We will look at this shortly. 7.10.2.8 Completion of the analysis Again it is necessary to remember that the chart and key list are not the end of the process but the means of engaging in analysis. Nothing in this process should suggest that it is a mechanistic process. In so far as it allows the construction of argument it teaches how an argument is constructed, but it cannot decide how important evidence is. The user has to make this decision, evaluating strength, persuasive value, credibility, or positive or negative effect. It cannot tell the user if the evidence assembled is admissible. The chart orders material and shows relationship and gaps. The chart does not solve problems. If there is a gap the user has to decide how to deal with it at the moment of analysis and argument construction. The human element in handling, locating, ordering, analysing evidence and constructing argument remains an act of knowledge, experience and imagination. Each inference requires an evaluation of its persuasive operation. Then the user needs to come to a view concerning the persuasive effect of the total mass of evidentiary facts. Stephen Toulmin: ‘Logic is concerned with the soundness of claims we makewith the solidity of the grounds we produce to support them, the firmness of the backing we provide for them.’ What is the objective? For a process model it may be solving a diagnostic model or increasing understanding of complex things or for knowledge acquisition. Wigmore’s analytic methods says Schum are ‘a conceptual microscope that allowed me to examine many subtleties in evidence’. The important point is to show alternative conclusions and test them out. Do they, or your counter-argument, stand up? Each inference can lead to the following processes: As we noted earlier in the chapter, an assertion can be met by: • explanation; • denial; • rival assertion. All counter-responses to your argument fall into a category that either: • explains it away; • denies the existence of the evidentiary fact; • offers a new rival evidential fact."
