After the events of 9/11, the number of fusion centers rapidly multiplied. As a result, state and local agencies that operated the centers adopted a myriad of policies. This thesis seeks to answer how fusion centers can implement policies as to operational structure and transparency that simultaneously safeguard against abuse of citizens' privacy while facilitating the collection, maintenance, and dissemination of information. Two methods of research are utilized: policy analysis and policy options analysis. This thesis examines existing federal guidelines, federal case law, and various federal statutes and regulations. Moreover, the thesis explores three policy options as possible decision-making tools for fusion centers: 1) mandatory federal guidelines, 2) imposition of a balancing test and administrative review process, and 3) a compulsory reasonable-suspicion requirement. In the end, this thesis recommends imposition of all three policies.

Modern states are approaching the issue of terrorism from both kinetic and non-kinetic perspectives; however, the focus of the international community has largely been on terrorist organizations, their leadership and their active and passive members, in whom the terrorist ideology is already deeply ingrained, and thus, they are difficult to turn toward a peaceful path. However, this thesis focuses on would-be terrorists, who may be relatively easier to influence. It identifies the possible causes that lead candidates toward the path of terrorism. According to Kahneman and Tverskys Prospect Theory, people in the losses frame are more risk acceptant and therefore more prone to join terrorists causes. To counter this risk-acceptant behavior, the answer lies not only in identifying possible causes for their placement in the losses frame, but in finding ways to transfer the would-be terrorists to a gains frame, thereby preventing them from joining the terrorist organizations. By adopting this strategy, there will be an indirect influence on the current wave of terrorism in the long-term, as well as a benefit in the short term by partially choking the inputs to the terrorists organizations.

Abstract:
This thesis seeks to balance trade and environmental concerns in international law. It studies a number of multilateral environmental and trade agreements to observe the extent to which environmental and trade treaty regimes have made allowances for each other's interests, and whether allowed such interests to be disregarded or overridden in practice. Serious questions remain, however, about the compatibility between overlapping environmental and trade rules in the absence of a clear authority relationship or means of securing unity in the international legal order as a whole. The international legal system does not possess well-developed hierarchies; thus, none of the agreements inherently takes precedence in the event of a conflict. Consequently, the aim should be to achieve a better harmonization of the two regimes through available mechanisms. The multilateral trade agreements have made allowances and included exceptions with regard to the protection of environmental concerns. However, the precise way in which trade institutions balance environmental considerations by comparison with trade considerations is likely to prove critically important for the protection of the environment. It is for this reason that this thesis analyses the current balance between trade and environmental considerations in the international legal order, and proposes ways for improving its coherence.

Abstract:
The serious consequences of ship collisions necessitate the development of regulations and requirements for the subdivision and structural design of ships to reduce damage and environmental pollution, and improve safety. Differences in striking ship bow stiffness, draft, bow height and shape have an important influence on the allocation of absorbed energy between striking and struck ships. The energy absorbed by the striking ship may be significant. The assumption of a â rigidâ striking bow may no longer hold good and typical simplifying assumptions may not be sufficient. The bow collision process is simulated by developing a striking ship bow model that uses Pedersen's super-element approach and the explicit non-linear FE code LS-DYNA. This model is applied to a series of collision scenarios. Results are compared with conventional FE model results, closed-form calculations, DAMAGE, DTU, ALPS/SCOL and SIMCOL. The results demonstrate that the universal assumption of a rigid striking ship bow is not valid. Bow deformation should be included in future versions of SIMCOL. A simplified bow model is proposed which approximates the results predicted by the three collision models, closed-form, conventional and intersection elements, to a reasonable degree of accuracy. This simplified bow model can be used in further calculations and damage predictions. A single stiffness can be defined for all striking ships in collision, irrespective of size.
