After the events of 9/11, the number of fusion centers rapidly multiplied. As a result, state and local agencies that operated the centers adopted a myriad of policies. This thesis seeks to answer how fusion centers can implement policies as to operational structure and transparency that simultaneously safeguard against abuse of citizens' privacy while facilitating the collection, maintenance, and dissemination of information. Two methods of research are utilized: policy analysis and policy options analysis. This thesis examines existing federal guidelines, federal case law, and various federal statutes and regulations. Moreover, the thesis explores three policy options as possible decision-making tools for fusion centers: 1) mandatory federal guidelines, 2) imposition of a balancing test and administrative review process, and 3) a compulsory reasonable-suspicion requirement. In the end, this thesis recommends imposition of all three policies.

Modern states are approaching the issue of terrorism from both kinetic and non-kinetic perspectives; however, the focus of the international community has largely been on terrorist organizations, their leadership and their active and passive members, in whom the terrorist ideology is already deeply ingrained, and thus, they are difficult to turn toward a peaceful path. However, this thesis focuses on would-be terrorists, who may be relatively easier to influence. It identifies the possible causes that lead candidates toward the path of terrorism. According to Kahneman and Tverskys Prospect Theory, people in the losses frame are more risk acceptant and therefore more prone to join terrorists causes. To counter this risk-acceptant behavior, the answer lies not only in identifying possible causes for their placement in the losses frame, but in finding ways to transfer the would-be terrorists to a gains frame, thereby preventing them from joining the terrorist organizations. By adopting this strategy, there will be an indirect influence on the current wave of terrorism in the long-term, as well as a benefit in the short term by partially choking the inputs to the terrorists organizations.

Abstract:
This thesis seeks to balance trade and environmental concerns in international law. It studies a number of multilateral environmental and trade agreements to observe the extent to which environmental and trade treaty regimes have made allowances for each other's interests, and whether allowed such interests to be disregarded or overridden in practice. Serious questions remain, however, about the compatibility between overlapping environmental and trade rules in the absence of a clear authority relationship or means of securing unity in the international legal order as a whole. The international legal system does not possess well-developed hierarchies; thus, none of the agreements inherently takes precedence in the event of a conflict. Consequently, the aim should be to achieve a better harmonization of the two regimes through available mechanisms. The multilateral trade agreements have made allowances and included exceptions with regard to the protection of environmental concerns. However, the precise way in which trade institutions balance environmental considerations by comparison with trade considerations is likely to prove critically important for the protection of the environment. It is for this reason that this thesis analyses the current balance between trade and environmental considerations in the international legal order, and proposes ways for improving its coherence.

Abstract:
The serious consequences of ship collisions necessitate the development of regulations and requirements for the subdivision and structural design of ships to reduce damage and environmental pollution, and improve safety. Differences in striking ship bow stiffness, draft, bow height and shape have an important influence on the allocation of absorbed energy between striking and struck ships. The energy absorbed by the striking ship may be significant. The assumption of a â rigidâ striking bow may no longer hold good and typical simplifying assumptions may not be sufficient. The bow collision process is simulated by developing a striking ship bow model that uses Pedersen's super-element approach and the explicit non-linear FE code LS-DYNA. This model is applied to a series of collision scenarios. Results are compared with conventional FE model results, closed-form calculations, DAMAGE, DTU, ALPS/SCOL and SIMCOL. The results demonstrate that the universal assumption of a rigid striking ship bow is not valid. Bow deformation should be included in future versions of SIMCOL. A simplified bow model is proposed which approximates the results predicted by the three collision models, closed-form, conventional and intersection elements, to a reasonable degree of accuracy. This simplified bow model can be used in further calculations and damage predictions. A single stiffness can be defined for all striking ships in collision, irrespective of size.

Abstract:
To date, the scholarship covering the Black Codes has centered on these laws' role as the predecessor of Jim Crow. Little study has been given to the laws as a whole--the one encompassing work being Theodore Wilson's Black Codes of the South. Other studies have examined the Black Codes' effect on specific states; however, no specific study has been done on the Black Codes of Kentucky and Tennessee nor has any study been made of these laws' relation to the antebellum Slave Code. This project therefore will represent an attempt to show that the Black Codes of Tennessee and Kentucky bear a direct relation to those states' antebellum Slave Code. The Black Codes of Tennessee and Kentucky were in many instances revised Slave Codes. Often this revision entailed only the removal of the word slave. In other instances, laws applying to free blacks remained on the law books following Reconstruction since they did not apply specifically to slaves and the federal government did not demand their repeal. Both states attempted to pass additional laws which applied to solely freedmen following the Civil War; however, due to Tennessee's position as a former Confederate state, its efforts were thwarted. These aspirations show Kentucky and Tennessee's desire to maintain the antebellum status quo and do not represent the beginning of Jim Crow law. This project will rest mainly on sources from the 1865-1866 period, primarily codes Tennessee and Kentucky's General Assemblies passed during these years. It will also include Slave Codes passed between 1800 and 1860 which were either revised or still in effect during the Black Code era, 1865 to 1866. Whenever secondary sources are used it will be the intent of the author to utilize the primary quotations from within those texts. Finally, it will be seen that the Black Codes of Kentucky and Tennessee owe their form as well as their function to the Slave Code. Likewise it will be clearly seen that the Black Codes were an attempt by Southern legislatures to hold on to the social and racial hierarchy of the antebellum South.

The percentage of correct steps of the right crosses” was stable during baseline for all participants improved substantially following the introduction of the auditory feedback, and maintained at 90 percent or more for all participants during follow-up.

Abstract:
This thesis aims to investigate the regulatory balance between inclusion and exclusion in competitive sport. Society is obsessed with categorising and treating individuals and groups according to their physical and non-physical differences, such as sex, gender, disability and race. This treatment can lead to the inclusion or exclusion of an individual from the tangible and intangible benefits of society. Where this practice becomes discriminatory, there exists a legal framework in place to protect basic human rights and ensure that people are treated with due respect for their similarities and differences. In a sporting context, the inclusion and exclusion of athletes based upon their differences is often a necessary part of the essence of competitive sporting activity. The protection of the essence involves the establishment of rules and categories that can have an unequal exclusionary impact on certain classes of individual such as some women, transgender, intersex individuals and those with a physical or intellectual disability. The essence of sport also embodies a dominant sporting culture that dictates who is suitable to sport and this can have an exclusionary effect upon particular racial populations. This literature based research, critically analyses a range of legal and non-legal cases concerning sex, gender, disability and race to identify when sporting exclusion is justifiable for the protection of the essence, and when it is unjustifiable and incompatible with equality legislation. A comparative analysis is adopted to examine the consistency and appropriateness of the sport and legal approach to this regulation. It will be shown that whilst a majority of the cases employ a justified inclusive or exclusive approach that is evidence based and in the pursuit of legitimate objectives, there do remain a proportion of cases which are unjustified. This thesis proposes a ladder of regulation, including a sports audit and the establishment of an international anti-discrimination unit, to stimulate improvements in rule making and encourage good governance in this field.

In this paper we shall consider the existing normative framework of the law of armed conflict, the jus in bello, as it relates to protection of the environment. We will review customary law of aimed conflict and highlight major conventional developments to assess the necessity and feasibility for reform in light of the trend in international environmental law to impose explicit environmental protection obligations on states. The Persian Gulf War of 1991, illustrates the issues presented and the conflicting values inherent in these two branches of international law. The post-war debate raised the questions whether the environment" is adequately protected by existing law from the environmentally destructive potential of modern warfare, or is new conventional law on wartime environmental protection needed.12 Serious consideration of these questions brings the international law-making process to a crossroads as it attempts to accommodate evolving environmental law norms, such as a yet to be defined "right of the environment", with countervailing values encompassed in the laws of armed conflict, which emphasize military necessity despite detriment to the environment

Abstract:
This thesis examines one instance of the long nineteenth-century’s engagement with the Antique: the medium of entertainment known as tableaux vivants. In tableau vivant performances, men, women and children were arranged into motionless (or nearmotionless) configurations, and presented to audiences in parlour rooms, pleasure gardens, circuses, public houses, exhibition halls, variety theatres and music halls. Many performances derived inspiration from Antique statues or classicising paintings, although some captured elements of distant cultures. All performances collapsed distances in space and time, permitting spectators to view – with arresting immediacy – both human bodies and the ideals or ideas which these bodies represented. Performances worked to consolidate the notion of a correspondence between ancient Greek and Roman societies and modern British society, as critics and impresarios proclaimed tableaux performers to represent vessels through which an impression (or a ‘sense’) of Antiquity was conveyed. Even those tableaux performances which instantiated ‘foreign’ peoples served to underline this correspondence, representing the inverse of the ‘civilised’ ancient societies to which modern British society aspired. For contemporaries, the same tableaux seemed to contain within them the promise of ‘the ideal’ and the threat of viewers’ and performers’ debasement; indeed, it was the latter threat which underpinned social purists’ anti-tableaux campaign towards the end of the nineteenth century. This thesis argues that tableaux vivants ought to be acknowledged as a fundamentally neoclassical phenomenon. Like visits to the British Museum or the Crystal Palace’s Greek and Roman Courts, tableaux vivants offered spectators the opportunity to engage with the classical past. For many working-class men and women, Antiquity was accessible only by virtue of these ‘popular’ exhibitions. As such, the thesis is situated within the field of Reception Studies, and explores responses to – and the broader impact of – a medium of entertainment which has hitherto been overlooked by historians of Classical receptions.

Today more and more physical objects are being connected to internet. The Internet of Things, or loT, is dramatically changing the way of living and the way we interact with things and each other. Home doors can be opened remotely with a watch, cars' performance can be upgraded remotely, devices monitor health and send updates to physicians remotely. loT technology has made some labor-intensive jobs simple and has the potential to simplify and enhance nearly every aspect of our lives. On the other hand, increased levels of high profile cyber security breaches in recent years have made it clear how important it is to make sure these devices are trustworthy and secure. While most users are aware of how critical it is to secure their laptops, mobile devices, and apps, due to the seamless ways in which loT devices integrates into our daily lives, users are often unaware of risks associated with them. At the same time, IoT device makers are aggressively releasing new products in a mad race to establish themselves in this emerging market. Increased pressure to differentiate on usability based functionalities has spurred products and features that are not properly vetted for security. Gartner predicts that by 2020, more than 25% of identified enterprise attacks will involve IoT, though loT will account for only 10% of IT security budgets. As loT continues to grow, vendors will favor usability over security and IT security practitioners remain unsure of the correct amount of acceptable risk.

Abstract:
Aim The aim of the study was to examine the wrist angles at impact when striking from two surfaces common in golf. The research question was: is there a difference in ulnar/radial deviation or flexion/extension at the wrists when striking from a mat placed on a steel platform compared to striking from grass.   Method Six male elite golf players (Handicap: +0.6±2.2) were recruited for the study. An optoelectronic system containing 12 infrared cameras captured reflective markers placed on the participants and on a golf club when they performed three shots from a mat and three shots from grass. The markers were identified in the Qualisys Track Manager software and the marker trajectories were imported into Visual 3D. Reflective markers were placed bilaterally on the medial and lateral epicondyle of the humerus, the radial and ulnar styloid processes, and the 2nd and 5th metacarpophalangeal joint. In addition, an elbow joint marker was calculated as the midpoint of the two elbow markers. The local frames were defined from these markers giving the proximal and distal ends of segments and the frontal plane.The wrist angles were defined as the orientation of the local frame of the hand segment relative to the orientation of the local frame of the forearm segment. Flexion/extension and ulnar/radial deviation of the wrists were calculated at impact.   Results There were no significant differences (p > 0.05) in ulnar deviation or flexion/extension at impact for either wrist between the two conditions.   Conclusion No significant differences in the wrist angles at impact between the two conditions indicate that the wrist position did not change significantly between the two conditions. This may be positive from a learning perspective since the technique does not change irrespective of the condition. Furthermore since there was no significant difference in ulnar deviation at impact between the two conditions, the ulnar deviation at impact is presumably not a reason for why players and researchers suggest that playing from mats is more injurious than playing from grass. The reason could be due to differences in the loads on the wrists when striking from the different surfaces. Future research should therefore be conducted to examine the differences in loading of the wrist joints between the two conditions.
Syfte och frågeställningar Syftet med studien var att undersöka handledsvinklarna vid träffögonblicket vid slag från två vanliga underlag i golf. Frågeställningarna var: finns det en skillnad i ulnar/radial deviation eller flexion/extension vid handlederna vid slag från en matta placerad på en stålställning jämfört med slag från gräs.   Metod Sex manliga elit golfare (Handikapp: +0.6±2.2) rekryterades till studien. Flexion/extension och ulnar/radial deviation av handlederna beräknades vid träffögonblicket.   Resultat Inga signifikanta skillnader (p > 0.05) upptäcktes för ulnar deviation eller flexion/extension vid träffögonblicket för någon av handlederna mellan de två underlagen.   Slutsats Att det inte upptäcktes några signifikanta skillnader i någon av handledsvinklarna vid träffögonblicket mellan de två underlagen visar på att handledens vinkelposition inte skiljer sig signifikant mellan de två underlagen. Detta kan vara positivt ur ett inlärningsperspektiv eftersom tekniken inte ändras om man byter underlag. Att ulnar deviationen inte skiljde sig mellan de två underlagen tyder på att ulnar deviationen troligtvis inte är en orsak till varför forskare och spelare föreslår att slag från matta är mer skadligt än slag från gräs. Anledningen till detta kan vara på grund av skillnader i handledsbelastning vid slag från de olika underlagen. Fortsatt forskning bör därför undersöka skillnader i belastningen på handlederna mellan de två underlagen.

Abstract:
This project is a master’s thesis in collaboration with Nomor, a company that offers pest control services. They had the need for the development of an automated mechanical rat trap for sewage systems. Brown rats populate the sewage systems in many cities, as it offers shelter and abundant food resources. Rats have been observed carrying various zoonotic diseases which are a health risk to people and animals, as rats may enter households via the sewage system. This report details the design and development process for a prototype for a striking mechanism, which will act as the foundation for a future trap. The process follows the theory described by Ulrich and Eppinger. The project resulted in the generation of 8 different concepts, which were screened down to a final pneumatic concept. The selected concept was then developed into a physical prototype, able to detect heat sources. A Simulink model was developed to support the detail design. The model calculates resulting impact energy from various input parameters, such as working pressure and moving mass. The prototype functions up to 3 bar with an impact energy of approximately 6 Joules.

Abstract:
In the topic of tax avoidance, there are two types of tax avoidance namely permissible and impermissible tax avoidance. Permissible tax avoidance is recognised throughout the world and more so it is recognised as a right. That is, a taxpayer has the right to choose to pay the least tax where the Income Tax Act permits. There other type of tax avoidance impermissible tax avoidance is completely prohibited. In fact, the South African General Anti-Avoidance (GAAR) primarily aims to combat impermissible tax avoidance although it has not been judicially considered. The application of the GAAR face a clash of interests of two parties namely the taxpayer s right to legally pay the least amount of tax and the government s need to protect the revenue base from impermissible tax avoidance. The question thereof is does the GAAR strike a balance between these two competing interests by drawing a line between permissible and impermissible tax avoidance. The GAAR attempts to limit the right of taxpayers to avoid tax but the complexity of the tainted elements hinders it to effectively inform taxpayers on what is permissible and what is not permissible.

Abstract:
In this work I illustrate the ways in which power structures function in operationalizing geographies of resistance in two particular carceral spaces. Specifically I examine the social organization and internal power relations present within hunger striking prison populations at Guantanamo Bay, Cuba and at Pelican Bay State Prison in Crescent City, California. I show that the Guantanamo hunger strikes are minimally organized with non-binding power structures, while the Pelican Bay hunger strikes have had greater levels of commitment, and have been more sophisticated in organization. I consider the relationships that exist between power, identity and violence within these hunger strike resistance movements. I contextualize these phenomena within a biopolitical framework that transgresses more traditional definitions of biopolitics; as opposed to conceptualizing biopolitics as a technology of power manifested by the state, I argue that oppressed populations, such as prisoners, construct their own power by regulating their own ‘vital biological processes’.

In the Irish healthcare system ward staffing is not matched with client acuity. With the recession came a moratorium on staffing and this combined with reduced length of stay for clients impacted significantly on nursing staff. Added to this a large number of front-line staff took early retirement leading to burnout of existing staff. Clear guidelines have been laid down by HIQA (2012a, 2012b) on the appropriate governance structure to ensure that client care is delivered safely and is of a high quality. The environment where nursing students undertake their clinical placement can have a positive or negative effect on them depending on the ratio of staff nurses to clients. The undergraduate nursing degree programme has been in place in Ireland since 2002. Nursing students register their qualifications with Bord Altranais agus Cnáimhseachais na hÉireann (Nursing and Midwifery Board, Ireland) upon successful completion of the programme. Nursing students are supported and facilitated on clinical placement by a qualified staff nurse named a preceptor. The term “preceptor” is the term used in Ireland to refer to a registered nurse who supports, guides and assesses nursing students on practice placement; the terms “mentor”, “practice placement supervisor” and “clinical supervisor” are also used in the literature to refer to the same role (Mead, 2012). For the purposes of this study the term “preceptor” will be used throughout this document. The quality of the nursing programme depends on the experience and level of supervision the nursing students receive in the clinical learning environment. This qualitative study explored current standards of the preceptorship model of nursing, to determine how preceptors perceive their role and the values preceptees place on the level of support they receive from preceptors during their clinical placements. I also needed to determine the level of support and training preceptors received from lecturers in higher education and management in the teaching hospital. The theoretical frameworks I used in the study were the Legitimate Peripheral Participation Theory (Lave and Wenger, 1991), which describes how newcomers become experienced members and eventually old-timers of a community of practice, and Social Learning Theory (Bandura, 1977), which proposes that learning takes place as a result of social interaction with other staff, including preceptors, through both verbal and non-verbal language. The literature implied that the role of the preceptor is stressful and the training inadequate (Haggerty et al., 2012; Eley, 2010; McCarthy and Murphy, 2010). This study set out to explore the tripartite relationship between preceptors, nursing students and lecturers. Using a qualitative approach, I conducted 24 semi-structured interviews with nursing students (n=8), preceptors (n=8) and lecturers (n=8). The study findings suggested that the preceptor’s role is difficult owing to time constraints, ward acuity and lack of resources. Part of the remit of a nurse working on a ward necessitates working different shifts and preceptors identified that it can be difficult to match the duty of a staff nurse with that of a nursing student. Preceptors found it challenging to give enough quality time to the students. Client care is always a priority with staff nurses, and must come first; the time they can spend with nursing students therefore tended to be ad hoc in nature. According to the preceptors they need on-going support from management of the hospital and lecturers in higher education. Those interviewed suggested they loved their role but felt they could not give enough quality time to the students. They would like more support from clinical placement coordinators (CPCs), from lecturers in higher education, and from management of the hospital. The preceptors also suggested that the training they receive needs to be more comprehensive, and to include more refreshers on curricula, teaching and assessing nursing students and providing feedback. The nursing students valued the time they spent with their preceptor, but this was sometimes limited owing to resources, ward acuity and working different shifts. They latched on to any available nurse when their preceptor was busy elsewhere or off duty. Overall, they would much prefer to have their named preceptor with them for support and guidance and because the preceptor was their assessor for their final interview on the clinical placement. The lecturers acknowledged the wonderful work the preceptors do in facilitating the nursing students in the clinical area. They believed that the preceptors should be given more support in the form of refreshers and “protected time” to precept the students. The lecturers would like to be more visible in the clinical area, but because of their teaching, research and administrative role their time is limited to quick visits to the ward. Some lecturers acknowledged that to remain current it is important for them to spend more time in the clinical area. Preceptors, employed by health care institutions, undertake the responsibility of supporting nursing students without protected time or remuneration. The nursing students are also supported by clinical placement co-ordinators (CPCs) on a 1 : 30 ratio. CPCs are employed by health care institutions to co-ordinate clinical placements. They assist with teaching and learning of students but do not formally assess them. They were not included in this study as there were insufficient numbers to match the sample size. To conclude, if there is insufficient time to precept nursing this can be a lost learning opportunity for the students. The nursing students miss the direct support and feedback from their preceptor and their learning is limited. They can finish their clinical placement not having reached their potential and maximised their learning. Despite the current climate of austerity there is a need to retain our highly qualified and capable nursing workforce.

Abstract:
The accumulating but small set of large semimajor axis trans-Neptunian objects (TNOs) shows an apparent clustering in the orientations of their orbits. This clustering must either be representative of the intrinsic distribution of these TNOs, or else have arisen as a result of observation biases and/or statistically expected variations for such a small set of detected objects. The clustered TNOs were detected across different and independent surveys, which has led to claims that the detections are therefore free of observational bias. This apparent clustering has led to the so-called "Planet 9" hypothesis that a super-Earth currently resides in the distant solar system and causes this clustering. The Outer Solar System Origins Survey (OSSOS) is a large program that ran on theCanada-France-Hawaii Telescope from 2013 to 2017, discovering more than 800 new TNOs. One of the primary design goals of OSSOS was the careful determination of observational biases that would manifest within the detected sample. We demonstrate the striking and non-intuitive biases that exist for the detection of TNOs with large semimajor axes. The eight large semimajor axis OSSOS detections are an independent data set, of comparable size to the conglomerate samples used in previous studies. We conclude that the orbital distribution of the OSSOS sample is consistent with being detected from a uniform underlying angular distribution.

This thesis explores how professional identity figures in the enactment of IS and focuses on groups of professionals as users and developers of information systems and investigates how they relay their professional knowledge via the system to retain identified aspects, in this case autonomy, of their professional identity. The study looks at how these professional groups of staff control, tailor and maintain important modules within an information system and how this facilitates the appropriation of it into their everyday working practices. It has been argued that the rise of professions in society has been such that they are seen as integral to post-industrial society. Yet, within information systems, minimal research has considered users as professionals and moreover users as developers. Instead, professions, professionalism and users as developers as units of analysis have usually been intertwined with discussions of IT/IS workers/professionals and codes of conduct via systems development. Additionally, many still propose the technologically deterministic route of rolling out information and communications technologies (ICTs) expecting that users will, and indeed can, 'download' what they know into a system. This approach is usually underpinned by the predominant assumption that the system will be developed by one group (developers) and used by another group (users). Therefore this study focuses on two professional developer-user groups within environments populated with skilled professional workers and considers the implications of the deployment of IS in such contexts. In particular, the author attends to the influence of technology on a central feature of professional identity - autonomy. The melding of professional workers, who often enjoy a particularly autonomous status in organisations, with information systems that have the potential to erode this, offers a fruitful site for investigation. This study looks at contact centre and academic environments and therefore, investigates how professional identity figures in situations where it would be expected that officially sanctioned autonomy, is as a rule minimal, within a contact centre environment and typically normal practice within an academic environment. In order to do this, the author draws on case study data, which provides insights into the deployment of a module of an enterprise-wide student information system in a department of a UK university and a scripting module in a HR contact centre.

By examining the framing that political actors made of the upcoming landmark LOAPA, Rumasa and abortion decisions issued by the Spanish Constitutional Court between 1980 and 1983, its influence on public debate and the final rulings, this thesis analyses the impact of external pressure on a new constitutional court using a process-tracing methodology. The research question addressed is whether strategic considerations, and more specifically, the preservation and enhancement of the Court's legitimacy had a significant influence on the three decisions. It is hypothesised that politicians successfully constrained the Court's choices by threatening its capital of public support. The thesis argues that both the risk of having its legitimacy eroded and the wider political consequences of the rulings had a decisive influence on the decisions taken by the Court. The results support theories positing that when adjudicating in salient cases, strategic concerns have a significant influence in constitutional courts decisions. It further sheds light on the challenges new constitutional courts face when in the process of building their legitimacy and trying to establish themselves as respected arbiters.
Mitjançant una metodologia de rastreig de processos (process-tracing) aquesta tesi analitza "impacte de la pressió externa exercida sobre un nou tribunal constitucional examinant l'enfocament (framing) que van portar a terme els actors polítics sobre les històriques sentències de la LOAPA, Rumasa i de l'avortament adoptades pel Tribunal Constitucional Espanyol entre els anys 1980 i 1983, la influència d'aquest enfocament sobre el debat públic i les pròpies sentències. La pregunta de recerca plantejada és si consideracions de tipus estratègic, i més concretament, la preservació i increment de la legitimitat del Tribunal varen tenir una influència significativa sobre les decisions finalment adoptades. Es formula la hipòtesi que els polítics varen ser capaços de restringir les possibilitats d'acció dels jutges posant en risc el capital de suport popular del Tribunal. La tesi argüeix que tant el risc de veure la seva legitimitat disminuïda com les conseqüències polítiques generals de les sentències varen tenir una influència decisiva sobre les decisions preses pel Tribunal. Els resultats donen suport a les teories que postulen que, quan decideixen en casos de gran importància, les consideracions de caràcter estratègic tenen una influència significativa sobre les decisions dels tribunals constitucionals. A més, contribueix a aclarir els reptes als quals s'enfronten els nous tribunals constitucionals quan es troben en el procés de construir la seva legitimitat i intenten establir-se com àrbitres respectats.

This thesis examines the role played by protest song in the development of the political culture of Germany’s industrial working class between 1844 and 1933. Protest song was an integral component in the struggle of the German working class to achieve some measure of political and social equality in the nineteenth and early twentieth centuries. Throughout this period, the working class found itself subjected to varying levels of political repression by the German authorities, and in order to promote their political views, industrial workers used the medium of song to protest against injustice. The thesis seeks to determine the significance of protest song for the political development of the German industrial working class through an analysis of song lyrics. The study of working-class protest song lyrics has largely been the preserve of historians from the former German Democratic Republic, where scholarship was shaped by the unique political imperatives of history writing under the Communist regime. This thesis seeks to redress the historiographical imbalance that this approach engendered, arguing that protest song produced under the auspices of the Social Democrats was both a culturally valid and politically significant feature of German working-class political life, albeit one that offered a different ideological approach to that of the overtly revolutionary output of the Communist movement. Additionally this thesis will acknowledge that working-class song was not merely used as an instrument of protest, but also as a medium to communicate political ideology. Protest song was an integral part of the cultural capital of the working class milieu, creating a distinct canon upon which German industrial workers drew in a variety of political, social and cultural situations. This study will engage with this canon in order to establish how the cultural practice of singing endowed working-class protest songs with an intrinsic political significance.

In the fall of 1921 oil workers of the San Joaquin Valley faced a post-war economic slump, wage cuts across the board and an increasingly hostile attitude of oil operators towards consultation with the federal government on labor relations. They voted to strike, and the next day eight thousand workers walked off the fields. Strikers crafted an image of “patriotic unionism,” underpinned by a faith in the federal government and the ideology of the American Legion. The strike did not end in gruesome class warfare like had been seen months earlier in the coal mines of West Virginia, but rather in ideological confusion and despair. The oil workers movement never fully embraced a class identity; instead it embraced the burgeoning conservative identity of Americanism. This effectively hobbled the growth of the movement. Upon the strike’s conclusion there was no mass pull to the left on the part of oil workers in the San Joaquin Valley, despite the fact that their movement’s design and identity had gotten them nowhere. On the contrary a portion of workers and supporters of the strike turned to the nativism of the Klan. Overall this project looks to complicate the narrative of “us vs. them” in labor history by analyzing workers’ identities, and also looks to contribute to the ever-evolving discourse on how historians should track American conservatism as a social force.

Given that Commercial Law tries to balance considerations of certainty and fairness, it follows that the law relating to letters of credit, as part of the general body of Commercial Law, involves a similar balancing exercise. This thesis argues that this balance should employ five basic principles, namely: (1) party autonomy (freedom and sanctity of contract); (2) certainty; (3) flexibility; (4) fairness; and (5) good faith. The thesis begins with a brief introduction to the objectives of the study. Chapter one introduces readers to the basis of letters of credit and the historical background. The five basic principles and the tensions between them are examined in chapter two. Chapter three discusses briefly how these five basic principles are applied to the law regulating letters of credit. Chapter four focuses on disputes arising between the issuing bank and the beneficiary, evaluating in particular the principle of independency and the fraud exception. The most important doctrine in the law of letters of credit, the doctrine of strict compliance is explored in chapter five. Disputes between the issuing bank and the applicant are examined in chapter six and the standard of compliance governing the reimbursement agreement (whether strict compliance or bifurcated compliance) is evaluated in the light of the basic principles. Chapter seven, deals with disputes between the applicant (buyer) and the beneficiary (seller), evaluating the law on the nature of payment (whether absolute-conditional) in the light of the basic principles. The concluding chapter draws on the key points of the thesis to put forward an overview as to the adequacy of the law. Essentially, the law founds itself on two cornerstone principles, the independency principle and the doctrine of strict compliance. Whereas the former protects the interests of sellers, the latter protects the interests of buyers. In each case, however, the principle designed for protection (and certainty) can be turned into a principle licensing unfairness-in one case, shielding fraudulent sellers, and in the other case shielding bad faith buyers. In the modern law, the central problem is to find the right way of addressing and balancing these competing considerations. The main proposals offered in the thesis recommend that the qualified strict compliance test be adopted and where actual fraud has taken place or is suspected on reasonable grounds by the bank, the fraud exception should operate. In addition, and with a view to striking the right balance between certainty and fairness, it is suggested that punitive damages be awarded exceptionally in cases where good faith and gross negligence have taken place, that the bifurcated compliance standard should be adopted where the issuer has been considered to have acted in good faith and without harming the customer, and that conditional payment be adopted in relation to payment under documentary credit. It should be emphasised that the position argued for in this thesis is that there should be some marginal adjustment to the ruling doctrines. No modification should be considered, however, where the essential certainty of the law would be jeopardised.

This research seeks to investigate the impact of equitable development strategies on urban environmental justice. I focused on the extent to which the processes that accompany the highly visible large-scale park planning projects promote equity and inclusion in the Rail Park in Philadelphia, Pennsylvania and the 11th Street Bridge Park in Washington D.C. This research focuses on natural urban environment settings, with attention given to the development of highly visible parks projects that take at least partial inspiration from New York City’s High Line Park. Park development in underserved neighborhoods can lead to green gentrification. Thus, equity concerns are raised, as the very residents that would benefit the most from environmental improvements such as green space remediation and expansion are more likely to be excluded due to their development. I employed a qualitative methodology utilizing content analysis and 33 in depth interviews were conducted at two park project sites in Philadelphia and Washington D.C. Based on grounded theory, I explored stakeholder attitudes, feelings, and perceptions tied to varied notions of equity and the engagement levels of planning processes connected to park project development. Trust capital emerged as a major theme in the perceived efficacy of development processes that pursue equitable goals. This factor fluctuates with stakeholder perceptions of equity and the legitimization of socioeconomic concerns expressed by the community in urban green infrastructure development. This research concludes that the inclusion of an equitable development (ED) process impacts greening project implementation and the individuals involved.
