Виходячи з визначень «суб’єкт», та «суб’єкт права», запропоновано власне визначення поняття «суб’єкти агарного права». Запропоновано поділ суб’єктів аграрного права на: сільськогосподарських товаровиробників, суб’єктів аграрного сервісу та інших допоміжних суб’єктів. Исходя из определений «субъект» и «субъект права», предложено собственное определение понятия «субъекты аграрного права». Предложено разделение субъектов аграрного права на: сельскохозяйственных товаропроизводителей, субъектов аграрного сервиса и других вспомогательных субъектов. Proceeding from the definitions of «subject» and «subject of law», the actual definition of the concept «subjects of agrarian law» is proposed. The division of subjects of agrarian law for: agricultural commodity producers, subjects of agrarian service and other auxiliary entities is proposed.

Abstract:
The works and activities of M.I. Kozyr, Doctor of Law, Professor, remain in the history of agrarian, land, and environmental law. Mikhail Kozyr's initiative, energy, organizational abilities were manifested in creative scientific and practical searches, numerous articles, textbooks, comments on laws, making legislative proposals, trips with scientific landings to republics, territories and regions of the USSR, on foreign business trips, participation in Italian and European agrarian unions. He appreciated, developed, promoted and taught collective farm – agricultural – agrarian law; developed new approaches to the legal provision of food security in Russia, clarifying the subject and methods, improving the quality of acts of agrarian law, implementing the norms of civil, administrative, land legislation in the legal institutions of agrarian law. M.I. Kozyr sought the restoration of agrarian law as a teaching discipline in law higher educational institutions. Currently, the ideas of M.I. Kozyr are recognized in the Russian legal, agrarian community: agriculture is included in paragraph "d" of Article 72 of the Constitution of the Russian Federation on the joint jurisdiction of the Russian Federation and it's subjects ; agriculture is included in the nomenclature of scientific specialties for the defense of dissertations; the multi-vector nature and importance of studying legal issues of agriculture, justification of ways to improve efficiency of legal regulation of economic activity in the agricultural sector of the economy. The professor's followers and students continue to provide scientific and legal support for the development of agriculture in Russia.

Abstract:
The evolution of agrarian law in Indonesia, particularly land law, must adhere to the constitutional mandate of promoting the welfare of the populace. This subject is compelling because existing studies predominantly address the legal-formal dimensions of customary land law without adequately examining its practical implications for public welfare. This research investigates whether the development of Indonesian land law is in accordance with the Agrarian Law and explores how to formulate legal frameworks that mitigate land disputes and conflicts related to the utilisation of Ulayat Land for development purposes. The objective is to present alternative recommendations for resolving national agrarian law issues, often diverging from constitutional directives. Employing a normative research method, this study draws on both legal and non-legal materials through philosophical, legislative, historical, conceptual, comparative, and futuristic lenses. The findings reveal that the current development of national agrarian law does not fully align with the Agrarian Law's mandate to enhance the welfare of the Indonesian people. Therefore, this research offers alternative legislative methods aimed at producing agrarian legal instruments that more effectively promote the prosperity of the Indonesian population.

The subject of the research – is a set of organizational-economic relations arising in the process of structural transformation of financial and credit relations in the agricultural business. The purpose of the article is a retrospective analysis of structural transformations of financial and credit relations in the agricultural business, evaluation of the effectiveness and feasibility of the introduction of agricultural receipts as a new instrument of lending to the agricultural business of the regions. Methodology of work – system-structural and comparative analyzes (to determine the effectiveness of the crediting mechanism according to the agricultural receipts of the farmers of the region); monographic (when studying the problems of the functioning of the mechanism of lending to agrarians by agrarian receipts) economic analysis (when carrying out a comparative analysis of the mechanism of classical bank lending to the agrarian business and the mechanism of lending to agrarians according to agrarian receipts); modeling and forecasting (when determining ways to overcome the existing deficiencies in the mechanism of lending to agrarian business entities of the region according to agrarian receipts). The results of the work – a retrospective analysis of the structural transformation of financial and credit relations in the agricultural business was carried out. The mechanism of crediting agrarians according to agrarian receipts and the scale of its distribution in the agrarian business of the region are considered. A comparative analysis of the mechanism of classical bank lending to the agrarian business and the mechanism of lending to agrarians according to agrarian receipts was carried out. In the framework of the pilot project “Agrarian receipts in Ukraine” of the international financial corporation (IFC) in partnership with the Swiss Confederation in Ukraine, the example of the Poltava region defined the effectiveness of the crediting mechanism according to the agrarian receipts of the agrarians of the region. The advantages and disadvantages of the mechanism of crediting the subjects of the agrarian business on agrarian receipts are noted. The ways to overcome the existing shortcomings of the mechanism of crediting the subjects of the agrarian business of the region according to agricultural receipts are determined. Conclusions – according to the results of the conducted research, the effectiveness of the mechanism of lending to the agricultural business of the regions according to agricultural receipts was proved, its advantages and disadvantages were noted, and attention was also focused. Proposed in Art. 7 of Law No. 5479-VI clearly delineate cases and restrictions on the debtor’s reimbursement of expenses incurred by the lender with the acquisition of the right to grow and harvest the pledged crop of agricultural products, which will ensure the principle of equality of parties on economic benefits and distribution of credit risks according to agricultural receipts.

The author believes that the new agribusiness relations will be followed by the formation of a new specific legal institution of agrarian law - the institution of legal regulation of agrarian entrepreneurship with its own subject, principles, methods and content of statutory acts aimed to ensure the efficiency of commercial agricultural production under new and constantly changing conditions, as well as food and environmental security of the State.

The paper deals with scientific approaches to the definition of state agrarian policy and concretization in law. Through agrarian sphere, law-making decisions are analyzed, thus expanding and clarifying the subject of legislative regulation using the mechanism of law-making concretization. The author believes that law-making concretization of legal provisions is necessary because, once implemented, it ensures the quality and efficiency of the legal system. A formal legal, systemic method is used to trace vectors of legislative decisions taken in the agricultural sector, starting with the basic legislative directions and guidelines set forth by the state agrarian policy, which are detailed (concretized) by special laws and statutory laws.

Problem setting. The article is devoted to the study of certain issues of correlation between the agrarian and legal categories “digital transformation of agrarian relations” and “innovation activity in the agrarian sector”, and to the disclosure of their legal features. Purpose of the research. The need to differentiate between the categories “digital transformation of agrarian relations” and “agro-innovation activity”, to study their interconnection and to distinguish their legal features is due to the growing relevance of digital technologies in the agrarian sector, the need to implement global sustainable development goals in the agrarian sector and to ensure further development of agrarian legal doctrine, and is aimed at further improvement of legal regulation of these relations. Analysis of recent researches and publications. Leading representatives of agrarian law emphasize that modern agrarian law and agrarian legislation have reached their maximum development on traditional methodological foundations and, as a result, innovative updating of the subject matter of agrarian law is of utmost relevance Article’s main body. At the doctrinal level, it is noted that innovation is not only a new product or service, but also a new technological process, a way of organizing production, changing the structure and creating new markets aimed at meeting the needs of a market segment and obtaining economic benefits. Innovations are systemic in nature, leading to changes at all levels of an agricultural enterprise, as successful implementation requires the interaction of all elements. Leading representatives of agrarian law emphasize that modern agrarian law and agrarian legislation have reached their maximum development on traditional methodological foundations and, as a result, innovative updating of the subject matter of agrarian law is of utmost relevance The need to differentiate between the categories “digital transformation of agrarian relations” and “agro-innovation activity”, to study their interconnection and to distinguish their legal features is due to the growing relevance of digital technologies in the agrarian sector, the need to implement global sustainable development goals in the agrarian sector and to ensure further development of agrarian legal doctrine, and is aimed at further improvement of legal regulation of these relations. The author establishes that legal regulation of relations in the field of implementation of agro-innovations is carried out on the basis of general provisions of legislation, but even under the legal regime of martial law, legislative support for the introduction of innovative technologies into the agro-industrial complex is considered to be one of the priority areas of the State agrarian policy. The article points out the following characteristic, specific features of agrarian innovations, such as a long process of implementation, mostly improvement, dependence on climatic conditions and natural zone, etc. These features distinguish agrarian innovations from innovations in other sectors of the economy. Conclusions and prospects for the development. The author has identified the links between the digital transformation of agricultural relations and innovations, and innovative activities in the agricultural sector, and as a result, the author’s own definition of “digital agro-innovations” is proposed. Particular attention is paid to information and technological agro-innovations as a separate type underlying the digital transformation of relations in the agricultural sector. It is concluded that there is a two-way interaction between digital transformation and innovation in agrarian relations, since the former is becoming a new basis for the functioning and development of the innovation sphere, and the development of innovations demonstrates an acceleration of the pace of development of digital transformation of agrarian relations. At the same time, the author of the article states that digital transformation is a generalized concept, unlike innovation and innovation activity, since the latter are the constituent components of digital transformation of agrarian legal relations which belong to the sub-branch of agro-innovation law in the system of the complex branch of modern agrarian law of Ukraine.

Abstract:
Abstract This study traces how it is applied the rule of law regarding expropriation of the two estates. The study also explains how the parts of the two expropriated estates are divided to the residents of Scortaru Nou village, Brăila county. In Scortaru Nou village, Brăila county, there were two estates belonging to Grădișteanu family: the domain Sihleanu in surface of 2,250 ha and the estate Ariciu in surface of 1,600 ha. The estates were subject, as well as all large estates in the country, of the expropriation laws that preceded the agrarian laws. They were subject to the 1918 law decrees, agrarian law of 1921 and agrarian law of 1945. The estates belonged to class II boyar - Zamfir Sihleanu. These estates reach in the wealth of Grădișteanu family, old boyar family of royal descent, by the marriage between Elena Sihleanu, daughter of Zamfir Sihleanu boyar with Constantine Grădișteanu. Later, the estates of Sihleanu and Ariciu reach also in the Ghica's family wealth by the marriage between the daughter of Constantine Grădișteanu and Elena Sihleanu, Mary, with Scarlat Ghica. In 1919, when the estates are subject to expropriation, the heirs of this beautiful fortune are John C. Grădișteanu, Şerban Ghica and Mary Ştefănescu. Later, in 1945, the heirs are Elena A. Bogdan and Michael Grădișteanu.

Abstract:
Land is the place where people of customary law communities live, and land also provides livelihood for them. Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA), agrarian law that applies to earth, water, and space is customary law where the joints of the law come from the local customary law community, as long as it does not conflict with national and state interests based on national unity and Indonesian socialism. This research study is normative juridical as the main approach, considering that the discussion is based on laws and legal principles that apply in the issue of customary or customary land registration procedures. Customary land rights are authorities, which according to customary law are owned by customary law communities over certain areas that are the environment of their citizens. This position of authority allows communities to benefit from natural resources, including land, within the area for their survival. The Land Registry is called Recht Cadaster. Conversely, for land rights that are subject to customary law, land registration is not carried out so that it does not produce a certificate, but a proof of payment of tax on land, for example Girik, and even if a land registration is carried out for land rights subject to customary law, this is known as Fiscaal Cadaster. Although customary land is not the object of land registration, based on the provisions of the Minister of Agrarian State/Head of the National Land Agency Number 5 of 1999, Article 4 paragraphs (1) and (2) stipulate that customary land can be controlled by individuals and legal entities by registering as land rights if desired by the right holder, namely citizens of customary law communities according to the provisions of the applicable customary law.

ntes de la reforma del 6 de enero de 1992 las acciones agrarias, se sujetaban a los procedimientos administrativos substanciados y resueltos por autoridades de ese orden, con la observancia de principios predominantes correspondientes; sin embargo a partir de que entró en vigor la reforma hecha al artículo 27 de la Constitución Política de los Estados Unidos Mexicanos, que dispuso modernizar la justicia agraria, se instituyeron los órganos de la justicia, tales como los Tribunales Agrarios y la Procuraduría Agraria, con el objeto de garantizar la seguridad jurídica en las tenencia de la tierra ejidal, las cuales son: el Ejido, los bienes Comunales y la Pequeña propiedad; por lo que actualmente el campo mexicano se estructura conforme al marco jurídico este artículo ya mencionado. De la reforma al artículo 1o. constitucional de 10 de junio de 2011, se obtiene que es obligación de todas las autoridades, en el ámbito de sus respectivas competencias, observar los derechos humanos contenidos en la Constitución Federal y en los tratados internacionales. Sin embargo, de ello no se sigue que los órganos jurisdiccionales nacionales, so pretexto del derecho fundamental de acceso a la justicia, de conformidad con lo previsto en la Constitución Federal y en los instrumentos internacionales de derechos humanos, dejen de aplicar los demás principios de la función jurisdiccional, tales como los de legalidad, igualdad, seguridad jurídica y debido proceso, pues ello provocaría un estado de inseguridad en la sociedad que a la postre significaría una transgresión a ese acceso efectivo a la justicia. Nuestro máximo ordenamiento establece en su artículo 17 que toda persona tiene derecho a que se le administre justicia por tribunales que estarán expeditos para impartirla en los plazos y términos que fijen las leyes, emitiendo sus resoluciones de manera pronta, completa e imparcial. Su servicio será gratuito, quedando, en consecuencia, prohibidas las costas judiciales. Por su parte la Suprema Corte de Justicia de la Nación ha sostenido que si bien a toda persona le asiste el derecho de acudir a los tribunales a dirimir sus controversias y litigios, éste debe ejercerse dentro de los plazos y términos y con los requisitos fijados por el legislador ordinario por medio de las leyes secundarias, los cuales son constitucionales en tanto revistan una racionalidad y proporcionalidad como medida restrictiva de acceso a la jurisdicción. Sin embargo, caso aparte y especial atención merece la impartición de justicia en tribunales agrarios, pues si bien son órganos dotados de autonomía y plena jurisdicción, pues en la fracción XIX del artículo 27 Constitucional señala que con base en esta Constitución, el Estado dispondrá las medidas para la expedita y honesta impartición de la justicia agraria, con objeto de garantizar la seguridad jurídica en la tenencia de la tierra ejidal, comunal y de la pequeña propiedad, y apoyará la asesoría legal de los campesinos. Abstract:
The agrarian question is one of Zimbabwe's enduring colonial legacies. At independence the ensemble if issues comprising the agrarian question included an inequitable racial distribution of land, different tenure systems for blacks and white settlers, a discriminatory provision of agricultural support services, and repressive relations between the state and the peasantry. Peasant grievances over the agrarian question mobilised their support for the liberation struggle which culminated in independence in 1980. Contrary to the expectations of the majority of Zimbabweans, agrarian reforms introduced since independence have not transformed the colonial agrarian structure. The thesis investigates factors which account for the nature of agrarian reforms. Using a socio-historical analysis, it examines changes and continuities in agrarian policies and laws. In the main, the thesis argues that reform has been shaped by changes in power relations in society which are reflected in the exercise of state power. It shows that the manner in which independence was achieved and the character and ideologies of the social forces that inherited state power account for the changes and continuities in policies and laws. The thesis demonstrates that land reform was initially constrained by the constitutional provision which protected private property from compulsory acquisition. More important, it argues that reform has been determined by the failure to transform the inherited accumulation strategy, of which capitalist agriculture is an integral element. In addition, it demonstrates that the manner in which land has been redistributed reflects the continuation of colonial ideologies of modernisation. Furthermore, the thesis shows that communal tenure as constructed by the colonial state has been retained partly because of the ideology of nee-traditionalism and partly because it allows the state to intervene in peasant land use and production processes' as part of the process of modernisation. It also shows that the modernisation of peasant agriculture has been attempted through the extension of input, credit, price and marketing packages. Consequently, the thesis shows that the agrarian question is as relevant today as it was at independence, and that the limited and contradictory nature of the agrarian reforms reflects the limitations and contradictions inherent in the post-colonial democratisation process. Hence agrarian reform can only be adequately addressed as part of a comprehensive transformation of the accumulation process and societal democratisation.

Abstract:
This thesis examines spirit mediumship in Chaiyaphum, a province in northeast Thailand. It explores the subjectivity, sociality, personhood, and religiosity of Isan people in relation to modern processes of state formation and socio-economic change. Based on long-term ethnographic fieldwork in Chaiyaphum, the thesis maps the rich pantheon and networks of spirit mediums in this province and pays close attention to ritual embodiment, performativity and personhood. Documenting the centrality of mediumship in domains that range from political legitimation to healing, the findings challenge the presumption that this form of vernacular religiosity is archaic, marginal or waning. Supernaturalism is strongly manifest in the lives of the people of contemporary Chaiyaphum and functions as a supple node for assimilating new concepts and symbolizing and negotiating new relationships in society. The thesis analyzes Thailand as a ritual state where people’s life and the state’s affairs are full of ritual practices. Spirit cults crucially contribute to state formation and nationalism. Ritual performances around historical figures that are enacted by the local people reproduce their subjection under the Thai state. Such spirit practices from the margins contain spectral power and maintain the central state’s power and the monarchy’s auratic potency. At the same time they draw the charismatic power of the central state into local circuits of sociality and meaning. In a region considered the powerhouse of state Buddhism, local spirit cults are not subservient to, undermined by, or detached from state Buddhism. They form a mutualistic relationship with Buddhism to serve people’s proximate needs. The thesis documents the intriguing world of medium-abbot, medium-monks, and spirit mediums whose techniques and authority are modeled on Buddhism, introducing the reader to a cast of practitioners whose identities disrupt the presumed hierarchies between Buddhism and mediumship. Spirit mediumship is central to the reproduction of Isan personhood in a dynamic and shifting globalized social landscape. In a region marked by high levels of labor mobility and social fragmentation, spirit mediums serve as the linchpins for recombinant forms of sociality and selfhood built around an idiom of spiritual kinship. Spirit mediumship can be considered as a contemporary vernacular of empowerment. Spirits facilitate the recognition of female desire and the enactment of extra-domestic feminine social projects. Mediumship encompasses heterogeneous forms of desire and sexuality that conflict with conventional modernist identities. As a healing discipline, mediumship illuminates a material theory of the self and comprises a corporeal technology for mending afflicted personhood through ritual enactments. The multisensory and performative aspects of ritual healing shed light on the relevance of spirit mediumship in reconstituting selfhood in a region undergoing turbulent social change.

The discussion pertaining to the inarbitrability of public policy disputes has a long-standing position in arbitration law. To protect public interests, domestic legal systems imposed a general ban on the arbitration of public policy disputes. In 1985, however, the United States Supreme Court in Mitsubishi Motors Corp. v. Soler Chrysler-Plymouth, Inc. removed antitrust disputes from the category of inarbitrable matters and marked a new phase in the history of inarbitrability. The general nature of Mitsubishi's reasoning affected other Western jurisdictions to remove the inarbitrability of public policy disputes in order to develop international arbitration. Mitsubishi's rationale and holding, therefore, can be considered to be pillars of the new approach to inarbitrability. This thesis critically analyzes Mitsubishi's reasoning and the record of the past three decades in light of case law and the views of prominent scholars. It draws a picture of the current situation of arbitrability in the United States, Canada, France and Belgium. The discussion explains that the removal of inarbitrability has resulted in an ineffective protection for public interests, which has caused dissatisfaction in certain sectors of society and may amount to formation of a radical view hostile to arbitration. The situation raises concerns as to whether the current development of arbitration will endure. This thesis borrows the term "sustainable development" from environmental law and economy, and applies it to international arbitration law. By redefining "sustainable development" according to the needs of international arbitration, this thesis provides a solution for developing arbitration without jeopardizing public policy interests. The solution balances private and public interests to achieve sustainable development in international arbitration.<br>La discussion relative à l'inarbitrabilité des différends portant sur l'ordre public occupe une position de longue date en droit de l'arbitrage. Afin de protéger les intérêts du public, les systèmes juridiques nationaux interdisaient généralement l'arbitrage de différends portant sur des questions d'ordre public. En 1985, cependant, la Cour suprême américaine dans l'affaire Mitsubishi Motors Corp. v. Soler Chrysler-Plymouth, Inc. retira les différends pourtant sur le droit de la concurrence de la catégorie des questions inarbitrables, et marqua une nouvelle phase dans l'histoire de inarbitrabilité. Defined the notion and essential features of the labor-legal status of the head of a higher education institution, in particular, the nature of the legal relationships that the composition is established between the head of a higher education institution (as an employee) and the founder of a higher education institution (as an employer). Features of the emergence and termination of labor relations with the head of the higher education institution are highlighted, and the gaps and conflicts in the normative and legal regulation of labor relations with the head of higher education institution are identified. Specific suggestions and recommendations for improving the legal regulation of the status of the head of a higher education institution as a subject of labor law have been formed.

Abstract:
There are many ways in which gender diversity and sexualness are experienced, spoken of and transacted in India. Recent activism against marginalisation related to sexual and gender nonconformity has led to transformation of some of these idioms into objects that circulate in particular registers of governmentality. In the process, something quite else is created, and this something else portends to speak the truth of 'sexuality in India'. Based on fieldwork carried out between 2005 and 2007 in cities, towns and villages around India, this thesis tells a story of this emergence of 'sexuality' as an aspect of personhood, a political object, a basis for social mobility, a mode of connectedness between people and as a legitimate cause for a movement. The term 'Queer', used variously in India, is a shorthand in some contexts for people who identify as Lesbian, Gay, Bisexual, Transgender, and with South Asian identities such as Hijra, Kothi and Aravani. In others, it refers to a political project challenging norms of heterosexual monogamy, marking a conscious move away from identity-based politics premised on a bio-medical presumption that desire defines personhood. Evoking both these meanings, I examine queer activism as the negotiation of terms of entry of Queer bodies into epidemiological and juridical registers. In relation to the first, I examine interventions of the transnational HIV/AIDS industry that target 'men who have sex with men' – or 'MSM' – the category through which the industry apprehends sexualness between male subjects. I focus on the political-economic conditions of epidemiological knowledge, and on the transformation of idioms of gender and sexualness that its production draws upon. The industry, I argue, is involved in establishing availability of socio-economically marginalised bodies for intervention and research. These relationships of availability are possible because of their promise of social mobility and respectability for queer folk, hitherto despised in masculinist political economies. This mobility is contingent upon the creation and adoption of epidemiologically overdetermined identities which ironically find political significance in being seen as timeless and 'traditional'. The dichotomous being of the 'MSM' - simultaneously the producer and the object of this epidemiological knowledge, implies that the production of this knowledge is predicated upon the ability of queer folk to perform their place in the 'community'. The relationships in the 'field' are already written into the data, and thus the knowledge. Epidemiological knowledge, and the subjects it speaks of, I thus argue, are best understood as articulations of the conditions of their production. The second theme, of Law and the juridical register, opens with an examination of the tensions involved in the production of 'homophobia' as a political object. The disavowal of erotic dimensions in the naming of experiences as 'homophobic violence' is situated in the context of a popular imagination of a worthy juridical subject, and in broader imaginings of power. I then turn to the conditions under which the law, and in particular, Section 377 of the Indian Penal Code, a Victorian anti-sodomy law under which homosexuality is seen to be criminalised, comes to be central to the Queer movement in India. Activism has given Section 377 a 'social life', an awareness of the law in public spheres, amongst law enforcers and branches of the State. Simultaneously, the Law has been inaugurated as a space for the articulation of more diffuse tensions. It has given a tangibility and intelligibility to experiences of exclusion, marginalisation and violence. I then examine a litigation at the High Court of Delhi challenging this law on grounds that it violates Fundamental Rights, focussing on the constitution of a coherent Queer body, cast simultaneously as enumerable, drawing on epidemiological knowledge; and, as capable of instantiation through individual narratives of violation. This project, where a sexuality is ascribed to the citizen-subject, is then juxtaposed with instances where activists actively strip sexualness off of the Queer body in order to make claims to citizenship. This is a cleavage in the Queer movement, an effect of the diversity of bodies it claims to speak of, as, and for, and the conditions under which these diverse bodies seek articulation. Between these projects lies ambiguity, which, I argue, is a precious resource for Queer folk, and for the movement. I suggest a conceptual shift from 'sexuality', (as personhood), to 'sexualness' (where desire flows through subjects without constituting them), argue that the Subject found in registers of governmentality may best be understood in terms of its political economy and distinct from psychic formations, and finally, offer up thoughts for a politics of ambiguity.

L'individuazione degli spazi concessi all'autonomia privata nella predisposizione dell'accordo di ristrutturazione, ha richiesto necessariamente la preventiva risoluzione di alcuni problemi di carattere sistematico e teleologico degli accordi, tra cui l'individuazione dei caratteri dell'istituto, con particolare riferimento agli elementi di comunanza e di diversita' rispetto ad altri strumenti finalizzati ad una soluzione negoziale della crisi d'impresa; la delimitazione del concetto di 'ristrutturazione' ed il suo rapporto, complementare o alternativo a quello di 'risanamento'; l'inquadramento del rapporto che intercorre tra il <<momento negoziale>> e quello <<giurisdizionale>> di formazione dell'accordo. The agreements of debt restructuring ABSTRACT The thesis analyzes the points of view pertaining to content and transaction about the agreement of debt restructuring, as at art. 182 bis l. fall., even without undervaluing the procedural aspects, which hold a prominent position in the case in point. Identifying the spaces granted by private autonomy, in preparation of the restructuring agreement, necessarily required the preventive resolution of some problems of systemic and teleological type concerning the agreements. Among them identifying the characters of the institution, with a special concern to the traits of community and diversity in comparison with other instruments directed to a contractual solution of the enterprise crisis: delimitation of the concept of à ¢ restructuringà ¢ and its complementary or alternative relationship with the concept of à ¢ recoveryà ¢ , and setting of the relationship existing between the à ¢ transaction time à ¢ and the à ¢ jurisdictional timeà ¢ in making the arrangement. A record of recent jurisprudential cases developed on this topic has been also taken in consideration, when outlining the possible content of the arrangement. As a whole the work aims to bring out the potentialities of the institution as instrument of settlement of the enterprise crisis. This chapter highlights the importance of paper as a powerful conduit for the spread of jurisdictions in the late colonial period. It compels different authorities to recognize and heed the words of colonial subjects. The chapter also discusses the Surat kuasa, the Malay and Indonesian term for power of attorney, probate, and letters of administration. The power of attorney, also known as volmacht in Dutch, was such a popular device in the Dutch colony. Produced for diverse reasons, powers of attorney were versatile and revocable, and the chapter elaborates three common kinds of powers of attorney: the first dealt with disbursing inheritance shares according to Islamic law; the second was granted by Arabs in Hadramawt to fellow Arabs, usually their relatives or business partners, specifically to manage their business and property in Southeast Asia; and the third was legally controversial and found only in the Netherlands Indies, where colonial subjects classified as “Foreign Orientals,” including Arabs, were restricted from owning certain kinds of property, such as agrarian land, which were reserved for colonial subjects classified as Natives by Dutch authorities. Ultimately, the chapter demonstrates a phenomenon called “illegal occupation,” in which some of the land was acquired through the recouping of debts and by transfer of land through powers of attorney.

Water is essential for all socio-economic development and for maintaining a healthy ecosystem in the world. At present, reduction of water scarcity is prime goal of many countries and governments. Water scarcity is one of the most important concerns of present-day geographers as water is the central subject of all kinds of developmental activities. Rajasthan is the largest state in India covering an area of 34.22 million hectares, i.e.10.5 percent of the country’s geographical area, but sharing only 1.15 percent of its water resources. The state is predominantly agrarian as the livelihood of 70 percent of its people depends on agriculturebased activities. Most of the state (60-75%) is arid or semiarid. Waterways are a vital and productive resource to our environment. Rajasthan in India is characterized by very low mean annual rainfall (100-400 mm), high inter-annual variability in rainfall and stream flows, and poorquality soils and groundwater. Rajasthan has a rich history of use of traditional systems of water harvesting in almost all the districts of the state. These practices have often saved the droughtaffected regions from problems of water famine. The serious problems of water shortages in many parts of the country are being largely attributed to the discontinued use of traditional water harvesting practices. This paper discusses reasons of scarcity of water in arid zones and also explore various traditional &amp; modern water systems to resolve the issue of water scarcity in arid parts of India.

Abstract:
In this class note, the aim is to clarify the content and practical applications of the subject of legal dogmatics. It will delve deeply into matters concerning its conceptualization, epistemological nature, empiricism, and rationality. Legal dogmatics will be studied as a legal science, establishing its relationship with other sciences. Different sources of law will be analyzed, as well as the concept and structure of legal norms. A conceptual characterization of legal systems will be developed, including normative hierarchy. Finally, a thorough exploration of the legal order within the Colombian legal regime will be conducted, considering the main existing legal systems. Ultimately, the objective is to provide a detailed outline of the topics to be covered during Legal Dogmatics and how these contents can be practically applied in legal practice to address common situations in the legal profession.

Understanding land accumulation dynamics is relevant for policy makers interested in the economic effects of land inequality in developing country agriculture. We thus explore and simultaneously test the leading theories of microlevel land accumulation dynamics using unique panel data from Paraguay. The results suggest that farm growth varies systematically with farm size --a formal rejection of stochasticgrowth theories (that is, Gibrat's Law)-- and that titled land area may have considerable infuence on land accumulation. Furthermore, our estimates indicate that a dualistic agrarian structure is the likely product of the unfettered operation of land markets.

This class note aims to clarify the content and practical applications of the Criminal Procedure subject, and it will delve into matters related to its conceptualization, the importance of understanding the basic concepts of criminal law, criminal offenses, and their consequences. The theoretical part of criminal procedure, the fundamental principles of procedural criminal law, and their relationship with other areas of law will be analyzed. A conceptual characterization of the penal system, the normative hierarchy, and a detailed overview of the legal order in the Colombian penal regime will be developed, taking into account the current regulations. Finally, the aim is to provide a well-detailed outline of the topics to be covered in the Criminal Procedure course. Moreover, it will demonstrate how these contents can be practically applied in the legal field to resolve common situations encountered during the student’s academic journey.

When we think on initiatives on access to and reuse of data, we must consider both the European Intellectual Property Law and the General Data Protection Regulation (GDPR). The first one provides a special intellectual property (IP) right – the sui generis right – for those makers that made a substantial investment when creating the database, whether it contains personal or non-personal data. That substantial investment can be made by just one person, but, in many cases, it is the result of the activities of many people and/or some undertakings processing and aggregating data. In the modern digital economy, data are being dubbed the ‘new oil’ and the sui generis right might be con- sidered a right to control any access to the database, thus having an undeniable relevance. Besides, there are still important inconsistences between IP Law and the GDPR, which must be removed by the European legislator. The genuine and free consent of the data subject for the use of his/her data must remain the first step of the legal analysis.
