Abstract:
Příspěvek je zaměřen na koncepci návratu zásady superficies solo cedit do českého právního řádu. Věnuje se především analýze přechodných ustanovení občanského zákoníku, jež mají za úkol znovuzavedení zmiňovaného principu realizovat. Přístup českého právního řádu je pak porovnáván s řešením, ke kterému bylo přistoupeno v obdobném případě počátkem devadesátých let minulého století v Německu. Příspěvek obsahuje rovněž polemiku s názory řešícími potřebu zakotvení superficiální zásady a její přínos. V souvislosti s uvedeným principem se konkrétně věnuje právu stavby a předkupnímu právu v obou dotčených právních úpravách.

Summary The new approach to a thing enables the concept of residential co-ownership within the superficiary right of building. Residential co-ownership may be created where a building with at least two apartments forms the component part of the immovable thing. ‘Superficies’: The Roman Origins Of The Right To Build Upon A Plot Of LandSummaryThe aim of this paper is to present the Roman origin of the right of superficies (the right to erect a building on a plot of land), which is thesubject of a bill drafted by the Polish Civil Law Codification Committee. This right is to replace the institution of perpetual usufruct, which has been extant in Polish civil law since the 1960s. Superficies has been present in many European systems of law (for example in the Bürgerliches Gesetzbuch German Civil Code of 1896, and the Austrian law of 1919). The author compares the subject and object of the right in question, the legal situation of the superficiarius and the rights of the owner of the land in Roman law and in the Polish draft bill. The main difference between the Roman superficies and the right proposed in the draft bill is the deviation from the principle of accession (superficies solo cedit): under the Polish draft bill the superficiarius will become the owner of the building. Furthermore, the Roman superficies was perpetual; in Poland it will be constructed as temporary (30-100 years). Both rights (in Roman and Polish law) share many other similarities: they are hereditary, and the superficiarius is to pay the owner of the land. The conclusion which may be drawn is that Roman institutions can still inspire the contemporary legislator.

Abstract The ancient history of the concept of condominium and the particular attitude towards the right of ownership of an apartment has attracted worldwide recognition for this type of property. The concept of condominium is based on three components: (1) individual ownership of an apartment; (2) joint possession of common property of a plot of land and parts of a building; and (3) membership in an owners’ association. An apartment in a condominium is an exception to the principle of superficies solo cedit in property law. In this case, the rights of ownership of owners of apartments in a condominium—the rights of ownership of a number of persons—are accumulated with regard to a plot of land. This article analyses, on the one hand, the peculiarities of apartment ownership in condominiums, Georgian legislation—which is the result of the reception of German civil law, and, on the other hand, the court practice developed on these issues in Georgian law.

У статті розглянуто низка питань, пов’язаних із конструкціями «квартирних прав». Автор зазначає подвійну природу «права на квартиру», яке є сукупністю особливих прав власності на квартиру та надає їх власнику одне з основних прав людини – право на житло. Метою роботи є розгляд прийнятних моделей «квартирних прав», відомих правовим системам континентального права, і порівняння їх із ситуацією, що склалася з цього питання в законодавстві України. Був використаний метод порівняльного правового дослідження. Автор робить такі висновки: 1. Ідея житлових майнових комплексів виникає на основі об’єднання технічних концепцій багатоквартирних будинків і спільної власності, відомих ще зі Стародавнього Риму. 2. Правова ідея встановлення спеціальних майнових прав відносно частин багатоповерхового будинку виникає у зв’язку з необхідністю визнання прав на ізольовані приміщення, особливо квартири, у виняток загального принципу superficies solo cedit. 3. Завдання розробки прийнятної конструкції щодо комплексу прав, які виникають у зв’язку з визнанням квартир та інших ізольованих приміщень об’єктами прав може бути вирішена з урахуванням досвіду європейських юрисдикцій: шляхом визнання таких приміщень в якості цільових об’єктів права власності з поширенням режиму спільної власності на земельну ділянку або шляхом визнання ізольованих приміщень об’єктами ексклюзивного права осіб на проживання, яке визнається компонентом часткової власності. 4. Визнання квартир як об’єктів майнових прав в силу їх цільового призначення виключає розширення правового режиму абсолютних майнових прав на них. 5. Аналіз чинного законодавства України дає підстави вважати ситуацію, модель відносин, які виникають між власниками квартир у багатоквартирних будинках, далекою від ідеальної і здебільшого не продуманою. 6. Закріплення конструкцій «квартирних прав» у чинному законодавстві має здійснюватися з урахуванням того факту, що житлові приміщення слід розглядати в якості меріторних благ.

Abstract:
The purpose of the paper is to classify the buildings built in marriage and investments made in one of the spouses’ property from the viewpoint of the current system of civil rights objects, to determine the appropriate ways to protect the interests of the spouses arising in connection with these objects. The analysis of the norms of civil and family legislation made it possible to identify the problem of legal insecurity of a spouse’s interest in common joint property when reimbursing expenses incurred in connection with his investments into the other spouse’s property maintenance or improvement. The same is true for the acquisition of ownership rights to a building erected during the marriage on a plot of land owned by the other spouse in the absence of primary registration of the right to it. It is established that a direct application of civil law object classification in determining the composition of marital property subject to division, leading to interdependent loss of efficiency of norms of civil and family law (repaying the action of each other), and deprivation of the indicated interests of a spouse legal protection. It is proved that the protection of the interest in compensation for expenses incurred to improve or maintain the personal property of one of the spouses can only be provided by adding a special norm to the Family Code of the Russian Federation that fixes the legality of this interest and determines the method of its protection. The spouse’s interest in acquiring ownership of a building erected during marriage on a plot of land owned by the other spouse, if the primary ownership of the building is not registered, can only be protected by adapting the principles of real property classification to the regime of common joint property of the spouses by expanding the scope of the exception to the principle of incorporation or by introducing an exception to the principle of superficies solo cedit.

Abstract:
The analysis undertaken in this article covers two issues: the legal status of water facilities and the methods of management of those devices that are owned by the State Treasury. The first one has not been the subject of interest of legal sciences for a long time. The doubts related to it were present in legal debate only through the case law of the administrative courts. The ground-breaking importance is held mainly by the judgment of the Supreme Administrative Court of 16 January 2009. It is the first judgment that settled on the legal status of the water facilities. The Administrative Court in Warsaw opined that the weir on the river was a part of the soil surface covered with fl owing water (river), however the Supreme Administrative Court questioned this view by affirming that such devices were subject to separate ownership and thus formed an exception to the principle of superficies solo cedit. Equally controversial is the governance of the water facilities owned by the State Treasury. The provisions of the Act on Water Law are inconsistent and incoherent. The problems arising in this context remain largely unnoticed in the case law of the administrative courts. The article is summed up by complex de lege ferenda conclusions, designed to remove incoherent and inconsistent provisions of the Water Law.

Influence of this Cadastral law on a real estate practice is also described in this work. Superficies solo cedit The topic of the presented diploma thesis is the principle of superficies viewed from its historic development and its place in current law. The principle stipulates that whatever is found on a land or has arisen from it, becomes parts of it. The superficies principle has been in employment since ancient Rome and has been reintroduced in our legal system after the recodification of private law in 2012 The thesis begins with the historical development of the superficies principle not only in Roman law, but also in the Czech lands, especially with its 1811 AD codification in AGBG. The historical development is followed by a brief description of the departure from the superficies principle following political and societal changes in post-war Czechoslovakia. This principle is gowerning the ownership of the land and is closely linked to the legal institutes as component parts, immovables, the right of superficies.. According to this principle, buldings and plants form part of the main legal object, which is land the superficies solo cedit principle leads us to the ancient Rome, which has been giving complex legal base to the current continental system of law untill nowadays. Therefore I dedicate my first chapter to the origin of the principle in roman law. Second chapter is dedicated to the ABGB Code, which is basicly inspired by roman law and as itself is the main source of the new Civil Code Nr. 89/2012 Sb. New civil code is the core of this thesis. Above all because it reestablished the superficies solo cedit principle and after many years brought it to life. Reestablishment of the principle has uncountable consequences not only in the area of private law. This diploma thesis deals with the principle of superficies solo cedit, whose roots go back to Roman law. The principle, which can be translated as "the surface gives way to the ground", expresses the rule according to which the land includes everything that arises on it, whether in a natural or artificial way. In the history of the Czech lands, the principle was applied under the General Civil Code from 1811 until the adoption of the Civil Code of 1950. On the contrary, this Code applied the opposite principle and thus introduced separate ownership of land and buildings. The principle returned to our legal system with the adoption of Act No. 89/2012 Coll., The Civil Code. The aim of this thesis is to present the principle in a historical context, to give an explanation of its current form and to specify the problems that arose with the adoption of the principle of superficies. This thesis is focused on the superficies solo cedit principle which was already known in Roman law and which expresses the rule that the surface yields to the ground. As a result of this rule, everything that is built on the land and that grows up naturally there belongs to the owner of the land. The aim of the thesis is to describe origin and historical development of the superficies solo cedit principle, subsequently to present its current expression in the legal order of the Czech Republic and to identify its problems, and, finally, to point out the effects of the restoration of the superficies solo cedit on the Czech legal system. The thesis is divided into seven separate chapters. Chapter One describes the expression and development of the superficies solo cedit principle in the Roman law. Chapter Two particularly deals with the ABGB Code from 1811 which was valid in the area of today's Czech Republic until 1950 and which significantly influenced the current Czech Civil Code. PRINCIPLE OF SUPERFICIES SOLO CEDIT This thesis focuses on the superficies solo cedit principle, which can be translated as "the surface yields to the ground". The principle originated in Roman law and is projected into legal systems of most of the European democratic countries until today. According to this principle, everything firmly attached to the ground or grown on the land is component part of the land. Therefore, plants and structures are considered as typical component parts of the tract of land. The owner of the tract of land simultaneously and automatically owns its component parts. All dispositions regarding the tract of land must include the component parts, as component parts are not separate objects of law. The topic of this thesis is the return of the legal principle of superficies solo cedit into the Czech legal order. The thesis aims at the comprehensive overview and the analysis of the issue of this principle based on its inclusion both in the historical and contemporary context. Another objective of this thesis is to look at the registration of the principle, including related institutes, into the public register - the cadastre of real estates. This thesis is divided into three parts. The main aim of this thesis was to give a comprehensive view of this issue, especially how the return of the principle has changed land law relations. The first part of the thesis describe the division of the law to private law and public law. The aim of the thesis is to describe the concept of the superficial principle in the valid legal regulation and its influence on land law relations. As a result of the reintroduction of the superficial principle into the legal order of the Czech Republic by Act No. 89/2012 Coll., The Civil Code, all that is associated with the earth's surface becomes part of the given land. The thesis is divided into five structured chapters. The first chapter is devoted to land law as an interdisciplinary law system. The aim of second chapter is to explain the key importance of the superficial principle within the context of land law. The third chapter deals with the historical background of the development of legal relations to immovables in the territory of the Czech lands, also including the introduction of the Roman settlement as the basis of the superficial principle. Comparison of building legislation according to current and new Civil Code In my master's thesis I focus on building legislation according to the Civil Code. The building, either as a separate thing or part of other things, is mainly the subject of ownership, but also of other civil relations. Therefore it is very widely used and discussed concept. The main goal of the thesis is to describe in detail concept of building in the current Civil Code, with focus on shortcomings and the most problematic areas, and confront it with changes in the new Civil Code. The purpose is also to provide summary of building issues and possible advantages or disadvantages its enactment in the new Civil Code. I mainly concentrate on different division of things and problems with definition of the term building, which apply to specific examples.
