Vernacular architecture represents a great resource that has considerable potential to define principles for sustainable design and contemporary architecture. This publication is the result of an overall aim to produce a valuable tool for analysis regarding vernacular heritage through different assessments, in order to define principles to consider for sustainable development. This was possible through a comprehensive reflection on the principles established and the strategies to recognise in different world contexts. The present publication was the result of an in-depth approach by 46 authors from 12 countries, concerned with the analysis and critical assessment of vernacular heritage and its sustainable perspective. The book presents 8 chapters addressing operational definitions and synopses advances, regarding the main areas of vernacular heritage contribution to sustainable architecture. It also presents 15 chapters and 53 case studies of vernacular and contemporary approaches in all the 5 continents, regarding urban, architectural, technical and constructive strategies and solutions. Abstract:
Superior Women examines female monastic authority at the abbey of Sainte-Croix in Poitiers from its foundation by Saint-Radegund in the sixth century through its sixteenth-century reform. Along with the abbey, Radegund established two strategies for her nuns to defend authority they claimed over their community, dependents, properties, tenants, and vassals. First, she secured a network of supporters, allies with extensive authority, to document the abbey’s privileges and defend Sainte-Croix. Their documents became a rich archive useful for recruiting new allies. Over time this network included the king of France, neighboring bishops, and the pope. Second, she used cultural artifacts, symbols, and ideas spotlighting her life story. Poetry commissioned from Venantius Fortunatus helped her win allies in Byzantium who then helped her secure a relic of the True Cross for the abbey. Later abbesses drew upon these cultural artifacts at times of crisis or at the loss of a traditional supporter in order to rebuild the abbey’s reputation and win new allies. These two strategies proved enormously successful for later abbesses at Sainte-Croix. Radegund’s example provided a powerful model of female authority on which the women of Sainte-Croix were able to draw, with the support of male allies. So long as Sainte-Croix was competently governed by abbesses talented in the deployment of Radegund’s strategies, the abbey remained strong, well supported, mostly autonomous, and in firm control of its dependents, and this situation persisted through the sixteenth century.

Abstract:
This chapter comments on Article 33 of the Rome Statute of the International Criminal Court. Prior to the adoption of article 33 of the Rome Statute, those who established international criminal tribunals contented themselves with a blanket prohibition on the defence of superior orders. However, article 33 declared that superior orders is a defence when three conditions are met: the accused must be under a legal obligation to obey orders of a government or superior; the accused must not know that the order was unlawful; and the order must not be manifestly unlawful. To date, the defence of superior orders appears to have been invoked in proceedings at the International Criminal Court only once, in a case involving charges under article 70 relating to the administration of justice and not to one of the core crimes listed in article 5 of the Statute.

Principle 27 deals with restrictions on justifications related to the doctrines of due obedience, superior responsibility, and official status. The defence of due obedience (or superior orders) is premised on the notion that orders must be obeyed and that subordinates often have little or no discretion to refuse to abide by orders of their superiors. The doctrine of command responsibility (or superior criminal responsibility), a creation of international criminal law, states that superiors are criminally liable if they fail to prevent or punish the crimes committed by their subordinates. Under international law in respect to international crimes, immunities are divided into functional immunity (immunity ratione materiae) and personal immunity (immunity ratione personae). This chapter first provides a contextual and historical background on Principle 27 before discussing its theoretical framework and how the doctrines of due obedience, superior responsibility, and official status have been applied in practice.

Superior orders is probably the best known defence in ICL; in case law as well as in scholarly debates. As the UN War Crimes Commission observed, ‘the plea of superior orders has been raised by the Defence in war crime trials more frequently than any other’. The legal debate on superior orders has produced three main schools of thought: the respondeat superior doctrine; the absolute liability or full responsibility doctrine; and the conditional liability or limited responsibility doctrine that exists in different versions. These three views are central to the analysis in this chapter of superior orders. Much has been written on the defence of superior orders. The discussion is limited to the main points in the superior orders debate.

Herder’s theory of translation not only ultimately inspired but is also superior to the most important current theories of translation, those of Berman and Venuti. It is superior to them largely because it continues a traditional conception that faithfully re-expressing the meaning of the source text is a central criterion of success in translation. Like his hermeneutics, Herder’s translation theory rests on his philosophy of language and his principle of radical mental difference. He develops a number of important principles here, including a principle that the way to achieve semantic faithfulness in the face of conceptual differences is to “bend” word-usages in the target language in order to reproduce those in the source language, and a principle that translation must also strive for musical faithfulness. His translation theory not only inspired Schleiermacher’s but also made possible the extraordinary improvements in translation practice that occurred in the generation after him.

This chapter gives a brief overview of Hamiltonian mechanics. The complexity of the Newtonian equations of motion for N interacting bodies led to the development in the late 18th and early 19th centuries of a formalism that reduces these equations to first-order differential equations. This formalism is known as Hamiltonian mechanics. This chapter shows how, given a Lagrangian and having constructed the corresponding Hamiltonian, Hamilton’s equations amount to simply a rewriting of the Euler–Lagrange equations. The feature that makes the Hamiltonian formulation superior is that the dimension of the phase space is double that of the configuration space, so that in addition to point transformations, it is possible to perform more general transformations in order to simplify solving the equations of motion.

Abstract:
This book defends the theory of legal monism against dualism and pluralism. Whereas dualism holds that different bodies of law such as international and national law are entirely separate and pluralism argues that there are many potentially overlapping and heterarchical bodies of law, monism considers all law to form part of one unitary and hierarchically ordered legal order, be it international, EU, or national law. To this end, this book will use the pure theory of law of the Vienna School of Jurisprudence, which has—since its inception in the first half of the twentieth century—been largely ignored by legal theorists. On the basis of philosophical/epistemological, legal, and moral/political arguments, it will argue in favour of monism under the primacy of international law, i.e. that in cases of normative conflicts, international and EU law prevail over national law, and thereby restore the respect for international legal cooperation. In other words, it will argue that only this version of monism takes the law and the concept of legal validity seriously; that it can better describe and explain the relationship between legal orders and resolve normative conflicts than dualism and pluralism; and that it has a superior moral dimension, which can help bring about a cosmopolitan legal order under global democracy and peace.
