Abstract:

Abstract:
<p>The increasing number of internet users in Indonesia, especially mobile internet users, has changed consumer habits and behavior in consuming entertainment. Internet penetration leads to the increasing consumption of streaming video on demand (SVOD) services in Indonesia, which is increasingly popular. Netflix is one of the largest SVOD service providers in the world that has a customer subscription system. The tight competition in the SVOD industry caused Netflix to experience a significant reduction in the number of global subscribers. Therefore, the researcher's goal is to predict which factors influence the consumer's decision-making process to continue to use Netflix in view of the model of consumer attitudes toward technology adoption. The research data come from non-probability sampling with judgmental sampling techniques of 237 Netflix’s subscribers across Indonesia that have subscribed Netflix for more than three months, and having an intensity of use for 2-5 hours or more per day. This research was conducted with a quantitative descriptive method using Structural Equation Modelling method. This study <span style="text-decoration: line-through;"> </span>indicate that there’s a positive relationship between perceived system quality and perceived enjoyment of attitude to use. Furthermore, there is a negative influence between the perceived price level and attitude to use. This study also reaffirms that the SVOD attitude to use is a predictor of continuance intention to use SVOD. This research also proved that perceived ease of use, perceived content quality, customization, and perceived psychological risk did not affect the attitude to use SVOD.</p><p><em><strong>Abstrak dalam Bahasa Indonesia.</strong> Dengan semakin meningkatnya jumlah pengguna internet di Indonesia, khususnya dari sisi pengguna internet seluler, telah mengubah kebiasaan dan perilaku konsumen dalam mengonsumsi hiburan.

Abstract:
Abstract Introduction Hepatic veno-occlusive disease (VOD), also known as sinusoidal obstruction syndrome (SOS) is a potentially fatal complication of HSCT and is characterized by hepatomegaly, right upper quadrant pain, jaundice, and ascites (Gratwohl A et al JAMA 2010). Severe VOD (sVOD) is clinically characterized by multi-organ dysfunction and is estimated to have a mortality rate of over 80% (Coppell JA et al BBMT 2010). VOD and particularly sVOD pose a significant economic burden in direct medical costs by adding an estimated $53,000 to HSCT (2004 U.S. dollars; Saito et al BBMT 2008), or $78,000 in 2015 dollars. However, little research has been conducted in ascertaining the indirect costs associated with premature death due to VOD. In our study, we developed an economic model to evaluate the indirect cost associated with premature death due to sVOD among HSCT patients in the U.S. Methods An Excel-based model was developed to estimate the indirect cost associated with premature death due to sVOD among HSCT patients. Model inputs included prevalence of sVOD as well as mortality, age, salary, employment rate, and life expectancy. Inputs were obtained from the published literature, Center for International Blood & Marrow Transplant Research (CIBMTR), Centers for Disease Control and Prevention (CDC), U.S. Census Bureau, and Organisation for Economic Co-operation and Development (OECD). The model considered lost productivity as the result of premature death by calculating the number of years between the age of sVOD-related death and the assumed age of retirement (65 years old); it was assumed that the lifetime salary reflected underlying productivity of HSCT survivors who did not develop sVOD. Annual salary and life expectancy among HSCT survivors were adjusted from the general population to reflect decreased productivity in the first 2 years immediately following HSCT. Annual average salary inputs by age categories were assumed to be the same as the general population. Age of the working population was assumed to be between 18 and 65 years old. Excess mortality from sVOD was calculated as number of deaths among sVOD patients minus the number of deaths among HSCT patients who did not develop sVOD. Indirect cost was expressed as the cumulative salary for all productive years contributed by a patient and included a 3% discount for each additional year. Total lost productivity years and indirect costs by age category were obtained by multiplying each respective per patient value by the number of excess deaths in each age category. A sensitivity analysis was performed to examine the impact of changes in key model parameters on model results. Results The model estimated 361 excess deaths per year due to sVOD in the HSCT population. The excess deaths due to sVOD were associated with indirect costs of over $68 million due to reduced life expectancy and consequent productivity loss. AlloSCT patients were younger on average, resulting in greater indirect costs ($39 million) compared to AutoSCT ($29 million). AlloSCT patients lost 3,637 productive years on average compared to 2,353 lost productive years for AutoSCT patients despite fewer patients receiving AlloSCT than AutoSCT. A sensitivity analysis showed that the total indirect costs due to overall VOD (non-severe and severe) were as high as $73.3 million. Conclusion sVOD imposes a substantial economic burden on patients in terms of excess deaths, lost productivity, and indirect costs. The model underestimates indirect costs largely due to not accounting for productivity loss among children and their caregivers or those older than 65. It also does not calculate productivity loss among HSCT survivors. Future research is warranted to elicit the additional indirect costs associated with non-severe VOD. Figure 3. Deterministic Sensitivity Analysis: Total Indirect Costs due to Excess Deaths due to sVOD Compared with HSCT Survivors without VOD. Figure 3. Abstract:
We analyze outcomes of two randomized field experiments to study the effect of binge-watching on subscription to video on demand. In both cases, we offered access to subscription video on demand (SVoD) to a random set of households for several weeks and used another random set of households as control group. In both cases, we find that the households induced to binge-watch TV shows are less likely to pay for SVoD after the free trials. Our results suggest that induced binge-watchers deplete the content of interest to them very quickly, which reduces their short-term willingness to pay for SVoD. We also show that carefully crafted recommendation reminders aimed at widening the preferences of consumers for content offset the negative effect of binge-watching and lessen the concerns of binge-watchers with lack of content refresh, and thus these reminders may help content providers manage supply costs, which may otherwise become prohibitive with frequent updates to SVoD catalogs.

Abstract:
Abstract Introduction: VOD (also known as Sinusoidal Obstruction Syndrome) is a potentially life threatening complication of hematopoietic stem-cell transplantation (HSCT). Severe VOD (sVOD), defined as VOD with evidence of multi-organ dysfunction (MOD), leads to high morbidity and mortality in HSCT patients. This study assessed healthcare utilization and costs associated with VOD in patients undergoing HSCT. Methods: A retrospective cohort study was conducted using the Premier research database and had a starting population of all patients with inpatient HSCT between January 1, 2009 and May 31, 2014. The VOD cohort ("all-VOD") included those who also had at least one discharge diagnosis indicating liver injury or at least two diagnoses for VOD symptoms, such as hyperbilirubinemia and/or hepatomegaly, during the study period. sVOD patients were identified using diagnoses for multi-organ dysfunction and were a subset of the VOD cohort. The non-VOD cohort was all patients from the starting cohort who did not have evidence of VOD. Primary outcomes were total hospitalization costs, hospital length of stay (LOS), and inpatient mortality. Secondary outcomes were intensive care unit (ICU) costs, ICU LOS, 30-day all-cause readmission rates and associated costs. Unadjusted descriptive analysis included Chi-squared or Wilcoxon Rank Sum tests for comparisons between cohorts, with non-VOD as the reference group. Multivariable analysis estimated the association between VOD status and primary outcomes, adjusting for differences in demographic, hospital, and clinical characteristics. Generalized linear models (GLM) were applied for total costs and LOS, and logistic regression was used for inpatient mortality. Recycled prediction was used to calculate the adjusted outcomes by VOD status. Results: A total of 5,418 patients had inpatient HSCT during the study period. The study included 291 all-VOD patients (134 sVOD and 157 non-severe VOD), in addition to 5,127 patients without evidence of VOD. Unadjusted descriptive analysis found that the all-VOD cohort had higher hospital costs (Median: $119,594, IQR: $59,793-$220,461) and longer LOS (Median: 28 days, IQR: 20-41) than the non-VOD cohort (Median cost: $62,747, IQR: $40,590-$120,974, p<0.001; Median LOS: 21 days, IQR: 16-27; p <0.001). The sVOD sub-cohort had much higher costs and LOS (Median cost: $198,436, IQR: $102,027-$406,683, p<0.001; Median LOS: 37.5 days, IQR: 27-66; p<0.001). Inpatient mortality rates in the all-VOD and sVOD groups were significantly higher than the non-VOD group (non-VOD: 3.0% vs VOD: 18.6%, p<0.001; sVOD: 39.6%, p<0.001). In multivariable regressions, the adjusted hospital costs for non-severe VOD was $8,988 higher than the non-VOD group (p=0.037), and sVOD was $41,703 higher than the non-VOD group (p<0.001). The adjusted hospital LOS for non-severe VOD was 0.90 days longer than the non-VOD group (p=0.023) and for the sVOD group was 7.02 days longer than the non-VOD group (p<0.001). The sVOD group had significantly higher inpatient mortality (10.6%) compared with non-VOD group (3.4%, Adjusted Odds Ratio=5.88, p<0.001), although the mortality difference between non-severe VOD and non-VOD groups was not significant. Discussion: This analysis is subject to limitations of administrative data. Since there is no diagnostic code for VOD, we used clinical judgment to sort through the codes most likely to be related to VOD/sVOD. Notably, the 40% mortality in the sVOD group is considerably lower than the approximately 80% mortality reported in the literature. One important reason for this difference is that our analysis measured mortality during initial HSCT hospitalization, while the higher rates in the literature are based on 100-day mortality. Additionally, our algorithm may have yielded less severe disease compared to the literature. Conclusions: VOD and sVOD were associated with increased healthcare utilization and costs compared with the HSCT patients without VOD. sVOD patients also had almost 6 times higher odds of inpatient mortality compared with patients without VOD. Abstract:
Faced with heavy competition of global subscription-video-on-demand (SVOD) streaming services, along with increased pressure on fi nancing and distribution of domestic content, legacy media players are increasingly exploring the potential of local SVOD services as domestic alternatives to global platforms such as Netflix and Disney+, often in collaboration with other European broadcasters and/or distributors. This article presents an in-depth case study of Streamz, a domestic SVOD alternative launched in Belgium in September 2020. Building on scholarly work on media disruption and platform power, the case study examines the political and market context that shaped the existence of the platform, and critically analyses the strategies pursued by legacy media players in attempting to develop and emulate key competitive advantages of global SVOD players. The article demonstrates how a persistent policy push to collaborate in a small market resulted in an unusual joint venture and, at the same time, how diff erent market factors, most of them characteristic for small media markets, pose signifi cant challenges for domestic players to develop a profi table platform in Europe, let alone be able to stand achance in a highly competitive streaming market.

Learning outcomes The case study illustrated strategic, marketing, financial and operational challenges faced by Netflix in India's growing SVoD market. This case is appropriate in courses such as Strategic Management, Business Strategy, Marketing Management and International Marketing for postgraduate MBA students, other graduate-level management programs and undergraduate-level students. The case was developed to raise awareness among students, to understand the complex nature of the technology-driven industry, to survive in the highly competitive market, to set up a company that serves the huge Indian market. This case delves into the dynamics of marketing on the Indian market, characterized by unorganized players such as local cable television; torrent downloads and organized and established players, low digitalization rates, language barriers, low internet penetration, lack of infrastructure, price-sensitive consumers. Due to up-gradation in technology, internet penetration, an increase in smartphone users, and the market has undergone a notable amount of change, due to a lot on new entrants, competitions, substitutes. The case states various obstacles, for a multinational company while entering the market such as India and how they are required to strategize, mold their marketing mix, need to analyze en-cash their strength, overcome their weakness, take maximum advantage of opportunities and modify their strategies to face huge challenges. The specific learning outcome of the case will help students to understand the strategy that multinational companies can adopt to sustain, compete in emerging countries such as India and within that emerging market such as streaming videos on demand (SVoD). This case will help students to understand the importance of internal and external resources, which help multinational companies to make strategies based on these resources. The case study offers learners the opportunity to explore the strategy in a dynamic environment. This case also highlights the critical issues that should be addressed by multinational companies when entering into a foreign market. The case highlights the importance of analyzing the competitive environment in which it’s going to compete and sustain. It can be used to introduce Ansoff’s growth matrix, internal and external factor analysis and porter’s five forces in the delivery of course for both regular and executive programs. The case should be offered in the middle term periods of the course. Additionally, the case could be used in marketing courses to indicate the importance of scanning the business environment in marketing activities for any organization. The case illustrates the strategies that companies can undertake to expand the market, introduce new products, as per the requirement of business environment and concerns linked with innovating approaches to support the organization to satisfy a larger number of price-sensitive consumers from varied backgrounds. Case overview/synopsis Netflix has been optimistic about the potential growth of the Indian market. It will grow slowly and gradually and become profitable. The SVoD market in India has been price sensitive. There are no plans for cheaper prices. Netflix had a long way to go. The pricing model of Netflix was a hurdle in its growth, but the future of Netflix in India was bright. There have been numerous challenges in terms of government regulations, pricing structure and an increase in the number of competitive players on the market. Netflix believed that Indian audiences enjoyed “Bollywood” film productions but watched low-quality soap opera content on television. Television audiences were a massive untapped market for their brand of original, exclusively produced content. Can Netflix come up with a marketing and growth strategy, or else they might be looking to lose market share and revenue. Should a new product such as Amazon and MI fire stick be introduced in the existing market like their competitors? Should they enter the existing market with existing products, or should they seek a new market in India, such as the rural market, the Pyramid market, the Tier II market and the City III market? Should they diversify into a new market with new products? How Netflix should plan its market communication if it wants to launch a new product or if it wants to reposition its existing product. Netflix had to rethink its strategies and also needed to address these issues so that they could travel smoothly on Indian roads. High marketing budget and aggressive promotions helped Netflix India to make a profit in its first year. Abstract:
This article examines the impact of multinational subscription video-on-demand (SVOD) services in Australia, noting the degree to which a stalled policy response to the challenge of unregulated SVOD services has been shaken up by coronavirus disease 2019 (COVID-19). We look at the phenomenon from a screen-ecological perspective – where dynamics of consumption, reviewing, production and regulation are interdependently and often contradictorily in play. We examine how these diverse, sometimes conflicted, perspectives can be approached as responding to new forms of internationalisation presented principally by the operations of Netflix in Australia (Amazon Prime Video, Disney+ and Apple TV+ are also mentioned when relevant). This article is part of a larger project (ARC Discovery DP190100978 Internet-Distributed Television: Cultural, Industrial and Policy Dynamics, chief investigators Ramon Lobato, Amanda Lotz, Stuart Cunningham) studying the cultural, industrial and policy dynamics of multinational SVOD globally and in situ locally.

Abstract:
This study employs a comparative analysis of industrial practices and marketing campaigns utilised by subscription video-on-demand (SVOD) platforms, Stan and Blim. It evaluates Stan’s creation and launch prior to the advent of Netflix in Australia, and the introduction of Blim well after Netflix had already established itself as the preferred SVOD in Mexico. Despite the substantial differences between the histories and impacts of these respective national television markets, this study identifies that both platforms have experienced relative success by capitalising on Netflix’s problematic ‘global’ status, by focusing on the production and distribution of content that is uniquely reflective of their geographic audiences. The aim of this research is to encourage scholarly inquiry into internet-distributed television to look beyond multinational portals like Netflix, to localise studies of transnational media and SVOD platforms and to consider the many ways that competing with Netflix has impacted the future of national television production.

Abstract:
Abstract Introduction: Hepatic VOD, also known as Sinusoidal Obstruction Syndrome, is a potentially life threatening complication of hematopoietic stem cell transplantation (HSCT). Severe VOD (sVOD), defined as VOD with evidence of multi-organ dysfunction, leads to high morbidity and greater than 80% mortality (Coppell 2010) in HSCT patients. The purpose of this study was to develop an approach, in the absence of a specific diagnosis code, to identify VOD and sVOD in a hospital administrative database and to measure incidence among HSCT patients. Methods: A retrospective cohort study was conducted using the Premier Healthcare Database, which contains more than 535 million patient encounters (inpatient and outpatient). The starting population was all patients with inpatient HSCT between January 1, 2009 and May 31, 2014 (n=5,418). Since there is currently no diagnosis code for VOD, we used clinical experience (CD, BN) to develop a coding algorithm to identify VOD within the database. In order to be categorized as having VOD, patients with HSCT had to have at least one code from the group B1, indicating hepatic or thromboembolic disease AND at least two codes from group B2, which is focused on VOD diagnosis criteria used in clinical practice (Figure 1). To more accurately identify VOD and exclude alternate etiologies of the liver abnormalities, patients with graft versus host disease (GVHD) (ICD-9 279.50) or TPN cholestasis (ICD-9 576.2 and TPN identified in charge master) were excluded. To qualify for sVOD, VOD patients also had to have at least one code from group C (Figure 1). Results: This algorithm identified 291 VOD patients (5.4% of the HSCT patients) (Figure 1). Forty-six percent (n=134) of those VOD patients, or 2.5% of the total HSCT patients, had codes consistent with sVOD. The incidence of VOD among pediatrics (≤ 17 years old) was 6.4% and the incidence in adults (18+) was 5.3%. The mean age and standard deviation (SD) in the no-VOD and VOD groups was 50.6 (SD 18.4) and 50.6 (SD 19.2), respectively (p=0.97) and the mean age in the sVOD group was 47.7 (SD 21.4) (p=0.08 compared to no-VOD). Among non-VOD patients 8.6% were < 17 years, compared to 10.3% in all-VOD (p=0.647) and 14.9% in sVOD (p=0.096). Among allogeneic HSCT patients, 7.2% had VOD, including 3.6% with sVOD, while only 4.4% of patients with autologous HSCT had VOD, including 1.8% with sVOD. Discussion: The incidence of VOD found in this study was lower than some literature estimates. Coppell et al., using a systematic literature review from 1979 through 2007, found an overall VOD incidence of 13.7%, with higher incidence in patients with allogeneic HSCT (12.9%) than in autologous (8.7%). However, this estimate includes older studies in a time when more intensive conditioning led to higher rates of VOD. Furthermore, our criteria were designed to identify patients with high certainty of VOD. In a more recent study in which 271 patients received reduced intensity conditioning for allogeneic HSCT, the cumulative incidences of VOD and sVOD were 8.9% and 1.5%, respectively (Tsirigotis 2014). Limitations: This analysis is subject to limitations of administrative data. Since there is no diagnostic code for VOD, we used clinical judgment to sort through diagnosis and procedures codes that could be associated with complications of HSCT to find the most likely codes related to VOD and sVOD. The lower incidence in our analysis may have been the result of relatively restrictive methodology designed to identify VOD patients with a high degree of certainty based on diagnosis codes. Conclusion: VOD is a potentially life threatening complication of HSCT and was found in 5% of inpatient HSCT procedures, half of which were deemed severe with multi organ dysfunction, in the 5-year period ending in mid-2014. Abstract:
We study international film flows between Bolivia and Latin America to explore the lack of Bolivian content on Netflix and its limited presence in other SVOD platforms. We characterize Netflix originals, third-party content, and recent Bolivian films, and develop a thematic analysis of their synopsis and genre description, completed with the results of a survey on the Bolivian consumption of streaming content. We identify common patterns in Netflix content and show how it differs from the more nationally minded Bolivian cinematic tradition. Our results point to a homogenizing effect SVOD platforms like Netflix might have on film productions.

Abstract:
This article considers how established methodologies for researching television distribution can be adapted for subscription video-on-demand (SVOD) services. Specifically, I identify a number of critical questions—some old, some new—that can be investigated by looking closely at SVOD catalogs in different countries. Using Netflix as an example, and drawing parallels with earlier studies of broadcast and cinema schedules, I ask what Netflix’s international catalogs can tell us about content diversity within streaming services, and how this can be connected to longer traditions of debate about the direction and intensity of global media flows. Finally, I describe what a research agenda around Netflix catalogs might look like, and assess the utility of various kinds of data within such a project (as well as some methodological pitfalls).

Abstract:
This paper is devoted to the analysis of one of the practices of reproducing ethnicity: conversations about national cuisine. Descriptions of national cuisines help articulate a person’s belonging to a certain ethnic group and serve to attribute various cultural characteristics to their “own” group and those of the “other” peoples. This article explores the ways Azerbaijanis, Armenians and Georgians living in St Petersburg think about their national cuisine. The focus of the study is on а comparison of these views as presented in semi-structured thematic interviews conducted by the author. Respondents who identify themselves with the same ethnic group from the South Caucasus generally think about their national cuisine in a way shared by the whole group, while the selection of main dishes differs significantly among the groups of different ethnic origin. It was observed that the general principles for organizing narratives about national cuisine were the same among the different ethnic groups. This includes the basic motifs, rhetorical turns, arguments and presuppositions (among them, ideas that there is a correspondence between ethnicity and eating practices, that national cuisine should be exclusive, family meals are national, etc.). At the same time, while ethnic food is a subject of national pride for Georgians and Azerbaijanis, Armenians do not seem to appreciate their cuisine in the same way.

Abstract:
Branding has been described as the defining industrial practice of television’s recent past. This article examines publicly available industry documents, trade press coverage, and executive interviews to understand the place of traditional television network branding in subscription video on-demand (SVOD) portals as represented by Amazon and Netflix. Focusing on materials relating to licensed rather than original content and this content’s role within the US domestic SVOD market, two distinct approaches emerge. For Amazon, the brand identities of some television networks act as valuable lures drawing customers into its Prime membership program. For Netflix, linear television networks are competitors whose brand identities reduce Netflix’s own brand equity. Ultimately, Amazon’s efforts to build a streaming service alongside network brand identities and Netflix’s efforts to build its own brand at the expense of such identities demonstrate the need to think about contemporary television branding as an ongoing negotiation between established and emerging practices.

Abstract:
In this essay, we take up three distinctive features of the US-based subscription video-on-demand (SVOD) platform Hulu: its ownership structure, its business deals, and its televisual aesthetics. Although there are substantial overlaps among these categories, we approach each of them separately so as to better enable us to link our analyses to some of the key questions and concerns about what contemporary television has become and how it should best be studied. By inserting Hulu into a conversation about today’s television ecosystem – a context from which it has been absent for too long – we purposefully broaden scholarly debates about SVOD platforms beyond that of Netflix and Amazon to reconsider some of the emergent conventions or common-sense norms that currently underpin our understanding of television in the Internet era. In the end, we argue streaming television is a multi-sited, quasi-iterative, and rapidly evolving marketplace, in which legacy practices persist alongside and often in competition with new modes of production, dissemination, and consumption.

Abstract:
Focusing on the United Kingdom, this article addresses key issues facing the international distribution industry arising from over-the-top (OTT) digital distribution and the fragmentation of audiences and revenues. Building on the identification of these issues, it investigates the extent to which U.K. distribution has altered over a ten-year period, pinpointing continuities in the destination and type of sales alongside changes in the role and structure of the industry as U.K.-based distributors adapt to a changing U.K. broadcasting landscape and global production environment. At one level, increasing U.S. ownership of U.K.-based distributors and the arrival of OTT players such as Netflix highlight the tensions between the national orientations of U.K. broadcasters and the global aspirations of independent producers and distributors. At another level, video-on-demand (VOD) has boosted international sales of U.K. drama. Although the full impact of subscription VOD (SVOD) on content and rights has yet to materialize, significant changes in the industry predate the arrival of SVOD.

Abstract:
Smartphones are increasingly used to access videos, including subscription video-on-demand services. This is especially true among millennials, who are the primary adopters. This raises the question of why millennials watch SVOD through their smartphones when other wide-screened devices offer better audiovisual quality. This research aims to reveal the motivations satisfied by using uses and gratification theory through qualitative approach and grounded theory strategy. Based on in-depth interviews of six informants, we found classical UG typologies, namely Information and Passing Time, and typologies recurring in new media research, which are customized experienced and media displacement. The study also produced expanded typologies, including hedonistic/eudaimonic entertainment, time/place-shifting, comfort/relaxation, and diversion/immersive experience. Lastly, binge-watching was discovered to be an emergent typology. As this research analyzes data from one informant, the results cannot be generalized. Operationalizing these typologies by using a quantitative approach is recommended for future research.

Abstract:
AbstractThe article describes and analyses the competing approaches to codification in Russia during the first decades of the nineteenth century following Napoleon (and his Code Civil) and its evaluation in the late nineteenth century. Based on recent methodology—the history of notions (Begriffsgeschichte)—this article presents the history of codification through the perspective of the emergence and development of the Russian legal terms 'svod' (compilation/digest) and 'ulozhenie' (system/code). These terms represented the 'battle flags' of the two parties: on one hand, those whom one might characterize as rationalist, universalist, Enlightenment-oriented, based on the French Revolution and inspired by the Code Napoleon; and, on the other, those who might better be described as history-oriented, traditionalist, romantic, nationalist. Speranskii, initially the prime representative of the first tendency, was ultimately successful as the leader of a Russian codification movement by claiming an original national approach to codification, while in practice combining the two elements. The article seeks to demonstrate that the categories of 'national', 'traditional', 'original'—as well as their opposites, 'universalistic', 'rationalist'—which were used in the political and academic discourse on codification in nineteenth-century Russia, may be analyzed as a rhetorical means of argument skillfully applied by the ambitious drafters of new codes (as well as by their opponents). Contextual analysis of both the Russian and European political background of codification discussions are applied in this work, which leads to conclusions on the construction (and deconstruction) of a national mythology of legal traditions. My view of the creation of a new code of laws (ulozhenie)—during the first three decades of the nineteenth century—is one of the completion of a Russian national project. It became such rather suddenly in the spring of 1812 as a result of both major forces and of chance circumstances, the movement of armies, global ideas and the passions of historical figures. The combination of a number of factors resulted in a situation whereby the political struggle over the new code was conducted through the language of nationalism by contrasting the 'national spirit of the law' with 'foreign principles'. In the struggle for a new code, the opposing sides not only used 'national rhetoric' introduced from outside but, also, changed the Russian language, inventing new 'national' meanings for legal concepts.

Abstract:
Abstract Background Given the life-threatening nature of severe VOD (sVOD) and associated multi-organ failure (MOF), the absence of other approved therapies for this complication in the USA, and the promising results to date with DF in this setting, DF has been made available since 2007 through a prospective T-IND. The aim of the T-IND is to gather additional data on safety and response to DF in a broader patient (pt) population, including those with sVOD/MOF and those with non-severe VOD. Thus far, this is the largest prospective evaluation of DF for the treatment of sVOD/MOF in pts undergoing HSCT, and in pts who developed VOD following chemotherapy (non-HSCT pts). Here we provide an update on the efficacy and safety of DF in HSCT and non-HSCT pts, together with analysis of other clinical features of interest, including GvHD. Methods The original T-IND protocol required pts to have a diagnosis of VOD by Baltimore criteria (total bilirubin ≥2.0 mg/dL with ≥2 of the following: hepatomegaly, ascites or 5% weight gain) with MOF (either renal and/or pulmonary failure) following HSCT, and was amended to allow inclusion of pts with non-severe VOD (defined as no MOF) occurring either post-HSCT and post-chemotherapy. Key exclusion criteria included clinically significant bleeding or the need for &gt;1 vasopressor. Complete response (CR) was defined as bilirubin &lt;2 mg/dL plus resolution of MOF (if applicable). Mortality was assessed at Day +100 (D+100) in all pts. DF was given at 6.25 mg/kg IV q6h (25 mg/kg/d) with recommended treatment duration of at least 21 days (d). Results The current interim analysis is based on 470 VOD pts enrolled between December 2007 and December 2012 at 75 centers, 45 of which developed VOD following chemotherapy and 425 had undergone HSCT (376 allogeneic HSCT, 89%). In HSCT patients, median age was 15 yrs (range 0.1–70), 55% were male and 18% had undergone multiple HSCTs (&gt;1 HSCT); 284 pts had severe disease at study entry. The most common diagnosis was leukemia (29% AML; 22% ALL; 6% other). Conditioning regimen included CY (66%), BU (50%) and TBI (36%). Median onset of VOD was 15 d post-HSCT. Of HSCT pts, 35% (147/425) achieved CR and 55% (Kaplan-Meier estimate) survived to D+100. In pts with sVOD, CR was 29% and D+100 survival was 48%. For pts with non-severe VOD, CR and D+100 survival was 47% and 69%, respectively. In all HSCT pts, delay of &gt;2 d (vs ≤2 d) in the start of DF after VOD diagnosis resulted in reduced CR (25% vs 39%, p=0.0052) and survival (Kaplan-Meier estimate) (38% vs 61%, p&lt;0.0001). Children (≤16 years) as compared to adults had higher CR rates (41% vs 27%, p=0.0038) and better survival (60% vs 49%, p=0.0203). In the 45 non-HSCT patients, median age was 8 yrs (range 0.1–63), and 53% were male; the most common diagnosis was ALL (33%) and AML (22%). Cyclophosphamide (49%), vincristine (44%) and cytarabine (33%) were the most frequent chemotherapeutic agents associated with VOD. Median onset of VOD after chemotherapy was 14 d, and sVOD was present in 53% of pts at study entry. Of non-HSCT pts, 40% (18/45) achieved CR and 62% were alive at D+100. Toxicity proved generally manageable: 23% of pts experienced at least one related AE, primarily consisting of hemorrhage including pulmonary bleeding (6%), GI hemorrhage (7%), epistaxis (3%), hematuria (2%), and hypotension (4%). Similar to the observation of decreased GvHD in other studies, the incidence of all grade GvHD in the allogeneic HSCT pts was low at 11%. Conclusions DF therapy in sVOD/MOF pts achieved significantly improved outcome compared to that expected based upon historical data. Given the results of this large cohort of pts, early treatment with DF (i.e. within 2 d of VOD diagnosis) is recommended, and consistently improved outcome was seen in pts who have not yet progressed to sVOD. Generally, DF was well-tolerated and as with prior studies, there was a low incidence of DF-associated toxicities. These results confirm the findings of previous trials and strongly support early intervention with DF once the diagnosis of VOD is made after HSCT, which also reinforces the validity of positive studies in prophylaxis to date and suggests further trials in prevention are warranted. Outcomes in children appear to be better than in adults, supporting the importance of this agent in the pediatric population in particular. In addition, low rates of GvHD were seen and this is an important area in which further studies are planned. Enrollment to the T-IND study continues.

Median age was 16 years (range 0.1–70), 55% were male and 18% had undergone multiple HSCTs (>1 HSCT). Overall, 220 pts had severe disease at study entry. The most common diagnosis was leukemia (29% AML; 22% ALL; 4 other), with conditioning of CY (69%), BU (45%) and TBI (39%), respectively. Median onset of VOD was 16 d post-HSCT. Overall, 30% (90/305) of HSCT pts achieved CR and 50% (Kaplan-Meier estimate) survived to D+100. In HSCT pts with sVOD, CR was 26% and D+100 survival was 45%. For the HSCT pts with non-severe VOD, CR and D+100 survival was 39% and 65%, respectively. In the T-IND, 155 pts matched the entry criteria for the original phase III trial and were compared to the phase III historical controls (HCs) who did not receive DF. Results showed a statistically improved outcome in CR (29% vs 9%, p=0.0019) and D+100 survival (49% vs 25%, p=0.0016) compared with HCs. In all pts, delay of >2 d (vs ≤2 d) in the start of DF after VOD diagnosis resulted in reduced CR (20% vs 34%, p=0.0195) and survival (Kaplan-Meier estimate) (37% vs 56%, p=0.0118). Children (≤16 years) as compared to adults had higher CR rates (33% vs 26%, p=0.187) and survival (56% vs 44%, p=0.0277). Toxicity proved generally manageable: 21% of pts experienced a total of 92 related AEs, primarily consisting of hemorrhage (18%) and hypotension (4%). Hemorrhage included pulmonary bleeding (6%), GI hemorrhage (4%), epistaxis (2%) and hematuria (2%), with 2% of pts experiencing life threatening hemorrhage in which a possible relationship with DF could not be ruled out. Similar to the observation of decreased GvHD in other studies, the incidence of all grade GvHD in the allogeneic HSCT pts was 8%. Conclusions: DF therapy in sVOD/MOF pts achieved significantly improved outcomes compared to HCs. Based on the results of this large cohort of pts, early treatment with DF (i.e. within 2 d of VOD diagnosis) is recommended, and consistently improved outcomes are seen in pts who have not yet progressed to sVOD. Generally, DF was well-tolerated and as with prior studies, there was a low incidence of DF-associated toxicities. These results confirm the findings of previous trials and strongly support early intervention with DF once the diagnosis of VOD is made after HSCT. Outcomes in children appear to be even better than in adults, supporting the importance of this agent in the pediatric population in particular. In addition, low rates of GvHD were seen and this is an area in which further studies are planned. Enrollment to the T-IND study continues. Disclosures: Richardson: Gentium: Advisory committee Other. Abstract:
Abstract Abstract 3482 Introduction: Defibrotide (DF), a characterized mixture of polydisperse oligonucleotides, has endothelial protective properties with profibrinolytic, antithrombotic, anti-inflammatory and anti-adhesive activity. The safety of DF injectable and oral formulations has been previously established in clinical trials including more than 9000 pts in the treatment of vascular diseases (eg peripheral arterial disease, deep vein thrombosis), with related adverse events (AE) reported in 2% of these pts. The protective endothelial effects of DF combined with its low toxicity profile led to investigation of its use in the treatment and prevention of hepatic veno-occlusive disease (VOD) in SCT pts. As pts undergoing SCT are likely to experience SCT-associated toxicities, it was difficult to assess the contribution of DF to observed toxicities in the initial single-arm trials. Chemotherapy-induced thrombocytopenia and endothelial cell injury predispose SCT pts to hemorrhagic and thrombotic complications. Bleeding is common in this population, particularly in pts with severe VOD (sVOD), characterized by multi-organ failure (MOF). We therefore undertook a comprehensive review of safety for DF in this setting. Methods and Results: To date, of 1824 SCT pts (pediatric: 737; adult: 1087) who received DF for the prevention or treatment of VOD/ sVOD, 104 (6%) experienced DF-related AEs. Of these 1824, 428 were enrolled in controlled clinical trials: one randomized phase 2 trial comparing 2 doses of DF and two phase 3 trials: one comparing the toxicity profile of DF to a historical control (HC) for the treatment of sVOD, the other to ‘no prophylaxis’ for the prevention of VOD in children. The phase 2 trial randomized 149 pts with sVOD/MOF to receive DF 25 or 40mg/kg/d (pediatric: 48; adult: 101). Both doses were well tolerated. DF-related AEs leading to treatment discontinuation (DC) occurred in 4% of pts: hemorrhage [gastrointestinal (GI), pulmonary, and diffuse alveolar], hypotension, and abdominal cramping. The percentage of pts with Grade 3–4 AEs was similar in both arms, however, pts randomized to 40 mg/kg/d were reported to have a higher incidence of all severity grade bleeding events than pts randomized to 25mg/kg/d (57% versus 46%). As efficacy parameters (CR rate; survival) were equal between the 2 dose groups, while the safety profile of the 25 mg/kg/day dose was slightly improved, the 25 mg/kg/d dose was chosen for future studies. In the phase 3 study, 102 pts with sVOD/MOF (pediatric: 44; adult: 58) treated with 25 mg/kg/d were compared with 32 matched HC pts. DF was generally well tolerated. DF-related AEs (possibly, probably, or definitely related) of Grade 3–5 severity occurred in 27 pts (26%). The following DF-related AEs led to DC of drug in 18 pts (18%): hemorrhage (pulmonary, GI, cerebral, catheter site, and hemorrhage, site not specified; hematochezia and epistaxis), headache, lethargy, hypotension, subdural hygroma, and TTP. Overall AEs, including hemorrhagic AEs, were similarly reported between the DF and control arms. The most frequent AEs were hypotension (39 vs 50%), diarrhea (25 vs 38%), vomiting (21 vs 28%), nausea (15 vs 34%) and pyrexia (15 vs 34%). The most common hemorrhages were epistaxis (13 vs 16%), pulmonary hemorrhage (12 vs 9%), catheter site hemorrhage (12 vs 3%) and hematuria (9 vs 16%). The phase 3 open-label study randomized pediatric pts to receive DF prophylaxis 25mg/kg/d (n=177) or control (n=176) from pre-SCT conditioning until Day+30 post SCT. Prophylactic DF was well tolerated, resulting in few related AEs (5%), including 1 GI hemorrhage which led to DF DC in 1 pt (<1%). AEs were reported at a similar incidence in the DF and control arms, including hemorrhage; the most common were hemorrhagic cystitis (11 vs 11%), GI hemorrhage (2 vs 4%), and epistaxis (2 vs 2%). Pts in both arms who reached the endpoint of VOD were treated with DF (25mg/kg/d); the incidence of DF related AEs in all pts treated for VOD was 14% (8/57). Conclusion: In the SCT population, DF-related AEs occurred with an increased incidence compared to other indications. The incidence was lowest in VOD prophylaxis pts and highest in pts with sVOD. In controlled SCT studies, DF was well tolerated, with AEs (including hemorrhage) reported with similar frequency to the control. These results indicate that DF can be used without increasing the risk of complications in this population of pts at high risk. Disclosures: Corbacioglu: Gentium: Consultancy, Research Funding. Abstract:
Abstract Defibrotide (DF) is a mixture of porcine-derived single-stranded phosphodiester oligonucleotides (9-80-mer; average, 50-mer) that has been successfully used to treat severe hepatic veno-occlusive disease (sVOD) with multiorgan failure (MOF) in patients who have received cytotoxic chemotherapy in preparation for bone marrow transplantation. However, its mechanism of action is unknown. Herein, we show that DF and phosphodiester oligonucleotides can bind to heparin-binding proteins (eg, basic fibroblast growth factor [bFGF] but not vascular endothelial growth factor [VEGF] 165) with low nanomolar affinity. This binding occurred in a length- and concentration-dependent manner. DF can mobilize proangiogenic factors such as bFGF from their depot or storage sites on bovine corneal endothelial matrix. However, these molecules do not interfere with high-affinity binding of bFGF to FGFR1 IIIc but can replace heparin as a required cofactor for binding and hence cellular mitogenesis. DF also protects bFGF against digestion by trypsin and chymotrypsin and from air oxidation. In addition, DF binds to collagen I with low nanomolar affinity and can promote human microvascular endothelial cell-1 (HMEC-1) cell mitogenesis and tubular morphogenesis in three-dimensional collagen I gels. Thus, our data suggest that DF may provide a stimulus to the sinusoidal endothelium of a liver that has suffered a severe angiotoxic event, thus helping to ameliorate the clinical sVOD/MOF syndrome.

Abstract:
Abstract Abstract 3041 Background: Given the potentially life-threatening nature of hepatic VOD, the lack of approved treatments for this disease and the increasing evidence indicating that DF leads to improved outcome, DF has been made available on a compassionate use basis for almost a decade and more recently via prospective expanded access programs. Although VOD is most frequent in pts post-SCT, it can be induced by chemotherapy alone. The CUP and T-IND have collected safety and outcome information from a broader pt population (n=1129 and n=333, respectively), including non-SCT pts who developed both non-severe and severe (sVOD) after chemotherapy. Demographics and results from this non-SCT population from the CUP and from an interim analysis of the T-IND are presented. Methods: CUP pts met VOD diagnosis with at least two of the following criteria: bilirubin >2mg dL, hepatomegaly and/or ascites or an unexplained weight gain of >5%. The T-IND pts met similar criteria but required the presence of elevated bilirubin with two other criteria. Pts had non-severe and sVOD, with sVOD defined as multi-organ failure (MOF; including renal or pulmonary failure in the T-IND or additionally CNS dysfunction in the CUP). Key exclusion criteria included clinically significant bleeding/severe coagulopathy or hemodynamic instability. DF was given at 25 mg/kg/d IV (in the CUP, dosing ranged 10–80 mg/kg/day, with median dosing 25 mg/kg/d) for a minimum of 14–21 days. Complete response (CR) was defined as bilirubin <2 mg/dL plus resolution of MOF (if applicable). Mortality was assessed at Day +100 (D+100) in all pts. Results: The current analysis is based on a total of 89 pts who developed VOD after chemotherapy (chemo) alone: 61 pts in the CUP and 28 pts in the T-IND. Pts were enrolled in CUP between December 1998 and March 2009; median age was 14 years (range 0.2–65) and 66% were male. In the T-IND the chemo pts were enrolled from December 2009 to September 2011; median age was 8 years (range 0.2–58) and 50% were male. The most common diagnosis was ALL (36% and 32%) and AML (30% and 25%) in the CUP and T-IND, respectively. Vincristine, cytarabine and cyclophosphamide were the most frequent chemotherapeutic agents associated with VOD, and with the exception of cyclophosphamide, their prior exposure was relatively similar between arms: pts in the CUP and in the T-IND, respectively, were treated with vincristine (31% and 46%), cytarabine (25% and 39%), and cyclophosphamide (16% and 61%). Median onset of VOD after chemotherapy was 19 days and 16 days in the CUP and T-IND, respectively, and sVOD was present in 46% and 50% of pts at study entry in the CUP and T-IND, respectively. Overall, 53% (47/89) of pts achieved CR, with 53% (25/47) of pts with non-severe VOD achieving CR and 52% (22/42) of pts with sVOD achieving CR. Overall, 68% and 67% of pts were alive at D+100 (Kaplan-Meier estimate) in the CUP and T-IND, respectively, 65% and 69% of pts with non-severe VOD were alive at D+100 in the CUP and T-IND, respectively, and 72% and 64% of pts with sVOD alive at D+100 in the CUP and T-IND, respectively. When VOD outcomes were compared to the SCT population of the T-IND (Richardson PG, et al. Blood [ASH Annual Meeting Abstracts] 2011;118:487), CR was 43% in non-SCT pts vs 30% in SCT and survival was 68% vs 50%, respectively. Toxicity proved generally manageable: 24% of pts experienced a total of eight related AEs, primarily consisting of hemorrhage (21%) and hypotension (3%). Hemorrhage included pulmonary bleeding (7%), epistaxis (7%) and GI hemorrhage (3%). Conclusions: Demographic and outcome data for VOD, a frequent and life-threatening complication of SCT, has been documented from a population of 89 pts following intensive chemotherapy alone. These pts were most frequently diagnosed with ALL and AML and recipients of vincristine, cytarabine or cyclophosphamide-based chemotherapy. The use of DF for VOD, which has been shown to improve CR and survival in SCT pts, is also associated with better outcomes in pts who have not undergone transplant. Generally, DF was well-tolerated and as with prior studies, there was a low incidence of DF-associated toxicities. The use of DF in VOD following intensive chemotherapy without SCT appears promising, but more research in this predominantly pediatric patient population is needed. Abstract:
Abstract Abstract 487FN2 Background: Given the life-threatening nature of severe VOD (sVOD) and multi-organ failure (MOF), DF was made available in the US through a prospective treatment IND protocol (T-IND) to gather additional safety and response data from SCT patients (pts) with sVOD who were not eligible for a pivotal Phase 3 trial. Following completion of this Phase 3 trial, the T-IND protocol has continued and been amended to include pts who would have met eligibility criteria for the completed phase 3 trial, as well as pts with non-severe VOD and non-SCT pts who develop VOD after chemotherapy (chemo). This is the largest prospective evaluation of DF for the treatment of sVOD/MOF post SCT and non-SCT pts to date. Methods: Pts were initially required to have a diagnosis of VOD by Baltimore criteria (total bilirubin > 2.0 mg/dL with > 2 of the following: hepatomegaly, ascites or 5% weight gain) with MOF (either renal and/or pulmonary failure) that followed SCT. Following treatment of 104 pts, an amendment expanded eligibility criteria to include pts with VOD after chemo and pts with non-severe VOD (defined as no MOF). Key exclusion criteria included clinically significant bleeding or >1 pressor to maintain BP. CR was defined as bilirubin < 2 mg/dL + resolution of MOF (if applicable). Mortality was assessed at Day +100 (D+100) in all pts. DF was given at 6.25 mg/kg IV q6h (25 mg/kg/d) with treatment duration recommended for at least 21d. Results: This interim analysis is based on 269 pts enrolled between December 2007 and March 2011 at 67 centers. Nearly all pts (n=251) had undergone SCT (with allogeneic SCT in 225, 90%); 18 developed VOD after chemo alone. Of the 269 cases of VOD, 200 were severe at study entry, with 25% (66/269) of all pts dialysis dependent and 31% (83/269) ventilator dependent. Median age was 16 years (range 0.1 – 70); 55% were male. In the SCT pts, the most common diagnosis was leukemia (29% AML; 22% ALL; CML 3%; 4% other), with conditioning of CY (71%), BU (46%) and TBI (38%) respectively; 18% had undergone multiple SCTs (>1 SCT). Median onset of VOD was 15 d post-SCT. When presenting after chemo alone (n=18), median onset of VOD was 16 d after the first dose, most frequently after CY (61%), cytarabine (44%) and vincristine (39%), and for treatment of leukemia (AML 33%, ALL 33%, other 6%). Overall mean number of days of DF administration in all pts was 22 (range 1–88).Of 269 pts, 32% (85/269) achieved a CR and 50% [ by Kaplan-Meier estimate] survived to D+100. In the subgroup of SCT pts, 31% (78/251) achieved CR and 50% survived to D+100; 134 pts met entry criteria for the original Phase 3 trial and comparison to the Phase 3 historical control showed a statistically improved outcome in CR (30% vs 9%, p=0.0006) and D+100 survival (46% vs 25%; p=0.006). Of 200 pts with sVOD, CR was 28% and D+100 survival was 44%. In the 18 chemo only pts, CR was 39% and D+100 survival was 50%. CR rate and D+100 survival for the 69 pts with non-severe VOD were 42% and 62%, respectively. Delay of >2 d (vs < 2 d) in the start of DF after VOD diagnosis resulted in reduced CR (23% vs 35%, p=0.0339) and survival (37% vs 56%, p=0.01). Children as compared to adults had higher rates in CR (35% vs 29%) and survival (55% vs 43%). Toxicity proved generally manageable: 22% of pts experienced a total of 81 related AEs, primarily consisting of hemorrhage (19%) and hypotension (4%). Hemorrhage included pulmonary bleeding (6%), GI hemorrhage (3%), epistaxis (3%) and hematuria (3%). Similar to the observation of decreased GvHD in other studies, the incidence of all grade GvHD in the allogeneic SCT pts was 8%. Conclusions: In 269 pts with mainly sVOD/MOF, DF therapy achieved significantly improved outcome compared to an untreated historical control. Importantly, CR and survival were improved in pts who were treated within 2d of VOD diagnosis (vs. later) and in pts who had not yet progressed to sVOD. As with prior studies, there was a low incidence of DF-associated toxicities. Interestingly, the incidence of GvHD in allo-SCT pts was low, consistent with the reduction of GvHD seen in the large randomized EBMT pediatric prevention study. These results confirm the findings of previous trials and strongly support early intervention with DF once the diagnosis of VOD is made after SCT, as well as its use in pts who have not progressed to advanced MOF. The use of DF for VOD following intensive chemotherapy without SCT also appears promising, but more research in this patient population is needed. Enrollment to the T-IND study continues. This article analyzes the current state of traditional television financing resources, detecting a critical situation in its three main sources (advertising, signatures and service charges). Next, it discusses the most dynamic part of the television sector: Video on Demand (VoD) and Subscription Video on Demand (SVoD) services, which could generate new resources for audiovisual production. However, the analysis of the catalogs of these services shows a low supply of European films compared to the United States. Thus, as on other occasions, the development of new television services and new business models could be a missed opportunity for the European audiovisual industry.
