Full textIn order to specify the movement of normalisation in the factories, the author tried to show the disorders which touched the different levels of the trade unions in Poland. Issued from the law of October 1982, the social organizations in the factories had to be not only news but also efficient in the point of view of the defense of the interests of workers and help of the different authorities in the enterprises. The author spent the year 1984-1985 in the university of Lodz where he could provide many inquiries: at first, he could go into 14 entreprises, located in Warsaw, Wroclaw Torun and Lodz. There, he could speak with the main responsables of the decision. Those are the main director, the president of the worker's council, the first secretary of the party, the president of the trade-union. In one of these factories, he could provide speakings, with a tape-recorder, so it was possible to determine the new forms of the partnership, the lack of participation of some members of the authorities, the principal role of the director, the weakness of the trade-unions the lack of consideration and the many conflicts in which they were placed in. In further, the author could provide two quantitative inquiries in Lodz and in Cracow pertaining to 160 000 workers to issue the composition of the councils and presidium. In conclusion, the author established the lack of differences with the past but as these organisations were specified in 1982 like the head of the normalisation, he concluded to the original movement because 4 years later, these trade union don't group the majority of workers

Full textThis thesis deals with the crisis of Argentinian trade unionism in the context of the policies that were put into practice between 1976 and 1999. In the first part, we analyze the slow complex formation process of the Argentinian proletariat and the progressive implementation of the Keynesian pact, which involved the institutional recognition of labor unions as mediators between class-assembled individual capitalists and salaried workers constituted as a collective agent. In Latin America, the societal pattern of this pact found political expression in the so-called “national-populist” regimes. In Argentina, Peronism had great influence on the way trade union organizations operate. In the second part, we analyze the progressive dismantling of this salary relation within the framework of neoliberal globalization. The breakup of the working class in its specific configuration, connected with the “Keynesian-Fordist” cycle, has entailed the destruction of collective social rights that had so far partially hindered the commodification of labor power. It is necessary to place the figures of the salaried worker and the different models of trade union organizations into historical perspective so as to fully grasp the scope of the recent transformations of the Argentinian labor world, the crisis of “traditional” unionism, as well as the recent reconfigurations of trade union and social organizations. The emergence of new conflicts has accompanied the adoption of changes in the struggle methods against the mechanisms of integration/subordination/exploitation of labor force in the neoliberal period

Full textThroughout this research we'll try to understand and explain the failure of the Tunisian Trade Union organization to free itself once for ail from the pressure of the political power this study intends to dig up the reasons why the state, that resorts to excessive forms of repression towards significant Trade Union contestations, violently repressing people' up raising, ends up paradoxically by recognizing the trade union representatives after having ruthlessly brutalized them. The notion of workers' representation and the social actors who are supposed to embody it, the trade union executives, are selected as relevant aspects for the study of the dialectic of domination and political dependency. These factors are examined at two levels: Social conditions of reproduction1)The milieu that the family constellation reveals shows significant structural and cultural evolutions of the society. 2)The modes of identity group composition, are studied with reference to age, regional belonging and schooling, 3)the signs of precarious ness of the workers condition are highlighted trough the study of labour work, activity sectors and professions. The world of representations The perception of social inequality and the judgements about richness and capitalism reveal a hopeful discourse and a pessimistic discourse witch put the blame on political power and bureaucracy. The study of social class and hierarchical perception unveil at the same time a huge scattering, and outline the existence of two groups, those who chose a Marxist vision and those who adopt an economic, moral and political conception

Full textFor a clear understanding of the procedures leading to the reunification of the C. G. T. (the general confederation of Labro) in 1936, this thesis focuses on the unitary activities of the local unions of four regions (the Paris area (région parisienne), le nord, le Pas-de-Calais and la Loire) and six branches of the C. G. T. (construction, railroad, printing paper, mining, metalworking and textiles). The primary conclusion is that the unions led communal actions with increasing frequency, especially from 1934 on. Although the economic causes were of relative importance, the rise of fascism and the decrees of the government of the union nationale (national union) played a much more dominating role for the reunification. As for the branches, it is notable that in mining and textiles the unitary practices had been relatively numerous until the general strike of 1934, after which the activities greatly diminished. On the other hand, for the sections of railroad, construction and mining, the activities accelerated. Besides, it was railroad which constituted the principal sector favoring the unity, especially after the appearance of Laval's decree. In this division, the role of the union network (l'union des syndicats) was decisive for the unity. In the regional comparisons, a clear opposition can be delineated between the province and the paris area, the latter having become the central point of the unity after the general strike. Finally, regarding the relationship between the unitary activities and the fusion, the conclusion is that while the national strategy of the two c. G. T. Was the most decisive, the role of the local unions was equally important, given their relative independence vis-a-vis the center in the activities for the reunification

Full textThis study of teachers'unions in england between 1944, when a reform of the school system was launched, much to the satisfaction of the profession, and 1985, when the relations between central government and the teachers reached their lowest ebb, seeks in book one to define the individual and collective identity of teachers'organisations. Three basic strategies have been developed in order to caulk these cracks : there have been attempts to construct a federation centred on the national union of teachers, schemes to set up a teachers'general council, and policies for joining the trades union congress. At the present time, the latter strategy alone has met with some success. In book two, the study concentrates on the policies worked out by teacher unions in three fields : the school system, teacher training, and salary negotiations. Book three finally deals with the types of relationship - based either on cooperation or on conflict- which teacher unions have developed with central and local government : "partnership", with its heyday in the 1950's and 60's, and strife as evidenced in the 1970's and 80's. The conclusion provides an assessment of the strengths and weaknesses of teacher unionism in the thatcher era

This was the result of an active and permanent participation. This participation permitted them to acquire legitimity within the political system. Women's participation in politics proved their strong adapted capacities gained in different ways in struggling legally as well as illegally. Their participation was massive, organic and orientated towards social changement. The political women's contribution started as mothers and not as citizens. Their fighting was oriented by a "principal contradiction" which was expressed in certain cases by "working class" and in other cases by the "whole nation". They did not incorporate their dependance as women which permits them to act in the society, despite their great and proved mobilization capacity. Women have been a major source of growth for trade unions in recent years, and are forming an ever-increasing proportion of trade union membership. Nevertheless, they are strongly under-represented at all levels of the union hierarchy. The reasons for their lack of participation can be ascribed to psychological and cultural barriers but they are also due to job- and union- related factors. Though factors. Though facts and figures as well as the points of view of female activists show that equality is still a goal to be achieved, there has been some progress. Most unions took measures aiming at the wider involvement of their female members. On the other hand, women are more and more playing an active part, and some of them are members of their unions' national executive committees. Under the influence of women, trade unions are more aware of the diversity of their affiliates and, more and more, they have come to accept that "women's issues" such as creches or sexual harassment are, similarly to bread and butter issues, trade union issues

However the fifties will be the years of union dissatisfaction wich will grow till the rome treaty and even more after it. The e. E. C. Did not anticipate social europe within what is now called the process of european construction. Social policy and social european law take shape in the seventies. Fordism, which enabled an exceptional economic growth, is dwindling. The crisis shatters the labour market : flexibility, job insecurity, feminization, "tertiarization" are the key words. The welfare state and the "european social model" are threatened. European unionism finds it difficult to adapt itself to the changes which undermine its finality and its identity. The heralded "post-fordism" remains obscure but labour may no longer be the centre of preoccupations. The reciprocal identification of the workin class and of the unions led the latter to create a project of economic and social organisation exceeding the mere market field. Can a "new unionism" claim on its own behalf such social europe as to generate a union project? the building of a social and community dialogue, in 1985, gave rise to many union disappointements. Social europe has reacted a dead end. No treaty, no texts, will prevent relocations in the european union symbolizing the opening of the markets. The union project for a greater economic and social cohesion is confirmed when put to the test of mass unemployment. Full textThis study concentrates on the history of the "yellow" trade unions of pierre bietry (by using the "yellow" press and the national and departmental archives) and the ideology of the movement. Trade unionism at the turn of the century cannot be reduced to the cgt or the emerging christian trade-unionism. The neglected aspect is indeed "yellow" trade-unionism, this proletarian, counter-revolutionary and anti-socialist current which advocated collaboration rather than conflict with the bosses. This thesis refutes the idea that the "yellows" were merely a group of marginals, "strike-breakers" or "social-traitors", financed by the bosses who were traumatised by the strength of revolutionary-syndicalism. In addition, this thesis does not accept that the "yellows" were the forebearers of "french-style fascism". On the contrary, the "yellows" were right-wing, proletarian trade-unions opposed to revolutionary syndicalists, and rejected the heritage of the revolution. They defended traditional values of catholicism and reiterated political values of the right. Even if the "yellows" seem to have disappeared as a movement after 1912, their ideas lived on, through the xxth century, and the discourse of the popular right-wing shows

Full textThe 20th August 2008 Law reforms the social democracy to reinforce the trade unions’ legitimacy and that of the collective agreements they sign. In order to do this, the reform modifies the representativeness’ criteria and the collective agreements’ validity conditions. It contains some measures serving that purpose. The newest are those which dedicate the electoral audience as a decisive representativeness’ criteria and those which impose to fulfil all the criteria at once to estimate the trade unions’ representativeness. These new steps have different consequences. Among the most important, from now on, representativeness is measured from the companies and not by the authorities. So, the “irrefragable” (which can’t be contested) presumption of representativeness is doomed to disappear on short-term. Moreover, the 20th August Law allows the subcontractors to participate to the professional elections under some conditions, which raises lot of juridical and practical issues. The reform makes some meaningful changes. However, it is pertinent to ask if it helps to champion social democracy. Is the choice of a representativeness reform focused on the trade unions’ legitimacy relevant? Indeed, this reform aims to reinforce the trade unions’ legitimacy, particularly with the introduction of the audience criteria. However it has raised several practical difficulties and litigations which imply that maybe the text must be revised. Furthermore, introducing the audience criteria, the 20th August Law could cause a politicization of the professional relations and elections: in order to reinforce the trade unions’ legitimacy, it ensures a closer link with the democratic elections system as we know it in France for other institutions. The examination of all these elements reveals that the real issue raised by the reform is not only about the trade unions’ representativeness or their legitimacy, but about the question of the division of competences between the Social Partners and the legislator, in other words, it’s about the autonomy of the Social Partners: which flexibility could we provide them with to establish standards in domains traditionally reserved for the legislator? In this case, how is it possible to articulate law and collective agreements? Does it necessarily need a constitutional revision? The research for solutions brings us to note that similar issues exist in Europe. However, different mechanisms are implemented. It’s interesting to search for some tools at this scale, which could be exploited to facilitate the development of social dialogue in France, or even solve the issues linked to the trade unions’ standard setting-role in the company or in laws elaboration

Full textCrisis of the legitimacy of the welfare state, crisis of the co-management, crisis of the trade-unionism, crisis of the social democracy. The use of the word " crisis " can't be under any illusion and can't let us think that it may be a recent phenomenon. This research supposes that the difficulties the social democracy are coming up against today took their roots in the origins of the trade-union rights. The 21 march 1884 law legalized the trade-union by calling it legal entity. It created the conditions of the gap between the salaried employees and their representatives. This gap kept on increasing so much that it questioned about the foundations of the social democracy and about the role given to the trade-union organizations too. It contributed to make us see the social democracy just as a co-management. The in-progress reform of the dialogue between employers and trade-unions forces the management and the labour to reconsider the basis of collective negotiations and my allow this social democracy wich keeps on looking for legitimacy to be revitalized in the long run

Full textPsychiatry is in a category of its own among medical disciplines. Independence and acknowledgement as a medical discipline in its own right has been a long and complex development process, involving claims to a difference which creates the profession's specific nature. The generalization of social security endorsement has contributed to the development and emergence of private psychiatry, and to the splintering of its field of activity. However, the mecanism of the social security system has imposed a conflict situation on free-lance psychiatrists and their union representatives. Indeed, the way national health insurance works cannot accomodate an absolute respect of the principles peculiar to the free-lance practice of psychiartry. Especialy in difficult economic situation. Confronted with the economic difficulties now affecting the profession, unions have made the defence of psychiatric activity the mainstay of their claims and theoretical arguments which are closely tied to the very concept of free-lance medecine. Psychiatric medical activity comes across as a complex and heterogeneous economic product, the features of which can only be grasped by analysing the conflicts to which it is subject. It is the product of a medical decision process, which in psychiatry does not stem a linear approach, even if such an approach claims to be rigorous, scientific and modelled on medical objectivity. From our analysis, we see that the only available statistics, plus the very few existing papers which deal with free-lance pratice in psychiatry, are insufficient to pinpoint the reality of the professions's economic status. A nationwide survey into the subject has proven decisive, rich in information, and has enabled a lot of attention to be focussed a certain number of phenomena which are already the premonitory signs of future positions

Full textOver the last decades, the activity of transnational corporations generates an increase of worker's rights violations on areas granting low social protection. Unions of the companies have had to adapt their strategies to this internationalization, throught the development of intra-group solidarity. This study suggests to pursue the evolution of the trade union action on judiciary grounds in order to achieve a more coercive supervision of the activities of transnational corporations. Workers of the subsidiary established in the hist state must therefore find support with unions of the parent, allowing them access to judicial review of the violation of their rights. Different mechanisms open to unions have been faced with the practice of transnational civil litigation. Thanks to these means of action, both the responsibility of the transnational cooperation, direct perpetrator of violations of workers' rights and states, under their obligation to protect human rights, have been considered. At the end of the analysis, the ILO and European Social Charter's procedures, specialized in the protection of workers' rights, seem little opened to the type of case considered. If the original field of the OECD is moire suitable, it shares with other quasi judicial mechanisms a lack of binding. Unions are encouraged to turn to full judicial mechanisms. Obstacles within the individual application to the European Court appear insurmontable. However, transnational civil litigation could be effectively brought before the domestic courts through the implementation of the proposed changes

Full textThe purpose of this dissertation is to evaluate the importance of the changes that affected both the industrial relations and the trade unions in Great-Britain between 1979 and 1987. The first part deals with the evolution of British industrial relations and the rise of trade union power since World War II. Full textThis research focuses on the legal and judicial actions of the European Trade Union Confederation (ETUC). Drawing on interviews, archives, grey literature and legal sources, this dissertation analyses how and why the Europeans trade unionists use European law and justice to defend their interests. By investigating the relationship between Social Europe, the European trade union movement and European law, this thesis makes three contributions. Firstly, we explain the limits of Social Europe by the dominated position of the trade unionists in the European legal field. Secondly, we contribute to knowledge about European trade unionism by doing the political and historical sociology of the trade union lawyers and their practices. Thirdly, by studying the legal and judicial actions of the European trade union actors as transnational mobilisations, we identify the resources, the organisational structures and the framings that characterise this form of trade union action

Full textLes développements théoriques se penchent sur le mode de fonctionnement et sur les déterminants de l’action des organisations syndicales, sur les causes du chômage et ses conséquences pour les travailleurs salariés et leurs organisations, ainsi que sur les obstacles et les incitants à l’action collective contestataire des sans-emploi.
Ces outils d’analyse sont ensuite utilisés pour examiner, depuis l’origine des organisations syndicales contemporaines et de l’indemnisation du chômage, au XIXe siècle, jusqu’à la réforme du mode de contrôle des chômeurs en 2004, les fondements et l’évolution de la relation que les syndicats belges entretiennent avec les questions de l’emploi et du chômage d’une part, avec les chômeurs d’autre part.
In Belgium, 85% of the unemployed are unionised. This peculiar situation is mainly related to the specific position of the trade unions, as the jobless can choose to receive their benefits through the intervention of one of the three national unions. The Ph.D. dissertation aims at examining the origins of that specific relationship and its implications on both the trade unions and the unemployed.
The theoretical part explores the features of union action and functioning, the causes of unemployment and its consequences for the workers and their organisations, as well as the impediments and impetus to the contentious mobilisation of the unemployed.
Based on that theoretical framework, the Ph.D. dissertation then examines the origins and the evolution from the 19th century till 2004 of the union positions on the issues of employment and unemployment on the one hand, and their links with the jobless on the other.

Full textThe objectives of this study consist on one side in understanding the reasons that lead a woman to militate within a trade union, and, on the other side in analysing her everyday life and her relationship with her men colleges. This study is realised in two parts, with three trade unions from Sao Paulo (Brazil). We first present some data related to both the world of labour, with its advantages and drawbacks, and the trade-union organizations. We then present a quick historical record about the three analysed trade unions before dedicating the second part of the study to their leaders (women). These women's militancy is then analysed, with the motivations of their involvement. Then, we try to better understand the daily actions they undertake as trade-union leaders, and the relationship they have with their men colleagues on one side and with the other women, militants or not, on the other side. Finally, in order to conclude this study, it seems necessary to better know these women's private life. We then are interested by the trade-union leader as a daughter, a wife and a mother

Full textThe studies show that SMEs, because of their lack of resources, not keeping pace with the Business intelligence. The specific needs of SMEs to create tools specific to their context for the implementation of a Business intelligence. The argument is that trade unions are an intermediate relevant to SMEs access to collective approach business intelligence. We use functional approach to study Business intelligence. Business intelligence has four functions : the scanning, the influence, the control of the intangible asset, and the central function of coordination of actors and activities. Two case studies are conducted within the unions of Metallurgy Rhodanienne and Allizé Plastics. As a first step, we study the performance of support developed by the trade unions in terms of the first three functions of business intelligence. This thesis focuses on the trade unions as a broker that coordinates SMEs depending on the mode network. Thus, in a second phase, two networks initiated by trade union action are studied in longitudinal. We develop the logic underlying the emergence of the two networks and detail their contributions to SME members concerning Business intelligence, in the light of two studies of networks, the social logic and strategic logic. Finally, we interpret the performance of these two networks by identifying five categories of performance factors which interact in a dynamic manner under : he influence of trade union action

Full textIn Germany medical syndicalism institutionalized itself in the welfare state, in purpose to give the profession a central position in the health-insurance system. The collective indentity constructed through this process is the "insurance physician". In France medical syndicalism has developped in opposition to the welfare state; so the "liberal physician" is the prevailing collective identity. Through the institutionalization of representation the interaction between the profession and the state is stabilized in germany. The public law status bodies play a great part in the implementation of health policy; which can be caracterized as a self-administred sectoral corporatism. In france representation is less institutionalized. The defense of the liberal identity causes internal cleavages and conflicts with the state. The profession doesn't play a big part in the health policy implementation. In both countries the prevailing structures of representation are weakening

Full textThe object of this thesis is to analyse the influence of bargaining structures on investment and on the growth process. We distinguish different bargaining structures depending on when the investment decision is taken. In a case of investment irreversibility, we highlight the existence of a distortion effect in the utilisation of the capital stock and, therefore, of an appropriation effect of the union. In a dynamic framework, the same results appear and confirm the preceding. The second part is devoted to growth and show a durable effect on growth of bargaining when the enterprise is leader and when the union maximises a utility of monetary gain. In a dual labour market and when the growth process is based on the existence of reciprocal externalities, there exists special configurations in which the bargaining process allow a better growth. In a last theoretical chapter, we introduce matching frictions in the hiring process and show the existence of a moderating effect of unemployment on the appropriation effect. A last part shows empirically the existence of a negative relation between the union rate and growth on a large sample of countries, hypothesis which is confirmed by a test realised on the oecd countries on a panel basis

Full textOne of the main problem that economists have to be faced consists in explaining how the wage process may lead to unemployment, even though agents consider it as unfortunate. The "new" microeconomic theories of the labour market have provided pieces of answers to this issue. This PhD dissertation will deal more specifically with the insiders-outsiders theory which covers the opposing interests bringing employees and work-less into conflict. Originally, the literature on the topic became organised into two approaches. The first one makes references to the Lindbeck & Snower's research which can be thought as following the seminal work of Becker, concerning firm-specific training. The second one coincides with a field in the economics of the trade union. Its foundation is to consider that these institutions serve the employees' interests and neglect the work-less who wish to get a job. Our works can then be seen as attempting to bring together these two research fields. In particular, it notices that two approaches to the problem are different from one another by taking into account either the replacement costs or the collective bargaining. We try then to show clearly the influence of the first ones when they are explicitly brought into the scope of usual trade union models. Our main contribution is to show that such approach evades the Occam' principle. It looks at some classic issues in the economics of trade union in a new way and provides some persuasive answers to very natural questions that usual models can not address. By singling out some involuntary unemployment state, we show some original results concerning successively (i) the process of the trade union objectives, (ii) the structure of the eligible contacts set and (iii) the properties of the contracts, especially concerning the relationships between wage, profit and the number of insiders

Full textAmerican teachers have acted as pioneers as regards union representation rights for public employees. However, in the early 1980s they were placed in many different circumstances as to the exercise of such rights. Depending on the state in which they worked, on the level at which they taught and on the public or private status of their schools, some teachers had no union rights while others were obliged to join a union. Besides, the procedure for forming a local union was in many cases so heavy that it overshadowed the ideological dimension of unionization. This dissertation is divided into three parts. The first one traces the evolution of American teachers' organizations and of the organizing process from an ideological point of view. The second one uses the example of Lycée français de New York from 1981 to 1985 to study the complexities of the certification procedure which teachers in private institutions had to follow at that time. The third one analyzes Albert Shanker's weekly columns in the New York Times to comprehend the ideas put forward by the American Federation of Teachers, a public school teachers' union which also organizes private school teachers on a small scale

Full textAt first sight, it's attempting the impossible to study the Malian trade-union movement given the weakness of wage earning classes in a country where the agricultural sector dominates, the unique nature of the syndicate and its implication in the country's economic, social and political situation. As for many other African countries, Malian trade-unionism finds its roots in the system of exploitation imposed on them by the colonialists. This study is centered on the development of this trade unionism (its beginning and its growth), the relevance of the ideological factor in the process towards independence and the build-up of the country, its structures, their functioning, the external relations and inevitable relation-ship between the trade-unionism and the government in power, be it colonial, civil or military. Since the creation of Malian trade-unionism in 1946, it has come across many difficulties. Tolerated by the colonialist although there was a constant struggle, it then entered into conflict with "l'Union soudanaise-RDA" despite its representation within her active pro-liberation element of the party. From 1960 until 1968 the "Union nationale des travailleurs du Mali" (UNTM) was recognized by the party as an integral pact of the internal structure necessary for the development and strengthening of socialism. Since the over-throw of Modibo Keita, the militaries try to subjugate the trade unionism. Despite the "responsible participation" political compromise between the new party "l'Union democratique du peuple malien" and the trade unionism, one question still remains: what are their chances of remaining united given the general instable atmosphere? In spite of the weakness inherent in the Malian trade union movement its represents a major force as it is proved by the government's appeals and attacks
