Abstract:
The Ottoman reforms of the mid-nineteenth century accelerated the process of opening up Syria to European travellers and traders, and gave Syria's Jews access to European Jewish communities. The resulting influx of Western ideas led to a decline in the traditional economy. It also allowed for the introduction of Western education, influenced the structure and the administration of Jewish society in Syria, and changed the balance of the relationship between Muslims, Christians, and Jews. Initially Syria's Jewish communities flourished in these new circumstances, but there was a developing recognition that their future lay overseas. After the opening of the Suez Canal in 1869, the bankruptcy of the Ottoman Empire in 1875, and the suspension of the Ottoman constitution in 1878, this feeling intensified. A process of decline set in that ultimately culminated in large-scale Jewish emigration. Thereon, the future for Syrian Jews lay in the West, not the East. This book covers Jewish community life, the legal status of Jews in Syria, their relationship with their Muslim and Christian neighbours, and their links with the West. It draws on a range of archival material in six languages, including Jewish, Christian Arab, and Muslim Arab sources, Ottoman and European documents, consular reports, travel accounts, and reports from the contemporary press and by emissaries to Syria of the Alliance Israélite Universelle. Rabbinic sources are particularly important in opening a window onto Syrian Jewish life and concerns. Together these sources bring to light an enormous amount of material and provide a broad, multifaceted perspective on the Syrian Jewish community.

Abstract:
This chapter discusses the military operations against the Islamic State (ISIL or Da’esh) in Iraq as in Syria. After recalling the relevant facts and the context, it exposes the legal positions of the intervening states as well as those of the other states. In a third section some doubts are expressed concerning the legality of the operations based on the argument of self-defence, particularly when it implies the bombing of the Syrian territory without the consent of its government. In the same vein, a final section shows that the majority of states has not accepted the ‘unwilling or unable’, ‘limited sovereignty’, or ‘self-help’ necessity arguments, or, for that matter, the permissibility of preventive or pre-emptive self-defence. Accepting such arguments would undoubtedly imply at the very least a new interpretation of the UN Charter.

Abstract:
Two low-level armed conflicts, Indonesia’s East Timor and Ivory Coast’s post-2010 election crises, provide detailed qualitative evidence of highly structured intergovernmental organizations (IGOs) engaging in effective civil warpreventing activities in member-states. Highly structured IGOs threatened and sanctioned each of these states and offered (long-term) benefits conditional on successful crisis resolution. The governments were aware of and responded to these IGOs’ concerns, as did the rebels in these respective cases. The early stages of the conflict in Syria in 2011 provide a counterpoint. With Syria’s limited engagement in only few highly structured IGOs, the Syrian government ignored international calls for peace. And, without highly structured IGOs’ counterweight to curtail the government, the rebels saw little reason to stop their armed resistance. The result was a brutal and deadly civil war that continues today.

This chapter examines the threats of military intervention expressed by the United States, the United Kingdom and France in reaction to the use of chemical weapons during an attack in the Ghouta area of Damascus in 2013 as well as the military strikes launched by the United States following the use of chemical weapons during an attack in the Khan Sheikhun area of Southern Idlib in 2017. After recalling the facts and context of the Syrian crisis, it studies the legal positions of the main protagonists (the United States, the United Kingdom and France) and the reactions of third States and international organisations. The final section analyses the envisaged and actual intervention’s precedential value and its impact on the jus ad bellum. It argues that targeting the military assets of a sovereign State as a reaction to violations of international law that this State has supposedly committed is far from being unanimously accepted from a legal point of view.

This contribution discusses the hostilities that opposed Israel against Egypt, Syria and the armed forces of other Arab states, which took place in October 1973. After setting out the context of this confrontation, which is directly linked to the 1967 Six Days War, it presents the legal positions of the main protagonists (Israel, Egypt, Syria) as well as those of third states and international organizations. The third section examines the legality of this resort to force under jus ad bellum and concludes that the military operations on behalf of the Arab states can be justified as an exercise of the right to self-defence. Finally, the conclusions discuss the limited precedential value of this specific incident with respect to the interpretation of the prohibition to use force in international relations.

How to resist President Donald Trump’s assault on international law? This introduction sketches the tripartite plan of this book. First, it discusses a counterstrategy of resistance based on transnational legal process. Second, it illustrates that counterstrategy with respect to immigration and refugees, and human rights; the Paris Climate Change Agreement, the Iran Nuclear Deal, and trade diplomacy; with countries of concern such as North Korea, Russia, and Ukraine; and with respect to America’s wars: Al Qaeda, Islamic State, Afghanistan, and Syria. Third, it reviews what broader issues are at stake in the looming battle between maintaining the post-World War II framework of Kantian global governance versus shifting to an Orwellian system of authoritarian spheres of influence.
