Abstract:
<p>Criminal responsibility is communicative ring and bridge of two important institutions of criminal law, crime and punishment and therefore is one of the most important issues of criminal law.<br />On the other hand, one of the conditions of obligation and criminal responsibilities is authority and freedom of action that a person could be required to preserve and respect for life, property and dignity of the people that in the actions is autonomous and free.<br />Although our legislator is considered to this issue in discretionary (Tazir) punishments crimes and life retribution explicitly and in the Haddi crimes are pointed to the lack of coercive responsibility, however, coercive criminal responsibility isn't specified in all instances of mentioned crimes, while in the discretionary (Tazir) punishments crimes, coercion is spiritual steward and is responsible for criminal responsibility due to the force committed crime and in the crime led to the death, in some cases crime is attributable to the duress, in the crimes included Hadd, coercing isn't considered spiritual steward.<br />In this paper, the mentioned issue is discussed in terms of legal and regulatory concerning the crime of adultery.</p>

Kelantan merupakan salah satu dari 13 negara bagian di Malaysia, perjuangan penerapan syariat Islam di Kelantan telah berjalan sejak lahirnya PAS tahun 1951. Namun otonomi atau kewenangan dalam penerapan syariat Islam yang dicita-citakan oleh PAS mengalami banyak hambatan karena bertentangan dengan UU Federal dan Akta Mahkamah Syariah. Dalam UU Federal tidak menganut azas negara Islam dan tidak menginginkan tegaknya hukum Islam berseberangan produk hukum di negeri kelantan. Akhirnya perbenturan diantara aturan pemerintah federal dan negara bagian tersebut, menjadikan peraturan negara bagian terpaksa dibatalkan pemerintah ferderal. Tulisan ini menjelaskan berbagai Upaya-upaya dalam penerapan syariat Islam yang dilakukan PAS di eksekutif, legislatif dan Majlis Syuro yang tiada henti dengan terus menyempurnakan produk hukumnya baik dalam bentuk Enakmen Jenayah Syariah Kelantan 1993 tentang hukum hudud, Qishas dan Tazir,serta peraturan-peraturan daerah (perda) melarang berbagai kemaksiatan.

 Human rights are basic rights that are inherent and universal in human beings. In Indonesia, human rights have been protected by the laws that originate and lead to “Pancasila” . No one can interfere with human rights or eliminate its. In this contemporary era, many practitioners and education thinkers, who analyze about Ta'zir (A punishment) applied to Islamic boarding schools, especially in Islamic boarding schools with typology of salafy. Some people argue that Ta'zir is a form of human rights violations, others say there are not. In this discussion the author tries to provide an analysis related to Ta'zir which is a punishment given to students who violate the rules in the Islamic Boarding School, Is it included in the category of human rights violations that must be eliminated. Or is it just a learning method that aims to provide a deterrent effect on students who break the rules.

 HAM merupakan hak dasar yang kodratnya melekat pada diri manusia dan bersifat universal serta langgeng. HAM di Indonesia dilindungi oleh UU yang bersumber serta bermuara pada Pancasila. Tidak ada satupun manusia yang boleh mengganggu ataupun menghilangkan hak asasi manusia (HAM). Banyak Praktisi dan pemikir pendidikan dizaman kontemporer ini yang menganalisa tentang Ta’zir (Sebuah hukuman) yang di terapkan pada pondok pesantren terutama pada pesantren yang ber-tipologi salafy. Sebagian berpendapat bahwa ta’zir merupakan salah satu bentuk pelanggaran HAM, sebagian lain mengatakan tidak terdapat pelanggaran HAM. Pada pembahasan ini penulis mencoba untuk memberikan analisa terkait Ta’zir yaitu sebuah hukuman yang diberikan kepada santri yang melanggar aturan dalam Pesantren, apakah termasuk dalam kategori pelanggaran HAM sehingga harus dihapuskan. Ataukah memang hanya sebuah metode pembelajaran yang bertujuan untuk memberikan efek jera pada santri pelanggar aturan.

Right now, zakat is an obligation for every Moslem, besides to purify wealth and soul, zakat is also a potential fund source to welfare purpose, social justice, to improve life quality of dhuafa people, and also as one of the resources to national development. As we know, regulation in Indonesia including local regulation is a reception Islamic Law. So, its so clear that there is a connection between Islamic Law and National Law and no exception for regulation of zakat that define Muzakki Fine as a form of punishment of Tazir.

Mühimme Defterlerinde sıklıkla görülen kürek cezası, nitelikli hapis cezası şeklinde görülen tazir cezasıdır. Kural olarak asli ceza olarak kullanılan ceza, bedeli ve nadiren de olsa tekmili ceza olarak uygulanmıştır. Tatbik yerine göre değerlendirildiğinde, kürek cezasının bedeni ve hürriyet kısıtlayıcı ceza olduğunu belirtebiliriz. Mezkûr cezanın şiddet seviyesi çok yüksektir; bu cezanın idam cezasından sonra en şiddetli ceza olduğunu söyleyebiliriz. Prensip itibariyle kanunilik ilkesine uygun bir şekilde uygulanan kürek cezası, kadınlar ve köleler dışında toplumunun tüm kesimleri için hükme bağlanabilmiştir. Şahsilik ilkesi de kürek cezası açısından kural olarak uygulanmıştır. Ancak "nefse" kefalet müessesesi, kürek cezasının şahsilik ilkesine istisna oluşturmaktadır. Kürek cezası, cezanın amacını açıklamaya çalışan neticeci teoriye ve umumi caydırıcılık teorisine uygun olarak kullanılmıştır. Bu ceza Divan-ı Hümayun ve/veya padişah emri ile hükmedilen bir cezadır. Padişahın bu konudaki yetkisi, cezanın affı konusunda da kendisini göstermektedir. Klasik dönemde uygulanan kürek cezasının mahkûma kamu hizmeti gördürme niteliği, bu cezadan öğrenilen bilgi, edinilen tecrübe olmuştur.

Islamic Shari'ah functioned by God as a deterrent to evil. Jurisprudence of Jinayat in Islamic law recognizes three kinds of punishment for a crime committed by a person; Qishah, hudud and ta'zir. The determination of punishment is not merely a revenge, but rather a goal to create a deterrent effect or shock to create a calm and peaceful society situation as the message contained in the word hayah which means a peaceful life. This paper aims to reveal the concept of punishment in the crime of corruption in the eyewear of Jinayat jurisprudence. Through literature review it can be concluded that the sanction of corruption is ta'zir, which is adjusted with the judge's decision based on the level of corruption that has been done. Sanctions in the form of ta'zir vary from mild to severe enough to recall corruption with a complex social impact. The ta'zir sanctions that can be given to the perpetrators of corruption are; Imprisonment, defamation, material fines to death penalty.<br />---<br /><br />Syariat Islam difungsikan Allah sebagai pencegah kejahatan. Fikih Jinayat dalam syariat Islam mengenal tiga macam hukuman atas kejahatan yang telah dilakukan oleh seseoorang; qishah, hudud dan ta'zir. Penetapan hukuman tidak hanya sekedar pelampiasan dendam, namun lebih pada tujuan untuk menimbulkan efek jera atau shock terapy agar tercipta situasi masyarakat yang tenang dan damai sebagaimana pesan yang terkandung dalam kata hayah yang artinya kehidupan yang damai. Tulisan ini bertujuan untuk mengungkap konsep hukuman dalam kejahatan korupsi dalam kacamata fikih Jinayat. Melalui kajian literature dapat disimpulkan bahwa sanksi tindak pidana korupsi adalah ta’zir, yaitu disesuaikan dengan keputusan hakim berdasarkan kadar korupsi yang telah dilakukan. Sanksi berupa ta’zir ini beragam dari yang ringan hingga yang cukup berat berat mengingat korupsi membawa dampak sosial yang kompleks. Sanksi ta’zir yang bisa diberikan kepada para pelaku korupsi adalah; penjara, pencelaan, denda materi hingga hukuman mati.

Abstract:
In the Islamic perspective the ruler is a consummate jurisprudent with special authority. In criminal matters, for example, the ruler also has a prominent role, such as setting limits (Hadd) to accepted behaviors and punishments for reprehensible behaviors. In fact, in the case of convenience and special circumstances, the ruler can disapprove or modify a certain punishment. The objective of the article is then to analyze the role of the canonical ruler in the transformation of limit punishments or corporal punishment (tazir) in Iran. Based on the descriptive ـ analytical method, the work concludes that, according to the belief concerning the permission to implement the limits during the time of The Absence, the basic principle is the lack of permission to switch the limits. But if the religious ruler realizes that the implementation of the limits, in certain circumstances, is contrary to the application objectives, the interests of Islamic society and the maintenance of the government, or in the confrontation with certain rules, such as “ to be ashamed ”(لاحرج) and“ without harm ”(لاضرر), he can rule to commute the sentence.

Abstract:
Three issues are explored in this article with regard to death by stoning as a punishment for adultery. First is its total absence in the Quran; the Quran makes no reference to stoning, providing a punishment of one hundred lashes of the whip for all adulterers, without any further qualification. Stoning as a punishment originates in the Sunnah of the Prophet, who applied it in the case of married adulterers, thus seemingly reserving the Quranic punishment for the unmarried adulterer. This perspective has dominated legal practice ever since. The second issue arising is as to how the conflicting rulings in the Quran and Sunnah relate to one another. Is it a case of specification (takhsis) or of abrogation (naskh)? If the latter, is it in order for the Sunnah to abrogate the Quran? The third issue is over the chronological sequence of the two rulings. If it is accepted that the Quranic ruling was revealed in Madinah after the few cases in which the Prophet applied stoning, then the Quran would have effectively overruled/abrogated the Prophetic practice. It is also said that the Prophet applied stoning by reference to the Torah, which was then set aside by the Quran. A minority opinion has also held that the Prophet applied stoning by way of tazir. A number of prominent twentieth-century shariah scholars have advised against the enforcement of stoning altogether.

Abstract:
Giant axonal neuropathy (GAN), an autosomal recessive disorder caused by mutations in GAN, is characterized cytopathologically by cytoskeletal abnormality. Based on its sequence, gigaxonin contains an NH2-terminal BTB domain followed by six kelch repeats, which are believed to be important for protein–protein interactions (Adams, J., R. Kelso, and L. Cooley. 2000. Trends Cell Biol. 10:17–24.). Here, we report the identification of a neuronal binding partner of gigaxonin. Results obtained from yeast two-hybrid screening, cotransfections, and coimmunoprecipitations demonstrate that gigaxonin binds directly to microtubule-associated protein (MAP)1B light chain (LC; MAP1B-LC), a protein involved in maintaining the integrity of cytoskeletal structures and promoting neuronal stability. Studies using double immunofluorescent microscopy and ultrastructural analysis revealed physiological colocalization of gigaxonin with MAP1B in neurons. Furthermore, in transfected cells the specific interaction of gigaxonin with MAP1B is shown to enhance the microtubule stability required for axonal transport over long distance. At least two different mutations identified in GAN patients (Bomont, P., L. Cavalier, F. Blondeau, C. Ben Hamida, S. Belal, M. Tazir, E. Demir, H. Topaloglu, R. Korinthenberg, B. Tuysuz, et al. 2000. Nat. Genet. 26:370–374.) lead to loss of gigaxonin–MAP1B-LC interaction. The devastating axonal degeneration and neuronal death found in GAN patients point to the importance of gigaxonin for neuronal survival. Our findings may provide important insights into the pathogenesis of neurodegenerative disorders related to cytoskeletal abnormalities.

Abstract:
A person may be said to commit a crime, although, he does not directly be a part of it. To encourage, order, assist another person for the commission of a crime is considered an offence as the act or omission of principal offender is considered. To encourage, order, assist another person for the commission of a crime in legal terminology is called Abetment. Abetment in criminal law specifies distinguish between an abettor and the principal offender. Under the Pakistan Penal Code, in many cases an abettor is not awarded the same punishment as awarded to the principal offender. There are few cases in which the abettor is awarded the same Punishment as awarded to the principal offender. Under Islamic Criminal law majority of Jurists are on the opinion that Hudood punishments will be awarded only in cases where Hudood offences are committed by Participant by Action (Arabic: الاشتراك بالمباشر) in case where these are committed by Participant by abetment (Arabic: الاشتراك بالتسبب), Hudood punishments shall not be awarded to them rather Tazir Punishment may be awarded to them. Thus, Participation in crime is either directly or indirectly. Participation by action (الاشتراك بالمباشر) and Participation by abetment (الاشتراك بالتسبب). Ingredients of Participation by abetment are Consensus (الاتفاق), Instigation:(التحريض and An Assistance (الاعانة). Causes for the commission of abetment are Causeof Shariat(السبب الشرعي), Causeof usages forabetment (السبب العرفي) and Cause of common sense forabetment (السبب الحسي). Further division of Participation by action and participation by abetment: It is further divided into two forms:Tawafuqتوافق)) and Tamalo (تمالؤ). In this reaserach article The Offence of Abetment under the Islamic Criminal law is discussed in detail.

Born in Damascus in 1931 Zakariyyā Tāmir is widely considered one of the most significant figures in the contemporary literary scene of Syria and the wider Middle East. This thesis addresses his literary trajectory and the ways in which representations of masculinity and femininity have changed throughout his career by situating the stylistic and thematic transformations in the context of major historical and political events in Syria and the region. Applying an approach that relates literary transformations to a rapidly changing political context, the research elucidates how the changing configurations of gender roles in Tāmir’s works can be understood in the context of what Kamal Abu- Deeb has described as a process of political and ideological fragmentation affecting the Arab East since the mid-1970s. Dividing Tāmir’s works into two periods (1958-1978 and 1994-2014) to connect them to the different historical conditions in which they appeared, this study examines the significance of masculinity, patriarchy, sexuality and female identity in relation to the collapse of the totalising discourse of modernity. The research scrutinises the ways in which this process has engendered a multiplication of voices and roles in his short stories. Employing Connel’s theory of hegemonic masculinity the study addresses the ways in which the mutually informing nature of masculinities and femininities in Tāmir’s stories channels compliance and/or subversion to patriarchy and patriarchal authoritarianism. In the first part, this dissertation puts into conversation Tāmir’s early works written in the late 1950s and early 1960s and the modernist trend. The organic relationship Arabic literature enjoyed with the project of national liberation is reflected in the fundamentally male-centred nature of the stories, leaving female characters at the margins of a progressive and existentialist struggle for emancipation from authoritarianism, patriarchy, religious tradition and exploitation. While examples from the very early stories show the significant presence of a genuine concern with the sexual dimension of female characters, episodes expressing a more openly political stance also exhibit a tendency to instrumentalise the female body in order to denounce the pervasiveness of the authoritarian state. The second part, devoted to the analysis of Tāmir’s latest works published since his self-imposed exile to the UK, looks at the emergence of prominent female characters openly expressing their sexual desire, simultaneously assessing their subjectivity and acting as decisive actors that shape the male protagonists’ masculinity. The analysis reveals how the works of this period retain a significant political charge, and brings together the appearance of original female characters and the correlated emergence of weak model of masculinity. In addition, stories typified by pessimism, as well as by extensive resorting to elements of Arab popular tradition, serve as illustrations of a peculiar form of Arab postmodernism which has appeared in Tāmir’s stories lately.

Abstract:
This thesis tested hypotheses about the response of Baird’s tapir to rising anthropogenic pressure in Honduras. Baird’s tapir is the largest land mammal native to the Neotropics, and was previously abundant in all countries between Mexico and Ecuador. Patterns in Baird’s tapir occupancy in Honduras were modelled to test the effect of a range of environmental variables on the distribution and abundance of the species. Analyses of the genetic structure of Baird’s tapir in Honduras revealed very little genetic diversity at the mitochondrial genome. Only two haplotypes were identified from 69 samples successfully genotyped, representing a remarkably low level of diversity, which is likely to affect the viability of the species in the long-term. Occupancy and population estimates were generated for four protected areas, and for the remaining regions in Honduras where Baird’s tapir have been confirmed to remain. Occupancy was found to be associated with environmental variables relating to accessibility. Although the population estimates generated here exceed previous estimates, evidence of ongoing poaching and deforestation of tapir habitat suggests that Baird’s tapir populations in Honduras may not be viable outside of the protected areas of La Moskitia. Population Viability Analyses for the remaining areas of tapir occupancy in Honduras demonstrate the vulnerability of the species to habitat fragmentation and hunting pressure. Annual surveys in Cusuco National Park (PNC) from 2009 to 2012 investigated the conservation status of the species in this tapir stronghold over the duration of this PhD project. Patch occupancy analysis demonstrated that Baird’s tapir display a distribution bias in PNC associated with accessibility, and identified that Baird’s tapir are suffering a population decline that has the potential to cause the extirpation of the species from this Park within the next few years.

Abstract:
Статья посвящена правовой характеристике фикха и ответственности в мусульманской системе права. Перечислены этапы возникновения и развития фикха. В статье выявляется трехуровневая система наказаний по мусульманскому праву, элементами которой являются такие виды наказаний как: «худуд», «кисас» и «тазир». В заключении работы формулируется вывод о том, что фикх представляет из себя совокупность теоретических знаний об исламской вере и ее практических положений правоприменения (Шариат) на основе норм главных источников мусульманской системы права - Священного Корана и Сунны Пророка Мухаммада (да благословит его Аллах и приветствует). The article is devoted to the legal characteristics of fiqh and responsibility in the Muslim legal system. The stages of the origin and development of fiqh are listed. The article reveals a three-level system of punishments under Muslim law, the elements of which are such types of punishments as: "Hudud", "qisas" and "tazir". In conclusion, the article concludes that fiqh is characterized as a set of theoretical knowledge about the Islamic faith and its practical provisions of law enforcement (Sharia) based on the norms of the main sources of the Muslim legal system - the Holy Qur'an and the Sunnah of the Prophet Muhammad (peace and blessings of Allaah be upon him).
