Full textChapter 1 clarifies the notions of privatization and control. The subsequent chapters are organized on the basis of the percentage of shares held by the state. Chapter 2 analyzes the legal problems accompanying "complete control" of the state during the corporatization stage of privatization, in which there is a one-man stock company with the state as sole shareholder. Chapter 3 outlines the different private and public law devices used by the state in order to exercise "internal control" on the company after the sale of part or all of the government-owned ordinary shares. Chapter 4 focuses on the "external control" which is the last weapon of the state to monitor enterprises that are already deemed to be "privatized" from an ownership point of view. Full textBecause of the evolution of the sector, international satellite organizations have undertaken for around ten years several internal reforms that lead today to the privatization of the three major organizations: Intelsat, Inmarsat and Eutelsat. These transformations constitute a particular sensitive issue as these organizations have been initially established so that to exploit satellite systems for the general interest of their members.
The impact of this phenomenon is no less considerable on the ITU, in charge of the international regulation, from a regulatory but also structural point of view. Moreover, the liberalization of telecommunication market undertaken under the aegis of the WTO grants to this organization a new major place in space telecommunication regulation.

This report examines the role of the privatization in Sri Lanka and assesses its effectiveness. The focus was given for the evolution of privatization and how socio-political factors such as rent-seeking, inconsistency policy making, market competition, political uncertainty and role of supporting institutions have affected the privatization process. After the independence in 1948, several reforms have been taken place in Sri Lanka. In 1977, a market oriented policy package which brought huge amount of foreign aids into the country was introduced. Further the privatization in Sri Lanka can be addressed as: Sporadic attempt, Systematic approach and Structured approach. The appointment of short-term governments and changing of the leadership has always been a hurdle for a successful privatization in Sri Lanka. In order to establish a successful privatization, it requires having the changing of ownership from public sector to private sector, creating a competitive market environment and forming a proper institutional framework. Unfortunately, due to less emphasis was given to the latter two factors: the privatization has always given undesirable outcomes. In the whole history of privatization in Sri Lanka, the highest value for Foreign Direct Investment (FDI) was recorded in 2008. It is clear that the reason for the FDI value escalation in 2008 is the improved confidence of foreign investors by addressing security concerns. In conclusion, it is time to investigate whether the current regulatory model is the most appropriate arrangement for the prevailing economic, social and cultural circumstances in Sri Lanka.

Full textSouth Africa needs a modern, sophisticated telecommunications network to ensure economic development and political stability. The same network must also provide affordable and reliable service to a great percentage of the population. The telecommunications industry is currently monopolised by Telkom, a state-owned business enterprise (SBE), and does not appear capable of meeting these basic requirements. The purpose of this paper is to present a case for restructuring Telkom and liberalising the telecommunications industry to best serve the needs of the South African economy. The objective for restructuring the telecommunications industry must be to maximise long-term consumer welfare for all South Africans. This paper argues that consumer welfare will be maximised only by dismantling the statutory monopoly structure and moving toward a highly competitive, privately owned telecommunications industry. The economic issues, of course, cannot be discussed realistically without reference to political, social and historical variables, all of which are also considered. By focusing primarily on economic issues, however, this paper strives to avoid the ideological disputes which usually surround discussions of state ownership. This paper focuses on the telecommunications industry because it represents the single most important infrastructural component in a modern economy. It also presents a unique opportunity if managed well, and a grave danger if allowed to continue in its current structure.

This thesis hypothesized that extensive telecommunications liberalization would not increase the penetration rate of the fixed telephone service better than other, less competition-oriented, policy alternatives. The hypothesis was validated in the case of Thailand and the Philippines. However, for the cellular mobile telephone and Internet services, extensive telecommunications liberalization could increase the penetration rates better than other, less competition-oriented, policy alternatives. Thus, the thesis demonstrates that past research has not paid sufficient attention to this issue and has assumed that the more extensive reform could lead to the faster and the better telecommunications development of all telecommunication services. The thesis suggested that less-developed countries (LDCs) should realize that they do not have to fully implement liberalization reforms, but should instead specifically tailor their telecommunications reform policies to their own pace and needs. This study found that extensive liberalization reforms or extensive opening of the market does not necessarily increase penetration rates of services better than other less competition-oriented policy alternatives under the following conditions: Assuming that the services have not yet reached their saturation levels based on the S-curve,
(cont.) 1. Users perceive the service as a necessity; and 2. the government perceives the service as a basic necessity; and 3. the government strictly commits and implements purposeful policies with the intention of increasing penetration rates of the services through the distribution of service provision authority. Or, 4. If the liberalization is implemented after the saturation level of the service is reached. The thesis results have the policy implication that liberalization can be a useful and effective alternative to lead to higher penetration rates, when and only if, the country and its people understand its goals, effects and implications and, more importantly, when the government provides the policy framework for universal service for the benefits of its people so that the liberalization can lead to self-sustainable development.

Full textAt this stage of development of the telecommunication sector, it is still concemed with issues related with the triptych regulation - re-regulation, privatization and competition. Although the institutional and regulatory framework of the telecommunication industry has changed radically since the 80s, a lot still remains to be done notably in developing countries. Due to pressures from international institutions, developing countries are privatizing their state owned incumbent operators, allowing entry of foreign and domestic operators and establishing separate regulatory institutions, a a way to alleviate the existing poor performance. The case of Middle East and North Africa region (MENA) countries ca be distinguished from two perspectives, first, they were Iate in implementing reforms compared to other groups of developing countries. Second, the institutional, political and economic nature of such countries shapes their decisions regarding the adoption of different reforms. This study aims at discussing the introduction of different telecom reforms depending on the institutional, political and economic specificities per country. We also aim at testing the effect of different reform sequences on the sector performance. The impact oftelecom market restrictions on MENA telecom performance is also addressed. Finally, we study the phenomenon ofFixed-mobile substitution in MENA region and its implications. We reach important empirical results that help to derive useful policy implications in MENA telecom sector

Full textCurrent satellite licensing regimes fail to take into account the international character of satellite telecommunications. The reliance on a national public interest standard does not properly address the interests of the community of states, industry and consumers and is not suitable to meet the aspirations of international space law. The international harmonization of frequencies and international standardization are indispensable for the introduction of these new services. The establishment of an international communications regulator with the power to adopt binding decisions if required is the most suitable way to address these problems. However, the development of an international public interest standard with clear policy objectives will be hard to achieve.
With regard to the different aspects of ground segment licensing, a gradual approach is the best way to balance the different interests and concerns in this field. The International Telecommunications Union GMPCS MoU and the development of European regulations show a feasible way to achieve a regulatory regime that facilitates the introduction of these new services. Lighter regulations, possibly the introduction of one stop shopping procedures, mutual recognition of licenses and the introduction of general authorizations are measures that can and should be taken at the international level. The interdependence of earth and space segment licensing may lead to the understanding that some aspects of earth segment licensing should also be regulated at international level.
The question will be whether States, industry and users are able to reconcile their interests and the sometimes opposing trends of international cooperation and international competition for the benefit of "all mankind".

Full textCe projet examine l'engagement d'organismes culturels Canadiens avec les politiques de télécommunication lors de deux audiences publiques au Conseil de la Radiodiffusion et des Télécommunications Canadiennes (CRTC) en 2009. Le mémoire argumente que durant l'audience sur La Radiodiffusion Canadienne par les Nouveaux Médias ces organismes ont ajouté de nouvelles problématiques aux intérêts, historiquement centrés sur le contenu, qu'ils défendent et ont commencé à plaidoyer les politiques qui gèrent le transport des données. Lors de la seconde audience, l'Examen des Pratiques de Gestion du Trafic Internet des Fournisseurs de Services Internet, ces organismes ont adressé directement le design, l'implémentation et le fonctionnement technique des technologies de la télécommunication dans leurs commentaires et présentations au Conseil. Le mémoire propose une typologie des organismes culturels Canadiens et résume leurs antécédents en défense des politiques culturelles et des communications. En utilisant une définition de la technologie orientée par les Études des Sciences et Technologies ainsi que de la théorie de l'acteur-réseau le projet démontre que la participation de ces groupes aux forums officiels d'élaboration des politiques de gouvernance internet est complétée par d'autres modes productifs d'interaction avec les technologies d'information et de communication (TIC). À l'aide d'exemples d'intégration des TIC par ces organismes dans leur travail le mémoire fait valoir que de telles pratiques produisent et contribuent à la redéfinition de l'internet. Les organismes culturels du Canada gagneraient à adopter une définition des TIC qui reflète leur relation mutuellement constitutive et co-productive. Le mémoire conclut que les infrastructures de télécommunication doivent être comprises comme étant des acteurs matériels et des participants afin de renforcer et responsabiliser les pratiques et la défense de politiques de ces organismes.
