Full textThe concepts and rules assciated to European systems of land law have historically spread throughout South America. This import did not arrive without creating difficulties, however: just like in Europe. The new ideas implemented by the civil code backlashed, as shown by forms of resistance and obstacles to the implementation of the models represented by the codes and by the "official" doctrine. In South American these reflect a complete Iack of understanding of the alternative forms of land tenure of the traditional societies, which are now the basis of the land claims or autochthonous peoples. This thesis analyses the high Andean region which is currently part of Peru and Bolivia. Based on a comparative historical approach the study advances a critical analysis of the legal transplant of possessive individualism in the region and the local resistances to the: importation of western legal doctrines. The advent of the occidental state involved the imposition of the possessive individualism and liberalism as central values of the new institutional Latin-American order. During the republican period such process, justified by the prestige or the European experience, was supported by the proliferation of a set of laws aimed at canceling any reference to the colonial system. In its economic profile, the new ideology gravitated around the establishment or individual freedom or disposition over the most evaluated asset according the economic and philosophical predicaments of European physiocracy: the land. For this reason the process of economic consolidation leaded to establishment of an increasing rural market based on individual titles to property, and to the eradication through an exhaustive legislative production, of any obstacle to the free alienability of the land

Full textBarito Kuala, a district in South Kalimantan, Indonesia, is located along the coast of the great river Barito, with an average width of 500 m and a length of about 900 km. Its proximity to the river has rendered its terrestrial landscape rich and fertile, with large areas of idle forest wetlands. These opportune conditions led the Government of Indonesia, since 1969, to implement transmigratory policies toward the district of Barito Kuala and earmarked it for various agricultural developments. As a result, in 2014, Barito Kuala became the largest rice producer in South Kalimantan, with 53% of its land area utilized as rice fields. The remaining areas are allocated for plantations (22%), followed by reeds (13%), housing (4%), forest (2%) and others (6%), including pond and rivers. The present land allocation in Barito Kuala is in stark contrast with satellite images taken in 1973, which clearly shows that most of its area was forest covered (64%) followed by rice field (26%), plantation (4%), and others (10%, including reeds and rivers). These facts indicate that land use changes occurred very quickly in Barito Kuala, especially with regards to forest and plantation areas. These major changes in land uses have triggered major shifts in land tenure, including land use rights. This situation is further complicated by the rapid development of a new metropolitan city of Banjar Bakula, established since 2012, which includes a part of Barito Kuala in its metropolitan zone. The emergence of land markets has also affected the form and pace of urbanization, including land transformations and land structures. It is interesting to consider the case of Barito Kuala; the transformation of a wetland-rural area into a sprawling and spectacular urban zone rife with land tenure issues

Full textThe delimiting and separating effort of what would be constituted as private property, in opposition to what was state-owned, occurred from the middle of the nineteenth century, in the context of the Brazilian state\'s process of insertion into the international capitalist logic and its related productive process transformation. As a result of this process, private property and the public property were established simultaneously. In reality, the informality of the public land tenure in Brazil interfered in the occupation of the territory, and encouraged countless urban and rural land conflicts. And yet, throughout Brazilian history, the lenient treatment given to the management of the national heritage benefited an illegal and improper appropriation of large fractions of national public areas by individuals using the \"legalisation and false legalisation\" game. This management of the national heritage is characterised by total ignorance of public dominance and the difficulty of the State to regulate and truly control the access to land and natural resources. Since 2003, the management of the national heritage in Brazil has adopted a number of administrative and legal changes by revising the state ownership role as \"heritage of every Brazilian\", aiming the social function of public property and reversing the historical logic of centralisation of decisions, a perspective reduced to revenue collection and the management of the legalities of public property. After ten years, as a result of these changes, if the execution of these actions had not been blocked, it is estimated that almost 560.000 families would have benefited by land regularisation actions of urban settlements in the real estate of the Union. Regarding to the recognition of rights, despite the advances, such changes were not sufficient to promote a significant shift to the national lands management logic. That is because aspects related to political, legal and administrative cultures permeated by urbanistic issues, has prevented more changes in the fulfilment of the social function of the national land. The territory that covers the banks of the Santos Canal, where the Port of Santos is located on the coast of São Paulo State, was chosen because of its strategic location to investigate how disputes and solutions proposed by the SPU, which is based on the multiple interests of the uses of National Lands, are established. The investigation analysed the cases of Ilha de Bagres and Sítio Conceiçãozinha.

Full textIn the development of the Senegal River Valley and more precisely irrigated agriculture, pastoralist populations put forward a set of strategies to strengthen family farms. Since the 1970-1980 drought crises the situation of nomadic livestock as well as sustainability challenges in the valley continues to deteriorate, due to the reduction of rangeland. This work aims to understand the survival strategies adopted by farmers to keep their farms viable. Survey work in 41 farm managers was used to analyze the logic of agricultural diversification and land capitalization among Fulani Walwalbé. To face to the expansion of Irrigated Village Perimeters, ranchers have chosen to strengthen their practice of irrigated agriculture to vary their sources of income and have better access to postharvest lands. Farmers in rural communities of Gamadji and Guede towns located in the middle valley are very present in irrigated production systems. In addition to the rain fed cereal production, the several modes of land tenure permit them to speculate on profitable horticulture, such as vegetable crops (tomato and onion). Irrigated agriculture also provides breeders the privilege to access to post- harvest lands. Their presence in the Waalo land is also a means of ensuring their traditional land rights on these lands. Thus the practice of irrigated agriculture meets financial and property logic. While farming practice does not allow Fulani herders have access to land, irrigated agriculture appears as a strategy to move away from land capitalization. The joint practice of irrigated agriculture and livestock transhumance has encouraged the emergence of an agro-pastoral area around Podor made of: golf recession, post-crop lands, water points, transhumance pathways.... However, transhumance movements remain the central practice among Fulani herders of the middle valley and long displacement periods still possible

Full textAfter a nuclear accident like Fukushima, the radioactive cesium 137 is transported from the atmosphere to the soil by rain water. Clays are mineral species which are naturally present in soils. These micrometric minerals (1- 100 µm) are very efficient and selective adsorbents for Cs ions. The objective of this PhD thesis is to look at the feasibility of a process called flotation to selectively extract these contaminated clay particles and to reduce the volume of soil to store. Flotation consists in separating minerals according to their surface properties. The most hydrophobic particles are collected by air bubbles and are transported up to the froth whereas the hydrophilic particles remain in the suspension. Cationic surfactants are employed to selectively adsorb on clays surface and increase its hydrophobicity. It was chosen to focus on systems containing illite clay and an ammonium bromide cationic surfactant called TTAB. The properties of illite and TTAB suspensions were determined (particle size, zeta potential, adsorption isotherm of TTAB, turbidity, rheology). Then, foaming ability, stability and drainage properties of these suspensions were looked at by using a lab scale instrumented column. It was shown that clay particles have a stabilizing effect on the froth. Moreover, selectivity for the smallest clay particle size fraction (3 µm) in foams was observed. The 2nd part of the work consisted in performing flotation experiments on illite clay and TTAB suspension with a new “mini” pilot flotation column in continuous mode. The influence of TTAB concentration, air flow and illite clay concentration and granulometry on foam drainage properties and extraction yields was determined. From this study, two transport parameters were dissociated and extracted: the true flotation rate constant and the drainage coefficient. Finally, they were used to perform a scale-up study of an industrial flotation unit

Full text“Terre de liens” (TDL) is an activist organisation in France whose main objectives are to maintain farmland, provide support to the setting up of farmers and raise public awareness on land tenure issues. Thanks to savings and public donations, TDL purchases land, withdrawing it definitively from the market to lease it to farmers engaged in organic processes. Thus, it seeks to reterritorialise agriculture and recreate a collective link to land, which the State and the market had transformed into a sectoral business and private speculation object.Based on a sociological study of agricultural profession, a TDL’s ethnographic approach, enriched with a statistical survey and semi-structured interviews, this study focuses on those who farm on these collective land plots. It examines the socio-professional changes which follows TDL's support to farmers. The latter generally set up on farms with no family connection, develop small-scale organic farming and a vision of their profession combining environmental sensitivity and social responsibility. Even though their activities are in agreement with TDL's expectations, their relationship to land is not uniform nor stabilised. The various tensions TDL experiences, from covering repair work of buildings to arrangements for the representation of farmers, show the ambiguities of collective land management. They illustrate the issues an alternative organisation raises in the context of the definition of a contemporary peasant identity, where freedoms and socio-professional constraints combine in complex arrangements
