Abstract:
Demotion is the decline in the position of the labor/ worker carried out by the company caused by the violation of the rules applicable within the company (indiscipline) which involves the decrease of authority, responsibility, status, facilities, even the salary earned from the company workers. This research is motivated by the implementation of termination of employment done by the company because the worker refuse to be demoted. The demotion made by the company is not caused by errors or violations committed by the worker / labor concerned but because of the restructuring department (the reason for efficiency). This study aims to analyze how the demotion validity that occurs in the worker of the company concerned and how the settlement process of termination of employment. This research was conducted by normative law research method that is by examining primary, secondary, and other non-legal material material supported by interview result. The results of the author shows that the demotion made by the company are not legitimate and not autonomously regulated in the company so that the termination of employment made by the company is an unfounded termination. This scientific study recommends the importance of the autonomous demotion regulation for the protection of workers.

Abstract:
The different interest between employer and employee is potentially causing Industrial Dispute between them. Industrial Disputes is dominated by Termination of Employment (laid off) dispute; one of the reasons is company efficiency. Based on that matter, it needs to be studied regarding its legality, procedure, employees’ rights and the pattern of Industrial Dispute Settlement regarding laid off through company efficiency. Based on these problems, several conclusions can be drawn. Firstly, Termination of Employment must be based on a valid reason under the law. Secondly, Termination of Employment due to company’s efficiency can only be done on the condition that the company permanently closed. Thirdly, in the case of termination of employment for company efficiency, the company must pay attention to the employee’s rights in the form of compensation based on consideration of wages and the employee’s duration of work. Fourthly, the pattern of Industrial Dispute Resolution that can be adopted by the parties is bipartite, tripartite and Industrial Relation Court.

The employer’s decision on organizational change is subject of an amendment to the Labour Code, according to which this employer’s decision is a substantive precondition for the employer’s termination. The employer’s decision on organizational change is genetically linked to the termination as a basic legal act in the labour law. At this level, the employer’s decision on organizational change is of a fundamental importance for the area of termination in the labour law. The fact that the employer’s decision directly affects the validity of the termination is also related to the constitutional right to work as well as to the constitutional right to protect the employee from an unjustified dismissal. The Labour Code, at the same time, in § 63 par. 1 letter b) precisely enshrines not only the form of employer’s decision on organizational change, but also its content, and in § 9 it also establishes the persons authorised to act on behalf of the employer

The research types that being used was a Normative Research. There are various reason in an employment termination. Dispute in Employment termination is a dispute of how employment relation ends. Terminating an employment relation must be accompanied by detailed and described as stated in Constitution No. 13 year 2003 about Employment. The Provision about arrangements for employment termination set out in article 150 until 171 Constitution No. 13 Year 2003 about Employment. Issues in this case is that PT Sari Gemilang didn’t described in detailed their reason why they terminated their workers. In the decisions of the Supreme Court didn’t consider Article 57 paragraph (2), Article 59 Paragraph (4), and Article 59 Paragraph (7) also Article 151 Paragraph (3) and Article 155 Paragraph (1) Constitution No. 13 Year 2003. Judge only considered that the relation between Company and Workers are disharmony. Disharmony is a situation, not a reason for termination. Panel of judges of the supreme court didn’t see there are reason for termination or not. There is uncertainty on the termination fee and the calculation that need to be paid by the employer due to disharmony.

Abstract:
Termination of employment is a complex problem. The impact on unemployment, criminality, and employment opportunities. It takes a harmonious relationship between employers and workers because it has the same interests. The purpose of this study is to describe the termination of employment to workers that should be done by the Company and review the implementation of the Labor Law after the Decision of the Constitutional Court related to Termination of Employment This research uses secondary data, with a normative approach, namely reviewing the issue of termination of employment based on applicable law in Indonesia. The results of this study show that the implementation of termination of employment in Indonesia must be under the Labor Law. Termination of employment is carried out in several processes, namely holding deliberations between workers and the company. If it is deadlocked then the last resort is through the courts. Troubled workers commit serious violations, immediately handed over to the police without asking permission from the authorities. Workers who will retire can be filed under the regulations. Similarly, workers who resign are regulated under company regulations and legislation. Based on the decision of the Constitutional Court, employers can break the employment relationship against workers because they have committed serious violations. Severe errors must be supported with some evidence. There has been a shift in the guilty judgment of workers, especially when it comes to criminal acts that are the authority of the court.

The long-term nature of corporate legal relations necessitates the theoretical selection of certain moments of their emergence, change and termination. The update of the corporate legislation has necessitated a review of the established positions on the moment of termination of corporate legal relations, analysis and study of the legislation and resolution of problems that arise in connection with its application. The introduction of the institution of consent in corporate legal relations necessitated a scientific rethinking of certain aspects of the mechanism of termination of corporate legal relations. The article investigates the main scientific approaches to determining the moment of termination of corporate legal relations, analyzes the moment of termination of corporate legal relations depending on the grounds for their termination. Based on four main approaches to determining the moment of termination of corporate legal relations, the positions of scientists who adhere to them are studied, changes to the current corporate legislation are analyzed, inconsistencies regarding the moment of termination of corporate legal relations are revealed. The peculiarities of the moment of termination of corporate legal relations in case of alienation of a share (part of a share) in the authorized capital of the company, exclusion of a participant from the company, its withdrawal, withdrawal, recovery from the defendant (claim from his possession) to a share (part of the share) are analyzed. Peculiarities of state registration of changes in information about a legal entity in the aspect of determining the moment of termination of corporate legal relations are determined. A position has been formed regarding the application of a separate approach to determining the moment of termination of corporate legal relations on certain grounds for termination of corporate legal relations and suggested ways to resolve existing inconsistencies in corporate law regarding certain grounds for termination of corporate legal relations.

The result of this study is (1) the subject is capable of overcoming pressure with anoptimistic attitude, (2) The subject can recover the situation so that the relationship with the closest person wellestablished,(3) The subject has good desire control so that it can withstand their current conditions without affecting theemotional condition. The conclusion of this research is the subject can accept situation of pressure very calmly,think positively, and also try hard to find a solution of the problems experienced by the subject after terminationof employment.

Abstract:
The information base providing the audit evidence of going concern of a company is studied. The requirements on the quantity and quality of the audit evidence to be obtained by the audit of financial statements are determined. Particular attention is paid to the procedural provision for the assessment of the risk of company termination in the foreseeable future. In view of the current auditing practice, auditors demand the extension and adaptation of the going concern when preparing financial statements by management personnel, provisions and recommendations of the respective standard for solving problems related with the methodology for testing the validity of the abovementioned assumptions. The article’s objective is to study, systematize and implement provisions of International Standards on Auditing (ISA) and general theoretical organization and methodical approaches to obtaining audit evidence of the going concern of a company. According to ISA, the auditor’s purpose is to develop and fulfill the audit procedures in a manner allowing him to obtain the audit evidence that is sufficient and appropriate for formulating justified conclusions laying the ground for the auditor’s opinion. A literature review shows that the modern theoretical and methodological framework of audit does not offer methodological tools for the effective assessment of the economic performance of a company for purposes of defining the termination risks. A study of the issue of testing the validity of the application of the going concern when preparing financial statements shows that the auditors are required to be competent in indicative economic parameters and items of financial statements, reflecting, first and foremost, the economic capabilities and economic performance of a company. The study of the application of the procedural provision recommended by ISA for identification and assessment of indicative performance parameters of a company is used to develop a combination of audit procedures and methods for evaluating the results of their implementation, which allows for the reliable assessment of the risk of the company’s termination in the foreseeable future.

Genuinly, the mandate of Manpower Law stipulates that the employment termintaion will cause complicated problem in the future, particularly on a large scale implementation. Menurunnya pendapatan perusahaan, dipicu dari menurunnya produksi dan melemahnya daya beli masyarakat, menjadi alasan kuat PHK dilakukan. Ditetapkannya Pandemi Covid-19 sebagai Bencana Nonalam melalui Keputusan Presiden No. 12 Tahun 2020. Justru makin memperkuat dalil perusahaan atau pemberi kerja untuk melakukan PHK. Sejatinya amanat dari Undang-undang Ketenagakerjaan bahwa PHK merupakan langkah paling akhir setelah ditempuhnya upaya-upaya lain. Pertimbangan dari hal ini bahwa PHK akan menimbulkan permasalan pelik kemudian hari, terlebih jika dilakukan skala besar. The liquidation is a topic which is not properly defined by the Czech legislation. There is no dedicated law, which would bring a complex description of the liquidation. The actual law regulation does not address the whole complexity and brings many questions. Therefore this thesis is concerned with problems of the liquidation in accordance with the Czech legislation. The aim of the thesis is to provide sufficient information which would give a comprehensive picture of the liquidation. The introductory part of the thesis focuses on a general description, definitions and law regulation of the liquidation. The main part of the thesis describes the process of liquidation involving the beginning, course, distribution of the liquidation balance, and its termination. The thesis is supplemented by several examples of documents utilized during the liquidation and tables presenting liquidation statistics in past years.

En droit colombien, face à une inexécution contractuelle, règne la règle, issue du droit français, de la résolution judiciaire. Ses conditions d’exercice ont été précisées par la doctrine et la jurisprudence, non sans de nombreuses ambiguïtés qui résultent de la difficulté de comprendre et de mettre en pratique ce procédé. Face à cette vision traditionnelle, l’unilatéralisme a fait irruption dans le monde contractuel contemporain et, plus concrètement, la possibilité de mettre fin à un contrat de manière unilatérale en cas d’inexécution. Cette tendance, qui trouve ses origines dans le droit anglo-saxon avant d’avoir pénétré le droit des pays de tradition romano-germanique, prétend revitaliser cette phase critique du contrat en évitant le recours au juge, au moins dans un premier moment, permettant que le créancier remédie à l’inexécution en mettant rapidement fin au contrat afin de rechercher sur le marché des solutions efficaces. Cette règle pourrait-elle être retenue en droit colombien ? En dépit de l’apparent monopole qu’y détient la résolution judiciaire, tant le Code civil que le Code de commerce colombiens, prévoient des hypothèses qui reconnaissent cette possibilité. Par ailleurs, plus récemment, a été acceptée la possibilité de convenir de clauses résolutoires. Ainsi, nous considérons qu’il est possible d’accepter la généralisation d’une règle de rupture unilatérale pour inexécution. À cet égard, l’étude du droit comparé s’agissant de l’inexécution ouvrant la voie à une rupture du contrat, d’une part, et de la manière dont elle s’exerce une rupture en cas d’inexécution, d’autre part, est d’un grand intérêt. Une telle analyse nourrit une proposition qui non seulement fournit des éléments en vue de l’admission de la rupture unilatérale du contrat pour inexécution en droit colombien, mais aussi cherche à éclairer la lecture qui a, jusqu’à présent, prévalu en matière d’inexécution résolutoire
Under the Colombian law, the general rule in case of breach of contract is that of termination as a consequence of a court order. Its conditions of exercise have been the object of development by the doctrine and case law, not without several issues that make difficult to understand and put into practice such category. In contrast with this traditional vision, unilateralism breaks in the contemporary contractual world and more specifically, the possibility of termination of contract in such a unilateral way in case of a breach. This trend has its roots in Common law and has been permeating the countries of Roman-Germanic law tradition; and it aims to grant vitality to that critical contractual phase, thus avoiding the intervention of the judge, at least as a first measure, allowing the creditor to remedy the consequences of the breach of contract by an early termination in order to seek effective solutions in the marketplace. Could this rule have a place in Colombian law? Despite the seemingly apparent monopoly of judicial termination of contract, both the civil code and the code of commerce acknowledge this as a possibility. Similarly, more recently the possibility of including termination clauses has been accepted. However, we hold that it is possible to accept a generalization of the rule of unilateral termination of contract in case of breach. A study of comparative law regarding the breach that results in contract termination and the analysis on the way this prerogative should be exercised are of great importance; it does not only enriches a proposal providing the parameters for the unilateral termination of a contract when a breach arises in Colombian Law, but also clarifies the understanding that until now exists in the matter of termination for non-performance

Cette imprécision conduit, dans certains cas, à l’exercice quasi arbitraire par l’administration de ses pouvoirs et au déséquilibre du contrat. Cette situation a entraîné divers préjudices pour les bénéficiaires de projet en raison de la suspension de la mise en œuvre de plusieurs contrats importants pour une longue période et, en conséquence, a accru le nombre des litiges

Abstract:
An important property of term rewriting systems is termination: the guarantee that every rewrite sequence is finite. This thesis is concerned with orderings used for proving termination, in particular the Knuth-Bendix and polynomial orderings. First, two methods for generating termination orderings are enhanced. The Knuth-Bendix ordering algorithm incrementally generates numeric and symbolic constraints that are sufficient for the termination of the rewrite system being constructed. The KB ordering algorithm requires an efficient linear constraint solver that detects the nature of degeneracy in the solution space, and for this a revised method of complete description is presented that eliminates the space redundancy that crippled previous implementations. Polynomial orderings are more powerful than Knuth-Bendix orderings, but are usually much harder to generate. Rewrite systems consisting of only a handful of rules can overwhelm existing search techniques due to the combinatorial complexity. A genetic algorithm is applied with some success. Second, a subset of the family of polynomial orderings is analysed. The polynomial orderings on terms in two unary function symbols are fully resolved into simpler orderings. Thus it is shown that most of the complexity of polynomial orderings is redundant. The order type (logical invariant), either r or A (numeric invariant), and precedence is calculated for each polynomial ordering. The invariants correspond in a natural way to the parameters of the orderings, and so the tabulated results can be used to convert easily between polynomial orderings and more tangible orderings. The orderings of order type are two of the recursive path orderings. All of the other polynomial orderings are of order type w or w2 and each can be expressed as a lexicographic combination of r (weight), A (matrix), and lexicographic (dictionary) orderings. The thesis concludes by showing how the analysis extends to arbitrary monadic terms, and discussing possible developments for the future.

Alfalfa irrigation is often withheld as a water conservation measure in Arizona. The objective of this research was to test the hypothesis that alfalfa yield and stand can be permanently damaged by withholding irrigation water. Irrigation was terminated during the summer (July through October) or winter (November through February) on a Superstition sand in Yuma. Summer irrigation termination reduced plant density from 4 to 1.5 plants per square foot and reduced hay yield from 0.76 to 0.27 tons per acre per cutting after irrigation was resumed. Winter irrigation termination had no residual effect on yield or plant density. Termination of alfalfa irrigation can permanently damage stands and reduce yield on sandy soil.

Irrigation termination at Maricopa was not detrimental to stand although hay yields were depressed from 1.47 to 1.28 tons per acre following the second cycle of summer irrigation termination and from 1.57 to 1.23 tons per acre per cutting following summer through winter irrigation termination. Alfalfa water use was reduced by irrigation termination even after irrigation was resumed. Total nonstructural carbohydrates in the roots were never less than the control during irrigation termination but decreased relative to normally irrigated alfalfa when irrigation resumed.

AbstractSentential Calculus with Identity ($$\mathsf {SCI}$$ SCI ) is an extension of classical propositional logic, featuring a new connective of identity between formulas. In $$\mathsf {SCI}$$ SCI two formulas are said to be identical if they share the same denotation. In the semantics of the logic, truth values are distinguished from denotations, hence the identity connective is strictly stronger than classical equivalence. In this paper we present a sound, complete, and terminating algorithm deciding the satisfiability of $$\mathsf {SCI}$$ SCI -formulas, based on labelled tableaux. To the best of our knowledge, it is the first implemented decision procedure for $$\mathsf {SCI}$$ SCI which runs in NP, i.e., is complexity-optimal. The obtained complexity bound is a result of dividing derivation rules in the algorithm into two sets: decomposition and equality rules, whose interplay yields derivation trees with branches of polynomial length with respect to the size of the investigated formula. We describe an implementation of the procedure and compare its performance with implementations of other calculi for $$\mathsf {SCI}$$ SCI (for which, however, the termination results were not established). We show possible refinements of our algorithm and discuss the possibility of extending it to other non-Fregean logics.

The US Nuclear Regulatory Commission (NRC) established criteria for acceptable residual radioactivity related to decommissioning nuclear power plants in the US [1]. A level of 25 mRem per year to the maximum exposed individual by site-specific pathways analysis, with ALARA is acceptable to the NRC. Systems and structures containing very low levels of radioactivity that meet this criteria are deemed acceptable to abandon in place as part of the decommissioning process and termination of the license. Upon license termination by the NRC, the owner may then demolish and remove remaining structures. In practice, site-specific criteria imposed by local state mandates, company management decisions, real estate value, and long-term liability potential have driven nuclear plant licensees to adopt an alternative disposition for these materials. Although the reasons are different at each site, the NRC’s criteria of 25 mRem per year are not the controlling factor. This paper will describe the regulatory process for termination of the license, and the other factors that drive the decision to remove radioactive and non-radioactive material for decommissioning. Several case histories are presented to illustrate that the NRC’s criteria for license termination are not the only consideration.

The report raises the problem of the exclusion of a partner as a penalty consequence for culpable neglect of the obligations arising out of the membership. It supports the thesis that exclusion is a subjective right of the company. Exclusion is defined as having a dynamic actual structure, and three major elements thereof have been examined: grounds for exclusion, procedure, and legal consequences of the termination of membership. It has been inferred that the principle for validity of exclusion is a legal guarantee for the freedom of the individual in the relationship between personality and society.

Matching a prosthetic foot to meet the activity requirements of the user can be a difficult process. The ideal stiffness characteristics of different functional activities may vary. This variation dictates that the prescribed foot must be a compromise of multiple ideals due to functional necessity. The effects of lower limb stiffness have been studied in regards to their ability to reproduce “normal” lower limb mechanics [1,2]. Other studies have tracked gait stability and performance measures for lower limb amputees during gait initiation and termination [3–5].
