Full textThe Italian legal language is almosty completely disregardes by Italian linguistis, despite the fact that for centuries it has been the subject of much criticism. This thesis offers an essentially linguistic and stylistic analysis based on a corpus of texts drawn up by the legislative body, judges and members of the legal profession. In this way, it aims to present the specific aspects of each category of text - legislative texts, jurisdictional texts and contracts - in their situation. A part of the corpus is provided in the annex, thereby giving the reader a "global" view of the documents. The analysis thus takes into account both the prose and the communication situation for each category of text, illustrating the reasons behind the linguistic and stylistic choice made by jurists when drafting legal documents. Comparison with other specialized languages enables one to affirme the language of the law has distinctive features that set it clearly apart from other jargons. This research shows that legal messages are always directed at several levels of readership. Concern for the citizens and their right to understand the message being addressed to them is not a priority for legal writers. The saying "ignorance of the law is no excuse" appears to be neglected. It is the law and its needs that prevail above all. However, this "juridical" manner of perceiving reality is bound to dye out : the right of citizens to understand the law as well as the increasingly simplification, as is borne out by the recent reforms being carried out in Italy

Full textThe aim of this thesis is to define the distinctive features of legal English as they appear in the law reports of the House of Lords and the Privy Council. Legal English bears the mark of the latin, saxon and norman influences which have moulded it and to which it owes the archaic tone with which it is commonly associated. Moreover, by using a lofty style and an elaborate syntactic structure, the English judge aims at emphasizing the dignity of the judiciary as well as the logical nature of a type of reasoning which is supposed to be objective. The law reports would hardly be different from other types of legal documents such as statutes, were it not for the presence of a metaphorical and even familiar language which enlivens the discourse and turns it into a communicative act. Therefore, legal English is brought within the reach of the common man in whose name justice is administered. At a time when the selection of English judges and their methods of reasoning are increasingly questioned by linguists as well as lawyers, it may be appropriate to define the identity of the addressees for whom this type of message is meant and to clarify the role of the judge within an institution which is part of the culture of a whole nation

Full textOur thesis concerns studies of the stylistic use of the French legal vocabulary in Georges Simenon’s prose. In fact, legal terminology, concepts of law and crime, discursive behavior of lawyers, texts of laws, problems of legal translation, those of linguistic interference, those of pragmatic, structural and semantic peculiarities of the language of international agreements, for instance, were examined by different linguists. So, contemporary linguistics are interested in studying legal terminology from different points of view. On the other hand, during the last decades, linguostylistic studies are also developing very quickly. In our thesis, legal terminology is studied from the point of view of stylistics, and this approach constitutes its’ theoretical and practical novelty. In the first chapter we examine some terms belonging exclusively to legal terminology, in accordance with Gerard Cornu’s classification, and we show that in reality approximately one sixth part of them can acquire, at least potentially, some figural meanings. In the second chapter, we study 53 legal terms used by Georges Simenon in their figural meaning to describe different situations from everyday life which, in the most of cases, are not associated with legal situations. In the third chapter we analyze, from the opposite point of view, stylistic figures used to characterize different legal situations presented in Georges Simenon’s prose. To summarize, even if these figures are relatively small in number, our thesis shows that the writer, in spite of his artistic intention, was not able to eliminate them completely and that they remain one of the most important elements of the poetical language

Full textThe purpose of this research is the comparative study of Russian and French legal terminology which tries to give a more precise definition of the types of legal discourse in both languages. This study will attempt to determine the structural and semantic specificities of the terms and collocations in both languages, the specific aspects of their functioning in different genres of discourse and the specific requirements for their translation connected to these two factors. We are dealing with the following genres of the legal discourse: normative discourse, jurisdictional discourse, doctrinal discourse and discourse of treaties. The existence of the latter as a self-standing genre constitutes the hypothesis of this thesis. The typologies of French and Russian discourse genres have similar features because of their pragmatic and communicational characteristics imposed by the law system. The differences between the typologies are due to socio-cultural and linguistic factors. The rest of the work addresses the following issues: legal term and concept in discourse, process of simplification of the formal structure of the legal term in discourse, and more specifically legal abbreviations, antonymic and synonymic relations in legal discourse and in legal collocations. This research aims at improving legal language teaching and professional practice of French-Russian legal translation
