Full textThe Italian legal language is almosty completely disregardes by Italian linguistis, despite the fact that for centuries it has been the subject of much criticism. This thesis offers an essentially linguistic and stylistic analysis based on a corpus of texts drawn up by the legislative body, judges and members of the legal profession. In this way, it aims to present the specific aspects of each category of text - legislative texts, jurisdictional texts and contracts - in their situation. A part of the corpus is provided in the annex, thereby giving the reader a "global" view of the documents. The analysis thus takes into account both the prose and the communication situation for each category of text, illustrating the reasons behind the linguistic and stylistic choice made by jurists when drafting legal documents. Comparison with other specialized languages enables one to affirme the language of the law has distinctive features that set it clearly apart from other jargons. This research shows that legal messages are always directed at several levels of readership. Concern for the citizens and their right to understand the message being addressed to them is not a priority for legal writers. The saying "ignorance of the law is no excuse" appears to be neglected. It is the law and its needs that prevail above all. However, this "juridical" manner of perceiving reality is bound to dye out : the right of citizens to understand the law as well as the increasingly simplification, as is borne out by the recent reforms being carried out in Italy

Full textThe aim of this thesis is to define the distinctive features of legal English as they appear in the law reports of the House of Lords and the Privy Council. Legal English bears the mark of the latin, saxon and norman influences which have moulded it and to which it owes the archaic tone with which it is commonly associated. Moreover, by using a lofty style and an elaborate syntactic structure, the English judge aims at emphasizing the dignity of the judiciary as well as the logical nature of a type of reasoning which is supposed to be objective. The law reports would hardly be different from other types of legal documents such as statutes, were it not for the presence of a metaphorical and even familiar language which enlivens the discourse and turns it into a communicative act. Therefore, legal English is brought within the reach of the common man in whose name justice is administered. At a time when the selection of English judges and their methods of reasoning are increasingly questioned by linguists as well as lawyers, it may be appropriate to define the identity of the addressees for whom this type of message is meant and to clarify the role of the judge within an institution which is part of the culture of a whole nation

Full textOur thesis concerns studies of the stylistic use of the French legal vocabulary in Georges Simenon’s prose. In fact, legal terminology, concepts of law and crime, discursive behavior of lawyers, texts of laws, problems of legal translation, those of linguistic interference, those of pragmatic, structural and semantic peculiarities of the language of international agreements, for instance, were examined by different linguists. So, contemporary linguistics are interested in studying legal terminology from different points of view. On the other hand, during the last decades, linguostylistic studies are also developing very quickly. In our thesis, legal terminology is studied from the point of view of stylistics, and this approach constitutes its’ theoretical and practical novelty. In the first chapter we examine some terms belonging exclusively to legal terminology, in accordance with Gerard Cornu’s classification, and we show that in reality approximately one sixth part of them can acquire, at least potentially, some figural meanings. In the second chapter, we study 53 legal terms used by Georges Simenon in their figural meaning to describe different situations from everyday life which, in the most of cases, are not associated with legal situations. In the third chapter we analyze, from the opposite point of view, stylistic figures used to characterize different legal situations presented in Georges Simenon’s prose. To summarize, even if these figures are relatively small in number, our thesis shows that the writer, in spite of his artistic intention, was not able to eliminate them completely and that they remain one of the most important elements of the poetical language

Full textThe purpose of this research is the comparative study of Russian and French legal terminology which tries to give a more precise definition of the types of legal discourse in both languages. This study will attempt to determine the structural and semantic specificities of the terms and collocations in both languages, the specific aspects of their functioning in different genres of discourse and the specific requirements for their translation connected to these two factors. We are dealing with the following genres of the legal discourse: normative discourse, jurisdictional discourse, doctrinal discourse and discourse of treaties. The existence of the latter as a self-standing genre constitutes the hypothesis of this thesis. The typologies of French and Russian discourse genres have similar features because of their pragmatic and communicational characteristics imposed by the law system. The differences between the typologies are due to socio-cultural and linguistic factors. The rest of the work addresses the following issues: legal term and concept in discourse, process of simplification of the formal structure of the legal term in discourse, and more specifically legal abbreviations, antonymic and synonymic relations in legal discourse and in legal collocations. This research aims at improving legal language teaching and professional practice of French-Russian legal translation

Full textOur dissertation is a comparative study investigating the main aspects of legal terminology in French and Romanian. In this context, the analysis aims at elaborating a bilingual, French - Romanian, Romanian - French, terminological dictionary of international commercial contracts. With this study we intend to improve the knowledge of legal terminology in Romanian. Romania has been faced lately, particularly since January 1st 2007, when it joined the European Union, with a real need for terminological studies, for dictionaries and data bases in all fields relating to translation and interpreting. The dissertation is structured in three parts marking a progression: •the theoretical framework - illustrating the need to define and delimit our field of study •the methodological framework - justifying the need for an ontology, for a classification of concepts that would enable the clarification of the nature and usage of the terms and their definition in our dictionary •the sphere of applications - illustrating our work by the elaboration of a bilingual, French - Romanian, Romanian - French, terminological dictionary of international commercial contracts, able to meet the needs of specialists working in the field of international trade, law professionals and translators working in these areas

Full textLegal dictionaries are notoriously misleading and a source of confusion for translators. This study aims at improving the quality of those lexicographic products in the context of translation in the European Union. The criticism of existing resources is accompanied by the proposal of a new lexicographical model. An English-Irish dictionary of environmental law in the EU is produced for the target users using a corpus of the key jurisprudence and doctrine. Once created, the corpus was exploited using the tools offered by Sketch Engine. The difficulties posed by the terminology of a minority language and that of a relatively recent legal domain are analyzed. Divergences between terminology used at national level and that used at EU level are also discussed

Full textThe PhD is the result of a research carried out in the sciences of language: lexicology, lexical semantics and discourse analysis. It is based on the primary sources of European Union law, the doctrinal sources of the Church's Social Doctrine and the corpus of German legal doctrinal texts, as well as a rereading of philosophical sources: Aristotelianism, Thomism, Kantism and romanticism.It is generally argued by European legal doctrine (in France, MILLON-DELSOL, 1991, CONSTANTINESCO, 1991) that the principle of subsidiarity, a rule of positive European law (Maastricht Treaty - 1993) defined in Article 3B), would initially have been theorized by the Social Doctrine of the Church in the 20th century (Pius XI, Quadragesimo Anno, 1931). The "directive" rule (CORNU, Legal Vocabulary, 2015), however, would have been relieved of its problematic philosophical and theological position in order to resemble a procedural rule. On the linguistic level, the French form subsidiarity would be a francized loan of the German neologism Subsidiarität.The PhD focuses on the inconsistencies of the linguistic hypotheses related to the connection of this notion and its linguistic form (subsidiarity, substantivation of the adjective subsidiary (relief, reinforcement of an element lower than a superior thing, initially in a Latin military context), as well as its attachment to philosophical and theological sources, in particular Thomists and personalists.A search for the Latin etymon and the German occurrence (Subsidiarität) tends to show that the subsidiarity form originally designates the Roman law (subsidiäres Recht), a regular occurrence of German legal doctrine throughout the 19th century. The PhD therefore presents the results of a retrieval and collection of a corpus of occurrences of subsidäre (Recht/Staat, Subsidiarität, Subsidiarität der Staat, Subsidiär-Prinzip, Subsidiaritätsprinzip, Grundsatz der Subsidiarität, Prinzip der Subsidiarität) in the works of the German legal science, especially among the members of the Historical School of Law (FK VON SAVIGNY) and the first formalists (Paul LABAND, Georg JELLINEK) and German thinkers of the Rule of Law VON MOHL, Julius VON STAHL).The work discusses this occurrence as a discursive formula, that is to say a German political slogan, which is diffused in the legal science and in the works of the historical school of economics, throughout the 19th century. Initially, it is a historicist slogan, advanced by Savigny in the Quarrel of the codification which crosses the German states of the Old Germanic Roman Empire, starting from the Congress of Vienna (1814). The occurrence (adjectival and adverbial) is subsequently disseminated and becomes a motive of the social law state (especially from R. VON MOHL, 1829), becomes substantive, becomes a legal principle (relations legal orders Regional and federal), then penetrates the economic terminology (Subsidiary State, subsidiary duty of the State in assisting the poor). His motive conditioned the vote of the first laws called "social" under Otto von Bismarck.The PhD attempts to demonstrate that the pontifical occurrence of 1931 is a late borrowing from these different theoretical and doctrinal sources and not a Catholic neologism

Full textOur thesis investigates the main aspects related to the language for special purposes, especially in legal terminology teaching. In this context, the analysis aims at elaborating of a Pedagogical Dictionary of Human Rights Terminology [DTADH]. The teaching of foreign languages is facing a real need for terminological studies.With this study we intend to improve the methods of term extraction through the computational linguistic approach. The thesis is structured in three parts marking a progression: The first chapter presents the theoretical issues about the optimization of the terminology teaching, the language for specific purposes and the making of dictionaries in the pedagogical lexicography perspective. Chapter two starts by describing the problem of the complex term, outline its main characteristics and looks at the problem of its definition. In chapter tree we propose quantitative and qualitative methods of terminology extraction and describe the field of the Human Rights. The thesis concludes with chapter four, where we describe the structure of the Pedagogical Dictionary of Human Rights Terminology as a suitable material, capable of solving the problem of professional communication

Full textGeneral outline of the thesis: The forms of the unchanging nature of the French and Russian terminology. A comparative study.This research aims at describing the setting up of specialized collocations with a contrastive perspective t, within the French and Russian specialized legal language.The aim of this research deals with the modelling of the syntagmatic links regarding the terms of the specialized legal language. We have drawn our inspiration from the ideas of the semantics of the framework, in particular, of the Filmorian frame that structures our study. The analysis unit is a collocation of the specialized legal language, which is called specialized lexical combination.The onomasiological approach sets the problem of the study of the conceptual systems concerning the SLC. The semasiological approach deals with the modelling of the SLC at language level. Thus, the two suggested approaches, the onomasiological and the semasiological ones, both answer the needs of the setting up of the two fields: the notional as well as the semantic ones that, in turn, lay the foundation of the interlinguistic typology. We use a comparative approach to be able to find some kind of parallelism within the process of creation and stabilisation of the two specialized languages: French and Russian. While making a comparison between the two specialized languages, we can analyse the difference of linguistic creativity in order to be able to infer the common principles that govern the formation of the SLC. The method of translation, even if it points out the properties outside the system of the concrete specialized language, either French or Russian, does answer the needs of the lexico-semantic modelling of their perspective means of combination.Key words : jurdical terminology, frame, collocation, specialized lexical combination, onomasiological approach, semasiological approach, conceptual systems, comparative approach, translation

Full textThe present doctoral dissertation entitled “Modern English Legal Terminology: linguistic and cognitive aspects” investigates the contemporary legal idiom, from a cognitive linguistics perspective. The aim of this study is to map out the peculiarities of English legal terminology and develop principles of systematization, within the framework of conceptual metaphor theory. This means 1) determining the basic concepts used metaphorically in English legal language, and 2) establishing the main cross-domain mappings and correlations between separate items within concrete domains.The Corpus of Legal English (COLE) was set up and a quantitative analysis performed, in which metaphorical expressions related to legal terminology were searched for and classified on the basis of meanings, conceptual domains and mappings. Thus, the conceptual metaphors of WAR, MEDICINE, SPORT and CONSTRUCTION were found to be the most numerous and valuable in Legal English. The main cross-domain mappings between these source domains and the target domain of LAW were established.In order to carry out this data-driven study, 156 legal texts were selected and compiled into the Corpus of Legal English (COLE). The source-texts represent various thematic categories. The COLE was systematically used to interpret frequency counts from the point of view of conceptual metaphor theory
Дисертаційне дослідження на тему «Сучасна англійська юридична термінологія: лінгвокогнитивний аспект» досліджує сучасну мову права з точки зору когнітивної лінгвістики. Головною метою дослідження було дослідження особливостей англійської юридичної термінології та принципів її систематизації з точки зору когнітивної теорії і власне теорії концептуальної метафори. В ході написання роботи були поставлені наступні цілі: 1) визначити головні концепти які використовуються у якості метафор в англійській мові права; 2) встановити головні концептуальні зв’язки між окремими елементами доменів.З метою вирішення цих питань і задач був проведений кількісний аналіз корпусу юридичної англійської мови. В ході цього аналізу біли виділені та класифіковані метафоричні вирази які пов’язані з юридичною термінологією згідно їх метафоричного значення. В результаті аналізу було виявлено що концептуальні метафори WAR, MEDICINE, SPORT та CONSTRUCTION займають домінуюче положення в мові права. Також були встановлені основні концептуальні зв’язки між сферою-джерелом та сферою-ціллю.В даному дослідженні було використано спеціально створений корпус, який включає в себе 156 правових текстів різноманітної сюжетної направленості, для проведення кількісного аналізу з точки зору концептуальної метафори

Full textAssessing the extreme profusion of legal and journalistic texts dealing with human rights in Arabic, the aim of this thesis is to retrace the history of those texts‟ translation and to highlight on the most important phasis of its evolution, at terminological, phraseological and ideological levels. This research has made us go back to nineteenth century Arab modernist intellectuals‟ productions. We recalled in Chapter 1 to the both historical and discursive contexts in which the concept of human rights was born. Then, we have presented a detailed description of the translations of three representative texts: the translations of the 1814 French Constitutional Charter by Rifâ„a Râfi „ al-Tahtâwî (1801-1873), of the 1789 Declaration of the Rights of Human being and the Citizen (DDHC) by Farah Antûn (1874-1922) and of the 1948 Universal Declaration of Human Rights (UDHR) by the United Nations translation services. Chapter 2 demonstrates that the translated texts always denote elements of contradiction or at least some contention between, on the one hand, the ideological motives at the heart of the drafting of the original texts and, on the other hand, the intellectual purposes of the translators. And in such context, Chapter 3 sticks to this point focusing this time on three translations of texts related to the same field but belonging to different genres: a political speech ("A new beginning", Barack Obama), a feature article (Human Rights Watch) and an extract from a survey(Amnesty International). We have highlighted the very complexity inherent to the status of translators of texts dealing with human rights. They, on the one hand, have to be conversant with linguistics, terminological and notional knowledge and, on the other hand, have to keep to traductive strategies (lexical and phraseological choices) in order not to misrepresent the designs of the source text (political, activist, informative ...)
