Grundtvig som fortolker af Det Gamle Testamente[Grundtvig 's reception of the Old Testament]By Jesper HøgenhavenThis article analyses aspects of Grundtvig’s reception of the Old Testament. In his historical works from 1812, 1814, and 1833, Grundtvig makes a number of important remarks on the role and significance of the Old Testament. His position has sometimes been characterised as “fundamentalist”, but as is shown in a discussion with recent contributions (Ole Vind, Kim Ame Pedersen), this is hardly a precise description. While Grundtvig repeatedly defends the Old Testament texts as historically reliable - and as authentic prophecies related to the coming of Christ - and makes polemic remarks against historical criticism, he nevertheless demonstrates a critical position regarding the canonical status of Old Testament books, and in his later works, he explicitly renounces the doctrine of verbal inspiration and directs polemical remarks at both rationalists and orthodox adherents of verbal inspiration. The Jewish scriptures are not the foundation upon which the church is built, as the orthodox theologians would have it. This does not mean that the Old Testament loses its importance for Grundtvig. His work amply demonstrates the centrality of biblical texts and motifs. In his sermons he makes extensive use of Old Testament quotations, interpreting them according to the classic patterns as prophecies directly relevant for the church, or as typological models for Christians. What is interesting, however, is that whereas explicit quotations are found less frequently in Grundtvig’s later sermons, his sermons are permeated with biblical motifs and imagery from the Old Testament. In his hymns, he achieves the creation of a universe which is biblical in a comprehensive sense.

Denne udgave (.textus receptus.) forblev i 300 år grundlaget for de fleste udgaver af Ny Testamente på gr.sk. Men allerede i 1514 havde den spanske kardinal Ximénes de Cisneros i Alkala (lat. Complutum) i samarbejde med et team af skriftlærde (Complutenser) på grundlag af ældre håndskrifter end dem, Erasmus havde til sin rådighed, udarbejdet en udgave, der - sammen med en tilsvarende udgave af det Gamle Testamente, den skaldet »Polyglotte« - måttet vente så længe som til 1520 på at få Vatikanets tilladelse til trykning.Det er denne sidstnævnte udgave - .Alkala-Texten. - Grundtvig på Det kgl. Bibliotek i København har studeret og fundet langt bedre og pålideligere end den, der stadig var grundlaget for de udgaver, de teologiske studenter læste under deres studium af de bibelske tekster i originalsproget. De hvilede på textus receptus. Den havde nemlig været grundlaget for Martin Luthers tyske oversættelse af det Ny Testamente, det såkaldte »September-Testamente«. Fra Grundtvig argumenterer derfor udførligt i en artikel i Nordisk Kirke-Tidende for aaret 1937, udgivet af Jacob Christian Lindberg, for, at de nordiske præster bør studere »Alkala-Texten«. ved siden af den, de kendte fra deres teologiske studium. Han vidste dengang ikke, at den klassiske filolog K Lachmann allerede i 1831 havde udgivet det Ny Testamente på græsk i en udgave, der lagde hovedvægten på de ældste og pålideligste håndskrifter. Denne udgave fik stor betydning for de senere udgaver.Grundtvigs artikel vender sig først og fremmest mod de tyske bibelkritikere, især teologen J.J. Griesbach, hvis kritik ikke lagde vægten på de ældste og pålideligste håndskrifter, men på en teologisk begrundet kritik af den almindeligt brugte tekst (textus receptus). Dette princip forkaster Grundtvig, fordi hovedsagen i studiet af det Ny Testamente m. v.re at komme den originale tekst i grundsproget så når som muligt. Han nærmer sig derved den nuværende kritik af den ældre bibelkritik. Grundtvigs ønske er dels en lommeudgave af Ny Testamente pi grundlag af Alkala-teksten, dels en udførlig videnskabelig tekst på samme grundlag.Artiklen - såvel Eisenbergs som Grundtvigs - præciserer dermed tillige den kristne religion, »Dåbspagten«, og den videnskabelige oplysning af denne religion, teologien, i Grundtvigs sprog »Kirke-Skolen«.

The article presents a Danish translation of the oldest extant manuscript of the Syriac Testament of Adam. This manuscript comprises the two first sections (the Horarium and Prophecy) of the total of three sections usually described as making up this composite text. In addition to giving an introduction and translation, the article discusses key issues of the text’s language and theology and aspects of its interpretation of the Garden of Eden story, such as the nature of the forbidden fruit, the future fate of Adam and its Christological implications.

Abstract:
This paper studies the Old Testament’s conception of forgiveness, which is characterized by its one-sidedness. According to the almost unambiguous testimony of the OT literature, only God can forgive. However, it is important to see God’s unreserved forgiveness against the background of his resentment at the apostasy and sin of man. At the same time the OT also weights God’s punishment and grace in favour of his grace. The paper also discusses the few OT examples of human forgiveness, noting them as remarkable exceptions which confirm the main thesis of the one-dimensional aspect of forgiveness.This aspect is due to the fact that the OT does not know the incarnationof God. It is not until the New Testament that there is a necessary connection between God’s forgiveness and the willingness of man to forgive his neighbour.

Abstract:
Literary texts are paths or tracks into cultural memory, not direct access to unmediated memory. Cultural memory studies are about how the past is mediated, how memory is produced and circulated. It is not about history “as such”. The Old Testament was created in periods of globalization. The writing is a piece of memory work meant for creation of national or local identity, and particularity in a global world. Memory as counter-activity is always present, focusing on the local, small tradition, the particular narrative, and creating its own way of coherence. Memories are not ready-prepared refl ections of the past. They are both eclectic and selective reconstructions. Remembering and forgetting the past refl ects the needs in the present. It is an active and ongoing, not predetermined process. Memory studies do not represent a coherent field, but are coming from different disciplines and discursive areas. It is an analytic instrument and a heuristic tool focusing the socio-cultural context.

XVII amžiaus Vilniaus pilininko jurisdikos teismo knygose įrašyti dvidešimties asmenų – šešių moterų ir keturiolikos vyrų – testamentai. Tokie šaltiniai papildo mūsų žinias apie šią menkai ištirtą bendruomenę, ypač jos religinius ypatumus, materialinę padėtį ir socialinius ryšius. Iš visų testatorių dvylika asmenų priklausė Romos katalikų, penki – evangelikų liuteronų bendruomenei. Ypač pažymėtini sutuoktinių liuteronų Melerių, Annos ir Hanuso, testamentai, kuriais tam tikros sumos paliktos katalikų špitolėms. Tarpkonfesiniai santykiai taip pat atsispindi pasirenkant liudytojus – Melerienės testamente išreikštos paskutinės valios liudininkai buvo liuteronų, Romos katalikų ir kalvinų bažnyčių atstovai. Tarp testatorių yra tiek pasiturinčių, net tarnų turinčių asmenų, tiek neturtingų, bet ne visiškų skurdžių. Tačiau net ir tie, kurių padėtis nebuvo ypač sunki, nepriklausė turtuolių luomui. Vilniaus pilininko jurisdikos gyventojų testamentai aiškiai rodo, kokie sudėtingi ryšiai siejo šios nedidelės, tačiau įvairialypės (profesiniu, materialiniu, tikėjimo ir kitais atžvilgiais) bendruomenės atstovus.

And 3) How is the application of pacta sunt servanda principle to testament made before Notary in the perspective of justice ?.The results of this research are 1) The application of pacta sunt servanda principle on testaments made before the present notary can be described that the implementation of pacta sunt servanda principle is required at all stages, either before, during or after the process of making the testament deed. 2) Any legal effect that arises when a testament made before a notary public does not apply the principle of pacta sunt servanda in the perspective of justice is that the testament is essentially a statement made unilaterally by the testamenter set forth in a deed that must be executed by the will . 3) The application of the principle of pacta sunt servanda to the testament made before the Notary in the perspective of justice is that in the making of this testament it must be adhered to two principles namely, firstly, giving equal rights and opportunities to the widest freedom of the broadest extent of equal freedom for each person. Selected aspects of testate succession in the light of the case-law of courts in the Lviv judicial district in the inter-war periodThe author of the article presents selected issues of testate succession soundness of mind of the testator, formal requirements of a will and its witnesses, joint and privileged wills, revocation of a will and its invalidation provided for in the Austrian Civil Code ABGB and in force in the part of Poland annexed by Austria. The author’s analysis of the provisions applicable to the issues in question is further enhanced by references to the case-law of courts forming the Lviv judicial district, illustrating the complexity of the provisions. The case-law testifies to how big a role was played by testate succession in the part of Poland annexed by Austria. On the other hand, it shows how many people did not know the ABGB provisions and how differently the provisions were interpreted by the courts.Ausgewählte Probleme der testamentarischen Erbfolge im Lichte der Rechtsprechung der Gerichte des Lemberger Berufungsbezirkes in der ZwischenkriegszeitDer Verfasser stellt im Aufsatz ausgewählte Probleme betreffend die testamentarische Erbfol­ge vor Geistesgegenwart des Erblassers, formelle Anforderungen an Testamente und die Zeugen, gemeinsame und bevorzugte Testamente, Widerruf des Testaments und dessen Aufhebung, die im österreichischen Zivilgesetzbuch ABGB vorgesehen waren und im ehemaligen österreichischen Teilgebiet galten. Die Analyse der die erwähnten Probleme betreffenden Vorschriften erweitert er um die Rechtsprechung der Gerichte des Lemberger Berufungsbezirkes aus der Zwischenkriegszeit und zeigt dabei ihre Kompliziertheit im alltäglichen Leben. Diese Beschlüsse zeugen davon, welch eine große Rolle die testamentarische Erbfolge im ehemaligen österreichischen Teilgebiet spielte. Andererseits sind sie ein Beweis, dass viele Personen die Vorschriften des ABGB nicht kannten und dass seine Vorschriften durch die Gerichte unterschiedlich ausgelegt waren.

It is an established fact that biblical historiography is fundamentallydifferent from modern historical reconstructions. It was neverthe aim to describe the past as it really was. The purpose of historiographywas didactic, and the means had little to do with modern historicalreconstructions. In this way it is preferable to consider biblicalhistoriography to be cultural memory, and it is sharing with memorythe right not to be dependent on historical facts. Rather it represents a“memory” of the past as constructed by an elite group – the few whowere able to write and read. Lars Schreiber Pedersen: “The Future of Egyptology in our Country.” H. O. Lange’s scientific testament The Royal Library in Copenhagen is the natural home of the Egyptologist and librarian H. O. Lange’s comprehensive archives. For almost 40 years, from 1885 to 1924, he worked at the library, from 1901 to 1924 as chief librarian.The archives at the section for Egyptology at the Department of Cross-Cultural and Regional Studies (ToRS) at the University of Copenhagen include a small collection of manuscripts, notes and letters to and from H. O. Lange. The collection also contains a scientific testament prepared by H. O. Lange. The testament is undated, but is thought to have been written in 1938 or 1939. In the testament, which H. O. Lange drew up after retiring from his position as associate professor in Egyptology at the University of Copenhagen, he gave an account of his own efforts within the relatively young field of study, which only gained a foothold at the university following the establishment of his own associate professorship in 1924, while also suggesting how the status of Egyptology in Denmark could be promoted. Characteristically for H. O. Lange, in the testament he was very modest about the results he had achieved during his time at the university. Instead, he drew attention to the people and institutions (in particular the Carlsberg Foundation) who had made it possible for him to establish Egyptology as a field of study at the University of Copenhagen. The training of a new generation of Danish Egyptologists who could ensure the University of Copenhagen’s continued leading position in Scandinavia was an issue very close to H. O. Lange’s heart. In the testament, he gave particular mention to his four best students: C. E. Sander-Hansen, Wolja Erichsen, Aksel Volten and Erik Iversen. He described what their future prospects and opportunities might be, including which jobs he thought they should each take upon themselves.All four students became prominent Egyptologists in their own right, and contributed to ensuring that the University of Copenhagen’s international reputation within Egyptology achieved as a result of H. O. Lange’s long-standing work was not just maintained but further expanded and developed.

Abstract:
The understanding of the role of the old Greek translation of the Old Testament, the Septuagint, has undergone great changes in the last decennia. From looking upon the Hebrew text as the original and the Greek text as only a translation, it has now been common to view the Greek version as a chapter in a reception history of biblical traditions. By being used by New Testament authors and in the Early Church the Septuagint gained canonical status – alongside the Hebrew Bible. Thus the Old Testament of the Church in reality consists of both versions. The article argues for this also pointing to some of the theological consequences of viewing the connection between the two parts of the Christian Bible from the perspective of reception history.

Gmndtvig does not have to presuppose the New Testament when dealing with OT, but can read it freely: it is the same God that acts in both books of the Bible, though in different ways, according to how he leads and maintains his people. The same freedom finds expression in Gmndtvig’s sermons where he moves about effortlessly in the whole of the Biblical universe.Some of these sermons are dominated by a solemn, Old Testament tone, especially those that follow a triadic stmcture: first the Old Testament prophecy is mentioned, in the middle its fulfilment in and with the coming of Christ is described, and finally follows the most important part, the fulfilment of the prophecy in the present, Grundtvig not failing to place his activity in the centre - but as a stage, naturally, in the course of the history of salvation.In Grundtvig’s hymns, too, this structure recurs, as in Blomstre som en Rosengaard, in which the triadic structure is connected with the so-called Vstructure, the right side of the »V« of the hymn describing the fulfilment of the prophecy. By means of the V-structure Thodberg shows how baptism is the focus of the hymn, and also that in his interpretation of Isaiah 35 as a prediction of baptism Grundtvig leans on the Septuagint rather than the contemporary Danish Bible translation. In the Danish Hymn Book, Blomstre som en Rosengaard is only a torso - baptism is not the essential thing here.The article mentions a number of other examples of influence from the Septuagint on Grundtvig’s hymns and sermons. Among these the hymn Hyggelig, rolig stands out since it contains a large number of phrases that refer to the Septuagint. This applies to stanza 4 in which Grundtvig shows how even the person most troubled by doubts and most deeply bereaved will have a foretaste of the Kingdom of God when approaching Heaven in his or her heart on the tone ladder of songs of praise. This is a rendering of Psalm 84 in the Septuagint. The article concludes that from the 1830s Grundtvig makes extensive use of the Septuagint when quoting from OT. The background is that Grundtvig regarded the Septuagint as more poetical than the Danish translation from 1736, and - more importantly - that in preferring the Septuagint Grundtvig follows Irenaeus by relying on the Bible of the New Testament and the Old Church.

Pomirtinės teismo psichiatrijos ekspertizės metu teismo psichiatrai ekspertai retrospektyviai vertina asmens psichikos būseną testamento pasirašymo metu. Šiose ekspertizėse teismo ekspertai dažnai turi vertinti senyvo amžiaus asmenų, sergančių sunkiomis somatinėmis ligomis, būseną ir įvertinti vidaus ligų poveikį psichikos būklei testamento pasirašymo metu. Tyrimo metu išanalizuoti Valstybinės teismo psichiatrijos tarnybos (VTPT) prie SAM 2016-2018 metais atliktų 117 pomirtinių teismo psichiatrijos ekspertizių duomenys. Tirtų asmenų, surašiusių testamentus, amžiaus vidurkis buvo 78 m. Tyrimo metu pastebėta, kad vyrai testamentus sudarė būdami apie 10 m. jaunesni, nei moterys: vyrų amžiaus vidurkis – 74 m., moterų – 82 m. Nustatyta, kad net 42 proc. atvejų testamentus asmenys pasirašė likus mėnesiui ar keletui dienų iki mirties. Tyrimo metu išsiaiškinta, kad beveik pusę notariškai patvirtintų testamentų pasirašė asmenys, būdami testamentinio neveiksnumo būsenoje dėl turėtų psichikos sutrikimų. Pomirtinės teismo psichiatrijos ekspertizės metu dažnai nebūna asmens psichikos būsenos įvertinimo ikitestamentiniu laikotarpiu, o testamento pasirašymo metu dauguma testatorių serga sunkiomis somatinėmis ligomis: lėtine smegenų išemija, onkologinėmis ligomis, cukriniu diabetu su komplikacijomis, kepenų ar inkstų nepakankamumu, Parkinsono liga ir kitomis neurodegeneracinėmis ligomis. Tyrimo duomenys parodė, kad teismo psichiatras privalo turėti gilias ne tik psichiatrijos, bet ir somatinių ligų sukeltų psichikos sutrikimų įvertinimo žinias.

INTERPRETATION OF TESTAMENTS MADE BEFORE A NOTARYSummary The article deals with problems connected with interpretation of testaments made before a notary. Following a brief introduction describing the notion of a testament as well as characteristics of this legal transaction and general remarks on a testament form, including a notary act form, the article focuses on interpretation of a testators declaration pointing at basic rules which should govern interpretation of a last will included in a notary act.Testament’s interpretation aim is to establish testator’s actual will recorded in the testament. Real life experience shows that many a time testamentary dispositions are very imprecise not to say unclear. Interpretation problems occur more often with personally written testaments than with testaments made before a notary thanks to professional knowledge of a person participating in preparation of a „last will” statement. A notary who takes down in writing bequeather’s will is working with him / her on the wording of the declaration of will. However, it happens that formulation of notarial will also raises doubts about bequeather’s actual will.For notarial wills, the rules stated in Article 948 of the Civil Code are binding, with the assumption of the testament „co-author’s” professionalism.Participation of a notary in drawing up a testament implies that law or legal terms included in the document carry the meaning used by legislators (Acc. to: E. Skowrońska, comments on SN law of 16 September 1993, III CZP 122/93, published in OSP in 1994 year, no. 10, item 177) and lawyers in their register. In case of contradictory content of a notarial will, by using the above mentioned interpretation principle, the interpretation results established for such a declaration of will could be very different from those established, if testator’s last will was expressed in a personally written testament. Thus, apparently, not only the testament’s content but also its form may influence interpretation result.Sometimes, a testament made before a notary uses plain language inappropriately. Testament’s content may include records understandable only to the testator and people from his/her surroundings. A testator may, even unintentionally, mislead a notary about his/her actual will.For notarial wills, the problem of ignorance of law is ruled out. This applies particularly to a rule of law concerning succession, but also to different ones (for example, to a rule concerning property regulations). It is assumed that a bequeather realizes consequences of his/her dispositions. He should be instructed about the consequences by a notary (Art. 80 § 3 of the Law on Notary Public). Therefore, in case of ambiguity (art. 948, paragraph 2 of the Civil Code) the interpretation which is rational not only from life but also from legal perspective, should be given precedence. For testaments prepared by a testator personally, presumption of knowledge of law is not valid.Beginning interpretation of declaration of will included in a notary act we assume that bequeather’s disposition is lawful and consistent with the rules of social intercourse, and that it does not aim to evade the law (article 58 of the Civil Code). A notary is obliged to refuse performance of transaction which is against the law (Art. 81 of the Law on Notary Public).As for testaments made before a notary, it may well be assumed that a document tendered in court is the testament of the person concerned (actually, it is an extract from the document) (Contradictory thesis requires refutation of presumption according to art. 247 of the Civil Proceeding’s Code), and also, that at the moment of drawing up the testament the testator had ability to bequeath and that his/her declaration of will is not defective. It should also be assumed that for testaments made before a notary a plea of lack of will to testate may be raised in very exceptional situations.

This article responds to an extensive review article by Jesper Tang Nielsen (Dansk Teologisk Tidsskrift 80, 2017, 51-69) of the present author’s book, John and Philosophy. A New Reading of the Fourth Gospel, by addressing the relationship between scientific scholarship and tradition in the interpretation of The New Testament. While postmodernists of various sorts may wish to deduce from the principle (as quoted by Tang Nielsen from Gitte Buch-Hansen) that ‘truth (without inverted commas) is now perceived as conditional on the method/perspective applied’ (a principle which taken by itself is almost a truism) that there is no longer any need to discuss the method or perspective to be applied, the article argues that there is precisely a need to discuss methods and perspectives and that the history – in the sense of the development – of scholarship plays a crucial role in this discussion. John and Philosophy extensively engages in just that discussion, and for that reason Tang Nielsen’s description of the book’s ‘stoicizing’ and‘(narrative-)philosophical’ method or perspective as being ultimately based on its author’s choice does not do justice to the book’s aim. In showing this, the article seeks to advance the cause of scientific scholarship as against all other, more directly ‘interested’ readings of The New Testament, including more traditional ones.

In 1954 the first issue of New Testament Studies (NTS) was released under the auspices of the Studiorum Novi Testamenti Societas (SNTS), which was founded on 16 September 1938 in Birmingham. The journal aimed to interlink (European) NT scholarship and to ensure its quality and standards by the society's members. Why did it take so long to release the journal, even though the Dutch NT scholar Johannes de Zwaan (1883–1957), who initially came up with the idea, intended the publication of an international quarterly right from the beginning? In 1953 he was not considered for election to the Editorial Board and therefore decided to publish another New Testament journal whose first issue appeared in 1956: Novum Testamentum. De Zwaan's correspondence with some of SNTS's first members and other so far unknown sources can elucidate these circumstances.

Con la realización del presente trabajo, pretendemos investigar sobre cuál es la aplicación jurídica del testamento en caso de pandemia regulado en el art. 701 del Código Civil español (1888-1889), dado que, si bien parecía un tipo de testamento inaplicable en pleno siglo xxi, tras la epidemia generada a nivel mundial por el coronavirus hemos visto que actualmente dicho precepto no es anacrónico y, por primera vez, tiene plena vigencia. En este sentido, en un primer momento partiremos de sus orígenes y reconocimiento jurídico desde el propio Derecho romano, el cual configuraba el llamado Testamentum Tempore Pestis (C. 6.23.9) —o testamento en caso de peste o pandemia como las que hubo en Roma—, de modo muy similar a nuestros días; para, seguidamente, examinar sus requisitos de contenido y forma esenciales para que hoy pueda ser usado. Para finalizar, analizaremos la naturaleza legal del testamento ante la epidemia actual generada por el Covid-19 y, de ese modo, entendemos que podremos encuadrarlo dentro de la tipología o clases de testamentos posibles.

The ancient text known as the Testament of Abraham is preserved in Coptic in the same codex as two other works, the Testament of Isaac and the Testament of Jacob. These testaments were probably written in the late first or early second centuries CE by Jewish writers, although the manuscript of the Coptic codex containing them is dated to 962. These books were considered part of the “testament” literary genre, which featured a biblical hero imparting his last words of religious wisdom to his family gathered at his bedside. Scholars agree that the stylistic and theological differences among these three testaments indicate that they were not written by the same author. Yet a close reading reveals that the Testament of Isaac is dependent on the Testament of Abraham, and that the Testament of Jacob is dependent on the two earlier texts. Moreover, the Testament of Abraham and the Testament of Isaac share similarities that distinguish them from the Testament of Jacob: unlike the Testament of Jacob, the Testament of Abraham and the Testament of Isaac reflect a universalist worldview that depicts a God concerned for all humankind, not only for his chosen people. This God reigns over all people, and themes specific to the Christian and Jewish faiths are virtually absent. Later Christian and Jewish literature concerning the theme of divine judgment exhibits elements that may reflect an awareness of a written or oral tradition that appears in the Testament of Abraham and the Testament of Isaac. The images of judgment and punishment, especially those in the Testament of Abraham, appear in the second-century Apocalypse of Peter and the fourth-century Vision of Paul, which is also known as the Apocalypse of Paul. Likewise, midrashic traditions regarding Abraham and Moses are reminiscent of traditions found in these testaments, particularly the Testament of Abraham. The possibility that early Christian apocalyptic texts were aware of these testaments is grounded in the fact that scholars give these texts a common place of origin, Egypt. The provenance of the midrashic texts is more difficult to identify, but because they share literary elements and theological concerns with the Testament of Abraham and the Testament of Isaac, I suggest that the authors of these midrashic traditions had access to written or oral traditions prominent in these testaments. This paper will examine early Christian apocalyptic and early Jewish midrashic texts that modify some of the traditions prominent in these testaments in order to accommodate their nonuniversalist rabbinic or early Christian worldviews.

Leksemy swoiste Nowego Testamentu Biblii gdańskiej (1632) to te autosemantyczne hasła leksykonu tego tekstu, które nie wystąpiły w leksykonach trzech zestawianych z przekładem gdańskim z 1632 roku wcześniejszych renesansowych przekładów Nowego Testamentu, a mianowicie w przekładach kręgu ewangelickiego – w Nowym Testamencie Biblii brzeskiej (1563), w Nowym Testamencie gdańskim (1606) oraz w jezuickim Nowym Testamencie Biblii Jakuba Wujka (1599). When considering applications in terms of section 2(3) of the Wills Act 7 of 1953, one is confronted with the practical problem that a document may be accepted as a will in terms of section 2(3) but from the facts it may appear that the deceased may not have had the necessary testamentary capacity or free will to make a will. Another option would be to consider the deceased’s capacity before considering the section 2(3) requirements, but one cannot consider capacity before one has a valid will, and the court’s interpretation of section 2(3) in Bekker v Naudé 2003 5 SA 173 (CC) prevents this route. A third option would be for the court to mero motu consider the deceased’s capacity to make a will when faced with a section 2(3) application. This approach would be in accordance with public policy. If all of these approaches are unsatisfactory, the legislature should consider an amendment to the Act.

AbstractDieser Beitrag untersucht drei Beispiele zur Überwindung von Vergänglichkeit und Endlichkeit, einer Inversion der Vanitas-Motivik, vor allem in den Klangkünsten: Wie ist es technisch möglich und kulturell zu bewerkstelligen, dem Verwehen von Klängen entgegenzuwirken? Die transhistorische Übertragungstheorie der médiologie von Régis Debray wird hierbei genutzt, um Formen und Strategien zur ‚ewigen Übertragung’ jeweils näher zu bestimmen. Ausgehend von Edisons Bewerbung des Phonographen als eines Hilfsmittels für hörbare Testamente von Verstorbenen wird die Aufführung von John Cages ORGAN 2/ASLSP in Halberstadt, das Vorhaben einer Millennium Clock der Long Now Foundation von Stewart Brand und Brian Eno sowie die Pressung der kremierten Asche eines Verstorbenen in einer Vinylschallplatte durch die Firma Andvinyly untersucht.
