Abstract:
This chapter focuses on dominant trends in Islamic feminist engagement with ahadith, including the primary issues presented by the hadith corpus, central interpretative approaches, and critical calls for more extensive and systematic engagement. Extending the analogical starting point of the Qur’an and Jesus Christ, it engages Christian feminist biblical exegetical approaches articulated by Elizabeth Schüssler Fiorenza, Musa Dube, and Phyllis Trible. These exegetes raise similar questions about androcentrism and misogyny, authority and communal function of the texts, and interpretative strategies. The chapter concludes by proposing ways in which Muslima theology can extend beyond both classical Islamic methods of hadith assessment (usul al-hadith) and a basic hermeneutic of suspicion to reclaim hadith literature through additional hermeneutic strategies, revisiting the relegation of extra-Islamic or non-Islamic materials, and collective reading.

Abstract:
This chapter employs spatial theory in order to think about female power in representations of the land and state of ancient Israel. By distinguishing among imperial, national, and local scales of space, it shows how the participation of women in public life differs according to scale. Biblical texts repeatedly preserve evidence of female leadership at the local, or tribal, level. For this reason, as well as because it represents a more egalitarian mode of managing and distributing resources, the chapter engages in a project of recuperating tribalism. Particular focus falls on the households that constitute a tribe and appear to have been run by women. Because the household served as the site of production, it also seems to have commanded some power in the face of the tax and tribute needy institutions of state and empire. Thus traces of female political influence becomes perceptible at these scales as well.

Abstract:
It is widely recognized that the Hebrew Bible is filled with rape and sexual violence. However, feminist approaches to the topic remain dominated by Phyllis Trible’s 1984 Texts of Terror, which describes feminist criticism as a practice of “telling sad stories.” Pushing beyond Trible, Texts after Terror offers a new framework for reading biblical sexual violence, one that draws on recent work in feminist, queer, and affect theory and activism against sexual violence and rape culture. In the Hebrew Bible as in the contemporary world, sexual violence is frequently fuzzy, messy, and icky. Fuzzy names the ambiguity and confusion that often surround experiences of sexual violence. Messy identifies the consequences of rape, while also describing messy sex and bodies. Icky points out the ways that sexual violence fails to fit into neat patterns of evil perpetrators and innocent victims. Building on these concepts, Texts after Terror offers new feminist strategies and approaches to sexual violence: critiquing the framework of consent, offering new models of sexual harm, emphasizing the importance of relationships between women (even in the context of stories of heterosexual rape), reading biblical rape texts with and through contemporary texts written by survivors, and advocating for “unhappy reading” that makes unhappiness and open-endedness into key feminist sites of possibility. Texts after Terror also discusses a wide range of biblical rape stories, including Dinah (Gen 34), Tamar (2 Sam 13), Lot’s daughters (Gen 19), Bathsheba (2 Sam 11), Hagar (Gen 16 and 21), Daughter Zion (Lam 1 and 2), and the Levite’s concubine (Judg 19).

In his famous courtroom definition of ‘the love that dare not speak its name’, Wilde pays tribute to Plato and ‘that deep, spiritual affection that is as pure as it is perfect’. But how does Wilde translate Platonic love into his works, especially The Picture of Dorian Gray, where erotic purity and perfection seem hard to find? Plato is a crucial influence, but this chapter suggests we should also turn to Roman sexual models, for two pivotal texts that Dorian reads are Petronius’ Satyricon and Suetonius’ Lives of the Caesars. What emerges is an idea of love and sex that destabilizes the categories of erastes and eromenos, that stresses erotic reciprocity rather than paiderastia, and that appropriates Roman models to a much greater degree than Wilde acknowledges in his speech.

Abstract:
This chapter begins with an analysis of the Miranda warning, pointing out the opportunities it provides for creating ambiguity. Following this, the chapter points out the ways police interviewers used ambiguity with juvenile murder suspect Kevin Rogers in Houston, Texas, and juvenile suspect Michael Carter in Baton Rouge, Louisiana. The third case describes the law enforcement interviews with Major Dragan Jokic of the Serbian army during the International Criminal Tribunal of Yugoslavia at The Hague. Major Jokic was accused of abetting genocide during the Srebrenica massacre. In all three cases, analysis demonstrates the ways that these government officials used ambiguity deceptively during their interviews with their suspects. This analysis includes the way the interviewers’ used deceptive ambiguity while presenting the speech events, schemas, agendas, speech acts, conversational strategies, and lexicon and grammar.

Abstract:
This chapter examines the enduringly formative impact of ‘Arabian Nights and Oriental Spies’ on the eighteenth-century novel. It studies Charles Gildon's The Golden Spy: or, A Political Journal of the British Nights Entertainments of War and Peace, and Love and Politics (1709). The novel merges a spy narrative and a sequence of embedded tales. While paying tribute to previous texts, Gildon in turn has helped to launch the so-called ‘it-narrative’, for the ‘spy’ in question is a coin (or rather a collection of coins) whose testimony exposes, in the words of the work's subtitle, ‘The Secret Miraculous Power and Progress of Gold, in the Courts of Europe’. The various coins in the narrator's possession often invoke concepts of metamorphosis or shape-shifting in order to illustrate the transformative agency of money, and The Golden Spy uses a serial structure akin to that of the Arabian Nights to reiterate this basic point.

This chapter focuses on the way in which arbitral tribunals have dealt with indirect expropriation claims based on investment agreements. It also looks at the cross-fertilization with two other sources of jurisprudence which deal with similar issues, under different circumstances and different legal bases, i.e. the US–Iran Claims tribunal and the European Court of Human Rights. The chapter (i) describes the basic concepts of the obligation to compensate for indirect expropriation; (ii) reviews whether and how legal instruments and other texts articulate the difference between indirect expropriation and the right of the governments to regulate without compensation; and (iii) identifies a number of criteria which emerge from jurisprudence and state practice for determining whether an indirect expropriation has occurred, and compensation is due.

Abstract:
This chapter comments on Article 29 of the Rome Statute of the International Criminal Court. Article 29 declares that crimes within the Court's jurisdiction are not subject to a statute of limitations. None of the preceding international instruments concerned with international prosecution of atrocities, from the Charter of the International Military Tribunal to the statutes of the ad hoc tribunals, have contained anything similar. This is only logical, because in the absence of texts within the instruments creating a time bar, silence was all that was required. There is also ample precedent for States refusing to extradite offenders where crimes are time barred under their own legislation. At the very least article 29 operates as an answer to any argument from a State Party whereby extradition might be refused because of a statutory limitation in its own domestic penal code.
