Abstract:
The monograph examines the most important elements of the modern concept of interpretation of international treaties, examines the history of the formation of the concept of interpretation of international treaties in doctrine and international practice, suggests approaches to conceptualizing the nature of interpretation of treaties, taking into account the provisions of the Vienna Convention on the Law of Treaties of 1969.
Along with scientific and theoretical aspects, practical aspects of the interpretation of an international treaty are disclosed. The features of the interpretation of an international treaty in the practice of international organizations, including international integration organizations, international judicial bodies (ECHR, international judicial bodies for maritime disputes, the International Criminal Court, the Court of the Eurasian Economic Union) are analyzed, individual doctrines of treaty interpretation (evolutionary interpretation, interpretation of contextual elements) are investigated. The peculiarities of the interpretation of international investment treaties are revealed, the problems of the interpretation of international treaties in the decisions of international commercial arbitration are identified, the place of the interpretation of treaties in the concept of comparative international law is investigated. The concept of interpretation of international treaties by national judicial bodies of states with the involvement of the practice of Russian courts is proposed.
For researchers, teachers, students and postgraduates of law schools and faculties, as well as anyone interested in the problems of modern international law.

Abstract:
This book offers an analysis of the law of treaties as it emerges from the interplay between the 1969 Vienna Convention on the Law of Treaties and customary international law. It revisits the basic concepts underlying the provisions of the Vienna Convention, so as to determine the actual state of the law and its foreseeable development. In doing so, it examines some of the most controversial aspects of the law of treaties. The book first explores the influence exerted by the Vienna Convention on pre-existing customary law. Certain rules of the Convention which, at the time of its adoption, appeared to fall within the realm of progressive development, can now be regarded as customary international rules. Conversely, a number of provisions of the Convention, in particular those which have been the subject of subsequent codification work by the International Law Commission, have become obsolete. It then examines the impact exerted by the Vienna Convention on the development of other fields of international law, such as the law of international responsibility and the law of international organizations. The last section of the book is devoted to cross-cutting issues, with particular reference to the notion of jus cogens — a concept first used in the Vienna Convention in connection with the problem of the validity of treaties and which, afterwards, has acquired a legal significance going well beyond the Convention.

Abstract:
Under Article 18 of the 1969 Vienna Convention on the Law of Treaties, a State which has signed or ratified a treaty has the obligation to refrain from acts which would defeat the object and purpose of that treaty prior to its entry into force. Vagueness and ineffectiveness are often indicated as the two major shortcomings affecting the obligation laid down in Article 18. This chapter assesses whether such criticism is justified. More comprehensively, it endeavours to reassess the impact Article 18 has had on State practice over the forty years since the adoption of Vienna Convention. Its major finding is that, while Article 18 seems to suffer from certain shortcomings, which inevitably weaken its normative force, it is by no means a rule devoid of any practical relevance, particularly if one takes into account the increasing recourse to this provision in cases before domestic courts.

Abstract:
This chapter concentrates on the means of interpretation as codified in Articles 31 and 32 of the 1969 Vienna Convention. It also deals with the misgivings as to rules on interpretation, namely as to whether it is at all possible to establish rules of interpretation and to elicit the ‘correct’ meaning from a treaty term. It further discusses certain misunderstandings, in particular as to the relative structure of the means mentioned in Articles 31 and 32. The chapter finds that Articles 31 and 32 are not only contractually binding, they also enjoy a solid basis in customary international law. Overall, it can be said that these two provisions are among the most important ones of the entire 1969 Vienna Convention. They offer the interpreting agency considerable flexibility to adapt the various means of interpretation to the different types of treaties.

Abstract:
This chapter presents a critical analysis of the case law of the European Court of Justice and of the General Court relating to the application of the international law of treaties. It covers the some forty cases in which the Courts have referred explicitly to the Vienna Convention on the Law of Treaties 1969, and a few more where this happened implicitly, during the period 1998–2010. Inevitably the emphasis falls on the application of the rules of treaty interpretation to the international agreements concluded by the European Union (EU), but also to the founding treaties of the EU itself. The Courts have been confronted with great regularity with questions relating to the law of treaties and thus have become increasingly sophisticated in their use of it. The recent accusation that the Court is adverse to international law seems to be based on a few dramatic cases, not on the steady stream of smaller cases in which the law of treaties plays a role.
