Abstract:
This study aimed at elaborating and identifying the law and the virtues of funeral prayer, the definition of absentee funeral prayer, the propositions of the inquiry of absentee funeral prayer, scholars’ opinions on the law of absentee funeral prayer, the ruling of absentee funeral prayer, time and distance limit in absentee funeral prayer, and the law of absentee funeral prayer on the victims of natural disasters. This study employed qualitative-descriptive method with normative approach techniques and library research. The result of the study shows that: (1) The law of absentee funeral prayer is permissible on the corpse that is not yet prayed on; (2) The ruling of absentee funeral prayer is the same as the ruling of funeral prayer; (3) There is no time limit for performing absentee funeral prayer on condition that the person dies at the time person who wants to perform prayer has been able to perform prayer; (4) The distance limit of absentee funeral prayer is the distance in which it is difficult to be visited by people who want to perform prayer; (5) The natural disaster victim, if his or her body is not found and is not yet prayed on, then he/she can be prayed on in absentia.

Sesuai dengan Pasal 10 ayat (1) Undang-Undang Pokok Agraria telah mengamanahkan terkait larangan kepemilikan atas tanah pertanian secara absentee. Dengan adanya ketentuan tersebut diharapkan para pemegang hak atas tanah pertanian dapat mengusahakan atau mengerjakan sendiri tanah yang dimilikinya sehingga tanah-tanah pertanian memang menjadi produktif dan tidak terdapat tanah pertanian yang di biarkan atau absentee. Tujuan larangan absentee agar hasil yang diperoleh dari pengusahaan tanah sebagian besar dapat dinikmati oleh masyarakat desa tempat letak tanah. Fenomena larangan tanah absentee/guntai secara nyata terjadi, tetapi tidak dilakukan sanksi yang tegas.Kata kunci: absentee, kepemilikan hak atas tanah, pertanian, sanksi. To make a fair and prosperous farming community, the government through a Land Reform program which includes a reshuffle of land ownership and control as well as legal relations concerned with land tenure. In accordance with Article 10 paragraph (1) the Basic Agrarian Law mandates Absentee prohibitions on ownership of agricultural land. With the existence of these provisions it is expected that holders of agricultural land can cultivate or work on their own land so that agricultural lands are indeed productive and there is no agricultural land that is left or Absentee. The purpose of the Absentee ban is that the results obtained from the cultivation of land can be enjoyed mostly by rural communities where the land is located. The phenomenon of the prohibition of Absentee / guntai land actually occurred, but no strict sanctions were made.Keywords: absentee,ownership of rights to land, agriculture, sanctions.

Abstract:

During the Civil War, twenty northern states changed their laws to permit absent soldiers to vote. Before enactment of these statutes, state laws had tethered balloting to the voter's community and required in-person participation by voters. Under the new laws, eligible voters – as long as they were soldiers – could cast ballots in distant military encampments, far from their neighbors and community leaders. This dissertation examines the legal conflicts that arose from this phenomenon and the political causes underlying it. Legally, the laws represented an abrupt change, contrary to earlier scholarship viewing them as culminating a gradual process of relaxing residency rules in the antebellum period. In fact, the laws left intact all prewar suffrage qualifications, including residency requirements. Their radicalism lay not in changing rules about who could vote, but in departing from the prewar legal blueprint of what elections were and how voters participated in them. The changes were constitutionally problematic, generating court challenges in some states and constitutional amendments in others. Ohio's experience offers a case study demonstrating the radicalism of the legal change and the constitutional tension it created. In political history, prior scholarship has largely overlooked the role the issue of soldier voting played in competition for civilian votes. The politics of 1863-1864 drew soldiers into partisan messaging, since servicemen spoke with authority on the themes the parties used to attack their opponents: the candidates' military incompetence, Lincoln's neglect of the troops, and McClellan's cowardice and disloyalty. Soldiers participated politically not only as voters, but also as spokesmen for these messages to civilian voters. In this setting, the soldier-voting issue became a battleground in partisan efforts to show kinship with soldiers. The issue's potency became evident nationally after the 1863 Pennsylvania gubernatorial race, presaging the 1864 presidential contest. The Republican incumbent ran as "the soldiers' friend" and attacked his Democratic rival as the enemy of soldiers for opposing that state's soldier-voting law. The issue was decisive in securing civilian votes for the victorious Republican. That experience launched a nationwide push by Republicans to enact soldier-voting laws in time for the 1864 elections.

Abstract:
This paper defends Israel's expropriation of property under the Absentee Property Law within the state’s pre-1967 borders on constitutional grounds, but holds that the Law’s increased use in the region of East Jerusalem is invalid under Israel's constitutional scheme. This distinction turns upon the state’s application of the Law for necessary purposes. I hold that Israel’s justification for breaching human rights explicitly protected must be based on the state’s need to preserve its foundational ideology and national purpose in times of extra-normal circumstances. Israel may act undemocratically only to the extent imperative to preserve the Jewish nation and the existence of the Jewish state for generations to come.

Abstract:
This thesis explores the relationship between gender, property and power in the context of British slave-ownership in the late eighteenth and early nineteenth centuries, working to unpick the categories of slave-owner, ‘West Indian’ and absentee. It demonstrates how both men and women played crucial roles as transmitters of West Indian property, acting as conduits who helped to facilitate the transmission of slave-based wealth into metropolitan society. The heart of the thesis is an analysis of qualitative material. It uses Barbadian slave-owner Thomas Lane as a lens through which to interrogate the complicated relationship between absentee slave-ownership and masculinity, exploring how male absentees, unlike many of their literary counterparts, were able to conceive and present themselves as both slave-owners and gentlemen. But it places a particular focus on female absentees, examining the mediations and constraints that these women faced, while also highlighting the ways in which they were able to carve a place for themselves within these always restricted parameters. Looking at Jamaican slave-holder Anna Eliza Grenville, it examines the ways she negotiated her position as a married woman and substantial property owner, as well as situating her slave-ownership within her broader social, political and imperial worlds. Indeed, nearly a quarter of absentees who claimed compensation following the abolition of slavery in 1834 were women. Using the records of the Slave Compensation Commission the thesis examines, where possible, how the most substantial female slave-owners became claimants and how they bequeathed the Caribbean property they owned or compensation they received. Absentee slave-owners were a large and diverse range of people. This thesis demonstrates just some of the many ways that these absentees, male and female, worked to bring slave-ownership ‘home’ to metropolitan Britain in the late eighteenth and early nineteenth centuries.
