Abstract:
The project of defining art most commonly consists in the attempt to find necessary conditions and sufficient conditions for the truth of the statement that an item is an artwork. That is, the goal is normally to find a principle for classifying all artworks together while distinguishing them from all non-artworks. Sometimes the goal is set higher. Some look for a ‘real’ definition: that is, one in terms of necessary conditions that are jointly sufficient for being an artwork. Sometimes the aim is to identify a metaphysical essence that all artworks have in common. This article surveys the main trends that mark the history of the project of defining art in the twentieth century before discussing the most important efforts in the past thirty years.

Abstract:
There are innumerable attempts at defining ‘religion.’ The need and possibility of defining religion have been challenged, but such claims often presuppose specific definitions of religion and certain definitions of definition. The link between a definiendum (expression to be defined) and a definiens (expression that does the defining) can be conceived of in different manners. Since definiens are intended to express the meanings of the definienda, definitions are theoretically impacted by underlying theories of meaning. A crucial semantic distinction is that between meaning realism (meanings as fully determinate) and meaning antirealism (meanings as indeterminate). Different theories of meaning resonate with different types of definitions (real, lexical, and stipulative). In the study of religion, a recurrent distinction is that between functionalist and substantive definitions. The limitations of both can be overcome by combining them. Homeostatic property cluster definitions are a possible alternative.

Abstract:
What did it mean for an ordinary Jew to be a Hasid? Although there are dozens of definitions of Hasidism, all of them are built on doctrinal categories. The chapter demonstrates these kinds of ideological definitions are inadequate, given that they turn Hasidism into an abstract doctrine, disconnected from its believers and their daily practices. Instead, this chapter offers a behavioral, or performative, definition of Hasidism as practiced in everyday life, a definition based on low-profile, often folk testimony, i.e. it shows what rank-and-file followers understood being a Hasid meant and how they defined their own distinctive features. It demonstrates that, contrary to a predominant assumption, the self-definition of a Hasidic group was closer to a confraternity than to a sect, which provides entirely new analytical categories and allows for a new view of the history of Hasidism, inter-group boundaries, and more.

This book proposes guidelines for constructing and evaluating definitions of terms, i.e. words or phrases of general application. The guidelines extend to adoption of nomenclature. The book is meant to be a practical guide for people who find themselves in their daily lives or their employment producing or evaluating definitions of terms. It can be consulted rather than being read through. The book’s theoretical framework is a distinction, due to Robert H. Ennis, of three dimensions of definitions: the act of the definer, the content of the definition, and its form. The act of a definer is what the definer does in defining a term; the book distinguishes, following Ennis, three basic acts of defining: reporting, stipulating, and advocating. The content of a definition is in one sense the information that the definition conveys and in another sense the words in its defining part. The form of a definition is the way it is expressed, for example as a definition by genus and differentia.

A bilateral investment treaty (BIT) is relevant for a particular arbitration case only when the case falls within its scope of application. Normally the scope of application of a treaty includes four aspects: subject matter (ratione materiae), covered persons and entities (ratione personae), territorial application, and temporal application. The Chinese BITs are not an exception to this but they do, however, raise some special, perhaps unique, questions. This chapter deals with the four aspects on the scope of application, with special attention to those issues with “Chinese characteristics”. It also deals briefly with the issue of investment admission, which has been left, by and large, within the discretion of the host state.

This chapter explores Article 28 of the ATT. The article defines all six official UN language versions of the text of the Convention as ‘equally’ authentic—Arabic, Chinese, English, French, Russian, and Spanish—despite the fact that most of the texts forming the basis of preparatory discussions and negotiations were in English. The particularities of English pose a problem with regard to the definition of some terms. For example, the word ‘overriding’, controversially included in Article 7(3), was clearly the basis for negotiations as the translations were amended so as to give equivalent effect to the term’s apparent balancing effect.

This chapter discusses the DSM-5 diagnostic criteria for substance use disorders and identifies addiction as a disease of reward, motivation, and memory rooted in complex biologic changes. It explains the epidemiology of addiction and identifies the rise and fall of specific drug use and behaviors. It then moves to the neurobiology of addiction, naming the numerous survival systems that are intertwined with addiction’s genetics, early brain development, and learning pathways. Finally, it looks at why some people become addicts, describing it as a pro-inflammatory, bio-psycho-social-environmental-spiritual disease state. Addicted persons often engage in this behavior, no longer to obtain pleasure, but to relieve discomfort created by withdrawal from the drug and the negative life consequences of addiction. The chapter concludes by addressing what needs to be done in both the short- and long-term, noting that applying the disease model to addiction has been the most effective method of saving lives.

The first part answers the book’s first question: ‘What is a Legal Dilemma?’ It frames the book’s analysis by offering a stipulative definition of the term legal dilemma and its constitutive components as a term of art. Once defined, the term will then be distinguished from numerous related concepts (Section A), such as legal gaps, disagreements, or paradoxes. The first part also considers various circumstances, including international law’s non-hierarchical nature and fragmentation, which increase the potential frequency with which dilemmas may arise (Section B). Finally, this part introduces a distinction between dilemmas responding to epistemic undecidability and to metaphysical undecidability (Section C).
