Проводится анализ положений ст. 1129 ГК РФ, на основании которого подвергается критике требование об обязательном присутствии двух свидетелей при совершении завещания в чрезвычайных обстоятельствах, которое является трудно выполнимым условием, препятствующим реализации гражданином, находящимся в экстремальной ситуации (условиях угрожающих его жизни), права совершить завещание.
