In resolving boundary disputes in Ontario, there are two separate statutory regimes that can be utilized by municipalities (and others). Focusing on the context of municipalities and disputes in relating to the location of roads, this paper provides a comparative analysis of Ontario’s Boundaries Act and the long ignored municipal resurvey provisions in the Surveys Act. It is the writer’s thesis that in these circumstances, the Surveys Act provides for a more efficient and better cost recovery process for municipalities than the regime set out in the Boundaries Act.

The scope of this chapter is to examine the concept of financial sustainability in Catalan municipalities through two different perspectives: The first refers to the perspective of law as it is recorded in the relevant legislation. The second refers to the point of view of mayors and municipality executives who were called to implement the legislation in practice. For the purposes of the study, the relevant Spanish legal documents are analyzed. The reality in practice is captured through the analysis of official documents and semi-structured interviews and informal discussions with mayors and executives of Catalan municipalities. A gap appears to exist between existing legislation and the actual needs of municipalities, which ask for more flexibility and independence to act since the targets set by law are successfully met.

The Barrier-Free Basic Plan (BFBP) of Japan is based on Article 25 in the Act on the Promotion of Smooth Transportation, etc. of Elderly Persons, Disabled Persons, etc., abbreviated as the “Barrier-Free Act”. BFBPs are created by municipal governments and play a crucial role in progressing the accessibility of existing buildings/facilities in cities. However, the number of municipal governments which have their own BFBPs stands at only 304 out of a total of approximately 1700 municipalities in 2020. The purpose of this paper is to describe the barriers and difficulties that administrative officers face in creating and managing BFBPs. The questionnaires were distributed in 2018 to 183 municipal governments which have their own BFBPs. The procedures of analyzing the results were as follows: 1) motivation for creating their own BFBPs, 2) supportive advisers in proceeding with the creation of BFBPs, 3) difficulties of creating their own BFBPs, 4) key factors promoting the quality of BFBPs, and 5) self-evaluation of their own BFBPs. In conclusion, the challenges that administrative officers faced in creating BFBPs and the required measures to raise the quality of BFBPs on a practical level were discovered, by considering the population scales of municipalities and the establishment year of the BFBP. The continuous removing of obstacles in existing buildings based on BFBPs will allow for more comfortable and accessible cities for everyone.

The topic of the article is the application of in-house procurement by municipalities in municipal services management. The essence of in-house contracts, also known as direct contracts, is a specific relation between the contracting authority and the economic operator. The contracting authority, which is a body governed by public law, exercises control over the economic operator, which is legally separated from its structure, similarly to the control it exercises over its own departments. Moreover, the economic operator is obliged not only to submit to this control, but also to carry out a principal part of its activities for the controlling contracting authority. It was often argued in the literature that awarding services, supplies, or works to one’s own subsidiaries without following a tendering or design contest procedure may adversely affect certain economic sectors, in particular by reducing competition or deteriorating the quality of provided services. The aim of this publication is to answer the question so formulated. To do so, one has to examine how in-house contracts have been regulated in the act currently in force.

This chapter examines the extent of cyclical, seasonal, and casual unemployment from 1870 to 1914, and shows that reported unemployment rates greatly understate the probability of job loss faced by manual workers. It also reveals the public and private battles over relief for the unemployed. In the 1870s, cities abruptly curtailed granting outdoor relief to able-bodied males, and beginning in 1886 the Local Government Board encouraged municipalities to establish work relief projects during downturns. However, neither municipal relief projects nor the work relief established as a result of the 1905 Unemployed Workmen Act succeeded in assisting the temporarily unemployed—most of those employed on relief works were chronically underemployed laborers.

To understand how things have worked is the best preparation for looking ahead. So I will not gaze into a crystal ball but explain what is happening in England and Wales. I will, however, set out and discuss some scenarios for the future. In 1989 the water industry emerged from the nationalization era which it had entered only fifteen years earlier. It was a late entrant into the world of public corporations that had emerged between the wars, and particularly after 1945—a world that was a product of Fabian thinking and wartime experience. The Fabians provided the intellectual base for ‘gas and water socialism’ in the late nineteenth and early twentieth centuries. Two world wars encouraged people to believe that the state could manage our basic industries efficiently, and the inter-war depression drew attention to deficiencies in the working of the market economy. ‘Gas and water socialism’ started in the last quarter of the nineteenth century, in the municipalities, with gas, water, electricity, and tramways. In the inter-war years there was a movement towards regional, then national operations, culminating in the post-war Nationalization Acts. Consolidation in water followed slowly. The amalgamation of municipal undertakings into ten Regional Water Authorities did not take place until 1973. It brought a host of water and wastewater undertakings onto a river basin basis. A further step was taken in 1983 with the substitution of smaller, more executive boards for the much larger bodies that had included local authority representatives. The model for nationalization in the UK developed from the experience of Herbert Morrison, a key figure in the post-war Labour Government. It involved an arm’s-length relationship with government. By the 19705, the flaws in this model were evident. The boards of the nationalized industries were required to act in the social interest, subject to breaking even financially. The definition of the social interest was the responsibility of the boards, without any clear mechanisms for ministers to influence their decisions. It was never clear what ‘breaking-even’, ‘taking one year with the next’, meant in practice. Moreover, having delegated social functions to such a public not-for-profit body, ministers found it difficult to stay clear.

This chapter is the first of two to examine order at Osh bazaar in Bishkek, Kyrgyzstan. Told from the municipality’s perspective, this chapter retraces attempts to create order at the perceived “chaotic” bazaar through reconstruction, and locates the origins of contemporary disorder to power and property struggles that date back to bazaar’s enclosure, or privatization, in the 1990s. Officials justified bazaar reconstruction through legal discourses and the creation of a distinction between “legal” and “illegal” traders. Once branded as “illegal” the city could remove them, while also extolling the efforts of the “legal” ones.

The most important reason to decentralise the public services delivery is to make the citizens' needs better known by the local governments, so it follows to act more efficiently to their satisfaction. Nonetheless it has been found an opportunistic use of these agencies to avoid legal limits on indebtedness imposed on sub-national administrations, generating fiscal illusion. Accordingly, the aim of this study is to analyse the effect of the functional decentralisation processes on public revenues and financing. The results show that the use of decentralisation process, especially companies are created by left-wing political parties in order to raise more income from commercialization of public services. It was also found that these practices are strongly linked to the municipality's fiscal pressure.

This paper studies the effect of internal conflict on local fiscal capacity using evidence from Colombia’s political conflict in the mid-20th century, better known as La Violencia. Following a difference-in-differences strategy, I find that internal conflict has negative long-term consequences in local fiscal capacity.
