Abstract:
The important but little-known Article 4, paragraph 3 of the Treaty on the European Union (TEU) expresses the principle of Union Loyalty. This article includes the principle of sincere cooperation and the obligation for Member States to help and not hinder the Union. The broad wording of this principle and its apparent obviousness falsely suggest that it is of secondary importance. In practice, the principle of Union loyalty proved decisive in capturing the precise obligations of Member States, in particular where the Treaty itself offered no solution. Not for nothing, the principle of Union loyalty is considered to be one of the main principles of the EU Treaty in legal literature. After a brief analysis of the legal context and the general meaning of the principle of Union loyalty, this article intends to examine the impact of this principle in tax matters. Based on Article 4, paragraph 3, TEU, the ECJ developed numerous principles to ensure the effectiveness of European tax measures and to make sure that - in the exercise of their sovereign fiscal powers too - Member States do not put the full functioning of the Union at risk.

"The principle of finding the truth implies the obligation of the judicial authority to carry out an effective investigation, ex officio, as soon as the commission of a crime is brought to their attention. To ensure the fair and efficient nature of this investigation, finding out the truth must be related to two derived principles: the principle of freedom of evidence and the principle of procedural loyalty. Procedural loyalty was originally understood as an obligation of those who participate in the discovery of the truth in any way, regardless of the procedural position they have, to behave correctly, being forbidden to those who administer evidence to use incorrect procedures, tricks or stratagems. The current regulation configured the principle of loyalty in accordance with the jurisprudence of the European Court of Human Rights, establishes that there is a lack of loyalty if the judicial authority uses procedures inconsistent with the fundamental principles of the legal order in order to obtain evidence. Disloyalty evokes deception, artifice, promise, threat, all of which have the effect of reducing or suppressing free will, and ultimately distorting the truth that the judge must determine. The present study aims to analyze the principle of the loyalty from a double perspective, national and European, referring both to the scope of the principle and to its particular forms of manifestation, respectively: the prohibition of coercion in taking statements of the defendant and the prohibition of entrapment, regardless of whether they come from judicial bodies or individuals. In the final part of the article, an analysis of the sanctions that intervene in the case of the violation of procedural loyalty is carried out, both by referring to the solution proposed in the jurisprudence of the Constitutional Court, and to the need to retain the autonomous character of the sanction of the exclusion of illegally or unfairly administered evidence."

When militaries mention loyalty as a value they mean loyalty to colleagues and the organisation. Loyalty to principle, the type of loyalty that has a wider scope, plays hardly a role in the ethics of most armed forces. Where military codes, oaths and values are about the organisation and colleagues, medical ethics is about providing patient care impartially. Being subject to two diverging professional ethics can leave military medical personnel torn between the wish to act loyally towards colleagues, and the demands of a more outward looking ethic. This tension constitutes a test of integrity, not a moral dilemma.

The article presents the results of a comprehensive study aimed at identifying the features of forming the consumers’ loyalty of scientific and technical information. The scientific work is based on data collected through in-depth interviews among employees of the Department of Long-term Planning and Marketing Research of the All-Russian Institute of Scientific and Technical Information of the Russian Academy of Sciences, as well as analysis of registration questionnaires of clients used to access scientific and technical information. The existing strategies and practices of forming customer loyalty are considered in the context of ensuring effective access to scientific and technical information. The authors identify a number of key principles of work on the formation of consumer loyalty, based on the results of the study: the principle of transparency and trust; the principle of relevance; the principle of accessibility; the principle of personalization; the principle of interaction and feedback. The article presents various aspects affecting the formation of consumer loyalty. Attention is focused on such aspects as the quality of information, its relevance, accessibility and usability. Based on the identified aspects and their impact on the formation of loyalty, the authors have developed recommendations for improving strategies and practices of loyalty formation. The recommendations are intended for organizations generating and distributing scientific and technical information, aimed at strengthening their competitiveness in the information services market. The article identifies potential areas for further research, including a deeper analysis of the needs of specific categories of consumers, as well as the development of specialized methods for forming and maintaining the loyalty of various user groups.

AbstractThe need to fulfil treaty obligations in good faith bases both the principle ofpacta sunt servandaunder Article 26 of the Vienna Convention on the Law of Treaties and the principle of loyalty under Article 4(3) of the Treaty on European Union. This article seeks to understand the precise relationship between the two principles. It argues that the principles are different embodiments of the same root concept. In particular, it argues that loyalty is a more sophisticated and specific version of the concept, since it establishes that the relevant states and institutions must take account of each other's efforts to fulfill their obligations faithfully. While the Court of Justice of the European Union has observed the consequent need for greater flexibility when determining Member State liability, it has not done so consistently, especially in the context of EU external relations. Lastly, this article proposes that the presented conceptualization of loyalty andpacta sunt servandacould help us understand how other international subsystems might develop the basic concepts in general international law.

AbstractComparing the EU law principle of loyalty with international law good faith and the duty of federal good faith in German constitutional law (Bundestreue), this article contributes to the discussion on the nature of the EU legal order and its relationship to international law more generally by finding that EU loyalty is in essence a specific incarnation of the international law principle that treaties are to be interpreted in good faith. At the same time, it challenges the assumption that international law good faith differs fundamentally from federal good faith. To this end, the article points at historical links between both, and posits that good faith is in essence a principle of constructive interpretation, the strictures of which increase with the level of integration of the legal order in which it is applied.

on the formation of commitment and loyalty among the staff, and compare different styles of personnel management and determine the most effective.
 Methodology:The methodological basis of the study was formed by the following principles: the principle of internal and external determination unity, the principle of consciousness and activity unity, the principle of systemic nature, the principle of objectivity, the principle of qualitative and quantitative approach in the process of data analysis, the principle of validity. Statistical processing of data included analysis of the significance of differences using the analysis of variance, the determination of correlation relationships between certain indicators. The correlation was performed with Pearson and Spearman coefficients. Statistical processing was carried out with the software package of SPSS 16.0.
 Main Findings: The staff is a valuable resource for the organization. And for a long time already it is known, that effective work of employees raises competitiveness and profitableness of the organization. Therefore, the management of personnel, as well as the formation of commitment and loyalty is becoming a top priority. In the course of our study, we studied the factors that affect the formation of commitment and loyalty of employees. We determined that under the current conditions of doing business in Ukraine, the level of loyalty and corporate culture depends on the management style and other factors that affect their level: 1) If the manager is oriented toward production goals, without taking into account the "personal factor", the level of organizational loyalty of subordinate employees is reduced. The highest level of development of communications between workers in the company raises the level of their loyalty. 2) Democratic leadership style increases the level of loyalty, corporate culture, and job satisfaction, and the authoritarian style of leadership leads to their reduction. 3) The presence of diverse tasks that meet the characteristics of workers and positive relationships with colleagues increase the level of loyalty and employee satisfaction. 4) The severity of such tendencies as "trustfulness- tameness -dependence" and "responsiveness-unselfishness-sacrifice" in the manager increases the level of loyalty of subordinates. Taking into account such factors by management as a mode of work, the diversity of work, independence in work, the correspondence of work to abilities, the possibility of advancement, the level of work organization, relations with colleagues, technical equipment, employee satisfaction with his labor can increase the level of corporate culture and its components.
 Applications of this study: The study could be useful for HR-specialists, managers, psychologists, and employees in different spheres. 
 Novelty/Originality of this study: Undoubtedly, loyalty plays an important role in the success of the organization. The level of employees’ loyalty, as well as their attitudes and labor values, largely determine the degree of staff's susceptibility to both external (salary, benefits, working conditions, etc.) and internal (the content of the work performed, the opportunities for professional growth, recognition, and evaluation of achievements) incentives.

Section 1 identifies the major features of the principle of loyalty – also known today as principle of sincere cooperation – and briefly illustrates the role that the principle plays in the EU legal order. After having stressed the multifaceted nature of the concept of solidarity in the EU legal order, Section 2 discusses the possible interactions this concept may have with loyalty in securing the constitutional framework of the Union. Section 3 traces the ways in which loyalty and solidarity may interact in crisis scenarios. The major findings of the analysis are summarized in Section 5.

Islamic banks as intermediary institutions shall maintain and comply with sharia principles so that in carrying out their business, they will continue to gain trust from the community, especially during the Covid-19 pandemic. The principle that is highly fundamental for the existence of an industry including sharia banks is fiduciary principle. The purpose of this study was to examine the implementation of the fiduciary principle in maintaining customer loyalty amid the Covid-19 pandemic. The research method used in this study was descriptive analysis. The type of data used was secondary data, namely in the form of articles, magazines, research journals, books, and other sources relevant to this study. The data collection technique used was documentation technique. The results of the study showed that the trust given to customers by sharia banks can increase customer loyalty in conducting various transactions. In addition, various efforts also needed to be made by sharia banks in order to maintain customer loyalty in the midst of the current pandemic by improving service quality and maintaining customer perceptions regarding the image of the bank. Therefore, sharia banks must uphold this fiduciary principle in order to prevent banking risks that may occur amidst the COVID-19 pandemic.

Rule of law requires a clear distribution of competences for the State institutions. Competence distribution is essential for separation of powers and hinders an antidemocratic accumulation of powers. The attribution of competences to State institutions by the Constitution regulates the reach, modality and procedure of the exercise of the competence. However, competences must be exercised in a way which is not detrimental to other institutions and the State as a whole. The inter-institutional obligation of mutual loyalty is a written or unwritten principle with high importance in European constitutionalism. The contribution treats with significant examples of this principle, as the “Organtreue” in the perspective of the German Federal Constitutional Court or the faithful cooperation principle in federal and regional systems. General aspects shall be pointed out which determine loyalty as a constitutional category.

The passage of the Emancipation Act in 1829 presented an opportunity for Catholics to reimagine their loyalty as equal subjects for the first time under the union between Great Britain and Ireland. This article explores the way Catholic loyalty was conceived in the decades that followed the act of 1829 through to the mid 1870s, when there was renewed focus on the civil allegiance of Catholics following the declaration of Papal infallibility. Historians are increasingly exploring a range of social, political and religious identities in nineteenth century Ireland, beyond the rigid binary paradigm of Catholic nationalisms and Protestant loyalisms that has dominated Irish historiography. However, Catholic loyalty in particular remains an anachronism and lacks sufficient conceptual clarity. Our understanding of a specifically Catholic variant of loyalty and its public and associational expression, beyond a number of biographical studies of relatively unique individuals, remains limited. By providing an exposition of episodes in the history of Catholic loyalty in the early and mid-Victorian years this article illuminates the phenomenon. It demonstrates that Irish Catholic loyalty took on different expressive forms, which were dependent on the individuals proclaiming their loyalty, their relationship to the objects of their loyalty, and its reception by the British state and Protestant establishment.

Resumen:El presente estudio se enmarca en la problemática de la vigencia y eficacia de la Constitución de 1978 a partir de la configuración dogmática del principio de lealtad. Se parte para ello de un dato relevante: la lealtad no encuentra un acomodo específico en el texto de nuestra Carta Magna, aunque ha sido elaborado doctrinal y jurisprudencialmente en otros sectores del ordenamiento, en otros niveles de gobierno y en el derecho comparado. Sin embargo, su vigencia es evidente e incluso necesaria a la luz de la evolución de nuestro sistema constitucional, sin que este ámbito de estudio haya recibido un análisis detenido por la doctrina. La lealtad se conecta, por ello con un triple postulado: el principio democrático, la supremacía constitucional en perspectiva multinivel, y la doble dimensión formal/material de la Constitución; pero sobre todo confronta y conjuga la necesaria compatibilidad del derecho con la política, y de la ley con la democracia. Desde estas premisas el presente trabajo analiza el origen y evolución del principio, y su fundamento y justificación, para con posterioridad abordar la proyección de la lealtad hacia el ordenamiento, hacia la configuración del poder, y hacia el constitucionalismo multinivel.Abstract:The analysis carried out in this paper addresses the problematic issue of the validity and effectiveness of the 1978 Constitution, on the basis of a dogmatic approach to the loyalty principle. The paper starts with the relevant fact that loyalty cannot be expressly found in the constitutional text of the Spanish Magna Carta, albeit case-law and scholars have developed said concept in other areas of the legal order, for other levels of government and in Comparative Law. Nevertheless, its validity is not only apparent but necessary in light of the evolution of our constitutional system, and yet, this issue has not been thoroughly examined by the legal doctrine. Hence, loyalty is argued to be based on three tenets: the democratic principle, constitutional supremacy from a multi-level perspective, and the twofold formal/material dimension of the Constitution. Above all, the loyalty principle confronts and brings together the much needed compatibility between Law and Politics in addition to that between Law and Democracy. On this basis, the present paper explores not only the origin and evolution of the loyalty principle, but also its basis and rationale, so as to address its role in the legal order and in the context of the configuration of power and of multi-level constitutionalism. Abstract:
English common law jurists in the Middle Ages and early modern times viewed loyalty exclusively as a phenomenon based on a deeply personalized connection between a vassal and his primary lord-king. It was in this form that the idea of loyalty reflected the traditional feudal principle demonstrating the connection of loyalty and its main attribute, fidelity, with the so-called cause of the king. Despite its ubiquity and related practices, this understanding of loyalty to some extent competed with the gaining popularity view of the applicability of the principle of loyalty and related behavioral stereotypes to such concepts as kingship and the community of the kingdom, including their territorial dimension. The article deals separately with the phenomenon of so-called dual loyalty, the origins of which are linked to the so-called right of fiefs and the practice of subfeudation. This form of loyalty and related subjection allowed for the simultaneous association of a person with two monarchs, as well as the practice of land ownership in two contiguous kingdoms. The author examines how such a form of loyalty was positioned in the right-wing literature of the 15th — 17th centuries, emphasizes the legitimate nature of this phenomenon, and considers the cases that led to its termination.

Quality is a guarantee for the existence of a business, even quality is the main requirement in long-term strategic planning. The reason is, quality or quality is the value that consumers need, and in return, consumers will always buy the product or service being sold. In principle, this research focuses on the study of product quality which has implications for loyalty with satisfaction as an intervening. The scientific method used in describing, interpreting, and drawing conclusions is based on quantitative. The analysis technique uses multiple linear regression statistics, which in its operation uses data from the distribution of questionnaires. Sampling was done at simple random to 97 consumers of PT. Kobe Main Cuisine. The results of the study explain that the quality of a product affects consumers' emotions, which then results in feelings of pleasure or satisfaction, from these positive feelings, an experience is built that directs consumers to always make repeated purchases. <p>The implementation of Good Corporate Governance (GCG) principles in the management of zakat institutions is one of the strategic efforts to increase muzaki loyalty. GCG, which includes the principles of transparency, accountability, responsibility, independence, and fairness, is an important foundation in the management of professional and trustworthy zakat institutions. This study aims to analyze the implementation of GCG and its impact on the level of muzaki loyalty in LAZ DPU East Kalimantan. Using qualitative research methods, data were collected through observation, interviews, and documentation. The results of the study indicate that LAZ DPU has implemented GCG on the principle of transparency in periodic reports, and institutional governance. Accountability is implemented through legal accountability, bookkeeping and recording, and duties and responsibilities. Performance and programs are also recognized in reports and audits. Independence is implemented to maintain integrity and neutrality in distribution, as well as fairness in service. The consistent and optimal implementation of GCG in LAZ DPU East Kalimantan has a positive impact on muzaki loyalty. Increasing trust and positive perceptions of muzaki towards transparent and accountable zakat management are the main factors influencing their loyalty.</p>

The article notes that the loyalty of the staff is of great interest in science. The interest in loyalty is just as high among the management of organizations, which is not due to the simple socio-economic conditions in which Russian business finds itself. Great interest in loyalty also opens up a research problem: loyalty programs developed at enterprises do not always ensure that loyalty is maintained at the proper level. This article is devoted to the resolution of this problem. In it, the author proposes a set of tools for regulating the loyalty of personnel in an organization. Tools by themselves do not have a regulatory effect on loyalty. In order for the tools to start functioning, a structure is needed that uses them. As such a structure, usually, there are divisions of personnel management services, sometimes, such a structure may be a trade union loyal to the organization. The main mission of the structure that regulates the loyalty of personnel is the implementation of the principle: to serve one’s company with interest. Such a principle is unlikely to ever be fully realized. But this is a very important social landmark of the company, to which it is necessary to set the employees. At the same time, like any social landmark, it is effective as long as the individual associates his personal success with it. The success of an organization’s loyalty programs depends to a large extent on the valid use of loyalty tools by the structures designed in organizations to regulate loyalty. The validity of loyalty instruments depends on how much they correspond to the goals of the company and the conditions for the implementation of this company’s business.

Virtue of loyalty represents one of the core virtues in democratic systems, as it enables the will of citizens to be implemented via decisions of elected government. Expertise represents a necessary attribute of every successful state apparatus, and it is an inevitable ingredient of all progress. This paper aims to explain the dynamic relationship between expertise and loyalty of non-elected personnel in democratic societies, with the focus on developing democracies, like the Serbian democracy. Neglection of loyalty to the legitimately elected government in favor of expertise undermines the core principles of democracy and drives a society into a sort of ?expert oligarchy?, in which there is no equality, and the will of the majority is ignored by the expert elite. On the other hand, neglection of expertise of appointed personnel in favor of their loyalty, as seen in the so-called spoils systems, is a recipe for a disaster and erosion of the entire society, as it places the state in the hands of ignorant laymen who can only offer unlimited loyalty. It is necessary to establish a minimum of expertise and loyalty of appointed, non-elected, personnel in democracies in order to create optimal conditions for progress. Inability to respect the principle of minimal expertise when appointing personnel in state apparatus suggests faulty policy and unfoundedness of policy of legitimately elected government.

Honesty, loyalty and reasonableness together refer to the principle of good faith in contemporary private law. The principle of good faith historically emerged as a natural law principle deriving from Roman law of nations, the universal set of rules applicable for all mankind. However, it also has immense historical effects on the early modern theories of international law. Being based on natural law and morality, good faith is well-equipped to be a fundamental standard of behavior in contemporary international law concerns. Good faith manifests itself as pacta sunt servanda as the basis of international treaty law. As a principle referring to honesty, loyalty and reasonableness, it guarantees the prohibition of the abuse of power and provides equitable solutions in legal relationships between sovereigns and private actors. Accordingly this article examines the application of the classical Roman principle of good faith in international law from a transhistorical perspective to clarify its contemporary applications, taking refugee law as an example. Introduction: Community productivity is critical in maintaining quality of life to avoid disasters. The use of digital technology in the economic aspect has also provided opportunities for people far from the market to earn income to meet their living needs. Objective: This quantitative study aimed to explore the impact of halal labeling, price, and product quality on consumer loyalty toward Indonesian skincare products among Muslim consumers in the Jabodetabek area. Specifically, it examines the mediating role of perceived value in these relationships. Method: Primary data were collected through a questionnaire distributed to 115 Muslim respondents who used Indonesian skincare products from Jabodetabek. The study employed random sampling was used for the participant selection. For data analysis, Structural Equation Modeling (SEM) using Partial Least Squares (PLS) was used to assess both the direct and indirect effects of the variables. Result: This finding revealed that labeling and price do not directly affect consumer loyalty. At the same time, product quality and perceived value do, with the latter being positively influenced by price and product quality. The study also concludes that perceived value is a crucial driver of consumer loyalty, emphasizing that companies should focus on enhancing product quality and perceived value to strengthen consumer loyalty while recognizing that halal labeling, although important in principle, does not directly impact consumer loyalty or perceived value. Implication: The findings suggest that product quality and perceived value are critical drivers of consumer loyalty for skincare products targeting Muslim consumers in Jabodetabeky. Halal labeling, while necessary in principle, does not directly influence loyalty or perceived value. Companies should prioritize enhancing product quality and delivering perceived value to strengthen consumer loyalty while considering competitive pricing strategies that enhance perceived value.

The requirements of modern procedural law require reflection on the necessary respect for the duty of loyalty in matters of forced execution and procedural solidarity. In this regard, we note that non-observance of the duty of loyalty and the principle of proportionality by the parties and the actors of the forced execution is penalised. Since the principle of procedural fairness tends to acquire autonomous importance, disloyalty must be penalised, wherever it comes from. The prohibition of abusive and unjustified measures is part of this, for example. However, there are a number of burdens which hamper the observance of the duty of loyalty and the effectiveness of procedural solidarity, in particular the upsurge in abusive measures and the excess of zeal of certain actors of forced execution. Therefore, legislative reform accompanied by a real change of mentality is necessary. The aim is to view forced execution not as a test of strength, but as a shared undertaking in which solidarity prevails between the parties. Clearly, better a bad negotiated execution than a difficult, long and costly forced execution.

It is feared that high competition and online transportation customer anxiety will reduce Gojek's customer loyalty. Customer satisfaction is an important element that can form customer loyalty. This study aims to examine the effect of trust on satisfaction and its effect on customer loyalty. Collecting research data using a questionnaire with a total sample of 150 respondents. Analysis of research data was carried out using SmartPLS version 3 software. The results showed that trust had a positive effect on satisfaction and loyalty, satisfaction had a positive effect on loyalty, and trust had a positive effect on loyalty, with satisfaction as a mediating variable.

The purpose of this study was to identify characteristics of traditional nursing in Chosun Dynasty. Various health care activities introduced in the classic works have been examined for the identification of major characteristics of nursing in traditional society. A study of the classical works revealed the following aspects of nursing care were evident : environment, diet, exercise, bedside care, medication and fetal discipline. In their treatment, it became clear that the most salient feature of traditional nursing in Chosun dynasty is the humanistic nature of care. Another distinctive feature of traditional nursing is its notion of empathic care.Loyalty is another key principle of traditional nurs ing in Chosun dynasty. However, the empathic principle was always practiced in keeping with the principle of loyalty. The principle of mean and confirmity with nature appear to have been a basic guideline for nursing practices in traditional society.Some nursing activities in traditional society are shamanistic, particularly the prayers offered for the recovery of a family member's illness and the protection of all family members from evil spirits.These shamanistic rituals imply considerable measures of empathy, loyalty, and filial piety according to Confucian tenets.

Checking the validity of the data used is the extension of participation, observation persistence, and triangulation. The result of this research is PT. The Bumiputera Sharia Life Insurance, Kediri Branch, provides services using a family approach strategy, where the approach taken is to maintain closeness with customers. When viewed from the five service indicators, namely reliability, responsiveness, assurance, empathy and physical evidence, then the four indicators have been implemented. However, in terms of physical evidence indicators, there are still deficiencies that are not appropriate, namely in the buildings and facilities provided. Implementation of sharia management at PT. Bumiputera Sharia Life Insurance, Kediri Branch, adheres to the principle of justice, namely the family approach. Then for the communicative principle lies in the application of speaking, listening, and looking culture. In the context of law, the understanding of principles is identified with moral values. The article explores the concept of loyalty in the philosophy of Josiah Royce, focusing on its potential understanding and application in its original meaning as formulated by the author within moral philosophy and corporate ethics. M e t h o d s . The research is based on an analysis of Josiah Royce's work "The Philosophy of Loyalty" (1908) and a brief review of critical literature on this subject. It examines the connection of loyalty with moral autonomy, duty, and individual self-expression in Royce's philosophy of loyalty. R e s u l t s . Loyalty, as understood by Josiah Royce, is defined as an ethical principle involving voluntary and devoted service to a cause that transcends personal interests while avoiding fanaticism or blind submission. Josiah Royce seeks to detach this concept from its traditional associations in "The Philosophy of Loyalty". The study demonstrates how Josiah Royce attempts to restore the old meaning of loyalty, distinguishing it from synonymous terms such as "faithfulness", "devotion", or "allegiance", which are often narrowly linked with loyalty to a sovereign. C o n c l u s i o n s . It is established that in "The Philosophy of Loyalty", Josiah Royce sought to restore the original meaning of loyalty, which extends far beyond its synonymous association with devotion in the context of patriotism, service, or sacrifice. Loyalty can be manifested in various forms, including patriotic, religious, and professional form. Loyalty plays a decisive role in moral development, helping individuals identify their duty and define themselves both as unique individuals and as members of a community united by a shared cause. Josiah Royce aimed to counter prevailing trends of individualism: loyalty and individual autonomy are not opposites, they are complementary categories, and loyalty fosters individuality by ensuring harmony between the personal and the social.

This duty intensifies in relationships based on cooperation and broadly understood intermediation, which is characterised by decision-making freedom of the ordering party before the conclusion of the contract with a contractor specified by the intermediary and independence of the insurance broker’s activities. The formula is based on a significant risk and trust at the same time. Firstly, insurance brokers do not know whether the presented offer will satisfy insurance seekers and, secondly, they cannot be sure if their offer will be finally accepted. Therefore, on the one hand, the duty of loyalty requires the intermediaries to provide extensive information about all the circumstances of the potential transaction, and, on the other hand, the same duty burdens the insurance customers with the obligation to confirm the actual situation caused by the insurance broker, in which the intended goal has been achieved. All in all, the intermediary’s purpose can only be accomplished with the participation of the insurance seeker. The aim of the article is to develop the model for the proper implementation of the tripartite obligation relationship, consisting of the entity seeking insurance cover, insurance intermediary and insurer.

Nord's functionalist methodology is based on two cornerstones: function plus loyalty. Function refers to the factors that make a target text works in the intended way in the target situation. Loyalty refers to the interpersonal relationship between the initiator, the target-text addressees, the source-text sender and the translator. War movies are one of the common movie types, but translating their subtitles is more complicated than translating other kinds of movie subtitles. This paper analyzes the characteristics of the war movies, and discusses the different translation methods of the war movie subtitles under the guidance of the principle of function plus loyalty, in order to improve the quality of the Chinese subtitle translation of the war movies and the audience's acceptance.

Integrated and sustainable decision-making, which requires directors of corporations to take into account environmental, social and economic issues into their decision process, is the “keystone” of the legal principles of corporate social responsibility. A voluntary form of the principle of integrated and sustainable decision-making is part of Canadian corporate law since the enlargement of corporate directors’ duties of loyalty in the BCE decision. Although socio-legal literature has shown that voluntary principles may have a real regulatory impact, the effectiveness of a voluntary principle of integrated decision-making in furthering social and economic issues has still not been assessed. This article will argue that in order to determine the potential of integrated decision-making in ensuring greater corporate social responsibility, it is necessary to study the legal, social and market-based control mechanisms by which integrated decision-making is implemented. To what extent do these control mechanisms enforce the principle of integrated decision-making, given the unequal access of stakeholders to these control mechanisms and the competing norms of shareholder primacy and share value maximization they carry? We find that while each of the regulatory mechanisms could be used to implement the principle of integrated decision-making, no mechanism alone is sufficient to ensure that social responsibility will trump financial considerations if a choice has to be made. The analysis concludes on the regulatory courses of action that could be taken to strengthen the principle of sustainable and integrated decision-making.

This investigation aims to analyze the impact of the joint liability model on the sharia cooperatives’ performance in Indonesia. The respondents are several group lending members of sharia cooperatives in Java, the center of sharia cooperatives in Indonesia. This study utilized the purposive sampling method to select samples conducted in April 2021. Data collection was carried out by distributing online and offline questionnaires to several sharia cooperatives utilizing the joint liability model. Data from 98 respondents were further analyzed by PLS-SEM analysis. The results unveiled that joint liability, which was influenced by indicators of trusts, norms, and networks, had a positive and significant effect on sharia cooperatives’ performance as measured by members’ satisfaction and loyalty. Thus, sharia cooperatives can take advantage of and maintain the joint liability model based on trusts, norms, and networks. The rationale is that the joint liability application has followed cooperative principles: the principle of kinship and cooperation. In addition, such a model has proven to increase the loyalty and satisfaction of sharia cooperative members.

Abstract:
Modern philosophy of law defines the principles (foundations) of law as the initial conditions of law, the determinants of its content, on which law relies and which constitute its foundation. At the same time, most European countries use ancient Roman legal formulas in their modern legal systems, which evolved into maxims and became the basis of modern positive law in the form of principles. The establishment of general legal principles, concepts/ constructions is reflected in the legislation, doctrines and case law of most countries. In this article, we focused on the values and concepts formulated in the 1930s by the novelist and legal historian F. Schultz, including the principle of isolation/abstraction, the principle of simplicity and tradition, the principles of freedom and authority, the principle of humanity, the principle of loyalty/ good faith, the principle of security, and some others. These principles continue to be researched by Ukrainian and foreign scholars who supplement this list and study their impact on the legal systems of Ukraine and other countries.
 We emphasize that the principles were not formulated by Roman lawyers, for example, in the preamble to their own works or in a separate law or legal document. Roman law was casuistic, it mainly consisted of decisions made in individual cases. This is related to the peculiarities of legal argumentation in ancient Rome, which had a dual nature. On the one hand, they were determined by the rules of law, and on the other hand, they reflected a system of filling gaps in legal relations by applying the principles of law and the oratory techniques of lawyers of that time.
 Modern legal scholarship has tried to find and argue for the existence of general principles of Roman law development as a basis for making specific decisions, or because Roman lawyers sometimes used certain terms and concepts on which their decisions were based.

The main purpose of Feng Menglong's creation of "Sanyan" (Three Collections of Short Stories) is to educate the general public. He adopted the principle of correspondence in the arrangement of the stories, that is, the titles of every two volumes form an antithetical couplet, and the contents complement and echo each other. Among them, Chapter 15 and Chapter 16 of Jing Shi Tong Yan (Stories to Warn the World) complement and echo each other, jointly expressing the theme of "sincerity and loyalty". In the aspect of realm, "sincerity and loyalty" is manifested as "stillness in the absence of movement and existence in movement", and in the aspect of content, it is manifested as "faithfulness and loyalty" and "filial piety and loyalty". These two aspects jointly construct the core ethical and moral values and code of conduct of the general public. In addition, "The Little Lady Gives Money to the Young Man" and Jin Ping Mei are in the same cultural environment and synchronic discourse space, and there are phenomena of mutual intersection and penetration in the texts, showing intertextuality.

Moral foundations theory proposes that individuals with conflicting political views base their behavior on different principles chosen from a small group of universal moral foundations. This study proposes using a set of widely accepted moral foundations (fairness, in-group loyalty, authority, and purity) as proxies to determine the degree of radicalization of online communities. A fifth principle, care, is generally surpassed by others that are higher in the radicalized groups’ moral hierarchy. Moreover, the presented data-driven methodological framework proposes an alternative way to measure whether a community complies with a certain moral principle or foundation: not evaluating its speech, but its behavior through the interactions of its individuals, establishing a bridge between the structural features of the interaction network and the intensity of communities’ radicalization regarding the considered moral foundations. Two foundations were assessed using the network’s structural characteristics: in-group loyalty measured by group-level modularity, and authority evaluated using group domination, for detecting potential hierarchical substructures within the network. By analyzing a set of Pareto-optimal groups regarding a multidimensional moral relevance scale, the most radicalized communities were identified among those considered extreme in some of their attitudes or views. An application of the proposed framework is illustrated using real-world datasets. The radicalized communities’ behavior exhibited increasing isolation, and their authorities and leaders showed growing domination over their audience. Differences were also detected between users’ behavior and speech, showing that individuals tended to share more “extreme” in-group content than they publish: extreme views get more likes on social media.
