Abstract:
The article examines the factors that ensure the constitutional provision of the rule of law in the system of public authorities. The aim of this study was to analyse the factors that ensure the constitutional provision of the rule of law in the system of public authorities. The constitutional design provides for the creation of rational structures for the functioning of public authorities, which should ensure democratic standards, economic development, anti-corruption policy by implementing the principles of the rule of law. The study used data on indicators that describe the state of the rule of law (Rule of Law Index), democracy (Democracy Index) and corruption (Corruption Perceptions Index). Methods of graphical comparison, scattering diagrams, classification of countries by categories were used. A graphical model of the dependence of the rule of law on the development of democracy and perceptions of corruption for 25 European countries is built on the basis of these factors. It is proved that the studied indicators are dependent: countries with a high Rule of Law Index (high level of restrictions on the powers of government institutions, protection of fundamental rights, law enforcement, security) have a high Corruption Perceptions Index (high level of anti-corruption) and Democracy Index. It is concluded that it is necessary to develop the constitutional provision of the rule of law by strengthening democratic values, improving economic growth and competitiveness, increasing control over corruption. Further research should analyse the impact of rule of law factors in low- and middle-income countries.

AbstractThe Rule of Law is considered a major aspect of modern governance. For every legal system, it is important whether the Rule of Law is attained and how far it has been attained. Though there are various indicators and indexes of the Rule of Law they all have their limitations. This paper reported a study conducted in Hong Kong in 2005, combining qualitative and quantitative methodologies, to assess the level of attainment of the Rule of Law in Hong Kong. It is found that the level of attainment is high but a downward trend is also discovered. A main objective of developing this new methodology in assessing Rule of Law, is that it could be used for tracking the development of the Rule of Law in a particular legal system and facilitating comparison between legal systems.

Constructing an assessment index system of law-based governance of a city provides a data basis and an empirical basis for China’s urban construction of the rule of law and highlights its characteristics in the era of big data. A thorough understanding of the theory of the rule of law is required in order to establish this index system. The establishment of the index system needs to be based on a deep understanding of the theory of the rule of law. In particular, it is important to understand the relationship between the core content of the rule of law and the law-based governance of a city, and then to determine the connotation of law-based governance of a city. This serves as the starting point for constructing the index system. At the same time, it is necessary to have a solid grasp of the index theory, adhere to the method of index setting, break down the concept of law-based governance of a city into different levels of indicators according to the types and attributes of the indicators and continue to visualize and operationalize them until the content can be measured. As a whole, this forms a complete assessment index system. Of course, the content of the index system is not fixed and needs to be constantly tested and adjusted in practice.

Abstract:
Based on Beer's law, it is assumed that the absorbance of a mixture is that of the neat materials weighted by their relative amounts (linear mixing rule). In this contribution, we show that this is an assumption that holds only under various approximations for which no change of the chemical interactions is just one among several. To understand these approximations, which lead incrementally to different well known mixing rules, we finally derive the linear mixing rule from the Lorentz–Lorenz relation, with the first approximation that the local electric field is correctly described in this relation. Further levels of approximation are that the local field equals the applied field (Newton–Laplace mixing rule) and that the change of the index of refraction and, equivalently, absorption is weak (Gladstone–Dale/Arago–Biot mixing rule). Even then the linear mixing rule is only strictly valid if the indices of refraction in the transparency region at higher frequency than the absorption have the same value and the mixing is homogeneous relative to the resolving power of the light (“micro-homogeneous”). Under these preconditions, linear mixing of the individual absorbances is established. We illustrate the spectral differences between the different mixing rules, all of which are based on volume and not on mass fractions, with examples. For micro-heterogeneous samples, a different linear mixing rule governs the optical properties, which refers to the experimental quantities, reflectance, and transmittance. As a result, for such samples, mixtures of already comparably high content give only weak signals due to band flattening, which are hard to distinguish from baseline effects.

AbstractIn this Article we argue that rule of law indices are a powerful tool to detect ills in the rule of law of EU Member States. In order to explain how to improve the indices’ potential, we give a critical overview of the methodological issues of the four rule of law indices which we consider particularly instructive for our purpose. These are the indices provided by the Freedom House (“Freedom in the World,” FIW), the Bertelsmann Stiftung (“Bertelsmann Transformation Index,” BTI), the World Bank (“Worldwide Governance Indicators,” WGI), and the World Justice Project (“Rule of Law Index,” WJP RLI). After analyzing the strengths and weaknesses of these indices, we turn to the EU Justice Scoreboard (EUJS). While the introduction of the EUJS in 2013 has already been an important step in order to lay the ground for an EU-wide analysis, in this Article we suggest how the EUJS should be further developed into a proper rule of law index by aggregating expert opinions into a single number. This would make the EUJS a significantly more useful tool in the ongoing EU rule of law crisis.

Abstract:
Economists have studied the psychology of crime and how individuals react to changes in the economy. One basic idea is laws are enacted to lower down crime rates and discourage potential offenders from committing crimes. This research analyses how the effect of rule of law on crime index variates in countries with different unemployment rates. The paper uses a cross-country analysis of high, moderate and low unemployment rate countries to examine the relation between rule of law and crime index. Further, we see how migration and unemployment rate affects crime index. This paper investigates how the effect variates in different countries and if the variables have a negative, null or positive effect on levels of crime. In this paper, we examine and clarify the relationship between rule of law, migration, unemployment rates and crime index over the period 2012–2020 by developing a model that depicts the structural effect of these variables on the crime index of a country using panel data regression. Through this research, we find that the rule of law has a negative impact on the crime index. Further, we find that migration and unemployment have a positive impact on the crime index.

The paper addresses the statutory and judge-made general anti-avoidance rules in these jurisdictions and deals with the core concept of avoidance an on how these eight jurisdictions either frustrate avoidance or allow it.<br>Este artículo compara la norma anti-elusiva general de la ley del impuesto a la renta con la doctrina del abuso de derecho del Civil Law(Nt 1) (Rechtsmissbrauch, abus de droit) en ocho jurisdicciones: Alemania, Croacia, Nueva Zelanda, Australia, Francia, la Unión Europea, los Estados Unidos y el Reino Unido. El artículo se ocupa de las normas anti-elusivas generales legislativas y jurisprudenciales en estas jurisdicciones y aborda el concepto central de la elusión. In late 2007, President of Mexico Felipe Calderon Hinojosa implemented a policy of direct confrontation with crime organizations, this decision generated a climate of widespread insecurity and increased high-impact crimes such as arbitrary executions, torture and forced disappearan- ces. In this context of violence some groups of society hired paramilitaries in San Pedro Garza García, Nuevo León and created self-defenses in some cities of Michoacán to protect their rights. This problem exhibited the incapacity of the State to provide public security and the situation of some territories formally under the rule of law but materially controlled by the organized crime.<br>A finales de 2007, el presidente de México, Felipe Calderón Hinojosa, implementó una política de confrontación directa con la delincuencia organizada. Esta decisión propició un clima de inseguridad generalizada y se incrementaron los delitos de alto impacto como las ejecuciones arbitrarias, la tortura y la desaparición forzada. En este contexto de violencia, algunos grupos de la sociedad recurrieron a la seguridad privada a través de la contratación de paramilitares en San Pedro Garza García, en Nuevo León, y la formación de autodefensas en algunos municipios de Michoacán.  Este problema exhibió la incapacidad del Estado para proveer seguridad pública y la situación de algunos territorios que formalmente estaban gobernados por los poderes constituidos, pero materialmente estaban subyugados en un orden normativo paralelo contrario a laconstitución y, en algunas ocasiones, controlados totalmente por el crimen organizado.

Abstract:
Can the reflection of legal scholars concerning the rule of law be enriched by the cultural conception of Freud about law? This article develops this question, based on how the rule of law was conceived in modernity, from a reading of the work of Hume and Rousseau, in order to show the potential compatibility that this conception had with the later work of Freud. Thus, Freud’s thinking about law is presented as a dialectical or paradoxical civilizatory force, restraining the passions even though they drive it, from a reading of his work Totem and Taboo. In this reconstruction, the genealogy of law is portrayed, from his story of the primal horde, and unconscious dynamics behind the law itself. Then the uses that various legal scholars have made of Freud in writing about the rule of law are analyzed, criticizing how they neglect the tragic sentiment of the Freudian cultural vision regarding law. Finally, the article states that the notions developed by Freud can serve critical legal thinking only if the law is seen as part of the culture, which leads to consider legal studies as a form of cultural studies.<br>¿La reflexión de los juristas sobre el gobierno del derecho puede ser enriquecida con la concepción cultural de Freud sobre el derecho? El presente artículo desarrolla esta interrogante, partiendo de cómo en la modernidad se concibió al gobierno del derecho, desde una lectura a los trabajos de Hume y Rousseau, para así mostrar la potencial compatibilidad que esta concepción tenía con la posterior obra de Freud. De este modo, se presenta el pensamiento de Freud sobre el derecho como una fuerza civilizadora dialéctica o paradójica que restringe las pasiones a pesar de que ellas lo conduzcan, desde una lectura de su obra Tótem y tabú. En esta reconstrucción se retrata la genealogía del derecho, desde su relato de la horda primitiva, y las dinámicas inconscientes que están detrás del derecho mismo. Después, se analiza los usos que le han dado a Freud diversos académicos del campo jurídico que han escrito sobre el gobierno del derecho, criticando como estos han dejado de lado el elemento trágico de la visión cultural freudiana sobre el derecho. Por último, el artículo plantea que las nociones desarrollados por Freud pueden servir al pensamiento jurídico crítico solo si el derecho es visto como parte de la cultura, lo que conlleva ver a los estudios jurídicos como una forma de estudios culturales.

Political science literature has focused itself mostly on the «pro-democracy» role of political parties, identifying them as essential instruments for representation. We agree, but we believe this is not the only aspect to focus on. Democratic parties do not only achieve power through regular elections, but they also aspire to rule within a democratic regime. In that sense, the functioning of political parties can be analyzed not only in terms of their contribution to electoral competition. In order to fulfill their democratic functions, parties need a strong constitutional order that allows them to provide two goods: the achievement of power through legalways and good governance within the Rule of Law.<br>Por lo general, la literatura sobre los partidos políticos en ciencia política se ha centrado en su rol «pro-democrático», identificándolos como instrumentos esenciales para la representación. Estamos de acuerdo, pero insistimos en matizar el tema dado lo siguiente: Los partidos democráticos no solo conquistan el poder mediante elecciones regulares, sino que también aspiran a gobernar dentro de un régimen democrático. Por tanto, el funcionamiento de los partidos polí- ticos puede ser analizado no solamente en términos de su aporte a la competencia electoral. Para cumplir sus funciones democráticas, los partidos necesitan un orden constitucional fuerte que les permita proveer dos bienes: la conquista legal del poder y el buen gobierno dentro del Estado de derecho. En el presente documento proponemos esta agenda de investigación y revisamos sus componentes a la luz del caso peruano post-Fujimori y las organizaciones políticas dentro de la dinámica de gobierno.

In this article, the author analyses the tort not only from a private view, but also from a public function as part of the legalpolitical- economic structure of a State. Likewise, he analyses the significance of the liability rule and how this social-democratic way of organizing law and entitlements fixes the size of the liability;however, it is an inaccurate description of what occurs in the world, as in the case of eminent domain. Therefore, he claims a more significant economic role for the liability rule.<br>En el presente artículo, el autor analiza la responsabilidad extracontractual no solo desde una visión privada, sino también desde una función pública como parte de la estructura legal-política-económica de un Estado. Asimismo, analiza el significado de la regla de responsabilidad y de cómo esta manera social-demócrata de organizar el derecho y las titularidades fijan el tamaño de la responsabilidad; sin embargo, esta es una descripción inexacta de lo que ocurre en el mundo como en el caso de las expropiaciones. Por ello, afirma un papel económico más significativode la regla de responsabilidad.

This article point out the progressive enrichment by which fundamental rights concept have gone through, providing to holders—government and individuals— not only rights, liberties, powers and immunity but also the obligation to respect, defend, guarantee and promote all them regardless the conduct displayed by the holder in this field. With this in mind, the author examines arbitration definition and main characteristics, highlighting its constitutional dimension proposing a systematic reading in accordance with fundamental rights.<br>El artículo toma como punto de partida el enriquecimiento progresivo por el que ha transitado la concepción de derechos fundamentales, que actualmente no solo implican el otorgamiento a sus titulares derechos, libertades, competencias e inmunidades sino que todos —Estado y particulares— estamos obligados a respetarlos, defenderlos, garantizarlos y promoverlos, independientemente de que su titular haya desplegado o no una conducta con ese propósito. A partir de ello, el autor analiza la definición y principales características del arbitraje, destacando su dimensión constitucional y proponiendo una lectura sistemática y en armonía con los derechos fundamentales.

Abstract:
The indicator-based scientific research has recently become a valuable source of information for policymakers, scholars and eventually, civil society. Many socioeconomic spheres are evaluated using composite indicators, whereas governance has not been left behind. Among several assessment measurements oriented on the rule of law and law enforcement, the Rule of Law Index devised by the World Justice Program stands out. Namely, it is a comprehensive and methodologically consistent index which measures the extent to which the countries follow the principles of the rule of law. However, the controversial question of the justification of its equal weighting scheme emerges. The presented study addresses this issue by applying the twofold I-distance approach to propose unbiased weights and an in-depth analysis of the index dynamics. Consequently, the aim of this paper is to scrutinize the Rule of Law Index and to shed light on its methodology. Furthermore, the proposed approach can serve as a foundation for future research on weighting schemes, which are enveloped with subjectivity.

Abstract:
Tax revenue refers to the income generated by governments and serves as a critical funding source for public services, infrastructure development, and social welfare programs. While effective legal frameworks and enforcement mechanisms facilitate tax compliance, corruption undermines tax collection efforts, erodes public trust, and distorts economic activity. This study examines the relationship between the rule of law, corruption, and tax revenue performance in North Macedonia. Comparative analyses of the World Bank Governance Indicators – Rule of Law Index and Control of Corruption Index were conducted among countries in the Western Balkan region. Secondary data from the World Bank were utilized, and multiple regression analysis was conducted to determine the impact of the Rule of Law index and Corruption index on tax revenue performance for North Macedonia. Findings indicate weak governance performance related to the rule of law and control of corruption across the Western Balkan region, with the index for all countries below 0. In North Macedonia specifically, findings indicate that approximately 50.7% of the variability in tax revenue can be explained by the rule of law and control of corruption indices. The correlation coefficient of 0,71, suggests a strong positive correlation between tax revenue (% of GDP) and the Rule of Law and Control of Corruption. These findings underscore the significance of addressing corruption and strengthening the rule of law to enhance tax revenue performance.

Abstract:
As law enforcement officers work in the system person-person they must possess the ability to stop conflicting parties� opposition, resolve conflicts on the basis of the rule of law. So developing conflict managing skill is crucial in professional training of future law enforcement officers. The article purpose is to identify the impact of the pedagogical conditions of the development of future law specialists� ability to resolve conflicts on the level of this skill development. Research methods were the following: general theoretical ones (analysis, synthesis, induction, deduction); general empirical ones (observation, pedagogical experiment, adapting techniques: �Tolerance Index�, �Methods of diagnostics of the communicative installation� etc.); statistic methods (criterion X2 ). An experiment was conducted on the basis of Yaroslav Mudryi National Law University (Kharkiv, Ukraine). The sample was 144 persons. Two experimental groups were created. In E1 (n = 52) the effectiveness of the pedagogical conditions (creation of a cultural and educational environment aimed at educating humanistic values of students; mastery of knowledge on conflict resolution; creation of various professional cases) was checked in the process of teaching law students and their internship. In E2 (n = 48) extracurricular educational activities were added to the above work. In control group C (n = 44), there was no mentioned purposeful activity. The research results: the number of law students with a high level of conflict management skill in group E1 +26.9%, in group E2 +41.7%, in group C +18.2%. The conclusion is about the importance of the complex application of the mentioned pedagogical conditions that may be effectively adapted for developing conflict managing skill in the professional training of other specialists.

Abstract:
This study aims to investigate the impact of economic and certain social and governance factors on the happiness index, with a focus on estimating their relative contribution to disparities among groups of countries classified according to income levels (high, upper-middle, lower-middle, and low). This study employs a multiple regression technique to analyse data collected from the World Bank database and the World Happiness Report spanning the years 2010 to 2019 to compare the four groups of countries categorized by the World Bank according to their income levels of each income group. The findings of this study show that healthcare expenditure and government effectiveness increase people’s happiness in all four groups of countries. Furthermore, the findings suggest that fiscal contribution matters for people’s happiness only in high income and upper middle-income countries. Additionally, infrastructure, government effectiveness, political stability and absence of violence and terrorism, rule of law and voice and accountability matter for the happiness of people in lower-middle income countries. All variables, except fiscal contribution, have a significant impact on the happiness of people in low-income countries. This paper is the first that analyses how economic and certain social and governance factors relatively impact happiness of peoples in selected four groups of countries that classified according to their all four income levels. Abstract:
The digitization of society has significantly changed the tools that society uses in all aspects of life. One of them is the judiciary sector, where it has moved significantly from emails to video conferencing or from electronic files to blockchain. On the one hand, COVID-19 demonstrated possible improvements and led to the streamlining of activities in the judiciary, but on the other hand, it also showed significant differences between countries in their digitization progress. One of the recommended solutions to improve digital services is to increase the budget. Our correlation between the results of the ICT development index in courts and the percentage of ICT expenditure in courts shows that this factor is not sufficient. At the same time, it turns out that although the justice department is a subset of public administration and e-justice is a part of egovernment, there is no visible relation between them in the results of the various indices. A prerequisite for the implementation of e-justice is not only expenses for ICT, but also user education, i.e., court staff, which are complementary to each other. Ensuring the availability and fairness of the justice administration is an important factor in the rule of law that affects the perception of the country among investors.

This article examines philosophical assumptions of whether and how happiness could become a goal of political action and standard for assessing government’s performance. It is argued that solidarity and care for the common good require the political economy of citizenship balanced with affirmation of the dignity of the human person in the form of basic human rights. The rule of law and fair procedures should be complemented with the concern for character development into citizenship and mature civic commitment. This unfolds both in faith-based and secular attempts to imagine and measure human development in terms beyond GDP index and economic statistics. To succeed these attempts must be based on an adequate anthropology, draw their strength from a sound moral source and inspire mature ethical agency. Catholic social thought conceives of integral human development as a way of envisaging social arrangements that foster flourishing of the whole person and each person. It is based on the vision of the human being as an image of God and draws its energy from the idea of “good society” in which respect for the dignity of the human person and care for the common good of all people are central to political and social life. The impact of formal institutions, including rule of law, human rights, and civil liberties on economic growth has been in the focus of the latest research agenda of the new institutional economics due to the current pandemic of the Corona-19 virus. Some limitations are necessary to be imposed to address a pandemic, but this is a real risk of lasting deterioration in basic human freedoms. Increased surveillance, restrictions on free expression and information, and limits on public participation are becoming increasingly common. The present fear is that the authorities worldwide are using the current situation to repress human rights for political purposes. This paper aims to explore the effect of the overall institutional environment, understood as the concept of human freedom, on economic prosperity in different jurisdictions around the world. Human freedom is a general term for personal, civil, and economic freedom and therefore the interconnection with economic growth can be seen in both directions. In our analysis, we use the Human Freedom Index published by the Fraser Institute as a proxy for human freedom. Here, human freedom is understood as the absence of coercive constraint. The index is calculated based on 79 distinct indicators representing different aspects of personal and economic freedom. This analysis seeks to answer several questions. First, we are interested in examining whether there is empirical evidence about the causality between human freedoms and economic growth. Second, we are interested in whether human freedom has a positive impact on growth rates. And third, we are interested in examining the influence of other determinants on economic growth. To test the causality between human freedom and economic growth, we have conducted a Granger causality analysis. The empirical strategy for identification of the possible influence of human freedom to growth rates includes the development of ordinary least squares (OLS) panel regression models for selected economies of the world, or around 174 cross-section units (countries) in the period between 2008 and 2017.

In Europe, organised crime, which is increasingly globalised and operates across borders, often involving many nationalities. Organized crime groups often reflect the societies, cultures, and value systems from which they come. Just as societies across Europe are becoming increasingly interconnected and have an international perspective, so too is organised crime connected and active internationally. Therefore, the fight against this form of crime, both national and cross-border, requires day-to-day operational cooperation, as well as an exchange of information between the law enforcement authorities of the European Member States. To effectively combat crime, police authorities must be able to exchange data in a timely manner. In this way, the EU approved in 2021 a package of reforms, which foster cross-border police cooperation and the new Prüm II Regulation approved by the European Parliament in March 2024 with the aim of promoting security for all in Europe. This Regulation, which, among other things, provides for the automated exchange of DNA profiles, dactyloscopic data, vehicle registration data, automated exchanges of facial images and police records, should put an end to the information gaps of previous regulatory measures, and thus increase the prevention, detection and investigation of criminal offences in the EU. However, through an examination of the main provisions of the Regulation, the Author will analyze the most important studies conducted on this issue, both social and legal, which have highlighted the danger of many provisions. In particular, in this study the Author will demonstrate that, although the security of European citizens is a legitimate and fundamental priority for the Commission, successfully implemented by a series of reforms aimed at fostering cross-border police cooperation including the new Prüm II Regulation, nevertheless the latter fails to produce improvements in terms of the rules of Directive 2016/680, on the protection of personal data with regard to the processing of data by police and criminal justice authorities. In fact, many of its new rules create further serious risks for the fundamental rights of the citizens themselves, with the consequent need for further new regulatory changes.

Abstract:
This paper introduces a dataset that gathers information on whether and how Latin America and the Caribbean (LAC) have complied with or deviated from implemented fiscal rules. It provides annual data on fiscal rules for 14 LAC countries from 2000 to 2020, and it considers the design features of the rules and information about numerical compliance. It provides descriptive statistics reflecting the panorama of the fiscal rules implemented in LAC countries. Additionally, it calculates compliance rates across countries, years, and rules. On average, this study finds that compliance with rules aiming to constrain debt ratios and structural balances is the highest, while compliance with fiscal balance and expenditure rules is the lowest. Furthermore, the data collection process revealed that LAC countries still have room for discretion even when they subject their fiscal policy to rules. To address this problem, the paper proposes an adjusted compliance index that considers different elements that add degrees of discretion to the rule. The study finds that the numerical compliance rates of each country are likely to be over-estimated once discretionary actions are accounted for.

Abstract:
This paper investigates how a country's economic complexity influences its sovereign yield spread with respect to the United States. Notably, a one-unit increase in the Economic Complexity Index is associated with a reduction of about 87 basis points in the 10-year yield spread. However, this effect is largely non-significant for maturities under three years. This suggests that economic complexity affects not only the level of the sovereign yield spreads but also the curve slope. The first set of models utilizes advanced causal machine learning tools, while the second focuses on economic complexity's predictive power. Economic complexity ranks among the top three predictors, alongside inflation and institutional factors like the rule of law. The paper also discusses the potential mechanisms through which economic complexity reduces sovereign risk and emphasizes its role as a long-run determinant of productivity, output, and income stability, and the likelihood of fiscal crises.

Abstract:
Rule of law is a much-debated concept today, and it is one of the fundamental pillars of any democratic system. When it comes to the countries of the Western Balkans striving to become members of the European Union, it is important to look at the characteristics they have in this respect, and to what extent they meet the criteria for becoming a member state. Due to their particular way of development, there are different de facto political systems functioning within the region, which is an obstacle that also stands in the way of rule of law. This study presents those aspects of the rule of law that clearly demonstrate falling behind other political systems. An independent judiciary, civil liberties, media pluralism, and corruption are all factors that require reform in the examined countries. It may be wise to try and point out the shortcomings of the system along the lines of these aspects.
