Abstract:
The article analyses the institution of the Senate as one of the chambers of the Parliament of the Czech Republic. The asymmetrical bicameralism conception adopted in 1992 refers to the solution of the Constitution of 1920. The internal organisation and the manner of work as well as the parliamentary mandate are typical for a democratic state. The basic function of the Senate is legislation, but the final decisions belong to the Chamber of Deputies. The equalisation of the position of both chambers is an exception. The second chamber does not have a control function, and the creative function is symbolic. The Senate has become established in the system of state organs.

Abstract:
However obsolete it may appear in the environment of the post-1989 Czech Republic, dissident activity has left its imprint on Czech society and politics. In Czech foreign policy, there is something like a dissident tradition, which dissidents themselves seem to uphold. In the Czech foreign policy process, there exists an explicit mechanism that has incorporated the dissident tradition, which, in quite a few cases, has affected policy outcomes. The introduction of the dissident tradition into Czech foreign policy was facilitated by the dissidents’ great concern for foreign policy and for human rights issues, and, in particular, for human rights issues outside the Czech Republic. We present evidence that dissidents have been concerned with foreign policy and with human rights issues by analyzing the membership of parliamentary committees of both chambers of the Parliament as well as the dissidents’ activities in the Senate and the Chamber of Deputies. Significantly, when activities tied to the dissident tradition emerge in the Parliament, the initiators of such activities are always (although not exclusively) dissidents; the opponents, always nondissidents.

Abstract:
This article deals with the phenomenon of invalid voting which has appeared in regional elections in the Olomouc region in the Czech Republic. First, contemporary theories of invalid voting are introduced. Second, the given hypotheses, which include both institutional and socio-economic factors that, according to the theories, contribute to higher levels of invalid voting, are tested. Statistical analysis such as linear regression is employed in the research. The dataset is comprised of municipalities (cases) in which regional elections were held. The results show that higher levels of invalid voting are associated with concurrent elections (elections to the regional assembly and elections to the upper house (the Senate) of the Czech Parliament) in those municipalities in which residents are older and less well-educated. If regional elections are held without concurring elections, socio-economic variables have a smaller effect on invalid voting. Therefore, the state authorities should consider a revision of respective electoral law and simplify the electoral process involved in concurrent elections.

Abstract:
The article is focused on the problems of studying the constitutional and legal aspects of the functioning of the bicameral parliament in the Republic of Poland. The research is carried out with the aim of studying and scientific understanding of the practical implementation of certain aspects of bicameralism in Ukraine. The peculiarities of the legal status of the Sejm and the Senate as the chambers of political representation of the sovereign Polish nation have been analyzed. It has been emphasized that certain competencies of legislative power in the Polish power system are intended to compensate for the strong positions of the executive branch, due to the assignment of the President of the Republic of Poland to it. It has been noted that in the period after the restoration of the bicameral structure of the Polish Parliament in 1989, until 2010, the Sejm held the dominant position. It has been established that at the present stage of development, the Polish constitutional doctrine foresees an asymmetric bicameral parliament model with the preservation of the system’s equivalence of chambers. It has been noted that the result of the accession of the Republic of Poland to the European Union, the Sejm and the Senate had functional changes that covered almost all the powers of the national parliament, including, first of all, legislative and control functions, led to the appearance of elements of the “European” function of the parliament and transformed already existing commitment of both chambers. The peculiarities of the influence of the EU legal acts on the processes of national legislation in Poland have been revealed. The directions of transformation of the normative and controlling function of the Sejm and the Senate have been determined. The principles of functional separation of powers of the Sejm and the Senate in the light of the national and European legislation have been established. It has been concluded that during the process of implementation of acts of the European law in the national legal system of the Republic of Poland, the chambers of the parliament managed to expand their powers at the expense of the so-called “European competence of the Polish parliament”.

Abstract:
This paper gives a brief survey of the results of the 1996 election to the Lower House and the Upper House of the Parliament of the Czech Republic. Methodology of power indices is used to evaluate voting power and relative influence of the parties represented in the parliament. A comparison with the 1992 electoral results is provided. The regional dimension of the electoral results is discussed, and a hypothetical impact of different values of electoral threshold on the structure of parliament is analyzed.

Abstract:
On October 2-3, 2020, regional elections were held in the Czech Republic amid the second wave of the COVID-19 Coronavirus pandemic. Despite the traditional attitude to this election as secondary, its significance for the expert community was in the fact that it made possible to study political preferences of the population on the eve of the upcoming elections in 2021. Although the citizens of the Czech Republic preferred ANO movement, analysts noted the strengthening of the opposition forces – Pirate Party, the Civil Democratic Party and the STAN movement. The main feature of their participation in the last election campaign was their coalition with regional associations and movements, which made it possible to mobilize the population and claim more active participation in the work of regional authorities. Thus, scholars concluded that this approach could become the key to success in 2021. In turn, the ANO’s coalition partners tend to weaken their positions. Their fate in the future parliament was uncertain.

Abstract:
Theory of parliamentary regimes presumes that parliament can express vote of no confidence in government. On the other hand executive power (government or head of state) is endowed with right to dissolve the parliament. However, these “doomsday devices” are not in balance in many parliamentary regimes, including the Czech Republic. On the basis of a comparative analysis of dissolution provisions in the constitutions of European states the article argues that the government in the Czech Republic should be given the right to dissolve the lower chamber at least in case that the latter expresses vote of no confidence in the former.

Abstract:
The thesis deals with the personal stability of the Czech Parliament in the period after 1993 when the Czech Republic was founded. The author assumes a better orientation in both organizational and procedural issues of reelected representatives. The aim of this thesis is to explore what factors have influenced the rate of reelection of MPs and Senators and how these are subsequently reflected in the personal structure of both Chambers. Using a quantitative analysis, the author tests the hypothesis that the rate of reelection will be higher in the Senate due to the majority voting system which is more personalized than the proportional one used in the Chamber of Deputies. The hypothesis was tested in the Committees analogically. Furthermore, the author tests if the current level of voter turnout influences the final election results and the rate of reelection, respectively. The text is divided into three chapters. The thesis is composed of a common structure heading from a theoretical background towards empirical analysis.

Abstract:
This Diploma Thesis deals with obstructions within the legislative process of the Parliament of the Czech Republic, more precisely in hearings at the Lower House. The aim of the thesis is to describe the phenomenon of obstructions and their importance in the legislative process. In the beginning, the author establishes three basic research questions, which he then tries to answer through quantitative methods. Firstly, the author answers the question whether either site of the ideological spectrum tends to use the tactic of obstruction more often. Secondly, he inquires whether there are any differences between the obstructions of a right-wing or a left-wing party. Finally, the author aims to clarify if the long-established parties in the Chamber of Deputies have an advantage in the practice of obstructions and thus are more successful in it than new parties are. The text is divided into three separate chapters with a logical structure starting from theoretical themes and continuing with an empirical analysis. The first part, which is purely theoretical, is followed by a chapter dealing with the legislative process which can be considered as a transition between the theoretical and empirical parts. The following chapter is based on empiricism and analyses stenographic records and interviews with the representatives of political parties. The carried out analyses suggest that it is impossible to state clearly which site of the ideological spectrum tends to use the tactic of obstruction more often, as in the majority of cases parties using this tactic find themselves in the opposition. However, while obstructing, both left-wing and right-wing parties use almost identical tools. Ultimately, it can be stated that parties represented in the House of Deputies for a long period are not more successful in practicing obstructions than other parties, even though they use strategies that are more sophisticated.

Abstract:
The presented diploma thesis "Alternatives for the regional reform of the Czech Senate" frames on the basis of a comparative analysis of regional second chambers in the West European countries the possible alternatives for the regional reform of the Czech Senate. The comparative analysis of second chambers of parliaments in Italy, Spain, the Netherlands and France identifies the similarities and differences between the examined second chambers, in particular with respect to their historical origin, way of election, size, constitutional powers, relation to the first chamber and relation to the executive branch of the government. The examined second chambers are classified according to A. Lijphart's typological concept on the scale of strong - medium strength - weak bicameralism. The comparative analysis is then the source for the framing of specific alternatives for the regional reform of the Czech Senate. The main conclusions of the thesis are: (1) examined West European regional second chambers fall within the types of medium strength and weak bicameralism, (2) the hypothesis about the weaker position of second chambers in unitary states is partially confirmed, and (3) the framing of representative and functional alternatives for the regional reform of the Czech Senate.

The objective of the Ph.D. thesis "Analysis of the Elections and Electoral Behaviour to the Senate of the Parliament of the Czech Republic" is an analysis of Senate elections on a micro- level of districts in regular terms from 1996 to 2012, including by-elections. Data file comprises a total of 2153 candidates and their election results at the municipal level aggregated to five defined categories by number of registered voters. Analysis is mainly focused on the differences in electoral support for candidates in municipalities up to 999 voters, in municipalities between 1000 and 4999 voters, in municipalities between 5000 to 9999 voters, in municipalities over 10 000 voters and finally in districts covering territory of the four largest cities in the Czech Republic (the Capital City of Prague and cities Brno, Ostrava and Pilsen). The purpose of this thesis is to explore whether the drop in voter turnout between the 2009 and 2014 European Parliament elections, as well as the general apathy toward the politics of the European Union, in the Czech Republic was contributed to by the mass media. Specifically, this thesis will examine the two most read daily newspapers of both 2009 and 2014, Blesk and Mladá Fronta Dnes, and analyze its articles with the use of search words in order to assess whether any change occurred in the way the European Union, its policies and institutions, were presented immediately prior to the 2009 and 2014 European Parliament elections. This will be achieved through the use of content analysis, both quantitative and qualitative, while evaluating the articles in comparative fashion. The thesis will argue that, given the essential role of the media as intermediary between the world of politics and the electorate, the portrayal, or lack thereof, of the European Union is a factor in explaining the electoral dynamics of the country. Abstract:
Scrutiny of legislative behaviour of members of parliament (MPs) has a long tradition in Western Europe. Nonetheless, there has been a research gap in the Czech Republic. Thus, the dissertation thesis identifies the most burning and exciting questions and delivers the answers as a collection of to some extent separated but still interconnected studies. To be more specific, I employ quantitative methods of analysis. I deal with the data on all the members of the Chamber of Deputies of the Parliament of the Czech Republic who held the mandate between 1993 and 2017. Overall, the original and unique dataset consists of 1,518 legislators and their comprehensive parliamentary activity. The results suggest that two main conflicts drive parliamentary politics - the institutional division between ruling parties and opposition, and the ideological left-right socio-economic dimension. Besides this, the thesis shows that both the age and tenure of the MPs noticeably affect their parliamentary activity. While older and more experienced MPs propose more bills, address more speeches and obtain more intra- parliamentary posts than young novices, the latter group focuses on the work outside of the parliament. Abstract:
The article2 is prepared for the International Scientific Conference “Currency, Ta xes and Other Institutes of Financial Law in the Year of the 100th Anniversary of the Founding of Czechoslovakia”. The chosen topic is up-to-date from the point of view of ongoing discussions on the tax obligations of both natural and legal persons. Taxes are accepted by law in the Parliament of the Czech Republic, but they are also the subject of decisions of the Supreme Administrative Court and the Constitutional Court. Especially, taxes are also a scientific and pedagogical subject at the Faculty of Law of the Charles University. In today’s socio-economic and social order, in a society where there is no planned economy, taxes are significant in terms of their status as one of the few tools and instruments of managing and influencing the whole economy and the standard of living of the population. The aim of my article is to focus in detail on the provisions of constitutions related to taxes and finally on the subsection 11(5) of the Charter of Fundamental Rights and Liberties, especially in the context of its 100 years of historical development.The framework for examination is the current concept of the rule of law and the concept of tax law as a tax law in a broad sense (not only taxes, but also fees and other similar payments). The interpretation of the text is complemented by a historical excursion. Finally, Ideal with the future of tax laws. In conclusion, I try to evaluate the current tax legislation in the constitutional order of the Czech Republic.

Abstract:
This chapter focuses on university governance, which reflects the structure of an institution, whether it is centralized or decentralized, but most importantly democratic and autonomous. The case is illustrated using the example of Charles University, which is a large and highly decentralized organization that has been affected by developments in the Czech Republic after 1989 and their consequences for higher education in the country. In this regard, different governance models and recent challenges for higher education institutions are explained. The structure, main bodies, and management of Charles University are described and put into context within the national regulatory framework. The chapter further explores the division of powers and control mechanisms. A special focus is placed on the role of the Academic Senate, which underlines the democratic principles of the institution. The final remarks highlight the importance of a democratic, autonomous environment for both research and education.

Abstract:
Democratic rule of law and the foundations of the democratic system in the discourse of the Sejm of the 10th termThe June elections in 1989, as a result of which representatives of the then contemporary opposition circles were introduced to the Po-lish parliament, radically changed the Sejm’s political and legal di-scourse. As a consequence of the December Novelization of Decem-ber 29, 1989, that is the amendment to the Constitution of the Polish People’s Republic of July 22, 1952, the principle of a democratic state ruled by law came into force rejecting the provisions on the leading role of the communist party as well as the alliance with the USSR. Undoubtedly, the changes of the second half of 1989 were a conti-nuation of the changes of the first half of 1989, which then resulted in the so -called April Novelization. Importantly, in the first half of 1989, the arrangements made during the Round Table negotiations initiated the transition, and draft amendments to the constitution were developed by the Council of State. In turn, in the second half of 1989 (i.e. after the so -called June elections), before the debate in the Sejm forum and later in the Senate forum took place, proposals for consti-tutional changes were presented in parliamentary texts, which were the subject of a parliamentary initiative. The aim of this thesis is to present the most important Sejm documents containing the then po-stulates relating to radical changes within the constitution. Particular attention should be paid to the issue of the principle of a democratic rule of law underpinning the new political and legal system.

Abstract:
This article discusses the general characteristics of the electoral system of Kazakhstan by the example of elections of the President of the Republic, the Senate of the Parliament of Kazakhstan and deputies of the Mazhilis. The features of dividing this system into majority and proportional are also disclosed. The article analyzes the features of the appointment and conduct of elections and the principles on which they are based. It is also shown how the active activity of the state in the field of legal education of young people and their familiarization with the electoral system affects the high participation rates of citizens in elections.
