Thesis for a degree of Candidate of Science in Law, specialty 12.00.05 «Labor law; social security law». – Yaroslav Mudryi National Law University, Ministry of Education and Science of Ukraine. – Kharkiv, 2018.<br>The dissertation is devoted to the systematic and detailed analysis of the legal essence, content and features of the status of the head of a higher education institution as a subject of labor law, as well as actual problems of practical nature and the search for solutions to them. In the scientific work the legal characterization of the activity of the head of a higher education institution as a form of realization of labor rights for the fulfillment of official duties, as well as a specific kind of labor activity was carried out. Defined the notion and essential features of the labor-legal status of the head of a higher education institution, in particular, the nature of the legal relationships that the composition is established between the head of a higher education institution (as an employee) and the founder of a higher education institution (as an employer). Features of the emergence and termination of labor relations with the head of the higher education institution are highlighted, and the gaps and conflicts in the normative and legal regulation of labor relations with the head of higher education institution are identified. Specific suggestions and recommendations for improving the legal regulation of the status of the head of a higher education institution as a subject of labor law have been formed.

Abstract:
The subject constructed by and for labour law---the "worker"---is bodiless, sexless, genderless, and male. This thesis investigates how and why this construction occurs both through a discussion of general theoretical issues surrounding the way law constructs its subjects, and through a specific case study. The case study considers a set of sexual harassment cases decided in the "mainstream" unfair dismissal jurisdiction. As a site of women's overt presence in the labour market, these cases are disruptive to settled constructions of "the worker", particularly because they connect the sexuality of women (and their gender) to their status as worker. In so doing, they suggest the possibility of a "womanworker"---a woman who is simultaneously woman and worker. The thesis concludes by exploring the consequences of this possibility and asks how the recognition of women's experiences, needs and specificities can allow the subject of labour law to be reconstructed.

<p>Eating disorders are now considered an epidemic among girls and women throughout the United States. This thesis suggests a study in which the acts and processes of anorexia nervosa and bulimia nervosa are positioned as a form of cultural labor undertaken by some Western women in order to embody the myth of the ideal female body. Este estudo procura estabelecer uma relação entre discurso e trabalho. Com base na Análise de Discurso francesa, tal como foi elaborada por Michel Pêcheux, busca ressignificar, desde Karl Marx, passando por Louis Althusser e Hannah Arendt o lugar teórico do trabalho no interior de uma teoria materialista dos sentidos. O que é o trabalho? Pergunta feita a vinte e um trabalhadores metalúrgicos da região metropolitana de Porto Alegre que sofreram acidente de trabalho. Os testemunhos narram, para além do acidente, as trajetórias profissionais. Na análise as definições apontam para a afirmação do óbvio. Determinações que rompem a linearidade do discurso, marcas da elipse e incisa, que levam o sentido ao limite da falta e do excesso. Nada é trabalho, tudo é trabalho. Efeitos de sentido designados discurso de labor, que interpelam o sujeito por um funcionamento verborrágico. O sujeito se desdobra como função e goza do alívio de ser meio do meio de funcionamento. O que no social é demanda de reprodução é para o sujeito demanda de consumo. A interpelação é do/no ato de produção. A comada social produz o sujeito como efeito entre o fato vazio, contingente do consumo e a falta objetiva, que o sujeito produz e que deve necessariamente reproduzir. Injunção na história, dispersão do sujeito. Algo escapa, acontece, transborda. O que se repete materialmente deixa marcas na ordem do discurso. A ambiguidade é o modo de acesso à ambivalência entre vida e morte: viver trabalhando para não morrer. Laço metafórico que confronta no sujeito um discurso que o consolida e que o esvazia. Causa de um gesto de realização impossível, o trabalhador se desloca na cadeia metonímica. Repetir, reiterar, reproduzir e resistir. O trabalhador existe entre ser e fazer, ter e estar, viver e trabalhar. No batimento da reprodução a vida resiste, mas não se resolve, permanece ambígua.<br>This study aims to set a relation between the concepts of discourse and work. Based on the french line of thought of Discourse Analyses, as theorized by Michel Pêcheux, the concept of work is defined based on ideas from Karl Marx, Louis Althusser and Hannah Arendt, as a way to resignify it within a materialist theory of meaning. What is work? This was the question asked to twenty one metal workers from the metropolitan area of Porto Alegre, who had a work accident. Their testimonies go beyond the accident and tell us about their entire professional life. It analyzes points to the obvious. Determinations that break the linearity of discourse, marks of ellipses and incises, all of those taking the meaning to the limit of the lack and the excess. Nothing is work, everything is work. Effects of meaning, designated as labor discourse, which interpellates the subject by a verbose operation. The subject unfolds as a function and as a jouissance of being a work medium. The interpellation comes from the act of production and in itself is present. The social command brings forth the subject as an effect between the empty fact – a consumption contingency – and the objective lack – which the subject himself creates and must reiterate. Injunction in history, dispersion of the subject. Something escapes, happens, overflows. What is materially repeated leaves traces in the discourse. The ambiguity is the door to the ambivalence of life and death: a life of work in order not to die. It is a metaphorical bond that sets at the subject a discourse that both consolidates and empties him. As a cause of a gesture of impossible realization, the worker moves himself in the metonymic chain. Repeat, reiterate, reproduce and resist. The worker exits between being and doing, having and being, living and working. At the beat of the reproduction, life resists, but does not answer itself: remains ambiguous.

Abstract:
The concept of ‘diversity’ has become a common feature in UK organisations over the last twenty or so years. It offers arguments about what the world is like, who people are, how they relate to one another, and how the world should be. It has been used to bring about a host of different actors, objects and practices. Yet, we know relatively little about one of the central elements of this field – diversity practitioners. They play an important role in defining what diversity means in local contexts, they are the experts of the field. Drawing on Foucault’s theories of power/knowledge and the ‘subject’, along with the notion of bricolage, the research examines the different forms of knowledge that diversity practitioners use to construct themselves as expert subjects, and in turn how they seek to construct a particular subject of others, the ‘diversity trainee’, as the subject who is the outcome of diversity training. The findings show how the subjects of the diversity practitioner and the diversity trainee are shaped by dominant societal discourses of the expert and the neoliberal subject, as well as by the history of equality work and the organisational challenges that diversity practitioners face. But they also show that diversity practitioners are actively involved in forming themselves as subjects by producing subject positions and rationalities, which construct skills, values, and knowledge. Diversity training is shown to mobilise a form of power known as ‘modern government’ in seeking to constitute the diversity trainee as a selfregulating subject, which adds complexity to previous discussions of the ethics of this form of power. Diversity practitioners are central elements of their field, so recognising the relations of power/knowledge in their practices is fundamental to considering any future development of their practices, as well as better understanding the concept of diversity itself.

The way that Goiânia was projected in the design of "City-Garden" brought from Europe in the early 20th century, by Architect Planner Atilius Corrêa Lima, expresses well the city's relationship with the countryside. Goiânia, a planned city under the aegis of modernity, occupied originally by the territory's agrarian society, the rural tradition of Goias his subjects, culture, way of being and acting of country man from Brazilian Cerrado (?). The design of City-Garden sought rapprochement of the field with city, rural livelihoods and urban to justify the creation of a city full of signs of modernity, advancement and progress that would provide the order of "isolation" of Goiás in relation to urban industrial society of Southeast Brazil. Thus, Goiânia should, at the same time, expressing his strong relationship with the field, but also, paradoxically, denying the rural way of life which is subjecting the inhabitants of Goiás. Rural and urban shall be more than spatial dichotomies to become socioeconomic dichotomies, the place of the "backwardness and stagnation" should be replaced by the place of the "advancement" and of the economic and social progress. This conflict materializes the hegemony of industrial capitalism on the territory of Goias and Goiânia is the hallmark of this hegemony. The symbol of modernity which arrives at the Center-Western Brazil to open the doors to progress. However, the process of metropolization took place quickly and provided a "disconnect" between time, space and subject. With significant structural changes in the rural space that they entered subject to urban life time slow quick time, had as a consequence the emergence of a metropolis with its urban fabric of loaded free that express the existence of rural in the city. This Rural, manifested in the form, the structure and function of these spaces in the city having as an agent of incorporation the rural subject with his technique and strength that characterize as workers and rural workers in the social division of labour. The relationship of rural with Goiânia and Goiânia with the peculiar form of rural and that needs a watchful as a look needed to see a stamp watermark that sometimes needs of body contact and tact to be unveiled. We thus contribute to the debate over relations city-countryside, urban-rural and city-rural and urban-field seeking to understand the social phenomena of "new rural" and new "ruralidades" in contemporary society.<br>Este trabalho de pesquisa enfoca o processo de metropolização de Goiânia tendo como objeto de análise o rural na cidade. A forma como Goiânia foi concebida na concepção de Cidade-Jardim trazida da Europa do início do Século XX, pelo Arquiteto Urbanista Atílio Corrêa Lima, expressa bem a relação da cidade com o rural. Goiânia, uma cidade planejada sob a égide da modernidade, ocupada inicialmente pela sociedade agrária do território goiano, da tradição rural de seus sujeitos, da cultura, do jeito de ser e agir do sertanejo do Cerrado Brasileiro. A concepção de Cidade-Jardim buscou a aproximação do campo com a cidade, dos modos de vida rural e urbano para justificar a criação de uma cidade carregada de signos da modernidade, do avanço e do progresso que iria proporcionar o fim do isolamento de Goiás em relação à sociedade urbana industrial do Sudeste Brasileiro. Assim, Goiânia deveria, ao mesmo tempo, expressar sua forte relação com campo, mas também, paradoxalmente, negar o modo de vida rural ao qual se sujeitavam os habitantes de Goiás. Rural e urbano passam a ser mais que dicotomias espaciais para se tornarem dicotomias socioeconômicas, o lugar do atraso e da estagnação deveria ser substituído pelo lugar do avanço e do progresso econômico e social. Esse conflito materializa a hegemonia do capitalismo industrial sobre o território goiano e Goiânia é a marca dessa hegemonia. O símbolo da modernidade que chega no Centro-Oeste brasileiro para abrir as portas da região para o progresso. Porém, o processo de metropolização se deu de forma rápida e proporcionou um descompasso entre tempo, espaço e sujeito. Com significativas mudanças estruturais no espaço que inseriram os sujeitos rurais do tempo lento à vida urbana do tempo rápido, teve como conseqüência o surgimento de uma metrópole com sua malha urbana carregada de rugosidades que expressam a existência do rural na cidade. Rural, este, que se manifesta na forma, na estrutura e na função desses espaços na cidade tendo como agente constitutivo o sujeito rural com sua técnica e força que os caracterizam como trabalhadores e trabalhadoras rurais na divisão social do trabalho. A relação do rural com Goiânia e de Goiânia com o rural se expressa de forma peculiar e que necessita de um olhar atento como um olhar necessário para se enxergar um carimbo marca d água que, às vezes, necessita do contato corporal e do tato para ser desvendado. Buscamos, dessa forma, contribuir no debate sobre as relações cidade-campo, urbano-rural e cidade-rural, bem como campo-urbano que buscam compreender os fenômenos sociais do novo rural e das novas ruralidades na sociedade contemporânea.

La ricerca sviluppa un nuovo aspetto del complesso rapporto tra liberta' economiche e diritto del lavoro, soffermandosi sui profili di collisione e sovrapposizione tra liberta' di circolazione dell'impresa e diritto del lavoro. L'interesse per la materia e' recentemente lievitato da quando il giudice dell'Unione Europea ha segnato il punto di equilibrio tra le liberta' di circolazione vantate dalle imprese, da un lato, e le liberta' e i diritti collettivi, di sciopero e di contrattazione, dall'altro. L'idea di fondo dalla quale si muove e' che esiste un filo concettuale invisibile che avvince le molteplici esteriorizzazioni del fenomeno della circolazione delle imprese nell'ordinamento dell'Unione. Detto legame puo' individuarsi nella volonta' dell'impresa di sottrarsi ad un diritto del lavoro considerato "ingombrante" nonche' nell'interesse a ridurre, in maniera determinante, i costi da sostenere per il fattore lavoro. Tra le poliedriche e poliformi immagini della vicenda economica della circolazione delle imprese vengono considerate, in particolare, due macromanifestazioni: la delocalizzazione produttiva e la prestazione di servizi (cd.) labour intensive. L'ordinamento sovranazionale europeo ha concesso alle imprese di tutelare il loro "diritto" alla circolazione avvalendosi delle disposizioni relative alle liberta' fondamentali - la liberta' di prestazione dei servizi ex articolo 56 TFUE e la liberta' di stabilimento ex articolo 49 TFUE. Entrambe le modalita' di circolazione sono suscettibili di produrre effetti e, in certa misura, collidere con il diritto del lavoro, vuoi per la compressione delle tutele di alcuni lavoratori che, pur operando in un dato ordinamento nazionale, sono sottratti alla sua regolazione lavoristica (i distaccati), vuoi per gli effetti indiretti che la paventata mobilita' puo' indurre negli ordinamenti interni, vuoi infine per i limiti e le restrizioni opposte all'esercizio dei diritti collettivi attivati per contrastare il progetto di circolazione. Il lavoro si articola dunque in tre parti: la prima che prospetta i possibili percorsi d'indagine ed i presupposti teorici che costituiscono lo scenario nel quale la tematica della libera circolazione delle imprese va inserita, la seconda che indaga la natura delle liberta' fondamentali e la loro attuazione giurisprudenziale, nonche' l'apporto ricostruttivo del diritto derivato, e la terza avente ad oggetto le restrizioni opponibili al diritto di sciopero, il piu' acre esito del conflitto tra libera circolazione delle imprese e diritto del lavoro. In particolare, il fulcro di questa sezione del lavoro e' costituito dall'accertamento degli effetti indotti nel sistema giuridico svedese da uno dei casi giurisprudenziali piu' discutibili, il caso Laval, che puo' fondare timori di dumping sociale nel territorio europeo e di destabilizzazione dei modelli di relazioni industriali. Il percorso, condotto attraverso il confronto con i principi fondamentali dell'ordinamento comunitario, addiviene alla conclusione della non indefettibilita' degli esiti dell'attuale contemperamento tra circolazione e diritto del lavoro e alla preconizzazione di una alternativa che valorizzi le tutele dei lavoratori e non si sostanzi in un pregiudizio per gli stessi.

La prospettiva di indagine perseguita dalla tesi ha ad oggetto l'individuazione delle ricadute giuslavoristiche del principio di dignita'. Nella prima parte, premessa una ricognizione delle accezioni di dignita' umana enucleabili dal dibattito dottrinario, l'analisi si e' appuntata sulla giuridificazione del principio nell'ordinamento interno e sovranazionale. Nella seconda parte della tesi, dedicata all'approfondimento dei rapporti sistematici tra dignita' e diritto del lavoro, si propone una lettura integrata delle proiezioni individuali e collettive della dignita', analizzata nella sua relazione con i principi di uguaglianza e solidarieta'. Il tema oggetto di indagine nell'ultima parte della ricerca attiene agli strumenti di tutela della dignita' della persona, con particolare riferimento, da un lato, alla tutela "ordinamentale", predisposta dalla costruzione del diritto del lavoro come ordine giuridico caratterizzato da disposizioni inderogabili; dall'altro, al regime di tutela della dignita' e dei diritti fondamentali derivante dall'elaborazione giurisprudenziale sul tema.<br>The thesis is characterized by a research perspective devoted to the identification of the effects of the principle of dignity on employment law. The first part of the research focused on the meanings of human and social dignity arising from the legal scholar reflection; this part of the thesis deals also with the juridification of human dignity in the national and supranational context. The second part of the thesis deals with the systematic relationship between dignity and labor law, in which dignity is observed in its relationship with the principles of equality and solidarity. The subject of the last part of the research is the one of the techniques for protection of human dignity. In particular, on one end, the relationship between human dignity and the tipycal inderogability of Italian labour law provisions has been analyzed and, on the other, the attention has been devoted to the judicial interpretation of dignity clause in the Italian and supranational case law.

М. ; Національний університет «Чернігівська політехніка», кафедра трудового права, адміністративного права та процесу. – Чернігів, 2019. – 86 с.<br>Трудова діяльність працівників поліції є однією з форм праці, право на яку закріплено у ст. 43 Конституції України. Вибір такої почесної професії завжди означав готовність до напруженої роботи на благо Вітчизни та відданість національним інтересам. Місія, що покладається на працівників поліції, є дуже відповідальною - служити суспільству шляхом забезпечення охорони прав і свобод людини, протидії злочинності, підтримання публічної безпеки і порядку. У межах реалізації нашою державою напрямку на європейську інтеграцію, надзвичайно актуальними сьогодні постали питання щодо реформування діяльності поліції в цілому, а також удосконалення правого регулювання статусу її працівників. Це стосується, зокрема, і трудоправового статусу працівників поліції. У розділі 1 роботи визначено сутність правового статусу працівника поліції як спеціального суб’єкта трудового права, поняття, зміст та основні риси його трудової діяльності, правові основи регулювання такої діяльності. Розділ 2 присвячений характеристиці основних принципів, завдань та функцій трудової діяльності працівників поліції. У розділі 3 досліджуються актуальні проблеми та напрями вдосконалення правової регламентації трудової діяльності працівників поліції. Наукова новизна роботи полягає в тому, що: 1) запропоновано внести зміни до ч. 5 ст. 91 Закону України «Про Національну поліцію», у якій йдеться про компенсацію роботи поліцейського у вихідні, святкові та неробочі дні шляхом надання йому іншого дня для відпочинку. Зокрема, необхідно передбачити як альтернативу можливість отримання грошової компенсації у подвійному розмірі при залученні його до роботи у такі дні, що у свою чергу узгоджувалося б зі статтями 72 та 107 Кодексу законів про працю України (с. 62-63); 2) дістало подальшого розвитку авторське тлумачення терміну «трудоправовий статус працівника поліції». Вбачається, що це закріплена Конституцією України, законами України «Про Національну поліцію», «Про державну службу», «Про запобігання корупції», Кодексом законів про працю України система прав, обов’язків, заборон, обмежень, заохочень та гарантій професійної діяльності працівника поліції, а також міра відповідальності за невиконання або неналежне виконання ним службово-трудових обов’язків (с. 21-22). Основні положення і висновки роботи обговорювалися на міжкафедральному науково-практичному семінарі «Правові реформи в Україні: стан і перспективи розвитку» (м. Чернігів, 2019 р.). Основні результати проведеного дослідження викладені у 1 науковій праці.<br>The employment of police officers is a form of labor, the right of which is enshrined in Art. 43 of the Constitution of Ukraine. Choosing such an honorable profession has always meant a willingness to work hard for the good of the Fatherland and a commitment to national interests. The mission of the police is very responsible - to serve the community by ensuring the protection of human rights and freedoms, combating crime, maintaining public safety and order. As part of our country's pursuit of European integration, the issues of reforming police activity as a whole, as well as improving the right regulation of its employees' status, are extremely relevant today. This applies in particular to the employment status of police officers. Section 1 of the paper defines the essence of the legal status of a police officer as a special subject of labor law, the concept, content and main features of his employment, the legal basis for regulating such activity. Section 2 deals with the description of the basic principles, tasks and functions of the work of police officers. Section 3 explores the current issues and areas for improving the legal regulation of the employment of police officers. The scientific novelty of the work is that: 1) it is proposed to make changes to Part 5 of Art. 91 of the Law of Ukraine "On the National Police", which refers to the compensation of police work on weekends, holidays and non-working days by giving him another rest day. In particular, consideration should be given to the possibility of receiving double compensation when hired to work on such days, which in turn would be consistent with Articles 72 and 107 of the Labor Code of Ukraine (pp. 62-63); 2) the author's interpretation of the term "police officer's employment status" was further developed. It is believed that this is enshrined in the Constitution of Ukraine, the laws of Ukraine "On the National Police", "On the Civil Service", "On Corruption Prevention", the Labor Code of Ukraine system of rights, duties, prohibitions, restrictions, incentives and guarantees of professional activity of an employee police, as well as the degree of responsibility for their non-performance or improper performance of their official duties (pp. 21-22). The main provisions and conclusions of the work were discussed at the inter-departmental scientific-practical seminar "Legal Reforms in Ukraine: State and Prospects for Development" (Chernihiv, 2019). The main results of the study are outlined in 1 scientific paper.

The thesis examines challenges museum curators face when outsourced performers – whose role it is to embody the work of other artists – are included in exhibition projects. The research questions are: What are the practical, juridical and ethical challenges that come with situating outsourced performance labour in the museum setting? What does the inclusion of live performance in exhibition projects mean for the role of the museum curator? Two exhibition cases in Stockholm are studied in the thesis: Marina Abramović – The Cleaner (2017) at Moderna Museet and Dora García, I Always Tell the Truth at Bonniers Konsthall (2018–19). The material consists of digital surveys that were sent out to employed performers from each exhibition case as well as interviews that were conducted with both performers and curatorial staff. The material was examined using theories on affective labour and the theoretical notion of de-skilling and re-skilling of acquired competences.  The thesis shows that the practical challenges include the architectural conditions of museum buildings, insufficient prior knowledge on what working with performers entail, short project timespans and limited exhibition budgets. The juridical challenges include a lack of union recommendations for performance in museums and the difficulty of situating reperformances of historical works that in its form and duration may go against national labour regulations. The ethical challenges include commodification of performers’ subjectivity through instances of affective labour and mechanisms of objectification. In turn, both the outsourced performer and the museum curator turned performance curator inhabits a precarious working situation. The role of the performance curator is highly administrational and organisationally tedious in its positioning between curatorship, performing arts production and human resource management. Additionally, it entails a prodigious amount of affective labour in the reproductive mode – of emotional investments, conflict resolution and social liaison.

Thesis advisor: Deborah Levenson<br>The emergence of the concept of Fair Trade has inspired a new form of supply-determination by socially conscious consumers. Since it began official certification, Fair Trade has served as a tool to curb the exploitation of labor. It has also promoted direct connections between vendors and producers, organized participatory democracy, continuity in trade relations, respect for the environment, movement toward equal status of gender, and living wages for workers. Small family farmers now produce over 51 percent of coffee in the world, and 90 percent of the world's cocoa. With a History Honors Thesis, I seek to examine the use of worker-owned recuperated factories of Argentina for the production of Fair Trade footwear and apparel. Such factories require more complicated chains of supply (primary materials, numerous factories for production, contractors, transportation, warehouses, and retail) than primary materials such as coffee. Started in the 1980s, the recuperated factories in Argentina may provide the complex links to a sweatshop-free market, which have been lacking. The experiment has exploded to about 180 businesses since an economic crisis in 2001 forced owners to flee and workers to gain expropriation, half through legislation and half through occupation, according to journalist Andrés Ruggeri. My project seeks to investigate whether chains of production and distribution of complex Fair Trade certified or sweatshop-free products, using recuperated factories in Argentina, could serve as an economic alternative for manufactured Fair Trade products. By pursuing in-depth research on this project and understanding porteño culture and labor struggles, I have built a strong foundation for a thesis. My independent study project for the School for International Training during my Fall 2005 semester abroad in the Southern Cone (Argentina, Uruguay, Paraguay, and Brazil) became my passion and provides preliminary background information. Basing the project on interviews I had conducted with workers from ceramics, textile, and shoe recuperated factories all over, I found evidence of new supply chains with words from key leaders like Raul Godoy, Vasco Abelli, and Luis Caro (Control Obrero, El Movimiento Nacional de Empresas Recuperadas, and El Movimiento Nacional de Fábricas Recuperadas por los Trabajadores). I also became personally involved in the network of founders of current trade groups based in Argentina, with whom I will consult for my work on the History Honors Thesis. Building directly on research interests, and especially the interviews that I conducted in my semester in Argentina, I will address the complexities of the philosophical foundations, key figures, and actions that have comprised the vast history of labor in Argentina from its pre-capitalist mutuales artisan communities up to the contemporary situation with close academic mentorship from Professor Levenson. With plentiful sources of information, I will document each prospective or current deal to produce for Fair Trade distributors, develop an understanding of which products are feasible for ethical supply chains, analyze the success of such collaborations with new distributors, and compare and contrast them with business for former or other clients. Portions of the movement vary in ideology and vision, but all seek to maintain relations with former distributors. The primary concern is surviving and gaining expropriation, but the movement is witnessing a series of new strong inter-relations and projects for Fair Trade. Anomalies noticed in midwifery practice prompted a review of literature around progress in labour after Loop Excision of the Transformation Zone (LETZ). The previous research was equivocal. This study investigates the pattern and progress of women's labours following LETZ, and the effect of the experience on women. It also explores the basis of clinical decisions made by midwives. It takes place in North East England and involves women giving birth in 2004-2005. The case study strategy brings together quantitative retrospective case control results, qualitative analysis of semi-structured interviews from women and midwives, and guidelines and protocols surrounding assessment and management of labour. The quantitative data is from 111 women after LETZ and 214 controls, reducing to 94 and 150 respectively after removal of cases with confounding variables. Interviews are from four women, three individual midwives caring for one of the women and a focus group of four midwives. In the interviews, women gave no thought to how their births may be affected by LETZ, as no one had discussed the possibility with them. Women having their second baby after LETZ take less time to reach full dilatation; a result related to grade of Cervical Intraepithelial Neoplasia. Women having their first baby after LETZ are 1.8 times more likely to be admitted later in their labours, an important emergent issue that needs further research. Women having their first or second baby after LETZ are 2.3 times more likely to have a premature birth, confirming indications in previous research. This study for the first time reveals important differences in pattern and progress of labour after LETZ. It adds to our knowledge of premature birth after LETZ. Midwives, obstetricians and colposcopists need to incorporate the study results into counselling of women before LETZ and during any pregnancy after LETZ.

This dissertation examines how the paradoxical process takes place whereby women are both integrated and segregated within male-dominated sites of social action, here in the Swedish labor market, national economy and military during the First World War. The potential of the First World War to change the societal gender distribution of labor in Sweden is limited by the fact that Sweden was not a belligerent state, and that the mobilization of men thus was limited. It is in social planning activity, and in the general state of preparedness for war and crisis, that this study has sought to analyze contemporaneous understandings of womens’ "tasks" in times of war and crisis. Earlier research has shown that women can be integrated in several different ways which can reproduce the gender order. This order can be re-created either in that women and men gain access to different "arenas" on different conditions, or in that women and men gain access to the same arena on different conditions (to mens’ advantage). From a gender-theoretical perspective, re-segregative integration is analyzed both at the level of conceptions and of practices. The study consists of three studies, regarding the domains of the labor market, the national economy (or economizing activity), and the military. The concept of the (social) task is used to capture those activities which voluntary organizations, the state, and/or womens’ organizations offered or enjoined/assigned to women in times of war and crisis. Women were offered tasks in e.g. the military medical service and in war veterinary care services, within so-called "time expense economizing" activities organized for the economy’s household sector, and with sewing articles of uniform clothing for older reserve troops (the landstormen). In addition, plans were laid up (although never carried out in practice) whereby women in wartime could be called upon to fill the "gaps" in the labor market left by men mobilized into the armed forces. In the domain of the labor market, womens’ integration was envisioned as taking place within an "extraordinary arena" on other conditions than those applying to men. Womens’ tasks were related to mens’ peacetime tasks, then being called "replacement work"; in relation to mens’ military service, placed into a context of "civil preparedness". In the domain of the national economy (or economizing activity), within the state National Economizing Commission, women were also integrated into a “special arena” on other conditions than those applying to men. Women were recruited into "womens’ administrations", or as the "only woman" to otherwise completely male-dominated administrations, and their tasks were limited to dealing with "the private households". In the domain of the military, women were still integrated into a "special arena" auxiliary to a male regular arena. Tasks were constituted as voluntary, were offered by voluntary organizations, and were focused on the provision of care services. In all these societal domains, a qualitative difference was created between what men did and what women did, or were envisioned to do. Womens’ tasks were constituted as feminized tasks. The tasks were however designed in a way which both challenged and confirmed more traditional conceptions of the "male defender", the "male provider", and the "masculine state and public sphere". One can reason here in terms of the gender order’s having been maintained, despite integration. In theory or in practice, this was done by tasks being recontextualized, whereby the existing order was maintained. By placing womens’ tasks into another context, order was secured, enabling the claim that "nothing has really happened". This could be expressed by saying that, when the gender order is threatened, a type of "assisting logic" intervened which placed threatening phenomena into a new context: the consequence of this was that tasks which women did, or were to do, became diminished.

This thesis deals with the development of the labor market in the region Plzeň in 2001 - 2011. The purpose is to identify what factors and how much affect employment and unemployment in the labor market in region Plzeň. The author analyzes the time series on population, employment and unemployment in the region Plzeň of the portals CSO, Ministry of Labour and socials affairs. The work contains an estimate of the supply side of the labor market based on demographic projections in context with the impact of pension reform. Research is subjected to the expected development of the demand side of the labor market on which it can be expected changes of the requirements of employers in skills needs. Analytical investigation in this thesis is completed questionnaire to which they are subjected unemployed. Through deduction from the information obtained from these data sources is determined the expected development of the labor market in the region Plzeň, and his problems are not adequately addressed.

In response to the reification of social reality caused, according to the first generation of the Frankfurt School, by the instrumental mastery of nature, Adorno, Horkheimer and Marcuse have elaborated a critique of instrumental reason aimed at providing the theoretical tools for a treatment of the social realm as a field of human practice. Concerned with the risks of reproducing the relationship between humanity and nature hindering human emancipation, they have nevertheless sought to limit the task of critical theory to a theoretical form of resistance, thereby divorcing social theory from the practical orientations found in Marx‟s critique of political economy. It was not until the works of second-generation critical theorist Jürgen Habermas, that one could find a renewed attempt to link theory with the objective conditions of existence thought to be required for human emancipation. With these theoretical developments, however, social theory was effectively stripped of its critique of technology, and became primarily concerned with the problem of human emancipation as a matter strictly regarding intersubjective relations. The present work proposes that the formulation of a social critique oriented towards the institutionalisation of emancipatory practice cannot presuppose or apologise for the instrumental mastery of external nature. It shall be argued that in order to achieve such a task, the critique of instrumental reason elaborated by the first generation of Frankfurt School theorists must be complemented and completed with the broad outline of an institutional framework capable of indicating the conditions of existence required for the actualisation of human emancipation as the labour-mediated reconciliation of humanity with both internal and external nature, and for which the works of G.D.H. Cole provide a potential basis for rethinking critical theory and updating libertarian socialism.

The process of obtaining the Master of Fine Arts degree led me to probe the aims and methods of my artmaking. What emerged and became uppermost was the issue of form and content or perhaps form versus content. While highly concerned with the formal aspects of art, content (subject matter) would not fade from my intentions or cease to occupy my mind. Through much "soul searching" and inquiries into numerous materials both familiar and new to me, I concluded that my intended content was about my experience of being. I further distilled my conclusion and focused on my ontological experience in terms of the self (subject) as contained by the body (matter). I realized that the successful and specific translation of my intentions into my artistic works had become one of the core issues in my artmaking endeavors. Thus, clarification of subject matter emerged as a core issue from the two year process and focused my attention. The many mediums I worked with helped to increase my sensitivity to the inherent nature, characteristics, and behaviors of materials. The body of work exhibited in the Autzen Gallery m Neuberger Hall from June 5th through the 20th reflects the preliminary residuals of this process.

Hence, they hardly become the agencies of social change to build a labor movement in China. However, based my observations between 2013-2015 in the Guangdong Province, I argue that a small group of labor NGOs have stepped beyond their supposed roles and become labor movement agencies in China; they actively assist and organize striking workers to negotiate with employers, and have hatched several informal labor groups in industrial zones. To explain this new development of labor NGOs in China, first, I argue that the state exerts its control on labor NGOs through a differentiated process, which creates a certain space for movement-oriented labor NGOs to survive. On the one hand, the state's need for NGOs in relieving its social welfare obligations gives them a chance to "disguise" as an ostensible social service provider by employing strategies. One the other hand, the different functions, power bases and vested interests of labor NGO-related state organstrade unions, public and national security agencies, and civil affairs bureaususually lead to less coordinated efforts in containing these groups. Second, the movement-oriented labor NGOs are able to develop strong ties to workers and facilitate labor organizing. During workers' collective struggles, they organize training to enhance workers' right consciousness and transmit the idea of collective bargaining to them; they also help elect and train worker representatives, offer tactics to them, and are even present on bargaining tables on workers' behalf. By hatching informal labor groups, these labor groups network and educate workers in communities to build solidarity, and encourage them to run group activities and learn self-organization skills. Particularly, worker-turned NGO activists, who previously experienced labor disputes and with leadership skills, notably facilitate these activities due to their deep understanding of workers' circumstance and demands, and profound knowledge of their language and labor dispute settlement. This research demonstrates that, although movement-oriented labor NGOs are probably transitional forms in China and not able to replace genuine trade unions, they have taken up some roles that trade unions were supposed to play, significantly contributing to improving the organizational capacity of Chinese workers.

Die Experimente zeigen wie Erwachsene und Kinder Subjektpersonalpronomen in verschiedenen Diskurskontexten interpretieren und generieren. Auf Spanisch können Subjektpronome entweder sichtbar (overt) oder unsichtbar (null) sein. Beide Formen werden im anaphorischen Diskurs gebraucht. Gegenstand der Dissertation ist es zu untersuchen, welche Unterschiede in der Bedeutung damit verbunden sind. Zunächst präsentiert die Arbeit einen generellen Standpunkt. Demzufolge besitzen die zwei Arten von Pronomen komplementäre anaphorische Präferenzen. Dies bedeutet, dass beim Vorhandensein von zwei möglichen Antezedenten zu erwarten ist, dass jede Form einen anderen Antezedenten wählt. Drei verschiedene Arten, Komplementarität zu konzipieren werden in Betracht gezogen. Im Verlauf der Dissertation werden ihre Vorhersagen in verschiedenen Interpretations- und Produktions-Experimenten getestet. Die Ergebnisse sprechen klar gegen die Idee von Komplimentarität. Im Anschluss wird in der Dissertation ein alternativer Standpunkt aufgezeigt welcher auf den rhetorischen Relationen zwischen den Sätzen eines Diskurses basiert. Entsprechend dieser Vorstellung kann die Pronomenauflösung als ein Nebeneffekt des Erschließens (Inferenz) dieser Relationen angesehen werden. Der Unterschied in der Verwendung von overt und null Pronomen würde dann nicht zuvor erschlossenen anaphorischen Präferenzen folgen, sondern wäre direkt abhängig von der Herstellung der Diskurskohärenz. In diesem Rahmen wird es möglich das Verhalten von Erwachsenen und Kindern in den Experimenten sinnhaft zu deuten.<br>This dissertation presents and discusses a series of experiments concerning how monolingual adult and child speakers of Chilean Spanish interpret and produce anaphoric subject personal pronouns in discourse. In Spanish, subject pronouns can be either overt or covert. Both forms are used in discourse anaphora. The dissertation investigates what difference in meaning they express. It begins by presenting a common general view, according to which the two kinds of pronouns have complementary anaphoric preferences. This means that, under the presence of two possible antecedents, each kind of pronoun is expected to pick out a different one. Three possible forms of conceiving complementarity are taken into account. Throughout the dissertation, their predictions are tested in different comprehension and production experiments. The results present strong evidence against the idea of complementarity. The dissertation considers then an alternative line of explanation, based on how the sentences of a discourse are related through rhetorical (coherence) relations. According to it, the resolution of pronouns can be seen as a by-product of inferring these relations. The difference between using overt and covert subject pronouns would not obey pre-determined anaphoric preferences (for subject and object antecedents, for instance), but depend on how pronouns contribute to the establishment of coherence in the discourse. Within this frame, better sense can be made of both adults’ and children’s performance in the experiments.

Abstract:
This thesis examines the effects of labor regulation on formal (regulated) labor markets in Latin America. It is divided in three chapters, in which I analyze the effects of pension programs on formal-sector labor supply and the effects of payroll taxes on formal-sector labor demand. The first two chapters analyze how future pension benefits affect formal-sector labor supply. Since formal-sector jobs comply with labor regulation, including contributions to pension plans, formal-sector workers receive long-run benefits in the form of pensions. If workers account for such benefits when they search for formal-sector jobs, the pension system affects formal-sector labor supply before the retirement age. In Chapter 1, I estimate the causal link between future pension benefits and formal-sector labor supply by using a cohort-based reform undertaken in Colombia. I demonstrate that workers with higher pension gains are more willing to work in formal-sector jobs, rather than working in unregulated businesses or by themselves. The result is consistent with a life-cycle model of formal-sector labor supply presented in Chapter 2, where pension benefits are an amenity of working in the formal sector. The results suggest that pension reforms may have large effects on the labor market that should be taken into account in the design of pension programs. Chapter 3 analyzes the effect of payroll taxes on formal-sector labor demand in the presence of wage rigidity. In particular, I study the impact of a reduction of payroll taxes on the creation of formal-sector jobs in Colombia, where about 40 percent of formal-sector workers earn the minimum wage. Using a reform that granted tax credits to firms hiring workers younger than 28 years of age, I obtain estimates of the effect of payroll taxes on formal-sector employment and wages. I show that payroll tax incidence is borne by formal-sector employers. The reduction in payroll taxes increased formal-sector employment and had no effects on wages. Using the estimation results, I recover an estimate of the elasticity of the formal-sector labor demand of -0.44. This study takes as its starting point the recommendation of the National Committee into Higher Education (1997) that the Quality Assurance Agency should establish a system providing benchmark information on standards operating within the qualifications framework in UK higher education. The introduction of subject benchmarking led to fears of increased external intervention in the activities of universities and a more restrictive view of institutional autonomy, accompanied by an undermining of the academic profession, particularly through the perceived threat of the introduction of a national curriculum for higher education. The study situates subject benchmarking in the context of a potentially changing identity for UK higher education, which some observers see as dominated by a growing lack of trust in universities and university professionals on the part of government and articulated through the increasingly prevalent use of performance indicators requiring institutions and individuals to conform to externally imposed norms. The various requirements of the Quality Assurance Agency, including, therefore, subject benchmarks are seen by some as threatening diversity by enforcing conformity. After a consideration of the literature on various aspects of this context, and in particular of the benchmarking principle, the findings of an empirical investigation are presented in which higher education professionals in chemistry, history and quality assurance were asked about their perceptions of subject benchmarking and its impact. The investigation did not bear out the fears articulated at the inception of subject benchmarking. Furthermore, the investigation showed that subject benchmarking was perceived as having none of the characteristics normally associated with a benchmarking system; in particular, it was not perceived as leading to improvement. Finally, observations are offered on the way forward for subject benchmarking, and areas are suggested for further research.

In this paper I provide an analysis of the postverbal subject in Thai. Thai is described as a SVO language by Hawkins (1983) and by Thai grammarians such as Surintramont (1979), Sriphen (1972), Waroamasikkhadit (1972), Kullavanija (1968), Chaiyaratana (1966) and in Thai traditional grammar books. However these analyses seem to be problematic due to the peculiar characteristics of such verbs as mii 'exist', kEEt 'occur', duumlan 'seem' as well as verb-like adjectives, which do not require any element or unit at all in the position right before them in a declarative sentence. To my knowledge these particular verbs have been analyzed simply as taking a non -overt subject or a deleted subject. This phenomenon raises the following questions: Do these verbs and verb-like adjectives require subjects? If so, where are they located? If not, what types of verbs are they? Are some sentences spoken in isolation in Thai are subjectless? In this analysis, I focus on the occurrence of the existential verb mii in a sentence spoken in isolation. I first present the forms of subject and object of intransitive and transitive verbs, including an element or a unit in the post-position of verb mii 'exist'. I argue that the misconstruction is a sentence, not a verb phrase. Then I argue that the element following the verb mii 'exist' is a subject, not a direct object, of this verb. Hence there are two subject types in Thai: preverbal and postverbal, with the subject verb (SV) structure for the former and the verb -subject (VS) for the latter. The paper ends with an application of HPSG theory (Pollard and Sag 1987) to the SV and VS structures in this language. I give the mii 'exist' and kEEt 'occur' constructions as examples for the VS structures. I divide the paper into five sections. Section 1: The Notion 'Subject'; Section 2: Background of the Thai Language: the points relevant to this particular analysis; Section 3: The Analysis; Section 4: Application of HPSG Theory to the SV and VS Structures in Thai; and Section 5: Conclusion.

Darbo tikslas yra išnagrinėti atstovavimo darbo teisėje instituto reglamentavimą Lietuvos teisės aktuose. Tačiau pagrindinis uždavinys yra išryškinti tiek darbuotojų, tiek darbdavių atstovavimo reglamentavimo trūkumus, išaiškinti pagrindines praktikoje iškylančias bei galinčias iškilti problemas, nustatyti dėl netobulo šio instituto reglamentavimo esamas spragas bei kolizines normas. Šiame darbe bus nagrinėjami tokie klausimai, kaip asociacijos laisvės principo esmės atskleidimas, be kurio nebūtų atstovavimo teisės, darbo teisės subjektų steigimo pagrindiniai principai bei didžiausias dėmesys skiriamas darbuotojų ir darbdavių atstovavimo problemoms išnagrinėti. Aptariant šiuos klausimus yra analizuojami tiek Lietuvos teisės aktai, tiek Tarptautinės darbo organizacijos konvencijų normos. The purpose of this work is to analyse the legal regulation of institution of representation of Labour Law subjects in Lithuanian national laws. However the main task is to expose shortcomings of legal regulation of the institution of the representation of employers and employees, to ascertain basic practical problems, to reveal breaches and collisions in legal regulation caused by it’s imperfection. In this work author analises a lot of questions with a view to reveal basic problems of this institute in Lithuania, examines the ways in which employee/employer relationships have changed and developed. There is aduced principle of liberty of association, which is the base of representation institute, discussed basic establishment rules of Labour Law subjects. As it was mentioned, the basic part of work describes the main problems of the representation of employee and employer. The writer considers the role of trade unions and how these have declined. There is a short review of real Labour Law subjects status in Lithuania.

Between 1983 and 2002, the United States economy lost 6 million jobs in manufacturing and income inequality increased sharply [Ebenstein, 2011]. Today due to the falling costs of transportation, coordination and communication this tendency is accelerating affecting both white and blue collar workers. While there many papers that analyze the productivity increase due to offshoring practices [Mitra, 2007], [Global Insight, 2004], [Houseman, 2010], most of them just assume that this improvement is automatically translated into lower prices therefore benefiting consumers. Nevertheless this assumption only holds in price competitive markets, which is not always the case. In this paper I will challenge the assumption of price competitive markets and argue how offshoring increases within-country income inequality.
