Abstract:
The main goal of this thesis is to describe crucial moments in the development of the WTO organization by focusing on key ministerial conferences and negotiations among influential members of this organization. The main goal is therefore to evaluate results and impacts of these ministerial conferences, to describe newly applied rules of international trade in selected trade areas and changes in the negotiation power among members of newly formed informal groups within the organization structures. The thesis is divided into four chapters, each of which describes a milestone which had a significant importance in the development of the WTO organization. The first chapter, called "The Uruguay round", is mainly focusing on the key initiators and players of the whole round of negotiations, on the results and impacts on further WTO development. The second chapter, called "The third ministerial conference in Seattle", is looking for the causes of the negotiations' failure and first strong disagreements among members which were notable since then. The third chapter , called "The fourth ministerial conference in Doha", is describing the process of the Doha negotiations by focusing on the crucial players, informal groups and on issues of the highest importance to most of the WTO members, i.e. trade in agricultural and nonagricultural products. The fourth chapter, called "The July package 2008", is analyzing the content of the proposed package. Even though the WTO members were able to reach conformity in some trade areas several crucial issues have remained unsolved which led to a collapse of the July negotiations and to a non-closure of the whole Doha round.

Abstract:
The World Trade Organization has its own binding dispute settlement system. To ensure compliance with the outcome of the dispute settlement procedures, the claimant Member is authorized to retaliate in case the respondent Member fails to comply within a certain period of time. However, the rules and procedures regarding retaliation and determination of compliance are ambiguous and have caused an interpretational problem called the sequencing problem. To address the problem, the parties to any dispute generally conclude bilateral ad hoc procedural agreements. However, by examining the procedural agreements concluded to date and by analyzing the potential problems of these agreements, this thesis concludes that due to the dependence on the will of the parties and the uncertain legal status of the agreements, the procedural agreements do not constitute a satisfactory method for addressing the sequencing problem. Alternatives such as amendments to the dispute settlement rules, an authoritative interpretation of them or ― if consensus cannot be reached soon ― clarification by means of a precedent from the Appellate Body, should be considered and attempted.

The thesis deals with a role of developing countries within the WTO and examines whether the developing countries are sufficiently involved in WTO negotiations in order not to play only a marginal role in the multilateral trade system. Thesis contains a historical overview of special and differential treatments for developing countries and the least developed countries. Thesis deals in addition with an issue of the implementation of special and differential treatments and describes the main WTO bodies concerned with implementation. Trade-related technical assistance programs are described in the last part of the thesis. These programs are JITAP, IF and the initiative Aid for Trade.

Master thesis deals with the issue of agricultural liberalization in the WTO and takes into account the role of Brazil in the whole process. Brazil as a developing country and a member of the BRIC group has a strong relationship to agriculture, and so the author wondered how Brazil behaved and what wanted to support. Important to achieving the objective is to determine why Brazil holds its position and what are the reasons. At the international level, Brazil is more and more visible, and thus its attitude towards agricultural liberalization is important for other countries.

Abstract:
An important task the WTO faces in pursuit of universality is the integration of nonmembers. Yet, becoming a member of the multilateral trade system is not easy. Accession to the WTO is a complicated and cumbersome process, which on average takes 10 years to complete. For a small state the task of joining the WTO is further protracted because its size poses certain development challenges when acquiring membership. Yet, accession for small states has not always been problematic.Accession jnder the GATT was far easier but under the WTO, accession ha come much more difficult. This thesis explores how accesion for a particular set of small states has changed through time, which it does by examining the Caribbean region. It examines how Caribbean states have joined the multilateral trade system and explores how changes in the accession process have shaped their accession experiences. The Caribbean makes an apposite case study, as not only does the region have a state, the Bahamas, currently in the queue to join the WTO, but it also has a number of states that have been members of ihe GATT/WTO for a long time, therefore permitting for research to tease out if the tuning of accession has an impact upon their accession experience. The thesis also examines whether the issue of smallness shapes accession and subsequent membership. In other words, the thesis explores whether institutional asymmetry affects the Caribbean states disproportionately because of the specificities of their political economies. It develops its argument by exploring the creation and evolution of the multilateral trade system with a key focus on aspects, which have had an impact upon accession. By utilising the conceptual framework of historical institutionalism the thesis argues Caribbean accession is shaped by the manner in which the multilateral trade system was created and evolved.

Abstract:
This thesis aims to analyze the position and influence of developing countries in the WTO. The key points of analysis are the participation of developing countries throughout the history of the GATT/WTO, an assessment of their activity and participation in the WTO bodies and decision-making process, an examination of their bagaining power, suggesting that the position of developing countries may improve through the formation of coalitions. Through a study and analysis of the current round of trade negotiations and its roadblocks, this paper assesses the current position and influence of developing countries in the WTO with an emphasis on the recurring deadlocks of the round. The main phenomena of the current round are an increase in coalition activity and the emergence of a new group of dominant players, namely India, China and Brazil. Owing to these new trends, developing countries in the WTO have been able to vigorously promote their interests. However, these interests clash with those of the developed world, which results in a stalemate of the negotiations.

Abstract:
The World Trade Organization (WTO) is an international organization created to coordinate trading rules among nations. Made up of internationally negotiated trade agreements, the WTO has three main objectives: (1)to assist in the free operation of international trade; (2) to allow continued progress of liberalization of such trade through fair negotiations; and (3) to create a system for the impartial settlement of international trade disputes. A key component of the World Trade Organization (WTO) is the Dispute Settlement Body (DSB). This body, as with the WTO itself, has only been in operation since January of 1995. The WTO, although relatively new, has made significant strides in improving the international trading system and resolving trade disputes. Unlike other international organizations, such as the international Monetary Fund (IMF) or World Bank, the WTO is not controlled by a board of directors, but instead is governed by its member nations. Given this type of arrangement, it is essential that the member nations abide by the signed agreements that govern the operation of the WTO and its Dispute Settlement Body. Otherwise the WTO cannot function as envisioned. This research argues that the European Union (EU) is presently abusing the system through its actions in the dispute settlement case EC- Hormones, Complaint by the United States. Using tactics designed to delay the resolution of this dispute, the EU has increased the costs ssociated with the Dispute Settlement Body (DSB) and threatened the credibility of the WTO.

Abstract:
This project explores the impact of international and domestic institutions on the decisions of political leaders. A theory of two-level institutional incentives is developed that seeks to explain how institutional context at the domestic and international levels affects the incentives, and thus the behavior of political leaders when making decisions related to trade policy. This theory argues that the institutional context in which political leaders make policy decisions has a significant effect on their decision-making. Further, the institutional context must include both domestic and international institutions. Building on previous work on the impact of institutions at both the domestic and international levels, this project seeks to test the theory of institutional incentives in the context of trade disputes under the GATT and WTO.A series of empirical tests are conducted using a dataset of GATT disputes combined with a new dataset of disputes under the WTO. These tests demonstrate strong support for the theories set forth in this project that domestic and international institutions combine to affect the behavior of political leaders. Domestic institutions affect the impact of international institutions and vice versa. This project extends previous work in two-level institutional incentives by demonstrating that institutional change at both levels has significant effects on the behavior of political leaders.

Abstract:
In this thesis I examine two widely held beliefs. First, I examine the belief that the World Trade Organisation (WTO) and the contemporary global trade regime are unjust. Second, I examine the belief that individuals should purchase Fair Trade goods. The purpose of these investigations is twofold. My major aim is to elaborate an account of global trade justice that combines research in international political economy with insights drawn from moral and political theory. These two disciplines are often separated in academic research and, as such, there is a need to combine an understanding of the reality of global trade arrangements with rigorous evaluation from the point of view of political morality. This thesis undertakes this task by engendering synergy between these literatures on the WTO and Fair Trade. The selection of these topics also provides a chance to subject the aforementioned beliefs to rigorous moral analysis. This is the second rationale for the project. In brief, my arguments are as follows. I argue that there are demands of global justice. I argue that this requires the WTO to meet certain democratic standards and certain demands of economic justice. I argue that the WTO does not meet these demands and I propose according reforms. I argue that the WTO must offer member-states substantively equal participation rights and that it should enact a policy structuring the global economic framework so as to help finance the development of welfare and legal provisions in developing countries. In addition, I make two arguments in relation to the belief that individuals should purchase Fair Trade goods. I reject one common defence of this idea but I argue that individuals should purchase Fair Trade goods because in doing so they can help generate a widespread contribution to addressing important moral concerns.

This thesis provides an analysis of the complex relationship between law and legitimacy in the WTO. It focuses on the notional dichotomy between ‘Member-driven’ (input-based) and ‘results-oriented’ (output-based) narratives of the WTO’s legitimacy, and how such narratives are both framed by, and reflected in, WTO law. It demonstrates how these narratives are used to legitimate the exercise of legal power in ways that exceed the reach of their internal normative claims; how they are used to displace responsibility for decision-making in the WTO; and the consequences of choosing to emphasize particular forms of legitimacy for our understandings of the WTO’s place in the world. In the process, the thesis also seeks to destabilize these legitimacy narratives by highlighting their partial, contingent and often mutually contradictory natures. The thesis proceeds in three parts. The first part (Chapter Two) clarifies what is meant by the terms ‘power’ and ‘legitimacy’ as used in the thesis and stresses their significance for WTO law. The second part (Chapters Three and Four) addresses two key input-oriented narratives of legitimacy associated with WTO law — those of consent and democracy. It argues that although consent has been central to understanding the legitimacy of WTO law as it is, and democracy is increasingly advanced in relation to WTO law as it should be, both narratives suffer from serious normative and descriptive limitations. The third part delves further into the concept of output legitimacy and its limits (Chapter Five), before exploring its application in relation to the legal-institutional dynamics of WTO negotiation rounds (Chapter Six) and the treatment of economic evidence in WTO dispute settlement (Chapter Seven). This part ultimately concludes that a more critical engagement with the concept of output legitimacy could open up productive avenues for rethinking the law and practice of the WTO.

Abstract:
Underdevelopment of developing countries is in present one of the thorniest problems of the world. Economic globalisation brings about increasingly deeper integration of world markets and increasing volumes of international trade. Multilateral trading system represented by the World Trade Organization (WTO) is one of the instruments that can, under certain circumstances, strongly contribute to economic progress of developing countries. The goal of the thesis is to reveal such circumstances and describe their coherence with the WTO and its predecessor the General Agreement on Tariffs and Trade. Firstly, the thesis focuses on theoretical basis of international trade as an instrument of economic development. The thesis also describes possible imperfections of the theory specifically with regard to developing countries. Secondly, the role of the WTO in the process of liberalisation of international trade and its activities leading to reduction or elimination of the imperfections are described. The thesis shows that, on the known theoretical basis, it is possible for developing countries to gain from liberalisation of international trade on the multilateral basis. The thesis, however, also indicates that it is possible to achieve certain improvements in the existing system to the benefit of the developing countries and leading to their greater and more equitable involvement in the international division of labour.
