Full textThe reform of the law of obligations created a distortion between the vision that positive law and legal science adopt of the mechanism of representation. In order to remedy this, financial intermediation activities have emerged as suitable study material. The term combines the services provided by professionals authorized to operate on trading platforms for financial instruments and digital assets as part of the processing of orders from their clients. While financial intermediaries cannot be considered as agents insofar as they do not act in the name of others but in their own name, the contracts they conclude with their principals nonetheless remain representation contracts. These service providers act on behalf of others, a mode of action which constitutes the essence of the mechanism of representation. Considering the principle of correspondence between the expression of the subject's interest and the exercise of a subjective right, it follows that the one who, such as the financial intermediary, expresses by his will the interest of another subject of law exercises prerogatives which relate to the subjective rights of others. The specific base of power thus implemented sheds light on the process of attributing the effects of action to others, which is presented as the second aspect of action on behalf of others. In view of the correlation established between the ownership of the subjective right exercised and the attribution of the resulting consequences, it is in fact the exercise of the subjective rights of others which justifies the attribution to the holder of these rights of the effects of the action. Based on a dissociation between ownership and the exercise of subjective rights, this analysis of action on behalf of others makes it coincide with the modern conception of representation. If the essence of the representation is lodged in the mechanism of the action on behalf of others, the fact that the action is carried out in own name or in the name of others must be considered as a simple variable of adjustment. of the representative phenomenon. The content of the obligations assumed by authorized service providers towards their principals is inextricably linked to their quality of representative. The obligation imposed on the financial intermediary to perform the mission entrusted to it by its principal depends closely on whether the first acts on behalf of the second, whose subjective rights it implements. In so far as it constitutes the technical translation of the power of representation vested in this intermediary, the mechanism of action on behalf of others leads to the imposition of obligations of diligence and loyalty shared by all representatives. Acting on behalf of others, the financial intermediary exercises a power of representation based on the subjective rights of the principal, which means that he assumes obligations common to all representatives. Previously analyzed as a simple adjustment variable of the representative phenomenon, the intervention in its own name of the financial intermediary cannot alter its essence, as confirmed by the study of the influence of such a mode of 'action on the regime of the obligation to perform the mission assigned to the intermediary. The obligation to render account incumbent on the financial intermediary follows the same logic. If the analysis of financial intermediation attests to the particularism of the law governing it, the renewed conception of the representation that it has made it possible to formulate confirms at the same time the absence of autonomy of financial law. We therefore hope that the study conducted here may constitute the basis for a reconciliation between legal science and positive law capable of shedding light on the understanding of the mechanism of representation at work in other branches of law

Indeed, as it allows for the affirmation of the fundamental principles related to the sovereignty of the people ; it also sets in place the tools necessary to work out the exercise of its functions and representation establishes the legitimacy of the democratic state. The institutional changes brought about in France by the regime of the 5th Republic, have led to a change in the way traditional political representation is viewed. The wish to see the arrival of a concrete democracy added to the end of the system of the primacy of law, has meant a modification of the representative process. Since then, the primacy of the law seems to be understood in relation to the priority of the Constitution, which has become a frame of reference for power, and an anthropological basis, allowing individuals to establish their poiltical identity

Full textIn most of the theoretical constitutional discussions, the concept of representation is treated as fiction because it is assumed that no one could represent another if the first doesn't behave exactly like the second does. Though, to say that an assembly represents people is either, at the best, an erroneous statement that legal science should correct or, at the worst, a lie or an ideology that every one should get rid of. But never comes the question why legal (or constitutional) systems use such concept like representation. That such a question is never asked is for the less amazing from legal theory and, above all, from positivist legal theory (normativist or realistic). Indeed, it is supposed to describe positive law so we should expect that it also describes the use of certain concepts like representation. The fact that postivist legal theory stays far from that concept proceeds from a value judgement which is obviously in contradiction with the purely descriptive methodology. Another position seems possible and would be founded on that simple constatation that legal systems do use concept of representation so the relevant point is then to understand why. It's then necessary to turn classical theoretical question upside down and instead of looking for the legal norms that should be deduced from theory of representation we are concerned with the theory of representation that legal norms need. The method is kelsenian and positivist. The point is not to suggest a new theory of representation but to describe the theory of representation that any legal system produces. The theoretical assumption is that legal systems do not only contain norms but also justifications of these norms (ideologies) that a positivist description must take in account - which doesn't mean that it takes it at face value. The enquiry starts with the end of the old regime, gives a large extent to the french revolution and a shorter to the modern period (the fifth republic is included)

Full textAutism is an early pervasive neurodevelopmental disorder characterised by severe difficulties in social interactions, communication and regulation of activities. An attempt to explain these behavioural disturbances has been made by the hypothesis of a primary cognitive deficit. This deficit was supposed to be focused either on a theory of mind mechanism responsible of the understanding and the attribution of mental states to oneself and to others, or on executive functions defined as a complex set of cognitive processes underlying the planning, the monitoring and the execution of actions and thoughts. First we present the theoretical, developmental and neurobiological foundations of theory of mind and executive functions. Secondly we specify the main findings in favour of their disruption in autism and consider the limits and the possible relations between these two functions. This leads us to hypothesize that both theory of mind and executive functions may depend on the early development of mechanisms involved in action perception and action representation. To test this hypothesis, we elaborated two experimental paradigms: the first one assesses the abilities in arranging sequences of goal-directed actions and the second one tests the perception of sequences of goal-directed actions. These devices were based on the premise that the representations of action are organized in a complex hierarchical structure monitoring the execution and the planning of our own activities as well as the perception of the actions of other people. The results show that the autistic subjects have difficulties in the conceptual organization of action knowledge especially that associated with object function and with the elaboration of temporal and causal links between the different stages necessary to the achievement of a goal. Consequently, deficits in theory of mind and executive functions observed in autism could result from a more fundamental and low level disorder disturbing the processes of perception and representation of the goal-directed structure of movements, acts and more complex actions

Full textThis thesis aims to study the causality notion and to develop propagation algorithms in the possibilistic networks framework. Intervention is a crucial notion to insure an efficient causal analysis in the sense that it facilitates causality ascriptions. We propose to introduce the do operator to represent interventions in possibilistic networks. We show that using such operator in the possibilistic framework reveals, in some cases, more interesting than its application for Bayesian networks especially for the propagation efficiency when reasoning with interventions. A possibilistic causal model based on possibilistic networks and allowing handling interventions is provided. This model proposes a typology of the forms that causal relationships can take in the possibilistic framework. Handling observation and dealing with interventions are unified through the propagation and conditioning process. We propose to improve propagation algorithms by taking advantages of possibility theory. Our approach consists of combining two representation tools in the possibility framework: possibilistic logic and possibilistic networks. These two alternatives both provide compact representations of possibility distributions. Hence, uncertainty at the level of nodes is represented in terms of possibilistic knowledge bases instead of possibility distributions. A propagation algorithm using the new representation, called hybrid, is proposed. Experimental results confirm the contribution of this new algorithm

Full textThis thesis is devoted to the study of quantum toroidal algebras and their representations. In the spirit of M. Kashiwara and following the definition suggested by D. Hernandez, we give different constructions of integrable representations called extremal loop weight representations. By specializing the quantum parameter, we get finite-dimensional representations of quantum toroidal algebras at roots of unity. The first construction uses the monomial crystals. We read into the monomials occurring in the monomial realizations of extremal crystals in term of q-characters of representations over the quantum toroidal algebra (via promotion operators). In the second construction, the extremal loop weight representations are obtained by fusion product of I-highest weight representations and 1-lowest weight representations (theaction being defined via the Drinfeld coproduct). We also give a construction via the affinization algebra of type A infinity and its combinatorial link with the quantum toroidal algebras
