Abstract:
The right to full and timely disclosure is one of the most fundamental rights of suspects and accused persons before the ICC. Regrettably, it is also the most violated right. This Chapter examines the difficulties the defence has encountered as a result of late, inadequate, or non-disclosure of material relevant to the case. Drawing heavily on the authors’ own experiences before the ICC, this contribution argues that the current disclosure regime of the ICC places an inordinate burden on limited defence resources, and improperly and unnecessarily constrains the ability of defence teams to effectively and efficiently prepare for and conduct the defence of the client. The Chapter makes a number of proposals for improvement, including management of time limits for final prosecution pre-trial disclosure, protective measures, transparency, and internal prosecution review.

The prosecution of piracy and armed robbery off the Somali coast has been at the centre of political and academic discourse since the initiation of the counter-piracy campaign. Notwithstanding the principle of universal jurisdiction which is widely seen as applicable to piracy, the overwhelming majority of the states involved in counter-piracy operations have proved reluctant to prosecute alleged pirates within their national courts. The international community seems to have selected the establishment of piracy prosecution centres in other states in the region, mainly Kenya, the Seychelles, Mauritius, and Tanzania, while at the same time it is making efforts to enhance prison capability within Somalia for the transfer of tried pirates. International prosecution does not fit the crime of piracy and armed robbery and in any event seems not to be an option for the international community. Nevertheless, there are many jurisdictional issues to be addressed in relation to the prosecution of piracy off Somalia, especially by third states.

When the speed of a fluid exceeds that of sound, discontinuities in density occur, called shocks.The opposite limit from incompressibility (constant density) is constant pressure. In this limit, we get Burgers equation. It can be solved exactly in one dimension using the Cole–Hopf transformation. The limit of small viscosity is found not to be the same as zero viscosity: there is a residual drag no matter how small it is. The Maxwell construction of thermodynamics was adapted by Lax and Oleneik to derive rules for shocks in this limit. The Riemann problem of time evolution with a discontinuous initial density is solved in one dimension. These simple solutions provide the basic intuition for more complicated shocks.

The focus of this book is the potentially radical and fundamental changes that are taking place within criminal justice in Britain and in France and the ways that these are driven by wider domestic, European, or international concerns. This metamorphosis away from established values and practices is eroding what were once regarded as core rights and freedoms in the name of efficiency, security, and justice to victims. Beginning with a comparative analysis of adversarial and inquisitorial procedural values and traditions, and an examination of broad trends in domestic and European criminal justice, the book then discusses how the roles of prosecution and defense have been reshaped in different ways in both jurisdictions—both in the text of the law and in their practices. The final part considers how systems within different procedural traditions adapt to address, or provide a remedy for, systemic flaws that produce wrongful convictions and, in particular, the role of the defense in these procedures. By adopting a comparative approach with France, the study explores the nature and reach of these trends, the ways that they challenge and disrupt criminal processes and values, and the contrasting responses that they provoke. It reveals how criminal justice traditions continue to be shaped in different ways by broader policy and political concerns; how different systems adapt, change, and distort when faced with (sometimes conflicting) pressures domestically and externally; and how different procedural values may serve to structure or limit reform, and so work to facilitate or resist change.

After a briefing from the West Sussex police, the DPP, Sir Archibald Bodkin, arranged for George Nicholls to return to Littlehampton and investigate further. Edith Swan was arrested and her house searched again. The search turned up some account books that could have supplied the paper for the recent libels. By the time her case came to trial, the Littlehampton libels had become a matter of more than local fascination. National newspapers reported the trial in detail. Swan was tried before a judge who found Swan’s performance in the witness box convincing and took the extraordinary step of cutting off the prosecution and telling the jury they should acquit. John Bull accused Nicholls of botching the case, prompting him to sue the paper for libel.

There have always been men and women who collaborate—provide aid, comfort, and support—to the enemy in time of war. In the Indies, both Europeans and nonEuropeans collaborated with the Japanese during the occupation. This chapter examines five war crimes tribunals involving Europeans, with the focus on the prosecution of a Japanese-speaking Dutchman who made radio propaganda broadcasts for the enemy and the trial of Head Police Commissioner P. J. H. M. Maseland, the highest-ranking official to collaborate with the enemy. The former was the NEI equivalent of “Lord Haw-Haw” and “Tokyo Rose,” and demonstrates that the Dutch took the impact of enemy propaganda on the war effort seriously. The latter was a Japanese-speaking police official who compromised his integrity during the occupation.
