Abstract:
Purpose The purpose of this paper (bibliometric analysis) is to analyse the global scientific outputs, research patterns, research emphases and trends of law and psychiatry (L&P) research during 1993-2012 from the Web of Science (WOS) database. Besides, the paper also offers an overview to deepen intercultural understanding and cooperation in the field among professionals concerned with the interface of this research field and related disciplines. Design/methodology/approach This paper conducted a bibliometric study of the characteristics and patterns of publication outputs, major journals, network of co-occurrence of authors, international productivity and collaboration. Findings International Journal of Law and Psychiatry, Journal of the American Academy of Psychiatry and the Law and Psychiatry, Psychology and Law were the representative journals in the field of L&P research. The results from the analysis of co-occurrence of authors suggest that the L&P co-authorship network analysis is relatively fragmented. In addition, the most productive institution was the University of California System, which published the most inter-institutional collaborative publications and was the top institution by centrality measures. The Harvard University published the most single-institute publications. The most productive country was the USA, which was the top country by centrality measures. The USA was the most collaborative country and took the central position in the collaborative network. Originality/value This is the first study to quantify and evaluate global research productivity in L&P viewed through the WOS during 1993-2012, which might provide a potential guide for future research among professionals concerned with the interface of L&P, as it is a very constructive contribution to the area.

Abstract:
Video game litigation in the United States is neither new nor infrequent, and video game developers can learn valuable lessons from cases won, and lost, by others before them. This article examines the evolution of United States intellectual property law from historically narrow roots to classifying video games as an art form deserving broad free speech protection. This article examines seminal cases in a variety of IP areas, including not only copyrights, but also reverse engineering, derivative works, patents, trademarks, rights of publicity, the Digital Millennium Copyright Act, contracts, and freedom of speech. These cases explore the factual and legal limits of American jurisprudence in video game law, including how one's own expression can be limited by the rights of others, permissible and fair use and of others' IP, and the impact these cases have had in the industry. As video games have leveled up into a multi-billion dollar industry, the law has leveled up, too, and this article is the primer you need to level up with it.

Abstract The theoretical model developed in this article predicts that collaboration with top-funded scientists positively affects the number of scientific publications of an individual scientist. Having combined data on funding and publication of Quebec scientists, this article empirically tests the theoretical predictions. This article examines numerous definitions of top-funded scientists as those in the top 10 per cent, or top 5 per cent in terms of total funding, funding from the public sector, and funding from the private sector. The results show that collaborating with such top-funded scientists has a positive effect on a scientist’s number of publications, hence confirming our theoretical predictions.

Two-dimensional steady-state Rayleigh-Bénard convection of thermodependent power-law fluids confined in a square cavity, heated from the bottom and cooled on the top with uniform heat fluxes, has been conducted numerically using a finite difference technique. The effects of the governing parameters, which are the Pearson number (0≤m≤10), the flow behaviour index (0.6≤n≤1.4), and the Rayleigh number (0<Ra≤105), on the flow onset, flow structure, and heat transfer have been examined. The heatlines concept has been used to explain the heat transfer deterioration due to temperature-dependent viscosity effect that m expresses.

Abstract:
The study’s main aim was to provide an in-depth insight into the Community Participation (also called Joint Forest Management or JFM) Rules enforced by the Government of Khyber Pakhtunkhwa (KP) in 2004 to reform the KP Environment Department from a “policing model” to a participatory one. It sought to find out; whether the JFM rules are followed in letter and spirit or the environment department of the province is still using age-old policies without involving the local communities in the management of forests. The study has uncovered the departmental and bureaucratic constraints towards the JFM Rules that stop the department from embarking on a journey towards a more participatory, inclusive, transparent, accountable, and sustainable management as well as development of forest resources. A qualitative research design was selected for this study and data was collected from a sample assembled on quota sampling technique with the quotas of respondents: 10 forest owners (people who have ownership rights in forests. 5 were taken from Malakand Division and 5 from Hazara Division of KP), 10 forest users (people who occasionally or permanently live in or near forests and use its resources in an arrangement with the forest owners. 5 were taken from Malakand and 5 from Hazara again), 10 government officials (5 from the environment department and 5 from the legal fraternity) and finally 10 environmental activists (including 5 female activists). Themes were developed after carrying out semi-structured in-depth interviews using interview guides. One of the major findings of the research were the sweeping and discretionary powers of the Divisional Forest Officer (DFO) which hinders the progress of JFM as DFO is not only the final authority on registration of a JFM Committee but can influence various other aspects of community participation and JFM like planning, funding and termination. It was also found that the territorial or protection staff (like Ranger, Forester & Guard) were still calling the shots in a top-down approach instead of a bottom-to-top approach by the mobilization and developmental staff (like Community Development Officer or CDO & Female Forest Extensionist or FFE) despite the JFM Rules. It was revealed that there is a great lack of funds and financial independence of the Directorate of CDEGAD (Community Development, Extension, Gender and Development) which is responsible for implementing community participation and JFM. The directorate staff is mostly financially dependent upon the discretion of the DFO. Even after 16 years, the environment department has not internalized JFM Rules. There was a lack of concern by government top management towards addressing this huge environmental problem of the lack of implementation of JFM despite the recent Billion and 10 Billion Trees "Tsunami" Afforestation Projects with the help of the UN under the Bonn Challenge. A very small number of community members reported that they are participating in the forestry and wildlife activities with the environment department. "Rubber stamp" and "token" participation were reported just to give legal cover to the departmental activities and a photo session for the social media instead of truly real incentive participation to achieve sustainable management and development of forest resources. There is a great if not an organized resistance of the majority of forestry staff to JFM Rules and keep these rules hidden under the carpet to carry on the traditional approach which is harmful for the communities, the department, the forests, and the wildlife in the long run. Lack of implementation of JFM Rules also facilitates corruption. Without local support and knowledge, the poverty in the forest-dependent communities cannot be eradicated. Lessons from Nepal's social forestry should be learned and utilized for KP's JFM. Nevertheless, the recent projects by the Pakistan Tehreek-e-Insaf led KP and Federal governments have given environmental activists a great glimmer of hope but the long-term positive results of it will depend upon its continuity by the future governments. The positions of CDOs, Female CDOs, and SOs (Social Organizers) need to be strengthened with legal powers regarding JFM. Several environmental policy and regulation needs were also identified in this study, followed by several recommendations for the environment department, provincial government, and civil society for bold and ambitious community-led forestry and wildlife conservation projects.

Full text
Abstract:
One way to reduce healthcare costs is to target the high spenders who remain persistently high in cost over time. Using claims data from China between 2010 to 2014, we sought to identify the level of concentration in spending and the proportion of spenders whose costs remain high over five years. Using a transition matrix and a linear regression strategy, we find that the top 10% of the spenders account for more than 50% of total expenditures. Of the individuals who were in the top 10% in 2010, 33.6% remained in the top 10% one year later and 23.6% were still in that category even four years later. Past spending plays a major role in the dynamic of health spending. A 10% increase in expenditure is associated with an increase of 0.36% to 1.33% of spending in the future. Persistence has some heterogeneity in terms of age, gender, and income level. Many diseases have strong predictive power for future spending. Research on the concentration and persistence of health expenditures will inform policymakers in terms of controlling costs and providing protection for catastrophic spending.

One day in late February 1873, the comisario of section 10 in Buenos Aires arrived at the home of Jacobo Varela to investigate reports that Varela had been involved in a duel with another young man, Julio Benites. Varela's brother met the policeman at the door and reported that, lamentably, Jacobo was ill and could not see him. When asked if he knew anything about a duel, the brother replied that he most certainly did not. Yes, Jacobo was bedridden because of a sword wound, but that was an accident: he had slipped while playing with the weapon and had fallen on top of it, the blade entering his right side below the shoulder and passing through his body. The additional wounds on his hands came when he attempted to pull the sword out.

Abstract:
This article explores the measurement and assessment of Tone at the Top (TATT) in CEO letters of Dutch listed companies (AEX) over a 10 year period. A combination of quantitative (text analysis) and qualitative research (close reading) is conducted. The main findings indicate that measured TATT is relatively stable for AEX companies over time. However, at closer examination significant deviations from the mean TATT are evident. Possible explanations are provided for these out-of-range TATT scores through the identification of several variables, e.g., difficult operating circumstances, investments and disinvestments, changes in the composition of supervisory boards, corporate governance, and compliance with law and regulations.

Abstract:
Economic efficiency is the key issue of sustainable development in urban agglomerations. To date, more attention has been paid to the estimates of productivity gains from urban agglomerations. Differing from the previous studies, this paper focuses on the influencing factors and mechanisms of the economic efficiency of urban agglomerations, and check the effects of three different externalities (industrial specialization, industrial diversity and industrial competition) on the economic efficiency of urban agglomerations. The selected samples are multiple urban agglomerations, and the economic efficiency of urban agglomerations includes single factor productivity and total factor productivity. China’s top 10 urban agglomerations are selected as the case study and their differences in economic efficiency are portrayed comparatively. Firstly, a theoretical analysis framework for three different externalities effect mechanisms on the economic efficiency of urban agglomerations is incorporated. Secondly, economic efficiency measurement index system composes of labor productivity, capital productivity, land productivity and total factor productivity, and the impact of various factors on the economic efficiency of urban agglomerations is tested. The results confirm some phenomena (MAR externality, Jacobs externality and Porter externality) discussed or mentioned in the literature and some new findings regarding the urban agglomerations, derive policy implications for improving economic efficiency and enhancing the sustainability of urban agglomerations, and suggest some potentials for improving the limitations of the research.

Abstract:
Background: The environment can play a relevant role in performance in runners. This study aimed to verify the distribution of the best European road runners across the continent, and to investigate variables related to country representatives in the European Senior outdoor top list 2019. Methods: The sample comprised 563 European runners, aged 18–48 years, ranked in the European Senior outdoor top list 2019 for distances of 10–42 km. Country-related variables were gross domestic product (GDP), competition place, population size, and sports investment. The countries were categorized as “top ten countries” or “other countries”. Binary logistic regression was used for analysis. Results: The United Kingdom showed the highest prevalence of runners in the ranking (men—17.6%; women—23.0%), followed by Spain (male ranking—12.1%) and Germany (female ranking—8.6%). For men, sports investment (OR = 1.13; CI95% = 1.03–1.28) and country GDP (OR = 0.96; CI95% = 0.93–0.98) showed an association with the chances of the athlete to reach the Top 10 ranking, while among women, the only variable significantly related was the competition venue (OR = 3.97; CI95% = 1.40–11.23). Conclusion: As in other sports considered “non-expensive”, the economic and demographic characteristics of the place where athletes train can provide advantages in performance.

Abstract:
Abstract The article explores the potential of theatre art in transitional justice, particularly in the field of reconciliation and healing. Presenting the context of reconciliation in Nepal 10 years after the end of the armed conflict, the authors argue for complementary processes of top-down and community-based, bottom-up approaches by introducing the concept of ‘theatre-facilitated dialogue’ as a way to strategically integrate Playback Theatre in peacebuilding. Analyzing the project ‘EnActing Dialogue,’ the article elaborates on the learnings from theatre-facilitated dialogue work in communities where ex-combatants of the Nepali People’s Liberation Army have settled. Based on the theoretical overview of secondary resources, the authors’ participatory observations, on informal interviews and quantitative data, the study explores how artistically enacted storytelling supports bottom-up reconciliation. By staging a noncognitive dialogue through storytelling, music and theatre, Playback Theatre contributes to the deconstruction of war-related identities, an understanding of root causes, as well as personal healing and relationship building at community level.

Abstract:
In this article the author traces the historic development of Islamic or sharia banking in Indonesia and this will be done by analysing the evolution of a series of successive laws promulgated over time. From these laws (Law Nos. 7/1992; 10/1998 and 21/2008) we can discern, how over the years, the Indonesian government gradually accept and recognized sharia banking principles, resulting in the establishment of Sharia Banks alongside conventional Banks. These successive laws also shows the gradual process of policy changes which involves a top-down, bottom up and again a top down approach. Through this process, Sharia Banks develops in Indonesia and has been able to meet society’s need not only for a modern banking system, but also more importantly, providing banking services in line with the sharia.

Abstract:
This paper presents experimental and numerical analysis of the change of temperature and force in the vertical direction during the friction stir welding of high-strength aluminium alloy 2024 T3. This procedure confirmed the correctness of the numerical model, which is subsequently used for analysis of the temperature field in the welding zone, where it is different to determine the temperature experimentally. 3D finite element model is developed using the software package Abaqus; arbitrary Lagrangian-Eulerian formulation is applied. Johnson-Cook material law and Coulomb?s Law of friction are used for modelling the material behaviour. Temperature fields are symmetrical with respect to the welding line. The temperature values below the tool shoulder, i.e. in the welding zone, which are reached during the plunge stage, are approximately constant during the entire welding process and lie within the interval 430-502?C. The temperature of the material in the vicinity of the tool is about 500?C, while the values on the top surface of the welding plates (outside the welding zone, but close to the tool shoulder) are about 400?C. The temperature difference between the top and bottom surface of the plates is small, 10-15?C.

The authors study the market for young attorneys. Using data from two surveys of attorneys who passed the bar exam in 2000, they find that attorneys who graduate from law schools ranked in the Top 10 nationally earn considerably more than those without such a qualification, even compared to attorneys who graduate from schools ranked 11–20. The premium to an elite education carries over to an attorney’s undergraduate institution as well, and the findings suggest that elite bachelor’s degrees and elite law degrees are close substitutes in terms of their relationships to salaries. The elite–law school premium is more robust to various methods for correcting for selection on ability than the widely studied premium to attending a selective undergraduate institution. The authors consider several reasons elite-school premiums may exist in this labor market.

Abstract:
Purpose – The purpose of this paper is to explore the similarities and differences of legal responses to older adults who may be at risk of harm or abuse in the UK, Ireland, Australia and the USA. Design/methodology/approach – The authors draw upon a review of elder abuse and adult protection undertaken on behalf of the commissioner for older people in Northern Ireland. This paper focusses on the desk top mapping of the different legal approaches and draws upon wider literature to frame the discussion of the relative strengths and weaknesses of the different legal responses. Findings – Arguments exist both for and against each legal approach. Differences in defining the scope and powers of adult protection legislation in the UK and internationally are highlighted. Research limitations/implications – This review was undertaken in late 2013; while the authors have updated the mapping to take account of subsequent changes, some statutory guidance is not yet available. While the expertise of a group of experienced professionals in the field of adult safeguarding was utilized, it was not feasible to employ a formal survey or consensus model. Practical implications – Some countries have already introduced APL and others are considering doing so. The potential advantages and challenges of introducing APL are highlighted. Social implications – The introduction of legislation may give professionals increased powers to prevent and reduce abuse of adults, but this would also change the dynamic of relationships within families and between families and professionals. Originality/value – This paper provides an accessible discussion of APL across the UK and internationally which to date has been lacking from the literature.

Abstract:
Abstract Independent analysis of police, fire, and ambulance calls for service demonstrates common patterns in emergency service activity. Targeted, place-focused interventions have been demonstrated to prevent future problems for emergency services. This research builds on these findings to examine the spatial and temporal intersection of police, fire, and ambulance incidents to explore the potential utility of enhanced collaboration between emergency-first responders. Using police and fire data from Surrey, BC, Canada, from 2011 to 2013, spatial and temporal patterns of police-, fire-, and ambulance-related incidents were examined. Initial analyses demonstrate that 36% of the City’s area experienced 72% of incidents responded to over this 3-year study period. Focusing on this high-volume area, the spatial and temporal intersection of these incident types was explored. Spatially, lattices of varying cell sizes (250 m, 500 m, and 1,000 m) were placed over the study area. Temporally, incident volume was examined across the entire 3-year study period, and at yearly and monthly intervals. Incidents were placed within these spatial and temporal frameworks and visual inspection was utilized to assess the convergence of service demand. Regardless of the cell grid size, police, fire, and ambulance incidents were spatially and temporally concentrated, with the top 10% of cells accounting for approximately 50% of all incidents across all services. Furthermore, there was considerable spatio-temporal convergence in cells which account for the top decile of call volume for all incident types. A 2 × 2 typology is proposed to classify locations (in this case grid cells) based on (1) the frequency at which they generate high demand for services (sporadic versus persistent), and (2) the combination of agencies required to respond to high demand problems (single versus convergent). The spatial and temporal convergence of emergency service problems observed in this study suggests that an interagency approach to problem identification will enhance problem analysis processes. Working in conjunction with established problem-focused intervention strategies (such as problem-oriented policing), the volume-service typology provides a framework that can contribute to the development of appropriate problem-responses. This, we hope, will support emerging efforts to increase the extent to which emergency-first responder agencies collaborate to maximize efficiency and effectiveness, and reduce harm.

Abstract:
Purpose “No climate change, no climate refugees”. On the basis of this theme, this paper aims to propose a method for undertaking the responsibility for climate refugees literally uprooted by liable climate polluting countries. It also considers the historical past, culture, geopolitics, imposed wars, economic oppression and fragile governance to understand the holistic scenario of vulnerability to climate change. Design/methodology/approach This paper is organized around three distinct aspects of dealing with extreme climatic events – vulnerability as part of making the preparedness and response process fragile (past), climate change as a hazard driver (present) and rehabilitating the climate refugees (future). Bangladesh is used as an example that represents a top victim country to climatic extreme events from many countries with similar baseline characteristics. The top 20 countries accounting for approximately 82 per cent of the total global carbon dioxide (CO2) emissions are considered for model development by analysing the parameters – per capita CO2 emissions, ecological footprint, gross national income and human development index. Findings Results suggest that under present circumstances, Australia and the USA each should take responsibility of 10 per cent each of the overall global share of climate refugees, followed by Canada and Saudi Arabia (9 per cent each), South Korea (7 per cent) and Russia, Germany and Japan (6 per cent each). As there is no international convention for protecting climate refugees yet, the victims either end up in detention camps or are refused shelter in safer places or countries. There is a dire need to address the climate refugee crisis as these people face greater political risks. Originality/value This paper provides a critical overview of accommodating the climate refugees (those who have no means for bouncing back) by the liable countries. It proposes an innovative method by considering the status of climate pollution, resource consumption, economy and human development rankings to address the problem by bringing humanitarian justice to the ultimate climate refugees.

Abstract:
Do we need yet more analysis of the responses to the September 11, 2001 (hereafter 9/11), terrorist attacks? Those tragic events occurred more than a decade ago, and their 10-year memorial focused on bringing “closure” to the event. For many, those attacks have become an increasingly distant, if still poignant, memory. For still others—such as the new cohort of undergraduate students who were only nine years old on the day of the attacks—9/11 is social history. Our contention in putting together this volume is that there continues to be significant reason to scrutinize 9/11 in terms of its consequences for the dynamics of surveillance. The aftermath of that tragic event played a major role in policy changes and in international relations. Wars were fought in Iraq and Afghanistan, sparked by 9/11, and many thousands more people died as a result. “National security” was elevated to a top priority in the United States and elsewhere, and this approach has had wave and ripple effects throughout the world. This is the “War on Terror,” and, unlike other wars, this one has no visible end point. These developments certainly affected surveillance practices internationally and have been the cue for the United States to demand that other countries fall in line with its approach. On the other hand, for many countries, especially in the global south, 9/11 is not a top-of-mind matter, nor is “national security” a vital concern.

Abstract:
Purpose Environmental management (EM) is becoming increasingly important in all types of organizations. The food industry represents the top industrial sector of the Spanish economy; however, there is still little knowledge about how it is managed environmentally. The purpose of this paper is to present a descriptive analysis of the Spanish food sector. Design/methodology/approach This study undertook a descriptive analysis based on probabilistic sampling surveys from food companies in Spain. The survey was sent out to 900 companies obtaining 128 answers. Findings The results of this study show that companies with an EM standard tend to have a more developed system and a greater presence of EM tools and actions. Moreover, statistical differences were identified among the characteristics of companies and various factors that affect the evolution of their EM. Originality/value There are no studies that reveal a clear picture of the status of EM in the Spanish food industry. This study presents a clear starting point that might help policy makers, consultants, researchers and other parties to set new improvement routes so companies do not get stuck in their progress toward environmental excellence.

Abstract:
Ten years of administrative data from a diverse, private, top-100 law school are used to examine the ways in which female and nonwhite students benefit from exposure to demographically similar faculty in first-year, required law courses. Arguably, causal impacts of exposure to same-sex and same-race instructors on course-specific outcomes such as course grades are identified by leveraging quasi-random classroom assignments and a two-way (student and classroom) fixed effects strategy. Having an other-sex instructor reduces the likelihood of receiving a good grade (A or A–) by 1 percentage point (3 percent) and having an other-race instructor reduces the likelihood of receiving a good grade by 3 percentage points (10 percent). The effects of student–instructor demographic mismatch are particularly salient for nonwhite and female students. These results provide novel evidence of the pervasiveness of demographic-match effects and of the graduate school education production function.

Abstract:
This article, based on an exploratory study of old Finnish family firms, examines two main research questions: “How do certain firms that have been involved in business for over one century perceive and rank their business values]” and “How do the members of the owner-families self-assess their family characteristics in these century-old family firms]” There are only 68 companies that belong to either the FBN-Finland Association (Perheyritysten liitto ry) or the Association of Finnish Entrepreneurs (Suomen yrittäjät ry) that are over 100 years of age. The data, based on self-assessments of the present active family executives working at the top level, were drawn from 10 FBN companies and 17 non-FBN companies (response rate 39.7%). When ranking the values, the Finnish respondents generally scored the desirable modes of conduct much higher than the desirable end-states. The top values were honesty, credibility, obeying the law, quality, and industriousness, which are all modes of good ethical conduct. The values of yielding good economic return to owners, willingness to grow, and to get social recognition all scored surprisingly low. The adjectives best describing the characteristics of owning families were: committed, responsible, fair, hardworking, and successful.

Among the main tools for soothing the contradictions are education and science. The author dwells upon the issue of educating students for Foreign Service. The education programs should include a following subject triad: history of international relations, international law and macroeconomics. This suggestion reflects the developments in worlds top universities. Among the key competencies required for work at Foreign Crevice are inter cultural communication, political psychology and negotiation skills. Th earticle out lines a program for getting MGIMO University to the top of world league tables. This goal is fairly new for Russian higher education; nevertheless it finds great support and encouragement on the part of Russian government in the form of laws and development programs. The government sets a goal of making 5 to 10 Russian universities world's best. The 70 years history of excellent research, education and training is a good ground for MGIMO to achieve this goal.

Abstract:
ABSTRACT Recently, it has been discovered that the transition of X-ray pulsars to the low luminosity state ($L\lesssim 10^{35}\, {\rm erg\ \rm s^{-1}}$) is accompanied by a dramatic spectral change. That is, the typical power-law-like spectrum with high-energy cut-off transforms into a two-component structure with a possible cyclotron absorption feature on top of it. It was proposed that these spectral characteristics can be explained qualitatively by the emission of cyclotron photons in the atmosphere of the neutron star caused by collisional excitation of electrons to upper Landau levels and further Comptonization of the photons by electron gas. The electron gas are expected to be overheated in a thin top layer of the atmosphere. In this paper, we perform Monte Carlo simulations of the radiative transfer in the atmosphere of an accreting neutron star while accounting for a resonant scattering of polarized X-ray photons by thermally distributed electrons. The spectral shape is shown to be strongly polarization-dependent in soft X-rays ($\lesssim 10\, {\rm keV}$) and near the cyclotron scattering feature. The results of our numerical simulations are tested against the observational data of the X-ray pulsar A 0535+262 in the low-luminosity state. We show that the spectral shape of the pulsar can be reproduced by the proposed theoretical model. We discuss applications of the discovery to the observational studies of accreting neutron stars.

Abstract:
This study analyzes changes in how corporate social responsibility (CSR) affects corporate value in China. We use multiple regression analysis on a sample of A-share listed companies on the Shanghai and Shenzhen Stock Exchanges from 2009 to 2018. We divide the sample into 2009–2012 and 2013–2018 periods according to the development of CSR-related media and corporate policies. The dependent variable is corporate value, measured by Tobin’s Q. The independent variable is the CSR score calculated and published by RKS, a widely recognized CSR evaluation agency in China. We use firm size, sales growth rate, return on equity, top 10 shareholders’ equity, operating cash flow, and debt ratio as control variables. The panel-based regression models find no statistical correlation between CSR score and corporate value from 2009 to 2012 but find that the CSR score has a significantly positive influence on corporate value from 2013 to 2018. The impact of CSR activities on corporate value increases over the 10-year period. This decade saw the Chinese government shift its development strategy from a rapid growth model to a high-quality growth model and pursue sustainable development. This study is useful for Chinese companies considering adopting CSR activities to promote sustainable development.

Full text
Abstract:
Pancasila as the source of all sources of law has obtained legitimacy legally through the Decree of the People’s Consultative Assembly Number XX / MPRS / 1966 on the Memorandum of the House of Representatives-Gotong Royong Regarding the Sources of Law and the Order of the Republic of Indonesia. After the reformation, the existence of Pancasila was re-confirmed in Law Number 10 Year 2004 which was subsequently replaced by Law Number 12 Year 2011 on Legislation Regulation. Pancasila as the source of all sources of law gives meaning that the national legal system must be based on Pancasila. However, now the existence of Pancasila is increasingly eroded in the national legal system. This is motivated by three reasons: first, the existence of resistance to the New Order that utilizes Pancasila for the sake of perpetuity of authoritarian power. Second, the strengthening of legal pluralism that resulted in legal contradictions or disharmony. Third, the status of Pancasila is only used as a symbol in law. Therefore, efforts should be made to implement Pancasila as the source of all sources of law in the national legal system: first, make Pancasila as a flow of law in order to avoid legal disharmonization due to the application of legal pluralism. Secondly, Pretend Pancasila as the top of legislation so that Pancasila have binding power against all kinds of laws and regulations so that it does not violate the principle of lex superiori derogat legi inferiori.

Abstract:
At present, the logistics industry in Spain is one that is mostly male-dominated, and women middle and top managers make up less than 10% of the workforce at these management levels. There is therefore an obvious lack of parity in this sector. Spanish regulation at present supports and promotes gender parity in different sectors including the logistics industry. Our article uses as a basis the fifth Sustainable Development Goal, “achieve gender equality and empower all women and girls”. Twenty-four female middle and top managers of the logistics sector were interviewed via a questionnaire of 52 questions. The research for this study was based on Avery and Bergsteiner’s 2011 Honeybee and Locust Sustainable Leadership Model and strived to determine how female middle and top managers in the logistics sector in Spain perceived leadership in their workplace and whether these perceptions were aligned with Avery and Bergsteiner’s sustainability leadership model. Findings showed interesting results, indicating that the Spanish logistics industry seemed to be a mixture of bee- and locust-type leadership. Respondents agreed that organizations were not very open to knowledge sharing and indicated that there is still a considerable need for improvement with regard to leadership practices in the logistics sector. Finally, our study is innovative in the sense that sustainable leadership and gender equality are two elements that have not been researched together.

Abstract:
Purpose This paper aims to investigate the moderation effect of customer orientation variable on the influence of professional competence toward the quality of strategy implementation. Design/methodology/approach This research is quantitative explanative associative, which is trying to explain the causality relationship between exogenous and endogenous variables. The research was conducted in the Shariah banking office in Central Java Province. The population of this research is all top and middle levels of Shariah Commercial Bank in Central Java region. The sampling technique used in this research is non-probability sampling, that is, purposive sampling, which is the method of determining the sample based on certain criteria and the research sample obtained is 113 respondents. The research approach used is quantitative with the analysis tool of Generalized Structure Component Analysis. Findings There is influence of professional competence variable and customer orientation on quality of implementation strategy. The higher the professional competence and customer orientation, the higher the quality of strategy implementation. It is also found that customer orientation moderates the influence of professional competence variables, which are quasi-moderating and reinforcing. Originality/value This research has two sources of problems, which are research gap and business phenomenon. Research on Drucker’s business purpose (1954) is realized when a firm identifies the relationship between strategic methods and its ability to generate profits. This research attempts to solve the problem or gap between market orientation and business performance, which has been widely researched by marketing experts, but still shows controversial results. In this research, the researcher takes the definition of Narver and Slater (1990) to examine market orientation because the mostly found empirical research on market orientation and innovation (Han, et.al. 1998; Subin and Workman, 2004; Ferrel and Luke, 2000) has used this conceptualization and its associated operations. Therefore, to compare and distinguish the results of this research with the results of previous research, this research uses the definition of Narver and Slater (1990). No previous study has comprehensively studied the moderating effects of customer orientation on the relation between profesional competence toward quality of strategy implementation, especially in a commercial bank in Central Java region.

Abstract:
The higher education diversity programs that Texas enacted after Hopwood v. University of Texas banned affirmative action had unexpected positive consequences for the state’s high schools. The Texas top 10% law, the Longhorn Opportunity Scholarship and Century Scholarship programs, and the Towards Excellence, Access and Success Grant program each explicitly linked postsecondary opportunities to high school performance and clearly articulated that link to students across the state. As a result, these programs worked as K–16 school reforms, using college opportunities as incentives to improve educational outcomes at the high school level. Using panel data describing Texas high schools between 1993 and 2002, the author demonstrates that Texas’s post- Hopwood higher education policies redistributed college-related activity at public high schools and boosted high school students’ academic engagement.

Abstract:
Object The volume of scientific literature doubles approximately every 7 years. The coverage of this literature provided by online compendia is variable and incomplete. It would hence be useful to identify “core” journals in any field and validate whether the h index and impact factor truly identify the core journals in every subject. The core journals in every medical specialty would be those that provide a current and comprehensive coverage of the science in that specialty. Identifying these journals would make it possible for individual physicians to keep abreast of research and clinical progress. Methods The top 10 neurosurgical journals (on the basis of impact factor and h index) were selected. A database of all articles cited in the reference lists of papers published in issues of these journals published in the first quarter of 2012 was generated. The journals were ranked based on the number of papers cited from each. This citation rank list was compared with the h index and impact factor rank lists. The rank list was also examined to see if the concept of core journals could be validated for neurosurgical literature using Bradford's law. Results A total of 22,850 papers spread across 2522 journals were cited in neurosurgical literature over 3 months. Although the top 10 journals were the same, irrespective of ranking criterion (h index, impact factor, citation ranking), the 3 rank lists were not congruent. The top 25% of cited articles obeyed the Bradford distribution; beyond this, there was a zone of increased scatter. Six core journals were identified for neurosurgery. Conclusions The core journals for neurosurgery were identified to be Journal of Neurosurgery, Neurosurgery, Spine, Acta Neurochirurgica, Stroke, and Journal of Neurotrauma. A list of core journals could similarly be generated for every subject. This would facilitate a focused reading to keep abreast of current knowledge. Collated across specialties, these journals could depict the current status of medical science.

Abstract:
Purpose – The purposes of this paper are to organize historical, solved questions and recent, unsolved questions in a coherent, progressive way; explore the key question to be answered under this systematic framework; and reflect on an alternative analytical perspective to the current “problem-solving-oriented” approach. Transnational bribery regulation, with the Organization for Economic Co-operation and Development (OECD) Anti-Bribery Convention as the central governing legal instrument, is on the top agenda of international governance. However, its complex nature makes theoretical viewpoints on this topic rather fragmented. This fragmentation is used to help understand the wisdom of the Foreign Corrupt Practices Act (FCPA) approach in the early years. However, as the FCPA approach was internationalized and evolves to its current phase, in which individual inquiries become path-dependent and interdependent, the fragmentation causes more confusion than makes contribution. Design/methodology/approach – Sections 2 and 3 retrospect the historical trajectory of academic research on the global regulation of transnational bribery, systemizes relevant theoretical insights and illustrates how people’s understandings of the wisdom of the FCPA approach in early years affect their evaluations of the effect of the OECD Anti-Bribery Convention in the contemporary era. Given that, at present, the most popular viewpoint is that the Convention is “ineffective”, Section 4 systemizes the diverse causal attributions of the “problem” in current academic literature, sorts out the roots causes and points out the key question for the next step forward under the version of the “problem-solving-oriented” analysis. Section 5 has a reflection on the inherent limitation of a “problem-solving-oriented” approach for our understanding of the effects of the Convention. Findings – Under the version of a “problem-solving-oriented” approach, the key question to be solved is how to establish a mechanism to cope with the surreptitious nature of transnational bribery and the self-sacrificed nature of the FCPA-style approach simultaneously. The popular “problem-solving-oriented” approach has an inherent limitation to create new knowledge on the multilateral anti-bribery collaboration. A reality-based, historical analytical perspective is a good alternative to it. Originality/value – The paper presents a personal, original organization of the conventional theoretical insights to the operation of the global anti-bribery collaboration and the underlying logics of these viewpoints. The paper also presents the author’s personal analysis of the “technical omission” and “inherent limitation” of a problem-solving-oriented approach to analyze the performance of the global anti-bribery collaboration, and the power of a historical analytical perspective as an alternative.

Abstract:

The paper examines 25,132 biochemistry research contributions of Indian scientists covered in the Web of Science for a period of 10 years (2004-2013). It was found that the biochemistry research is gradually growing and average annual growth rate was 36.84 per cent. The solo research was not prevalent and team research is more in the Indian biochemistry research and 97.46 per cent publications were contributed by multi- authors. It was observed that the value of co- authorship index was generally increasing and it varied from 93 to 105 during the period of study. Journal articles contribute 89.43 per cent of the total output followed by reviews (7.14 %). Indian researchers collaborate largely with the researchers of USA (2.49 %). The geographical distribution shows that Tamil Nadu, Uttar Pradesh and Delhi lead the list. The study shows that, C. Abdul Jaleel (58) and L. Pai (37) are the top ranked authors in the field. ‘Plos One’ is the top ranked journal and it published 296 papers during the study period. Academic institutions contribute more number of papers (50.26 %) followed by research institutions (28.24 %). The Lotka’s law was not found fit with the observed author productivity distribution of Indian biochemistry research.
