AbstractThe five thoughtful, incisive articles by Professors Bernstein, Chamallas, Geistfeld, Moore, and Sugarman offer a breathtaking range of perspectives on the Restatement, Third of Torts: Intentional Torts to Persons (“ITR”). Some view tort law from the widest vantage point, inquiring whether this forest deserves its own appellation or should instead be assimilated to the rest of tort’s greenery. Some focus more on the trees–on the distinct doctrines that characterize the torts and defenses that ITR is restating. In this response, we engage with the participants at both levels.Our response also addresses two fundamental questions–the role of a Restatement and the significance of the “intentional tort” category. First, ITR is a Restatement of tort law. It is not a model code of tort law, nor is it an academic article committed to a particular vision of the proper purposes and principles of tort law. We see our task, not as creating a grand theory from which all of intentional tort doctrine can be deduced, but as a bottom-up endeavor, accurately characterizing developments in the case law and then providing the most sensible and persuasive justifications for extant doctrine. At the same time, however, we strive to provide intellectual coherence to this body of law. Thus, we examine not only the holdings in narrow doctrinal categories, but also the consistency of those holdings with more general tort law principles.Second, what is distinctive about the intentional torts to persons? How do they differ from torts of negligence or from other intentional torts? These questions have no simple answer, because most of the intentional torts to persons have very long historical roots, and because the common law process of reformulating doctrine has played a vital role in defining the scope of these torts in current American law. It is thus not at all surprising to find tensions and apparent inconsistencies between some current doctrines.Nevertheless, we believe that the contemporary formulations of these torts are indeed justifiable in principle. First, these intentional torts sometimes reflect a hierarchy of fault or culpability. Purposely injuring someone is more culpable, ceteris paribus, than negligently causing the same injury. Second, these torts sometimes protect distinct interests, such as the interest in avoiding emotional harm or in freedom of movement, that for various policy reasons are not protected by liability rules if they are only negligently invaded. Third, the intentional torts do not simply identify species of conduct that reflect greater fault or culpability than negligence. Comparing intentional torts is sometimes akin to comparing apples and oranges, because these torts protect a varied set of interests or protect them in varying ways. Fourth, the intentional torts express a pluralistic set of values and principles. No single principle (such as welfare, autonomy, or freedom) fully explains all of these torts. And fifth, although these intentional torts contain some reasonableness criteria, for the most part they reject the reasonableness paradigm of negligence, and thus reject the more flexible, less structured criteria of liability that that paradigm engenders.

Abstract:
Despite the findings of natural scientists and philosophers, the law of torts is still clinging on a strictly deterministic (in the Laplacian sense) idea of the world. Probabilistic considerations are not alien to the legal world, yet they are generally regarded as ad hoc exceptions to handle particularly complex cases. From this perspective, this thesis advocates the need for a theoretical shift. A probabilistic approach to reality should become the norm, whereas determinism should only be considered a heuristic tool when confronted with prima facie deterministic cases. In Chapter II it is shown that a strictly deterministic concept of causation is inadequate to face the intricacies characterizing modern litigation. In fact, the deterministic version of the ‘but for’ test necessarily creates frictions with the kind of evidence produced by modern science. The introduction of a purely probabilistic concept of causality is advocated and a distinction is drawn between the ex-ante and the ex-post probabilistic approach to causation. The former seems to be a better approach for lagged torts, whereas the latter is more appropriate to handle instant torts. Also, it is shown that in a probabilistic world the very concept of harm assumes a different meaning. Building on the new definition of harm introduced in Chapter II, in Chapter III it is suggested that the debate on the goals of tort law should be reconsidered. In a probabilistic world welfare maximization and corrective justice are not mutually exclusive, but must be regarded as necessary complements. In Chapter IV, it is argued that the problems created by a deterministic mindset stretch way beyond the analysis of causation. In fact, a Laplacian (deterministic) view of the world often prevents us from contemplating probabilistic solutions even when deterministic options have failed. From this perspective, Credit Rating Agencies (CRAs) are a perfect example. Both the legal and the economic literature have advanced solutions to improve CRAs incentives to issue accurate ratings. Yet, in most cases, the proposed solutions did not exploit the probabilistic nature of ratings, thus they were not framed exclusively in probabilistic terms. To the contrary, by designing a simple and legally workable strict liability rule it is possible to tie CRAs profits to the quality of their probabilistic predictions. In Chapter V, it is investigated whether the law and economics movement can be considered the answer to the indeterminacy of predictions haunting other sciences. Not surprisingly, the answer to this question is no. Even the extremely simplified world of tort law and economics is dominated by an indeterminacy principle.

The New Zealand Court of Appeal has recently acknowledged the existence of a freestanding tort of invasion of privacy in Hosking v Runting. The tort is in its infancy and the courts are still grappling with essential problems, the most prominent of which is the conflict with countervailing interests in freedom of speech. In need of guidance, the courts turn to overseas authorities, predominantly from the United Kingdom and the United States of America. The commonly found descriptive nature of the comparison invites a broader analysis of these jurisdictions. In this thesis, I offer a theoretically informed comparative law analysis of New Zealand's new tort with the American public disclosure of private facts tort and the British extended breach of confidence action. In all three jurisdictions, the conflict of privacy with individual and societal concerns in freedom of speech has led to an exten-sion of (quasi-) constitutional norms derived, for instance, from the New Zealand Bill of Rights Act 1990 into the common law sphere – the horizontal effect. The horizontal application of constitutional rights poses significant legal problems to the common law, because it has learned to deal with duties rather than rights. The time has come to re-consider the nature of rights in both constitutional and tort law. The comparison shows that New Zealand has effectively adopted two torts – one following the duty-based lead of the United States of America and an alternative modelled along the lines of the more rights-orientated British law. The law of the United Kingdom and the USA differ to a degree that calls their comparability into question. I present the preferable British ap-proach as a 'constitutionalised common law tort of privacy.' The results also show that this model represents a competitive third way to traditional solutions based on common law or statute by means of utilising a statutory human rights instrument as an analytical framework for the common law.

The purpose of the thesis is to examine problems related to the liability of multinational enterprises (MNEs) for their subsidiaries' torts. The reason for the existence of the problems is that the legal theories and practice fail to understand interdisciplinary features of MNEs. Thus, there have been no satisfactory solutions to the problem of tort liability of MNEs. In order to understand the questions of liability, there should be an examination of the concept of multinational enterprise using interdisciplinary methodology. Thus, the thesis, in the first section, examines the social, economic, managerial and legal characteristics of MNEs and compares the findings of this examination to the current understanding of MNEs in the way that tort liability is applied to them. As a result, there is a conflict between legal understanding of the structure of MNEs and contemporary realities; while legal practice considers MNEs as simple vertically structured organisations; an interdisciplinary examination reveals more complex horizontal structures with different characteristics. This conflict creates problems of liability and also prevents satisfactory solutions to problems of tort liability in the context of MNEs. In the second section, the thesis examines the existing laws related to liability of MNEs from different jurisdictions. The aim of this examination is to assess whether these laws are adequate for the challenges modern MNEs create. The thesis seeks in each sub-section to understand how groups of companies are conceived by these laws and how liability rules would be different if modern understandings of MNEs are applied in these cases. In the final section, the thesis aims to identify the basic problems of achieving satisfactory tort liability for MNEs and it offers solutions to the problems of liability for MNEs subsidiaries' tort based on the findings in the first and the second parts of the thesis.

Abstract:
This paper looks at Texas tort law reform to make claims regarding the relationship between Texas tort reform and damages recovered. Starting with reform in 1977, Texas has passed 15 pieces of legislation that, in principle, restrict the damages plaintiffs recover. Most empirical analyses have focused primarily on analyzing behavior resulting from the tort reform. In other cases, research has looked at the impact the most recent reform has had on damages recovered in medical malpractice lawsuits. This paper is the first to study the impact of Texas tort law reform on damages recovered while looking at the entirety of recent law reform in the state. Specifically, I test the impact of the 15 different laws on total allocated loss, economic loss, and noneconomic loss recovered in all cases from 1988-2012. My findings suggest that caps on medical liability damages are successful at decreasing damages recovered when the cap is geared at either noneconomic damages, or a total damage figure that excludes punitive damages. This suggests that future caps on medical liability damages should explicitly cap either economic or noneconomic damages. Next, the results imply that caps on punitive damage legislature were most successful when using specific value caps paired with an evidence standard—caps of this nature decreased total damages by 28% in 1987 and 85% in 1995. Finally, an introductory legislation restricting the use of joint and several liability in cases when plaintiffs had little guilt was successful, it decreased total damages by 18.6%. This was followed by three failed attempts to impact the application of joint and several liability where the guilt threshold was higher, suggesting that joint and several liability is rarely used if the plaintiff has substantial guilt.

The paper discusses aspects of access to justice, ie, the concept of liability regarding the damage to the environment and environmental crime. An overview of the provisions of the Directive on environmental liability regarding environmental damage is given. Cases of access to justice related to environmental crime and environmental forensics are presented. The main aspects of access to justice under the Aarhus Convention are explained. Problems, challenges, and dilemmas in the implementation of access to justice in the field of environmental crime are pointed out. An assessment of the implementation of access to justice in the segment of liability for environmental damage and punishment for torts in the field of the environment is given. It is considered whether the concept of liability for environmental damage is more effective than criminal environmental protection in terms of actual environmental protection.

The contract represents an instrument of legal transactions through which the contracting parties regulate their rights and obligations within the limits of compulsory regulations, public order, and good customs. The Law on Contracts and Torts proclaims the principle of disposition and autonomy of will, as a result of which the contracting parties can create rights and obligations for themselves and the other contracting party with their free declarations of will, regulate their mutual relations in a different way from legal solutions, as long as they do not exceed the set limits, under the threat of nullity of the contract. In addition to the above, the contract can extend its effect besides the contracting parties, and it can be used to contract rights in favor of third parties, whose will did not participate in the creation of the contract itself. In this paper, the authors will show the impact of a contract in favor of a third party, as an exception to the inter partes principle, on the example of a contract concluded between RF PIO and JP "Pošta Srbije" and look at the legal validity of such a contract, through court practice.

The distant precursor of modern obligations is to be found in that sphere of social relations in archaic societies, which today we call civil torts. The essence of these relations was personal liability for injurious actions, resulting from the sense of revenge of the victim or his relatives. The gradual abandonment of the primitive forms of enforcing creditors' rights by forced execution during the period of the Law of the Twelfth Table and the construction of patrimonial liability for debts also had adverse effects, the main one being the fraud of creditors' rights, in particular by alienating property before the lawsuits for debt recovery were filed. The name actio pauliana naturally derives from the name of the praetor Paulus, as it is referred to in the Digeste, as a means of protecting creditors and combating fraud. The purpose of the Pauline action was to re-establish the situation prior to the conclusion of the fraudulent act and, implicitly, to restore the property fraudulently disposed of, which is why it is logical that the person liable should be the owner of the property from which the creditors can draw. The effect of admitting the action was to revoke (deprive of legal effect) the legal act concluded to the detriment of the creditors. This is the source of inspiration for modern legislation, which calls the action in question a "revocatory action".

Abstract:
The paper presents a continuation of the research on the problem of realization of compensation for damage caused by the commission of criminal offense. In the first paper created within the same project, the author laid the foundations of the problem, dealing with the theoretical notion of damage caused by a criminal offense, the notion of civil torts and tortious liability, and the distinction between the notion of damage and the consequence of a criminal offence. This time, the author will concentrate on settling the receivables for damages by presenting the entire path that one claim for damages should take. Namely, obtaining a property claim should occur primarily in criminal proceedings, but it is most often adjudicated in litigation because in most cases the subject entitled to it is referred to litigation in order to exercise his right to compensation. After the judgement in the civil procedure is rendered, which orders the defendant-convict in the criminal procedure to compensate the caused damage either by compensating the damage in money or by returning the thing, or by annulling a certain legal deal, the concrete execution of the verdict in the executive procedure begins. While studying the manner of collecting the claims of the entitled subject through all three different procedures for the damage caused by the commission of criminal offense, the author also deals with controversial issues that may arise (the issue of statute of limitations for property claim, the issue of subjects who may be holders of property claims, the adequacy of the procedure in which the property claim is exercised, the means of execution of a monetary claim for damages caused by the commission of criminal offense, etc.).

Contextualización: el sector agroindustrial genera diversos subproductos que pueden ser contaminantes del medio ambiente por su inadecuada disposición o simplemente porque no son aprovechados, como es el caso de la extracción de aceite de alta calidad para lo que se utiliza la semilla de Sacha Inchi. En este proceso se genera como subproducto torta de Sacha Inchi, caracterizada por su contenido proteico, que posiblemente pueda sustituir otras fuentes proteínicas utilizadas en la alimentación animal y, por ende, generar más alternativas para la alimentación de estos. Objetivo principal: evaluar la inclusión de torta de Sacha Inchi en la alimentación de pollos de engorde de la raza Cobb 500 con el fin determinar cómo afecta esta inserción los parámetros productivos, tales como ganancia de peso, consumo de alimento, conversión alimenticia (CA). Vacío de investigación: se realizó la pregunta de investigación ¿es la torta de Sacha Inchi una opción viable para suplementar las dietas para pollos? El motivo por el que se planteó este interrogante es que el incremento en el costo de la elaboración del alimento para la producción avícola ha obligado a los productores a utilizar alternativas propias de la zona caucana para disminuir dichos costos, como los subproductos de la industria de Sacha Inchi [Plukenetia volubilis L.]. Metodología: el estudio se realizó en el municipio de Popayán, departamento del Cauca. Se realizó un estudio de tipo analítico-cuantitativo, con un diseño completamente al azar, para evaluar los efectos de incluir torta de sacha Inchi [plukenetia volubis L.] en la dieta de pollos de engorde de la línea Cobb 500. En el primer ensayo se evaluaron los efectos de 4 tratamientos con diferentes niveles de inclusión de torta de Sacha Inchi [0 %, 10 %,20 % y 30 %] en pollos en etapa de iniciación durante doce [12] días. Y en el segundo ensayo se evaluaron 3 tratamientos con diferentes niveles de inclusión de torta de Sacha Inchi [0 %, 5 %,10 %] en pollos en etapa de finalización durante veintiún [21] días. Para cumplir con el objetivo propuesto, se analizaron los siguientes parámetros productivos: consumo de alimento, ganancia de peso y conversión alimenticia. Utilizando estadística descriptiva, en la etapa de iniciación, se observa que a medida que aumenta el porcentaje de inclusión de torta de Sacha Inchi, disminuye el consumo del alimento. La inapetencia marcada en estas dietas se debe a la presencia de factores antinutricionales en la proteína, principalmente expresados por los taninos de esta. En la etapa de finalización, para contrarrestar el efecto de los factores antinutricionales, se realizó un horneado de la harina a 102 C° por veinte minutos y se observó un mejoramiento significativo en la apetencia, en relación con la etapa de iniciación. En cuanto a la ganancia de peso, se determinó que, en ambos ensayos, a medida que se incrementa la inclusión de torta de Sacha Inchi (TSI)], la ganancia de peso disminuye; siendo más notoria la disminución en la ganancia de peso en la etapa de finalización. En cuanto a la conversión alimenticia, en la etapa de iniciación, se infiere que a medida que se incrementa el porcentaje de inclusión de TSI, aumenta la conversión alimenticia; de igual forma en la etapa de finalización. Resultados. Los resultados obtenidos permitieron identificar que la inclusión porcentual de Torta de Sacha Inchi hasta en un 10 %, prehorneada y sin hornear] en etapas de iniciación y finalización de pollos de engorde, no presenta índices de mortalidad; la inclusión de la torta en niveles de más de 10 % sí afecta negativamente los parámetros productivos evaluados. En los dos ensayos, al hornear las tortas de Sacha Inchi se presenta una reducción de los taninos que causan inapetencia en los pollos, pero no es total. Conclusiones. Se deben plantear investigaciones futuras que analicen el aprovechamiento de la torta de Sacha Inchi en otras especies de interés pecuario, específicamente en especies poligástricas, teniendo en cuenta la posibilidad de que estas especies sí puedan tener una mejor asimilación del complejo proteico presente en la planta de Sacha Inchi [plukenetia volubis L.].
