While classical fairy tales do not portray much depth of suffering, many contemporary fairy-tale retellings explore trauma and its aftermath in great detail. This article analyzes depictions of trauma in fairy tales, utilizing as a primary case study the “Beauty and the Beast” retelling A Court of Thorns and Roses by Sarah J. Maas, arguing that this text provides a scientifically accurate representation of trauma and its aftermath, thereby articulating the real in fairy tales. Further, this article classifies that work as not simply a “dark” fairy tale (a contentious term that invites rethinking) but rather as fairy-tale torture porn, in a nod to the horror genre that foregrounds torture, surveillance, and the disruption of bodily boundaries and safety. However, the text’s optimistic account of healing is uniquely relevant in a time of widespread trauma due to a global pandemic, thereby demonstrating that fairy tales remain germane in contemporary contexts.

Abstract:
Horror film sequels have not received as much serious critical attention as they deserve this is especially true of the Saw franchise, which has suffered a general dismissal under the derogatory banner Torture Porn. In this article I use detailed textual analysis of the Saw series to expound how film sequels employ and complicate expected temporal and spatial relations in particular, I investigate how the Saw sequels tie space and time into their narrative, methodological and moral sensibilities. Far from being a gimmick or a means of ensuring loyalty to the franchise (one has to be familiar with the events of previous episodes to ascertain what is happening), it is my contention that the Saw cycle directly requests that we examine the nature of space and time, in terms of both cinematic technique and our lived, off-screen temporal/spatial orientations.

Abstract:
The thesis asserts the need for a re-evaluation regarding the stylistic influence, historical development and global proliferation of the genre of Torture Porn. It applies Rick Altman’s semantic/syntactic/pragmatic model of assessing film genres to examine torture porn. It considers the role and impact that mainstream industry professionals such as critics assert in the creation and reception of the Torture Porn genre. The thesis contextualises a historical framework for the genre’s inception within the transnational history of cinema. It argues that Torture Porn’s visual aesthetic has organically flourished and evolved from this transnational history of cinema. Applying visual analysis, the thesis explores the fetish image’s functionality to convey sexual meaning within edited sequences thematically depicting violent torture. The thesis asserts that the authentic classification of torture porn depends on the visual aesthetic of a distended fetishistic image. It argues that torture porn films must encapsulate the illustration of this distinctive visual aesthetic within sequences that thematically contain a form of sadistic torture or significantly relate to the infliction of impending torture. Building on previously established feminist theory canonised by Carol Clover, the thesis offers a re-examination of Clover’s work to argue that torture porn offers the spectator an innovative, sadistic type of ‘final girl’, a character who both evolves, and similarly differs from, its predecessors within the American Slasher, Horror, and European Rape Revenge film genres. The thesis demonstrates a clear connection between the spectator’s desire to view torture porn spectacles, and an international increase in box office sales. It provides a case study of the independent Lions Gate Entertainment Corporation to expose their active role in establishing torture porn as a mainstream multiplex genre. The Torture porn genre transforms the company within the entertainment industry.

Abstract:
The purpose of this study is to verify if the implantation of the judicial hearing of custody in Brazil represents the beginning of a civilizing and humanizing process of the criminal justice system, in so far as it translates into an instrument of criminal policy to combat the culture of the normality of violence in the act of imprisonment. For that, a historical-evolutionary clipping is made on the practice of torture, in search of a conceptual delimitation of this phenomenon that has a significant conceptual variation. Next step, a correlation is drawn between the custody hearing and the constitutional fundamental rights and guarantees of the detainee in flagrant offence, specifically, as regards the violation of the detainee's physical and moral integrity. In this historical and normative hermeneutic north, from a re-reading of the Arendtian concept of banality of evil, it is investigated whether the custodial audience would be a prelude to overcoming the normality of the inhumanity, the naturalization (banalization) of violence in the act of imprisonment in flagrant offence.
O presente trabalho tem como finalidade verificar se a implantação da audiência judicial de custódia no Brasil representa o início de um processo civilizatório e humanizador do sistema de justiça criminal, na medida em que se traduz em um instrumento de política criminal de combate à cultura da normalidade da violência no ato de prisão. Faz-se, para tanto, um recorte histórico-evolutivo sobre a prática da tortura, em busca de uma delimitação conceitual desse fenômeno que possui uma variação conceitual significativa. Ato contínuo, esboça-se uma correlação entre a audiência de custódia e os direitos e garantias fundamentais constitucionais do preso em flagrante delito, especificamente, no que tange à violação da integridade física e moral do detento. Nesse norte hermenêutico histórico-normativo, a partir de uma releitura do conceito arendtiano de banalidade do mal, investiga-se se a audiência de custódia seria um prelúdio da superação da normalidade do desumano, da naturalização (banalização) da violência no ato de prisão em flagrante delito.

La tortura es una práctica muy antigua, y según el informe de Amnistía Internacional del año 2000, aún utilizada por tres cuartas partes de los gobiernos del mundo. Las secuelas físicas y psicológicas que las víctimas sufren, sumada a las secuelas psicológicas de los familiares, son inmensurables tanto económica como culturalmente. Bolivia no está ajena a este flagelo, ya que lamentablemente durante épocas de dictadura militar y durante gobiernos constitucionalmente elegidos la tortura fue y es una práctica común. El objetivo del presente estudio fue visibilizar la tortura como un problema aún presente en nuestra sociedad, además de identificar las secuelas físicas de personas afectadas por tortura que acudieron al ITEI (Instituto de Terapia e Investigación Sobre las Secuelas de la Tortura y Violencia de Estado) durante el periodo 2006 a 2010.

Esta investigación ofrece un estudio de la evolución en el derecho penal interno del tratamiento de la tortura, poniendo especial énfasis en el artículo 150-A introducido al Código Penal mediante la Ley 20.968, atendiendo en todo momento a las fuentes internacionales que Chile suscribió y ratificó, a saber, la Convención Contra la Tortura y Otros Tratos o Penas Crueles, Inhumanos o Degradantes y la Convención Interamericana para Prevenir y Sancionar la Tortura. Importante consideración tendrá el delito de coacción, en tanto este es uno de los posibles propósitos que tiene en mente el sujeto que ejerce conductas constitutivas de tortura.

Em junho de 2012 o jornal “Estado de Minas” iniciou a publicação da série de reportagens que deu origem a esta pesquisa. “A tortura de Estela contada por Dilma” foi publicada durante nove dias por este jornal e resgatou a memória da tortura em Minas Gerais. Além disso, a série revelou a existência de tais práticas na cidade de Juiz de Fora, fato nunca antes revelado oficialmente. Buscou-se, neste trabalho, compreender, por meio da Análise do Discurso Pecheutiana, como a imprensa discursa sobre a ditadura militar e como a rememoração deste período em Juiz de Fora reconstrói significados na memória do leitor. Detectou-se que há uma reafirmação do compromisso do jornalismo com a revelação de fatos ocultos da história do país por meio do resgate da memória. Além disso, verificou-se que há uma radicalização no discurso bem versus mal, onde a militância ativa contra a ditadura é retratada como totalmente boa, enquanto os militares aparecem como figuras exclusivamente más. Como a série apresenta como personagem principal a figura política de Dilma Rousseff, também foi possível detectar a existência de um olhar positivo do sujeito do discurso sobre a atual presidente do país, uma vez que ele entende que uma boa militante poderá ser uma boa governante. Por fim, evidenciou-se a dificuldade de se resgatar a memória do país por meio de depoimentos de sobreviventes, uma vez que a rememoração provoca o revivamento das dores do passado e, muitas vezes, aquelas pessoas que poderiam contribuir para o resgate de determinados períodos preferem não se sujeitar a certas emoções. Dessa forma, observou-se que o jornalismo, manifesto pelo gênero reportagem, é capaz de levar as memórias do país até os leitores de forma leve e, ao mesmo tempo, profunda. Temas não antes discutidos são apresentados aos leitores e conduzem à reflexão acerca do passado do país. Além disso, quando o jornalismo revela fatos não publicados por meios oficiais, ele instiga a abertura de discussões sobre determinados temas, seja por meio da repercussão em outras mídias, seja no cenário político.
“Estado de Minas” started publishing series of articles which gave rise to this research. “A tortura de Estela contada por Dilma” has been published for nine days by this newspaper and rescued the memory of torture in Minas Gerais. In addition, the series revealed the existence of such practices in the city of Juiz de Fora, a fact never before officially revealed. In this work, the author tried to understand, through Pecheutiana’s Analysis of Discourse, as the press talks about the military dictatorship and how the recollection of this period in Juiz de Fora reconstructs meanings in the reader's memory. It turned out that there is a reaffirmation of journalism's commitment to the revelation of hidden facts of the history of the country through the recovery of memory. In addition, it was found that there is a radicalization in discourse good versus evil, where the active militancy against the dictatorship is portrayed as totally good, while the military appear as exclusively bad figures. As series has as main character the political figure of Dilma Rousseff, was also possible to detect the existence of a positive look of the subject of the discourse on the current president, since he believes that a good militant can be a good ruler. Finally, evidence of the difficulty to rescue the country's memory through testimonies of survivors, since the recall causes the revival of past pains and often those people who could contribute to the rescue of certain periods prefer not to be subject to certain emotions. Thus, it was observed that journalism, manifested by the genre entry, is able to take up the memories of the country readers in a light way and, at the same time, deep. Topics, that was not discussed before, are presented to readers and lead to reflection on the past of the country. In addition, when the journalism reveals facts not published by the official media, he instigates the opening of discussions on specific topics, either by impact in other media, whether on the political scene.

Esta dissertação trata dos debates sobre a proibição da tortura durante a Assembleia Nacional Constituinte brasileira de 1987-88 (ANC). Busca-se analisar as propostas normativas apresentadas em torno desse tema, particularmente no que se refere à conjugação entre o uso de categorias penais e os direitos humanos, e as estratégias discursivas utilizadas, em suas conexões com os diferentes objetivos políticos presentes nesse debate. Parte-se da hipótese de que um novo tratamento jurídico da tortura era uma tendência nacional e internacional que estava em curso à época da ANC. Fundava-se no direito penal e estava voltado contra a violência praticada por agentes públicos, tanto os que haviam atuado na repressão política durante a ditadura civil-militar brasileira quanto os responsáveis pela repressão da criminalidade comum. Entretanto, havia ressalvas quanto à constitucionalização dessa demanda normativa, na medida em que era percebida como uma reprovação da repressão política e como uma extensão indevida de direitos a criminosos comuns. Foram expressas em diferentes estratégias discursivas que representaram fatores importantes na formatação do texto constitucional sobre a proibição da tortura. A pesquisa se baseia na análise de documentos produzidos pela ANC e na revisão de bibliografia sobre o contexto desse debate.
This dissertation studies the debates about torture’s prohibition during the Brazilian National Constituent Assembly of 1987-88 (NCA). It intends to analyse the normative proposals presented about the theme, particularly in what it articulates both the use of concepts of criminal law and human rights’ discourse; and the discursive strategies elected, in their connections with different political goals present in these debates. The hypothesis which guides the research is that a new juridical treatment towards torture was an international and national trend during NCA, based in the criminal law, and referred to practices of state agents, both those engaged in political repression, during the Brazilian civil-military dictatorship, and those who worked in daily repression of non-political criminality. However, there was resistance against constitutionalizing this normative claim, since it was perceived as a disapproval of political repression practiced by the civil-military dictatorship and as an undue recognition of rights to non-political criminals. The resistance was expressed through a variety of discursive strategies, which represented important factors in designing the constitutional text prohibiting torture. In order to accomplish its goals, the documents produced by the NCA are analyzed, and the literature about the context of these debates is reviewed.

En esta memoria podrá encontrar los principales argumentos esgrimidos por los Tribunales Superiores de Justicia de nuestro país, tanto para acoger o rechazar la acción indemnizatoria interpuesta con el objetivo de hacer valer la REE en las violaciones a los DDHH acontecidas en Chile durante el RM. Para ello, las autoras de esta memoria realizaron una larga investigación, producto de la cual encontraron xxx sentencias que se pronuncian sobre la materia. Con el objetivo de abordar mejor el objeto de análisis, se desarrolla en primer lugar una reseña del contexto histórico político de dos periodos, en el cual acontecieron las violaciones a los DDHH, y el contexto existente en el país al momento de interponerse las demandas y dictarse las sentencias en análisis. La investigación se centra sólo en aquellas violaciones con resultado de muerte, desaparición o tortura de las víctimas, y se tratan las materias jurídicas más relevantes y controvertidas encontradas en los fallos investigados. Al finalizar esta memoria, encontrará los argumentos esquematizados, posibles tendencias argumentativas y se concluye con la apreciación de las autoras sobre la manera en que deberían tratarse estas materias en relación a las violaciones a los DDHH.

El Sistema Interamericano de Derechos Humanos se enfoca en las victimas durante todo el procedimiento contencioso pero aun es poco el esfuerzo para medir el impacto de la implementación de las decisiones adoptadas por la Corte en materia de reparaciones, si bien el propio sistema creó un mecanismo de seguimiento, este se ha convertido en un nuevo procedimiento contencioso muchas veces centrado en el estricto cumplimiento de la decisión de fondo pero olvidando la razón de ser del sistema: el interés en promover derechos en la victima. Es en este interés, de esta investigación hacer uso del enfoque de capacidades para poder describir cual es el impacto de las reparaciones en las victimas. La utilidad de este enfoque radica en que permitirá verificar el impacto que tienen las reparaciones en la vigencia de los derechos de las víctimas y así visualizar si efectivamente las reparaciones han logrado hacer pleno capacidades centrales en las victimas que haga reales los derechos convencionales Para lograr este propósito, se propone una metodología de análisis a la luz de la teoría de las capacidades, la cual es aplicada en 4 casos contenciosos seguidos contra el Perú, con la intención de medir como afectaron las reparaciones en el ejercicio de capacidades centrales en las victimas. Además, se explican las ventajas de medir el impacto de las reparaciones a la luz de este enfoque a la luz de los resultados obtenidos de los 4 casos materia de estudio. Al ser este estudio aproximativo y ser pionero en el análisis de impacto desde el enfoque de capacidades se espera que las conclusiones aquí desarrolladas sirvan como punto de partida para otros estudios, aunque como se verá a lo largo de la investigación, la posibilidad de este enfoque abre mayores puertas a otros tipos de análisis multidisciplinarios sobre el Sistema Interamericano de Derechos Humanos.

Abstract:
The events of September 11, 2001 fundamentally changed the world for many in the United States. It was shocking and horrifying -- it was, in a word, traumatic. This trauma took on a new dimension with the release of the horrifying Abu Ghraib "torture photographs" in 2004. Large-scale traumatic events such as September 11 and the Abu Ghraib revelations can impact not only the individual and his or her personal identity, but entire social bodies and its corresponding national identity as well. This study investigates how the American social body psychically dealt with the horror of these national traumas and socially negotiated what it means to "be an American." Specifically, it examines a disparate group of rhetorical artifacts, from articles in mainstream news reports to popular horror films, and looks for emergent patterns to provide insight into the larger whole. This study draws on a variety of theoretical perspectives and employs a method of close reading and frame genre analysis to organize and understand the complex interplay of forces tuned toward a deeper understanding of the rhetorical dimensions of horror in times of social upheaval. It focuses first on the mainstream news organizations reporting of both September 11 and Abu Ghraib to outline the master narrative and counter-narrative that emerged. It then analyzes three sets of films in the popular culture to better understand how the nation attempted to rhetorically constitute an "American Subject" in the wake of a horrifying trauma. The study concludes with an analysis of the different psychical subject positions that may be taken in the rhetorical negotiation of the American Subject and offers an explanation of the rhetorical function of the torture porn horror genre in this time of national trauma.

Abstract:
Objectives / Scope During summer 2017, EIFFAGE GENIE CIVIL MARINE was invited by BP to bid for the construction of a concrete caisson breakwater protecting an offshore LNG liquefaction floating terminal which will be located 10 km west from Saint Louis, at 33 m water depth on the Mauritanian / Senegalese maritime border. Methods, Procedures, Process The basic design as originally proposed by BP was composed of 18 rectangular concrete caissons laying on an underwater rumble-mound foundation. Dimensions of the concrete boxes were approximatively 63,5 meters long, 32 meters wide and 30 meters high, on a design consisting of multi rectangular cells (128 units/caisson) EIFFAGE GENIE CIVIL MARINE answered to the ITB by proposing under an EPC basis an alternate caisson shape optimizing drastically the concrete quantities. Results, Observations, Conclusions Alternate caisson dimensions were 54,5 m long, 28 m width, 35m height including a 3 m high crest wall at the top against extreme waves overtopping. The geometry of the caisson has been changed to a 10 lobes caisson. The weight of each caisson is around 16 000 tons. As a result of the subsequent FEED studies performed from April 2018 to February 2019, including 3D model testing in basin, Eiffage was able to reduce the amount of concrete required by 40 % compared to the first design, leading to 124 200 cum of concrete and both financial as well as environmental benefits. Novel/Additive Information Execution plan involving Mauritania and Senegal This infrastructure offers key local content components for this gas field development in each country, something Eiffage had key experience with thanks to an historical presence in the the region : Eiffage started its activities in Senegal more than 100 years ago. The original execution plan as proposed by Eiffage for the EPC phase signed in February 2019 was to build the 21 concrete caissons in Dakar -Senegal. A dedicated yard of 15 hectares has been reclaimed besides the actual port of Dakar providing a safe direct access to the sea and the required water depth for the caissons towing. As a result, at peak more than 600 jobs will be created in Senegal, with the reclaimed land for the fabrication yard left as a legacy for the port area. The underwater rumble mound requires 2 million tons of quarry material. EIFFAGE's proposal was to produce, transport and load from Mauritania those materials. A specific logistics scheme between the quarry and vessels loading point has been developed including a bypass road around Nouakchott. The transport of the quarry materials requires the mobilization of 170 trucks. A special safety mitigation plan including dedicated training is being implemented in order to reduce identified risks linked to road transportation.

Abstract:
La investigación tiene como objetivo examinar el concepto de mito desde las perspectivas psicológicas y estructurales de Carl Jung y Levi Strauss, junto con los pensamientos filosóficos sobre fenomenología de Maurice Merleau-Ponty y Martin Heidegger y las discusiones en torno al concepto occidental de luz simbólica y las críticas sobre la postura instrumentalista de la tecnología. La investigación sostiene que la creación de mitos es una forma necesaria de tecnología social que puede transformar la experiencia en valores altruistas que se realizarán en el futuro, impulsados por el poder saciante de la sabiduría y el conocimiento para desarrollar aún más dicha tecnología. La investigación visita la chamanología y la fórmula del mito canónico de Levi Strauss acerca de la discusión que falta sobre la experiencia psicológica y la comunidad. Desde el punto de vista del profesional, la investigación también desafía la crisis epistemológica del dualismo al buscar una comprensión sistémica y la creación de los mitos, utilizando los últimos métodos aplicados de gestión organizacional sostenible de Joseph M. Coll. La revisión contextual eventualmente plantea la hipótesis de una nueva metodología para la creación de mitos contemporáneos, a saber, Daoísta Bricoleur, con un enfoque técnico específico en la producción de películas ensayistas. Este proyecto dirigido por la práctica implica un viaje presentable de metáforas y significantes sobre mi historia y experiencia personal. Como inmigrante de primera generación de Nueva Zelanda nacido originalmente en una pequeña ciudad minera de carbón en el este de Mongolia Interior, China, mi auto-posicionamiento es esencial para el proceso de creación de mitos. Con un pensamiento sistémico y una metodología hipotetizada, la investigación considera la producción cinematográfica como una organización en crecimiento orgánico que se basa en múltiples restricciones creativas y flujos de trabajo algorítmicos que sirven al establecimiento estructural de las unidades míticas básicas necesarias. De manera pragmática, la investigación estudia a los profesionales del cine como Chris Marker y Adam Curtis, y a músicos como Elysia Crampton Chuquimia y Howie Lee, para explorar creativamente los problemas técnicos y teóricos del cine ensayista, reexaminando la historia y la experiencia de una manera socialmente consciente, dando la bienvenida a mi origen cultural mongol interno, manchuriano y chino, y la complejidad de mi crianza. La práctica del diseño se centrará en el proceso de crecimiento de una narrativa mitopoética contemporánea específica. Eso me involucra a mí, una briqueta de chamán y una aguja que renace a lomos de Bixi 赑 赑, un dragón tortuga que disfruta nadando en medio de la nada mientras carga montañas en la espalda. Un mito tan personal observa y resuelve conscientemente el yo en el contexto de la crisis del Antropoceno. Anima a que las representaciones y los conceptos crezcan y se transformen en nuevos descubrimientos y autorrealizaciones, como un proceso interno de aprendizaje que ayuda al yo y al público a acercarse a la voz de la inconsciencia y las respuestas emocionales. En última instancia, la investigación capitaliza los conceptos contemporáneos para promover la sabiduría de la autoaceptación como paz interior. Su objetivo es revelar al Dao de los mitos y la creación de mitos como una respuesta tecnológica para resolver el llamado de David Attenborough de cambios de paradigma global en su libro A Life of Our Planet.

Abstract:
Las concreciones carbonáticas de tipo septaria objeto del presente estudio se localizan en las proximidades de Tortuero (Guadalajara), en el flanco noroeste (NO) de un sinclinal tumbado en el límite entre el Dominio nororiental del Sistema Central Español y la Cuenca de Madrid. Las concreciones se encuentran en facies mixtas correspondientes a la Capa de Margas de Alcorlo (Turoniense Medio, Cretácico Superior). Esta unidad pertenece a la Mesosecuencia I del Cretácico Superior y corresponde a un máximo regresivo. La metodología empleada para la caracterización mineral y textural ha permitido inferir un posible modelo genético para explicar el origen de estas concreciones carbonáticas. Las concreciones presentan dos formas: una esferoidal y otra discoidal, con diversos tamaños. En su interior se reconocen dos zonas, una interna caracterizada por la presencia de silt (limo) y carbonato (calcita) y una externa de micrita peloidal microbiana, con porosidad secundaria de tipo shrinkage (septarias). Esta porosidad estáparcialmente rellena de un cemento fibroso de calcita. Se deduce que las concreciones se desarrollaron por debajo de la interfase sedimento-agua en un ambiente palustre asociado a la línea de costa. La interrupción de la sedimentación favoreció el crecimiento concrecionar entorno a un núcleo no determinado/visible a partir de aguas continentales freáticas. El origen de las septarias se relaciona con procesos de deshidratación del sedimento por desecación y cementación posterior, característicos de ambientes palustres.
